ED97097 CASE# 23-9961 OF COLLISION 08/29/23 16:20 OF CbLLI510N NARRATIVE 23-9961 On 08/29/2023 at 1621 hours, I was dispatched to a non-injury two-vehicle collision with driver exhibiting signs of impairment at the intersection of N 8th Street and Park AVE N, within the City Limits of Renton, County of King, State of Washington. Upon my arrival at approximately at 1627 hours, I observed two vehicles in left turning lane at the intersection of N 8th Street and Park AVE N. Unit#1 was a silver Toyota Tacoma plate (WA Plate #C63272X) that rearended Unit#2 Silver BMW Z4 plate (WA Plate #143YST). Upon contacting driver of Unit#1, he stated he was at red light and upon the light turning green, he assumed Unit# 2 was moving and he moved forward impacting Unit# 2. Unit# 2 stated he was sitting at a red light and then was rearended by Unit# 1. While on scene, I saw the driver of Unit 1 outside his vehicle speaking to Officer B. Grozay. Upon my approach, Unit# 1 was identified by his WADL as Munsch. He appeared confused and slow in speech, I would have to repeat directions multiple times for him to comply. He stated he had nothing to drink and did not take any medications or other substances. The driver of Unit#1 was positively identified via pictured WADL as Munsch. The driver of Unit#2 was positively identified via pictured WADL as Gaudio. I asked MUNSCH if he would be willing to conduct voluntary Standardized Field Sobriety Tests (SFSTs) to determine if he was okay to drive. MUNSCH stated he would conduct voluntary SFSTs. MUNSCH and I stood on a flat surface of the roadway where I asked if he wore contacts and he replied, "No." I asked MUNSCH if he had any medical or eye conditions that would prevent him from following a pen with his eyes and he replied, "No" I then conducted the NHTSA Field Sobriety Tests. HGN: I asked MUNSCH if he could see the pen I was holding in front of him and he replied, "Yes." I asked him to touch the pen with his pointer finger which he did. I asked MUNSCH to track the pen with his eyes only. I then explained the instructions for completing the test to MUNSCH. I asked MUNSCH if he understood and he replied, "Yes." I then administered the Horizontal Gaze Nystagmus test. MUNSCH was able to follow the pen with his eyes only but did move out of the position that I instructed him to remain in on at least one occasion. Romberg: Prior to conducting the Romberg test, 1 asked MUNSCH to stick his tongue out of his mouth. MUNSCH did so. I did not observe any signs of recent marijuana use. I asked MUNSCH to get into the same position he held for the HGN test. 1 requested MUNSCH to estimate the elapsed time of 30 seconds while having his head tilted back and his eyes closed. 1 asked MUNSCH if he understood the instructions which he stated, "Yes." I told MUNSCH to begin the test while I simultaneously had a stopwatch app on my wristwatch timing him. MUNSCH performed the test and stopped when he believed 30 seconds had passed. According to my stopwatch, the total elapsed time was 27 seconds. Based on the NHTSA SFSTs, I did not develop probable cause to arrest MUNSCH for Driving Under the Influence. I was informed that MUNSCH had a traumatic brain injury a couple of years ago and PAGE 3 OF 5 REPORT NO. Officer Grozav had contacted a roommate of MUNSCH's who confirmed there had been a delay in processing information by MUNSCH. I had the Renton Regional Fire Authority (RRFA) respond to the scene to conduct a welfare check on MUNSCH to determine if the collision had effected him in any way. RRFA later responded and cleared MUNSCH medically. Based on the above statements, 1 determined that the Driver of Unit#1 (MUNSCH) was the predominant factor for the collision as Munsch was not paying attention to traffic in front of him before colliding with the other involved vehicle. Both of the involved vehicles were able to be moved from the crash scene safely. However driver of Unit# 1 stated he had only slept 4 hours and was advised to walk home and get some sleep. An exchange of information and case number was provided to all involved parties.
