The applicant is requesting an Administrative Tier 2 Temporary Use Permit in
order to construct 5 model homes on future lots created as part of the
Copperwood Preliminary Plat prior to the recording of the plat_ RMC
4-9-240D.2 allows for the construction of the lesser of; 5 model homes or 20%
of the total number of lots with a Tier 2 Temporary Use Permit. The
subdivision of the 12.68 acre site would result in 47-lots used for the eventual
development of single family residences; with tracts for tree preservation,
critical areas, access, and stormwater. Twenty percent of the 47 lots would
amount to 9 lots which exceeds the 5 maximum allowed model homes
pursuant to RMC 4-9-240D.2. Therefore, the applicant is limited to the
construction of 5 model homes. The proposed homes would be constructed on
what will be future Lots 29, 30, 32, 33, and 34. Access to the lots would be
gained from SE 2nd St via new public looped street.
The Temporary Use Permit is hereby Approved with Conditions' and subject to the following
conditions.

1. The applicant shall provide a notarized original abatement agreement form, as provided by the City.
The agreement assures the temporary use will ultimately be removed as required by the terms of the
permit. The applicant shall also provide an original signed Release and Indemnification Agreement as
well. Both agreements shall be provided to the Current Planning Project Manager prior to building
permit approval.
2. Only five single family building permits shall be issued for Copperwood subdivision prior to
recording of the final plat, regardless of what the underlying lots allow.
3. All model homes shall be connected to water, sewer, and storm before building permits are final.
4. Applicant shall provide approved access and fire hydrants prior to construction of model homes.
Identification of such access and hydrants shall be provided with the building permit application for
review and approval by the Planning Division Project Manager and the Fire Plans Reviewer.
5. The proposed lot lines for the model homes (Lots 29, 30, 32, 33, and 34) shall be staked and strung
to ensure proper assessment of setbacks prior to construction of model homes.
6. The applicant shall make an appointment for the submittal of the individual building permits with the
Building Department prior to submittal. The primary building department contact is Jan Conklin, 425

RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be
reopened by the approval body. The approval body may modify his decision if material evidence not

fact. After review of the Reconsideration request, if the approval body finds sufficient evidence to
amend the original decision, there will be no further extension of the appeal period. Any person
wishing to take further action must file a formal appeal within the 14-day appeal time frame.
APPEALS: Appeals of the permit issuance must be filed in writing on or before 5:00 p.m. on October
16,2015. Appeals must be filed in writing together with the required fee with Hearing Examiner c/o
City Clerk, City of Renton, 1055 S Grady Way, Renton, WA, 98057. Appeals to the Examiner are

appeal process may be obtained from the Renton City Clerk's Office, 425-430-6510.
EXPIRATION: A Temporary Use Permit is valid for up to one year from the effective date of the permit,
unless the Community & Economic Development Administrator or designee establishes a shorter time
frame or an applicant can request that a permit be valid beyond the one year expiration, for up to five
years at the time of application or prior to permit expiration.

in order to construct 5 model homes on future lots created as part of the Copperwood Preliminary
Plat prior to the recording of the plat. RMC 4-9-240D.2 allows for the construction of the lesser of;

subdivision of the 12.68 acre site would result in 47-lots used for the eventual development of

Twenty percent of the 47 lots would amount to 9 lots which exceeds the 5 maximum allowed model

Quadrant Homes is proposing the construction of 5 model homes (less than 20% of total
number of lots) on the Copperwood plat before plat recording. Copperwood is a 552,483
square foot (12.68 acres) site to be divided into 47 single family homesites. This plat is an
assemblage of 8 parcels: 152305-9066,9067,9201,9043,9093,9100,9221 and 9170.
Proposed density is 4.45 DU/ AC with an average lot size of 6,083 SF. The plat is zoned for R-4
(small lot cluster R-8). The project site is surrounded by existing single-family subdivisions with
similar densities; however, along the south property lines are larger single-family lots (due to
topography) that range from 1 to 2 acres in size.
The models are proposed for future homesite numbers: 29, 30, 32, 33 and 34. All homesites
will access off of new public road: Graham Ave SE. Each homesite will have a rock construction
entrance and silt fence erected during construction. 5torm drains inserts will be in place during
construction to prevent construction debris contamination. Primary access to the site is from
NE 4th Street (principal arterial), south on Jericho Avenue SE (collector arterial), and west on SE
2nd Place (residential access street). Further information regarding access and traffic is
addresses in the Transportation Impact Analysis (TIA) prepared by The Transpo Group and
submitted with the plat application.
The on-site soils consist of approximately 6 to 12 inches of topsoil overlying 2 to 5 feet of
medium dense silty sand with gravel (weathered till) overlying dense to very dense silty sand
with gravel (unweathered glacial till). Glacial till soils are generally suited for residential
development and are one of the more common soil types in and around the City of Renton.
The Geotechnical Report was prepared by Terra Associated, Inc. The lots will be graded and
finished per approved plat drawings (lUA14-000550).

Maplewood Creek flows through the eastern part of the property with a 100 foot buffer. There
are no threatened or engendered species of plants or animals mapped for this site. New home
construction will be approximately 300 feet or more from the creek. Storm drainage and
erosion control BMPs will be in place throughout construction per permit LUA14-000550.
Trees have been removed or saved per the Tree Protection Plan, prepared by Washington
Forestry Consultants, Inc., and Tree Retention worksheet, included with this submittal, as part
of the plat permit. There are no saved trees on the proposed model homesites. The project
proposes to retain 34 healthy significant trees and, therefore, we meet the tree retention
guidelines in RMC 4-4-130. There are no retained trees on the proposed model homesites.
As designed, there are approximately 1,225 lineal feet of proposed (on site) public right-of-way,
which will be 53 feet wide with 26 feet of paving, curb, gutter, planter (8 feet wide) and
sidewalk (5 feet wide) on both sides. The internal roadway network has been designed to
provide looped roadway with two shared private access tracts and one access tracts and one
access easement within Tract B to serve the adjacent property owned by Berquist.
The project development will utilize and extend existing City of Renton public utilities
throughout the project site (sewer and storm), water from Water District No. 90 and dry
utilities (power, telephone, natural gas and cable) to serve all lots.
The project storm drainage system is a two-cell open "wet pond" with 3.1 side slopes. The
treated storm water will be conveyed to Maplewood Creek via a storm pipe to a bubble-up
catch basin with a bird cage for discharge. For more detailed information regarding the
proposed storm system, please reference the preliminary storm plan and Technical Information
Report (TIR) prepared by Barghausen Consulting Engineers, Incl.

Release al Indemnification Agreen ___ lt for Model Homes
This agreement is made by and between the City of Renton, Washington, a municipal corporation of the State
of Washington ("City") and QUADRANT HOMES ("Owners").
Recitals
The Owners own real property in the City legally described in Exhibit A, attached.
The Owners have submitted an application for building permit(s) and/or a Temporary Use Permit to construct
model homes on the real property prior to recording of a short plat or final plat. Since changes to the short plat
or final plat may be necessary after construction of the model homes rendering the homes illegal, there is some
risk in building the model homes.
In consideration of the inherent risks associated with the construction of buildings in advance of the recording of
the plat, the City requires the owner to execute an indemnification agreement prior to any model home
construction activities.
Agreement
The parties agree to the following:
1. The City authorizes the Owners to do the work as described in the Temporary Use Permit application
No. once building permits have been obtained.
2. The owners assume the risk that the model home(s) must be removed or reconfigured and therefore
release and discharge the City and its representatives from all known and unknown losses, claims,
damages or causes of actions which the owners have or may have relating to buildings or structures
authorized by the Temporary Use Permit.
3. As a condition of granting Owner permission to construct model homes, Owner agrees to indemnify,
defend and hold the City of Renton Harmless from any claims or liens that may be exerted against the
property as a result of construction of model homes and use of the unrecorded plat of ______ _

4. Owners understand and acknowledge that, should the model home construction not comply with the
proposed lot configuration of the final plat, that no variances to development standards for either the
lots or the homes may be granted as such a situation would be considered a "self-induced hardship".
5. Owners acknowledge that they understand that any construction begun prior to the recording of the final

coverage, etc.) or removed prior to recording of the final plat. If the final plat is not recorded prior to the
expiration of the Temporary Use Permit, Owners acknowledge that the homes must be removed unless
complying with all applicable code requirements (e.g. one home per lot, etc.).
6. Applicant will also provide an Abatement Agreement and a security device acceptable to the City to
ensure removal of any structures not in compliance with City regulations at the time of expiration of the
Temporary Use Permit and understands construction of the model homes is at Owners' own risk.
7. The provisions of this agreement shall bind the parties, their legal heirs, representatives, successors
and assigns and shall expire upon the recording of the final plat of COPPERWOOD
