The applicant is requesting a Critical Areas Exemption to remove 13 dead/dying
trees (See Exhibit 3) in the tract just east of the single family home located at
9454 S 196th Pl, within Olympic Peak Development (See Exhibit 1). The tract is
approximately 83,745 square feet and contains wetlands and protected slopes.
The proposed tree removal will be located within the wetland buffer and one
tree will be removed within a protected slope. Our contracted city arborist,
Doug Hunter, confirmed that the trees are dead and/or dying and are high risk
trees (See Exhibit 4).

EXEMPTION JUSTIFICATION: Renton Municipal Code, Section 4-3-050C.3.c.iii. Dangerous Trees: Removal of
non-native invasive ground cover or weeds listed by King County Noxious Weed Board or other government
agency or dangerous trees, as defined in Chapter 4-11 RMC which have been approved by the City and
certified dangerous by a licensed landscape architect, or certified arborist, selection of whom to be approved
by the City based on the type of information required. Limited to cutting of dangerous trees; such hazardous
trees shall be retained as large woody debris in critical areas and/or associated buffers, where feasible.

FINDINGS: The proposed development is consistent with the following findings pursuant to
RMC section 4-3-050C.5:
1. The activity is not prohibited by this or any other chapter of the RMC or state or federal law or regulation.
2. The activity will be conducted using best management practices as specified by industry standards or
applicable Federal agencies or scientific principles if submitted plans are followed and the conditions of
approval ofthis exemption are met.
3. Impacts will be minimized and disturbed areas will be immediately restored, if submitted plans are followed
and the conditions of approval of this exemption are met.
4. Where wetland or buffer disturbance occurs during construction or other activities in accordance with this
exemption, the site will be revegetated with native vegetation as required as a condition of approval for this
exemption.

The above land use decision will become final if the decision is not appealed within the 14-day appeal
period {RCW 43.21.C.075{3); WAC 197-11-680).
APPEALS: An appeal of this administrative land use decision must be filed in writing together with the
required fee to the City of Renton Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA
98057, on or before 5:00 p.m., on December 29, 2015. RMC 4-8-110 governs appeals to the Hearing
Examiner and additional information regarding the appeal process may be obtained from the Renton City
Clerk's Office, (425) 430-6510.
RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be
reopened by the approval body. The approval body may modify his decision if material evidence not readily
discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After
review of the reconsideration request, if the approval body finds sufficient evidence to amend the original
decision, there will be no further extension of the appeal period. Any person wishing to take further action
must file a formal appeal within the 14-day appeal time frame.

Brief Description of Project
We are requesting a critical areas exemption to remove 13 dangerous trees within a critical area buffer. The tree
removal is proposed within a wetland buffer and within sensitive and protected slopes. No tree stumps are proposed
to be removed, and all trees shall be left as large, woody debris on site.

PURPOSE: Exempt activities provided with a letter of exemption from the Development Services
Administrator may intrude into a critical area or required buffer (Subject to any conditions or
requirements provided by the Administrator).
APPLICABILITY OF EXEMPTIONS: The following is a general list of activities that may be exempt from the
critical areas regulations. More specific descriptions of the activities are contained in the Critical Areas
Regulations. Some ofthe listed activities may not be exempt in certain critical areas. The Planning
Division will evaluate you request according to the City of Renton Critical Areas Regulations in RMC 4-3-
050C, J, L, and N.

I recommend removal of 13 high risk trees in the HOA parcel adjacent to 9454 5. 1961h Pl. I have attached a list of the
trees with identification numbers and a corresponding map to show their location and sensitive areas. In order to better
identify these trees in the field, I will tie blue flagging around them no later than 10/29/2015. Please let me know if you
