NARRATIVE
23-12893
On 11/08/2023 at approximately 1739 hours, I was dispatched to an unknown-if-injury and blocking
vehicle collision in the 3800 block of NE 4th Street, within the City Limits of Renton, County of King,
State of Washington.
Several Renton Officers responded to the scene and discovered that one of the involved party's was
complaining of head pain and requested the Renton Regional Fire Authority (RRFA) respond for
evaluation.
Upon my arrival, RRFA was already on scene evaluating the involved parties. RRFA treated and
released all patients at the scene. While on scene, I collected each involved party's driving
documents and independent involvement leading up to the collision.
The driver of Unit#1 stated she was the sole occupant of her vehicle and was attempting to exit a
private property parking lot, located at 3895 NE 4th ST, on the south side of the roadway. The driver
of Unit#1 stated that she was intending to make a left turn out of the parking lot to proceed
westbound onto NE 4th ST following the turn. The driver of Unit#1 stated that both eastbound lanes
of NE 4th ST had created an opening in traffic to allow enough space for Unit#1 to turn. The driver of
Unit#1 believed all eastbound traffic on NE 4th ST was clear and therefore proceeded out into the
roadway. As Unit#1 reached the center-turn-lane, Unit#1 was met by another vehicle - Unit#2. The
driver of Unit#1 claimed she did not see Unit#2 traveling in the center-turn-lane due to backed up
traffic. The driver of Unit#1 stated that she was unable to avoid the collision after having pulled out
into the roadway and that Unit#2 struck the front of Unit#1 subsequently causing significant damage
because of the collision.
The driver of Unit#2 said he and his juvenile passenger were traveling eastbound in about the 3800
block of NE 4th ST (in-between Queen Ave and Union Ave NE) and in the center-turn-lane. The
driver of Unit#2 stated he was intending to continue east to the intersection of Union Ave NE to make
a left turn. It should be noted that the distance to reach the intersection which was another 515 feet
away from where the collision occurred. Upon reaching the location of where Unit#1 was turning out
from, Unit#2 observed Unit#1 but was unable to avoid the collision. Both vehicles collided in the
roadway and Unit#2 suffered moderate damage to the front quarter panel, bumper, and fender of the
vehicle.
A witness who remained at the scene, identified as Kelly Rickenboch, stated that she saw the
collision occur. Rickenboch stated that an uninvolved vehicle was able to successfully turn from the
same parking lot that Unit#1 was attempting to turn from just prior to the collision. Rickenboch did not
see where Unit#2 emerged from but did not believe either vehicle was speeding or driving recklessly.
Based on the above statements, 1 believe that the driver of Unit#1 (Thomas) was a contributing factor
for the cause of collision as Thomas is required to comply with RCW 46.61.190(2) which states that
every driver of a vehicle approaching the point nearest the intersecting roadway where the driver has
a view of approaching traffic of the intersecting roadway must stop before entering the roadway, and
after having stopped shall yield the right-of-way to any vehicle in the intersection or approaching on
another roadway so closely as to constitute an immediate hazard during the time when such driver is
moving across or within the intersection or junction of roadways. Unit#2 was already underway in the
roadway and had right of way.
Based on the above statements, 1 believe that the driver of Unit#2 (Kubay) was also a contributing
factor for the cause of collision as Unit#2 violated RCW 46.61.290 -Improper Center Lane Usage.

NARRATIVE
Unit#2 (Kubay's vehicle) traveled eastbound from just east of Queen Ave NE with the intent to reach
Union Ave NE. The violator vehicle traveled well in excess of the allotted three-hundred feet in the
center-turn-lane as allowed by law. I estimate the violator vehicle still had 515 feet to travel in the
center-turn-lane to reach their intended turn. This estimate does not include the distance already
traveled in the center-turn-lane prior to the collision.
RCW 46.61.290 is defined as; "Upon a roadway where a center lane has been provided by distinctive
pavement markings for the use of vehicles turning left from either direction, no vehicles may turn left
from any other lane. A vehicle shall not be driven in this center lane for the purpose of overtaking or
passing another vehicle proceeding in the same direction. No vehicle may travel further than three
hundred feet within the lane.
I issued the driver of Unit#1 (Thomas) a written warning via mail for Fail to Stop at Intersection
causing a collision.
I issued the driver of Unit#2 (Kubay) a written warning via mail for improper center-turn-lane use.
Unit#1 had to be impounded due to extensive damage. Unit#2 was moved off the roadway and was
unsure if he was going to have his vehicle impounded or drive it home. An exchange of information
was provided to all involved parties.
