TI IIS AGREEMENT is made this 21 _ day of Scptcmber,1995 by and between
Kinder -Care Learning Center, Inc. A Delaware Corporation (Kinder -Care), and Anton A.
Althoff and Millic Althoff, husband and wife (Althoff).
Background
Kinder -Care is purchasing a parcel of land, further described as Exhibit "A" in the County
of King, City of Renton, State of Washington from the Althofrs. In connection with their
purchase of the property, Kinder -Cary: wishes to grant and convey a Utility easement to the
�p Althofrs. The purpose of this casement is for construction of a sanitary sewer by Althoff

_Q across the property being purchased by Kinder -Care.

IN CONSIDERATION of the sums of one dollar ($1.00) and other bargained for

00 consideration, and subject to the 'grins and considerations set forth below, Kinder -Care
hereby grants Althoff an easement for the purposes and to the extent provided herein.
THEREFORE, the parties agree as follows:
(I.) Grantor Kinder -Care grants and conveys to Grantee Althofrs, its successors and
assigns, an easement to construct and maintain a sanitary sewer pipeline under the land of
Grantor, more particularly described as Exhibit "B".
(2.) Grantee Althoff will bear the entire cost of construction of said sanitary sewer pipeline
and will hold Grantor Kinder -Care harmless from any and all costs, expenses and claims or
demands relating to, arising from or out of the construction of the easement.
(3.) Grantee Althoff will return Grantor Kinder -Care property to its original condition and
bear all cost in doing so, once the sanitary sewer pipeline ahs been constructed.
(3.) Grantee Althoff shall maintain said sanitary sewer pipeline within the easement area in
a good state of repair and bear all costs in doing so.
(5.) In the event Grantee fails to perform the maintenance and repair required by this
agreement, Grantor shall notify grantee of his default and after thirty (30) days of Grantee's
default, Grantor shall have the right to perform such maintenance and repairs. The Grantee
shall reimburse the Grantor for any and all expense incurred on account thereof within ten
(10) days of receipt of statement.
(6.) This Agreement shall be binding upon and run with the land and shall inure to the

benefit of and be binding upon the owners described above, their heirs, successors and
