NARRATIVE
Renton Case #24-2278
On 03/01/2024 at 1417 hours I was responded to the 800 block of Benson RD S, in the City of
Renton, King County, Washington. I was responding to a call of an accident. This incident was
captured on my body worn video camera. This report is a summation of events that occurred and is
not an exact sequence of events.
While en route, dispatch advised the following: Vehicle off road into water, unknown injury,
passengers out of the vehicle.
I arrived on scene located the involved party. Unit 1 vehicle was off the roadway and partially
submerged in a drainage retention pond, directly east of Benson Rd S. Both occupants of Unit 1 were
no longer inside the vehicle and standing next to the Benson Rd S.
I identified Unit 1 as a 2006 Honda Civic (WA LIC #CBX2916), being driven by the unreported owner
of the vehicle, who I identified via his Honduras ID as Elias A Cardona-Rivera (DOB 03/13/2001).
Inside the vehicle with Cardona-Rivera at the time of the accident was his cousin, verbally identified
as Lam J Pena-Garcia (DOB 02/01/2019).
Unit 1 driver did not speak English, all communication was done via Language Line. Unit 1 driver told
me he and his passenger were not injured. Unit 1 driver stated that as he was traveling north on
Benson RD S, he lost control going around a corner. Unit 1 driver stated that as he tried to regain
control of the vehicle, he accidently pressed the accelerator making the vehicle go faster. In doing so,
the vehicle went through a chain link fence and into a retention pond. Unit 1 driver stated that his 5-
year-old passenger, was wearing a seat-belt, but was not in a proper child restraint system.
Unit 1 driver stated that he did not have a license and did not have insurance for the vehicle. Unit 1
driver stated that he recently purchased the vehicle but has not switched the vehicle into his name.
Fire responded to the scene and medically evaluated both individuals.
I took photographs of the partially submerged vehicle at the scene along with the sustained vehicle
damage. All photos were later uploaded to Axon Evidence.
I provided Unit 1 driver with a business card, case number and answered their remaining questions.
Bankers Towing was dispatched and removed Unit 1 vehicle via crane from the retention pond. At the
owner's request, Bankers removed the vehicle from the scene.
Based on the above statements by Unit 1 driver, I advised that I would be issuing him several
citations related to the accident. A citation for Negligent Driving 2nd Degree - RCW 46.61.525,
Operating a Motor Vehicle Without Insurance -RCW 46.30.020, No Valid Operators License with
Valid ID -RCW 46.20.015, and Fail to Use Child Restraint-RCW 46.61.687, were all later authored.
I informed the driver the citations would be sent in the mail and confirmed the correct mailing address.
I then cleared the scene.
