DESCRIPTION: The applicant is requesting a Critical Areas Exemption to address a code
enforcement action that was opened in November 2015 (CODE15-000680) for
placing illegal fill on the property within a Native Growth Protection Area -
Steep Slope Hazard Area on the west side of the property. This exemption has
been applied for as a corrective action to the grading violation and in order to
CRITICAL AREA:
obtain a grading license to complete the restoration. The proposed project will
remove all the illegal fill material and restore the critical area back to pre -fill
condition. The work will be completed in conformance with the
recommendations of a licensed geotechnical engineer as detailed in a
Geotechnical Report prepared by Robert M. Pride, LLC (dated June 5, 2016) and
under an approved grading license. Based on the recommendations of the
geotechnical report, staff has recommended conditions to require the hillside
be restored to its original grade, covered with jute netting material and
revegetated per an approved landscape plan prepared by Marguerite Jacobs,
Eufloria Landscapes, LLC, that complies with the recommendations of the
licensed geotechnical engineer, as an added measure to provide additional
erosion protection to the slope. A Temporary Erosion and Sediment Control Plan
implementing Best Management Practices has been approved as part of the
grading permit application and is consistent with the Drainage Report prepared
by Darrell Offe, P.E., Offe Engineers.

EXEMPTION JUSTIFICATION: Renton Municipal Code 4-3-050 Critical Areas Regulations Subsection C.3.a.iii
Approved Restoration and Mitigation Plan
FINDINGS: The proposed development is consistent with the following findings pursuant to
RMC section 4-3-050C.2.d:
L The activity is not prohibited by this or any other provision of the Renton
Municipal Code or State or Federal law or regulation;
fl. The activity will be conducted using best management practices as specified
by industry standards or applicable Federal agencies or scientific principles;
iii. Impacts are minimized and, where applicable, disturbed areas are
immediately restored;
iv. Where water body or buffer disturbance has occurred in accordance with an
exemption during construction or other activities, revegetation with native
vegetation shall be required;
v. If a hazardous material, activity, and/or facility that is exempt pursuant to
this Section has a significant or substantial potential to degrade groundwater
quality, then the Administrator may require compliance with the Wellhead
Protection Area requirements of this Section otherwise relevant to that
hazardous material, activity, and/or facility. Such determinations will be based
upon site and/or chemical -specific data.
DECISION: An exemption from the Critical Areas Regulations is hereby Approved with
Conditions*.
CONDITIONS: 1. All work must be done in accordance with an approved grading license (see
B16005037).
2. Work shall commence upon the end of appeal period. If work commences
prior to the end of appeal period, it is at the owner's risk. The grading license is
conditioned to require construction inspector verification of final grade prior to
landscape installation.

The above land use decision will become final if the decision is not appealed within the 14 -day appeal
period (RCW 43.21.C.075(3); WAC 197-11-680).
APPEALS: An appeal of this administrative land use decision must be filed in writing together with the
required fee to the City of Renton Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA
98057, on or before 5:00 p.m., on October 31, 2016. RMC 4-8-110 governs appeals to the Hearing Examiner
and additional information regarding the appeal process may be obtained from the Renton City Clerk's Office,
(425) 430-6510.
RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be
reopened by the approval body. The approval body may modify his decision if material evidence not readily
discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After
review of the reconsideration request, if the approval body finds sufficient evidence to amend the original
decision, there will be no further extension of the appeal period. Any person wishing to take further action
must file a formal appeal within the 14 -day appeal time frame.
EXPIRATION: Five (5) years from the date of decision (date signed).

Dear Mr. Syrbu,
As requested by the City of Renton I have evaluated the existing slope that has been
covered with fill soils that have experienced recent sliding over the lower retaining wall.
It is understood that new retaining walls will not be allowed due to the steepness of this
slope, and that slope conditions must be stabilized to prevent future sliding of the
surficial fill soils.
This report provides recommendations for slope stabilization in lieu of installing a new
retaining wall for slope support. The most reasonable option involves removing the
existing fill soils on this slope that has been subject to surficial failure. The native glacial
recessional deposits are intact and have not been adversely affected by the downslope
movement of the overlying fill soils.
Depths of fill soils removal on this slope is expected to vary from 3 to 6 feet with most of
this fill existing near the top of the slope where the rear yard was extended. Field
inspections will be required to confirm adequate removal of the loose fill soils to expose
the medium dense native soils. Landscape planting must be accomplished after
placement of a coarse filter cloth that will provide additional erosion protection to this

SECTION 1.1 DRAINAGE REVIEW
1.1.1 PROJECTS REQUIRING DRAINAGE REVIEW
Drainage review is required for any proposed project (except those proposing only maintenance) that is
subject to a City of Renton development permit or approval, including but not limited to those listed at
right, AND that meets any one of the following conditions:
1. The project adds or will result in 2,000 square feels or

Tfiis project Is to remove an illegal fill that was placed on the property within a Native Growth Protection
Area — steep slope hazard area; on the west side of the property. The subject property naturally sheet
flowed from the east to the west towards state Route 485 along the westerly property line. The proposed
completed project will be to remove the fill material back to the pre-fill condition. The regarded slopes will
be protected and revegetated upon completion. The completed project will re-establish the natural
discharge from the property onto State Route 405.
Core Requirement #5 — Erosion and Sediment Control
A•Temporary Erosion and Sediment Control Plan implementing the Best Management PraCtices has been
provided as part of the grading permit application. The project does not exceed the State Department of
Ecology requirements of clearing/grading over 1.0 acres in size; therefore NO NPDES permit will be provided
as part of the final engineering plan submittal.

Dear Mr. Syrbu,
As requested by the City of Renton I have evaluated the existing slope that has been
covered with fill soils that have experienced recent sliding over the lower retaining wall.
It is understood that new retaining walls will not be allowed due to the steepness of this
slope, and that slope conditions must be stabilized to prevent future sliding of the
surficial fill sods.
This report provides recommendations for slope stabilization in lieu of installing a new
retaining wall for slope support. The most reasonable option involves removing the
existing fill soils on this slope that has been subject to surficial failure. The native glacial
recessional deposits are intact and have not been adversely affected by the downslope
movement of the overlying fill soils.
Depths of fill soils removal on this slope is expected to vary from 3 to 6 feet with most of
this fill existing near the top of the slope where the rear yard was extended. Field
inspections will be required to confirm adequate removal of the loose fill soils to expose
the medium dense native soils. Landscape planting must be accomplished after
placement of a coarse filter cloth that will provide additional erosion protection to this

This project is to remove an illegal fill that was placed on the property within a Native Growth Protection
Area — steep slope hazard area: on the west side of the property. The subject property naturally sheet
flowed from the east to the west towards State Route 405 along the westerly property line. The proposed
completed project Will be to remove the fill material back to the pre -fill eonditton. The regarded slopes will
be protected and revegetated upon completion. The completed project will re-establish the natural
discharge from the property onto State Route 405.

A -Temporary Erosion and Sediment Control Pian implementing the Best Management Practices has been
provided as part of the grading permit application. The project does not exceed the State Department of
Ecology requirements of dearing/grading over 1.0 acres in. size; therefore NO NPDES permit will be provided

Dear Mr. Syrbu,
As requested by the City of Renton 1 have evaluated the existing slope that has been
covered with fill soils that have experienced recent sliding over the lower retaining wall.
it is understood that new retaining walls will not be allowed due to the steepness of this
slope, and that slope conditions must be stabilized to prevent future sliding of the
surficial fill soils.
This report provides recommendations for slope stabilization in lieu of installing a new
retaining wall for slope support. The most reasonable option involves removing the
existing fill soils on this slope that has been subject to surficial failure. The native glacial
recessional deposits are intact and have not been adversely affected by the downslope
movement of the overlying fill soils.
Depths of fill soils removal on this slope is expected to vary from 3 to 6 feet with most of
this fill existing near the top of the slope where the rear yard was extended. Field
inspections will be required to confirm adequate removal of the loose fill soils to expose
the medium dense native soils. Landscape planting must be accomplished after
placement of a coarse filter cloth that will provide additional erosion protection to this
slope. Please call me if there are any questions.
