Mr, Smith indicated that the dedication would not occur on the applicant's property.but acquisition would be negotiated with the adjacent property owner if deemed necessary: He also noted that it was uncertain if proper dedication had previously occurred along ' ,,. the southerly portion of the site. The Examiner inquired if review of the title insurance - ' •policy would reveal the status of S.E. 18th Street. Mr. Anderson indicated that review of the document would be accomplished, and all information regarding the• dedication would be submitted to the Hearing Examiner and the Public Works Department. The Examiner referenced Section 0.6 of Exhibit #1 regarding consistency of the emergency ' vehicle connection to the Richard Moe development to the south and inquired if such common access has been properly aligned. Although Mr. Smith was uncertain of final plans for the Moe development because application for building permit has not yet occurred, he noted that certain adjustments could be made in final, review to 'assure proper alignment of the emergency vehicle access at mid-point in the properties. The Examiner inquired if noticeof the public hearing had been transmitted to the Rolling Hills Homeowners' Association. Mr. Smith contacted the Planning Department to acquire the information, 'and reported to the Examiner that although a copy of the notice of public, hearing had' not been mailed to the homeowners' association, notices had been distributed to adjacent property owners and proper legal publication and posting had occurred in accordance with state law. The Examiner indicated that he would close the public hearing with the stipulation that information regarding the status of S.E. 18th Street would be acquired and transmitted to the applicant upon receipt. There was no objection. The Examiner requested further comments. Since there were none, the hearing on File No. SP-204-78 was closed by the Examiner at 11:40 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: • 1. The request is for approval of a special permit_ to construct 25 multifamily units on • 2.06 acres in the R-3 and R-2 zone. 2. The Planning Department report accurately sets forth the issues, applicable policies ;' and provisions, findings of fact, and departmental recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. • 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. '43.21.C. , a Declaration of Non-Significance has has 'been issued for the subject proposal by Gordon Y. Erickset , responsible official, subject to: . After reviewing the Planning Department report, examining ' available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on August 22,• 1918 at 10b.50 a.m. in the Council Chambers of the , .. Renton Municipal Building. ' Parties wishing to testify were affirmed by the Examiner. It, was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Michael Smith, Planning Department, reviewed Exhibit #1, and entered the. following additional exhibits into the record: Exhibit #2: King County Assessor's Map Exhibit #3: Storm Drainage Plan ' Exhibit #4: Architectural Elevations (2 sheets) Exhibit #5: Site Plan Exhibit #6: Landscape Plan Exhibit #7: Ordinance No. 2450 (by reference) The Examiner asked the representative for the applicant if he concurred in Exhibit #1. - Responding was: John Anderson ' 10620 N.E. 8th ' ' Bellevue, WA 98004 Mr. Anderson indicated his concurrence in the report and noted the consistency and compatibility of the proposal with other developments 'to the east and south of the site. He questioned Fire Department requirement for a turnaround at the eastern end of the site ' as referenced in Section:0.6 of Exhibit #1. •The Examiner requested -testimony in support or opposition to the application. There was no.•response. Relocation of the southern emergency vehicle access on Exhibit #5, site plan, to align with the adjacent southerly development per the requirements and approval of the Planning Department. • 2. Acquisition of the south 30 feet of S.E. 18th Street and subsequent dedication to the City for public right-of-way per the requirements and approval of the Public Works Department. • 3. Approval of the storm drainage plan (Exhibit #3) by the Public Works Department. 4. Revision of the landscape plan (Exhibit #6) to include additional coniferous trees • so as to constitute an effective buffer within the eastern 50-foot landscape buffer area, similar to that provided in the two southerly developments, per the requirements and approval of the Planning Department. Structures are not to be. located in this easterly 50 feet. The landscape plan is to be further revised in accordance with the staff recommendations (Exhibits #1 and #6) per the approval of the Planning Department. 5. Installation of off-site improvements per the requirements and approval of .the Public Works Department. Per the attached : memorandum of August 31, 1978, the .Public• Works Department. testified that this • • portion of the street .is privately owned but may be a public road by prescriptive" use. 11:• Emergency vehicle' acbess between the proposal-and the southerly abutting development (Richard Moe;. Special Permit No. SP-097-77) requires further coordination since this access does not align with each development. The Planning staff estimated' that .the proposed emergency vehicle access must be. relocated approximately 20. to' 25 feet; . east of its present location on the southerly', portion of the site. It was apparent;;: ' that this could be easily accomplished. 12. The. Fire Department testified that the emergency vehicle turnaround on the eastern' ' portion of the site, as .originally recommended in Exhibit #1, would not be necessary . due to the emergency vehicle access provision to S.E. 18th Street on the northern portion of the site. . 13. Off-site improvements are required on Grant Avenue S. and S.E. 18th Street. 14. A. storm drainage plan (Exhibit #3) was submitted to the Public Works Department; however, no comment was provided for the record.. CONCLUSIONS: 1. The proposal conforms to the Comprehensive Plan and' zoning requirements. This development ". . .will not be unduly 'detrimental, to adjacent surrounding properties and 'enjoyment thereof." (Section 4-708. (3) ) 2. Additional vegetation is .required, in the easterly 50-foot. landscape'buffer area. . . The landscape plan, Exhibit #6, should be revised to- include sufficient'quantity and size of coniferous trees to supplement existing trees. Deciduous trees comprise most of the existing vegetation; therefore coniferous trees will provide buffering ' during the winter months. : . 3. The applicant was agreeable to providing the landscaping recommended by staff in Exhibit #1, Item 0.7. The developing properties south of the proposal were required . to install a landscaped berm along Grant Avenue S. .For continuity and buffering of traffic from the development, this.bert should be extended along S.E. 18th Street. Other comments by staff relative to the landscape plan appear appropriate. ' . ' 4. Although the submitted building- elevations (Exhibit #4) are somewhat general, it ' is apparent that the design is 'appropriate for, the site and •surrounding area. Details • were not provided concerning the building.materials and colors; however, the building elevations hint of vertical wood siding' similar to what has been previously approved in the southerly two developments (e.g'. , Richard Moe, SP-097-77) , Earth-tone colors are preferable as was approved in the two southerly developments. 5. A sufficient amount of open space is contained in'the proposal to provide recreational opportunities for- residents; however, the easterly 50-foot .landscaping buffer area is not. to be used as a recreation area. • ' .6. Topography: The site rises from west to east at approximately a 5.5% slope. 2. Soils: Alderwood gravelly sandy loam (AgC) : Permeability is moderately rapid in the surface layer and subsoil and very slow in the substratum. Runoff is slow to medium, and the erosion hazard is moderate. This soil is used for timber, pasture, berries, row crops, and for urban development. 3. Vegetation: The site is dominated by scrub grass with some deciduous trees along Grant Avenue and a few evergreens near the eastern boundary line. 4. Wildlife: Existing vegetation on the site provides suitable habitat for birds and small mammals, 5. Water: There is no surface water evident on the site. 6. Land Use: The site itself contains an older single family residence with an apartment complex to the west across Grant Avenue. To the south is a condominium project presently under construction and to the east is a single family residence which is adjacent to a resi- dential subdivision. One single family residence is located on the property north of the subject site. F. NEIGHBORHOOD CHARACTERISTICS: The area is a mixture of single family residences, apartments, some other condominiums, and undeveloped properties. G. PUBLIC SERVICES: 1. Water and Sewer: An existing 12-inch watermain runs north-south on Grant Avenue and an 8-inch main extends east-west on S.E. 18th with a 3-inch main running north-south on Grant north of S.E. 18th. Eight- inch sanitary pipes extend north-south on Grant and east-west on S.E. 18th while a 24-inch sanitary pipe runs in northwest-southeast direction northwest of the subject site. 2. Fire Protection: Provided by the Renton Fire Department as per ordinance requirements. 3. Transit: METRO Transit route 145 operates along Benson Road South within 2 mile west of the subject site. 4. Schools: Spring Glen Elementary School and Fred Nelsen Junior High School are within 4 mile , to the south of the subject site while Lindbergh Senior High School is within two miles to the east. 5. Parks: . Philip Arnold Park is located within one mile to the north of the subject site and Tiffany Park is approximately 12 miles to the east and Talbot Hill Park is within 14 miles to the southwest. H. IMPACT ON THE NATURAL SYSTEMS: Development of the subject site will disturb soil , remove vegetation, and increase storm water runoff. Increased traffic and noise are also expected. K. SOCIAL IMPACTS: Development of the site will provide increased opportunities for social interaction within the neighborhood, L. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION: Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended, RCW 43-21C, a Declaration of Non-significance has been issued for the subject proposal (see attached). This negative declaration is further predicated upon proper development procedures in accordance with the City's Comprehensive Plan, Zoning Code, and other City ordinance and special requirements which provide for suitable environmental mitigation measures. The natural character and trees on the site should be retained as much as possible and the established fifty (50) foot buffer area along the easterly por- tion of the site should be retained in its natural character and sup- plemented with additional dense landscape/screening buffer. The subject proposal is consistent with the existing zoning and Comprehensive Plan designation for the site. The proposed density o a" owelling units per acre) and the installation of a 50-foot s reening/natural buffer area will provide a reasonable transition from the high density multiple family residential area west of the site to the single family residential area east of the site if appropriate development standards and density controls are main- tained. 2. The subject site was zoned to R-3 (0.66 acres along the westerly 200 feet of the site) and R-2 (remaining 1.40 acre portion of the site) on December 24, 1968. Specific restrictive covenants were estab- lished and filed at that time. These covenants establish a 50-foot setback from the east property line to be landscaped and retained and a landscape plan to be provided and approved by the Planning Department. The proposed site plan appears to be consisten with this requirement. However; natural vegetation on the site is quite sparse and not sufficient to serve as a buffer. The same situation existed in the Richard Moe application (Special Permit No. SP-097-77) and it was recommended that additional landscaping be provided to meet the covenant requirements and be consistent with the Comprehen- sive Plan Land Use Report, 1965, Objectives 1 and 2, p. 17. A dense evergreen buffer together with the greenbelt within the Rolling Hills sub- division adjacent to the easterly boundary of the subject- site, should serve as suitable screening and buffering. 3. The proposed density of 25 dwelling units is less. than that which is allowed by the Zoning Ordinance. With the existing combination of the R-3 and R-2 zoning, the maximum allowable density is 36 dwelling units (R-3 area = 0.66 acres = 19.8 dwelling units; R-2 area = 1.4 acres = 15.4 dwelling units). 4. The subject proposal is consistent with the setback requirements and lot coverage limits of the R-3 and R-2 zones and is compatible with the requirements of Section 4-708(3). 5. The proposed parking is consistent with the requirements of Chap- ter 22 of the Parking and Loading Ordinance. Approximately one- half of the required parking is proposed for covered stalls (50 parking stalls required; 54 parking stalls provided). 6. The circulation/driveway system as proposed is acceptable to the Fire Department with connecting emergency exits to the north and south adjacent properties as recommended. However, turnaround space for emergency vehicles will need to be provided at the east end of the subject site. In addition, fire hydrants must be in- stalled prior to any building construction. Emergency vehicle connection to the Richard Moe development to the south is con- sistent with the requirement for the previously approved special permit no. SP-097-77. 7. The landscape plan appears generally acceptable. Detailed require- ments, materials, size, spacing, and locations should be approvbd by the Planning Department. Some areas of concern which will re- quire more attention in the final landscape design include: (a) Retention of particular trees on the site to be included in site development subject to Planning Department approval . (b) Supplemental landscaping in and around the parking/circulation areas to reduce the visual impact and barren appearance of the asphalt. (c) Alternative landscape material in certain areas for screening and buffering per Planning Department approval . (d) Provision of dense evergreen buffer within 50-foot easterly buffer area. (e) Provide earth berm along public rights-of-way in conjunction with landscaping to provide additional screening and reduc- tion of impacts to the single family residential neighborhood. 8. Building design and materials should be compatible with the similar condominium project adjacent to the south (i .e. , Richard Moe) and the Rolling Hills single family residential area to east. Suitable cedar, brick, or other masonry exterior materials, together with cedar shake roofs and earth tone colors should be incorporated per Planning Department approval . 9. Engineering Department advises that sidewalks will have to be in- stalled on Grant Avenue South and one-half of a right-of-way acquired for S.E. 18th Street. In addition, there is a require- ment that S.E. 18th Street be improved with one-half street section of curb, gutter, and sidewalk; and installation of 18 feet of paving and storm sewer. 10. Approved street lighting is required on the south half of S.E. 18th Street as per Traffic Engineering comment. 11. Utilities are available to the site. Utilities Engineering indi- dates that engineering drawings will be required for water and sewer. Also, the standard fees of one cent (1 ) per square foot for water and sewer will have to be paid prior to any site devel- opment. Topography: The site rises from west to east at approximately a 5.5% slope. 2. Soils: Alderwood gravelly sandy loam (AgC) : Permeability is moderately rapid in the surface layer and subsoil and very slow in the substratum. Runoff is slow to medium, and the erosion hazard is moderate. This soil is used for timber, pasture, berries, row crops, and for urban development. 3. Vegetation: The site is dominated by scrub grass with some deciduous trees along Grant Avenue and a few evergreens near the eastern boundary line. 4. Wildlife: Existing vegetation on the site provides suitable habitat for birds and small mammals. 5. Water: There is no surface water evident on the site. 6. Land Use: The site itself contains an older single family residence with an apartment complex to the west across Grant Avenue. To the south is a condominium project presently under construction and to the east is a single family residence which is adjacent to a resi- dential subdivision. One single family residence is located on the property north of the subject site. F. NEIGHBORHOOD CHARACTERISTICS: The area is a mixture of single family residences, apartments, some other condominiums, and undeveloped properties. G. PUBLIC SERVICES: 1. Water and Sewer: An existing 12-inch watermain runs north-south on Grant Avenue and an 8-inch main extends east-west on S.E. 18th with a 3-inch main running north-south on Grant north of S.E. 18th. Eight- inch sanitary pipes extend north-south on Grant and east-west on S.E. 18th while a 24-inch sanitary pipe runs in a northwest,-southeast direction northwest of the subject site. 2. Fire Protection: Provided by the Renton Fire Department as per ordinance requirements. 3. Transit: METRO Transit route 145 operates along Benson Road South within 2 mile west of the subject site. 4. Schools: Spring Glen Elementary School and Fred Nelsen Junior High School are within 4 mile , to the south of the subject site while Lindbergh Senior High School is within two miles to the east. 5. Parks: Philip Arnold Park is located within one mile to the north of the subject site and Tiffany Park is approximately 12 miles to the east and Talbot Hill Park is within 14 miles to the southwest. This negative declaration is further predicated upon proper development procedures in accordance with the City's Comprehensive Plan, Zoning Code, and other City ordinance and special requirements which provide for suitable environmental mitigation measures. The natural character and trees on the site should be retained as much as possible and the established fifty (50) foot buffer area along the easterly por- tion of the site should be retained in its natural character and sup- plemented with additional dense landscape/screening buffer. The subject proposal is consistent with the existing zoning and Comprehensive Plan designation for the site. The proposed density dwelling units per acre) and the installation of a 50-foot s reening/natural buffer area will provide a reasonable transition from the high density multiple family residential area west of the site to the single family residential area east of the site if appropriate development standards and density controls are main- tained. 2. The subject site was zoned to R-3 (0.66 acres along the westerly 200 feet of the site) and R-2 (remaining 1.40 acre portion of the site) on December 24, 1968. Specific restrictive covenants were estab- lished and filed at that time. These covenants establish a 50-foot • setback from the east property line to be landscaped and retained and a landscape plan to be provided and approved by the Planning Department. The proposed site plan appears to be consisten with this requirement. However; natural vegetation on the site is quite sparse and not sufficient to serve as a buffer. The same situation existed in the Richard Moe application (Special Permit No. SP-097-77) and it was recommended that additional landscaping be provided to meet the covenant requirements and be consistent with the Comprehen- sive Plan Land Use Report, 1965, Objectives 1 and 2, p. 17. A dense evergreen buffer together with the greenbelt within the Rolling Hills sub- division adjacent to the easterly boundary of the subject- site, should serve as suitable screening and buffering. 3. The proposed density of 25 dwelling units is less. than that which is allowed by the Zoning Ordinance. With the existing combination of the R-3 and R-2 zoning, the maximum allowable density is 36 dwelling units (R-3 area = 0.66 acres = 19.8 dwelling units; R-2 area = 1.4 acres = 15.4 dwelling units). 4. The subject proposal is consistent with the setback requirements and lot coverage limits of the R-3 and R-2 zones and is compatible with the requirements of Section 4-708(3). 5. The proposed parking is consistent with the requirements of Chap- ter 22 of the Parking and Loading Ordinance. Approximately one- half of the required parking is proposed for covered stalls (50 parking stalls required; 54 parking stalls provided). 6. The circulation/driveway system as proposed is acceptable to the Fire Department with connecting emergency exits to the north and . south adjacent properties as recommended. However, turnaround space for emergency vehicles will need to be provided at the east end of the subject site. In addition, fire hydrants must be in- stalled prior to any building construction. Emergency vehicle connection to the Richard Moe development to the south is con- sistent with the requirement for the previously approved special permit no. SP-097-77. 7. The landscape plan appears generally acceptable. Detailed require- ments, materials, size, spacing, and locations should be approved by the Planning Department. Some areas of concern which will re- quire more attention in the final landscape design include: (a) Retention of particular trees on the site to be included in site development subject to Planning Department approval . (b) Supplemental landscaping in and around the parking/circulation areas to reduce the visual impact and barren appearance of the asphalt. (c) Alternative landscape material in certain areas for screening and buffering per Planning Department approval . (d) Provision of dense evergreen buffer within 50-foot easterly buffer area. (e) Provide earth berm along public rights-of-way in conjunction with landscaping to provide additional screening and reduc- tion of impacts to the single family residential neighborhood. 8. Building design and materials should be compatible with the similar condominium project adjacent to the south (i .e. , Richard Moe) and the Rolling Hills single family residential area to east.
