EE44306 CASE# 24-796 OF COLLISION 01/23/24 17:54 OF CbLLI510N NARRATIVE 24-796 On 01/23/2024 at approximately 1801 hours, I was dispatched to a non-injury and non-blocking vehicle collision at the intersection of NE 4th Street and Duvall Ave NE, within the City Limits of Renton, County of King, State of Washington. While en route, Dispatch advised that there were two vehicles involved in a collision at the intersection and were pulled off the roadway in a nearby parking lot waiting for Police contact. Dispatch advised the vehicles involved were a Chevrolet Cruz and a Honda CR-V. Upon my arrival, 1 contacted the involved parties and confirmed there were no complaints of injury requiring immediate medical response at the time of report. While on scene, I collected each involved party's driving information and their independent recollection of the incident. The driver of Unit#1 stated she was the sole occupant of her vehicle and was traveling southbound on Duvall Ave NE approaching the intersection of NE 4th ST. The driver of Unit#1 stated that she was intending to make a right-turn to proceed westbound onto NE 4th ST. The driver of Unit#1 stated that she believed traffic was clear and proceeded out into the intersection to complete her intended turn. During the turn, Unit#1 was met by Unit#2 which had been traveling westbound on NE 4th ST in lane 1 of 2. Both vehicles collided in the roadway causing moderate damage to the driver's side of Unit#1. The driver of Unit#2 stated that she was the sole occupant of her vehicle and was traveling westbound on NE 4th ST approaching the intersection of Duvall Ave NE in lane 1 of 2. The driver of Unit#2 stated that she had a green light and was intending to continue west through the intersection. As Unit#2 continued through the intersection, she noticed Unit#1 had turned from the north side of the intersection and appeared to have made her turn directly in front of Unit#2's lane of travel. The driver of Unit#2 was attempted to avoid the collision by swerving but ultimately collided with Unit#1 causing moderate damage to the front passenger bumper/quarter panel of Unit#2. Upon review of the intersection, I observed a Yield sign posted for southbound traffic on Duvall Ave NE attempting to turn west onto NE 4th Street, and similar to what Unit#1 was attempting to complete. Based on the above statements, 1 believe the driver of Unit#1 (Lobos Linares) was the predominant factor for the cause of collision as Lobos Linares violated RCW 46.61.190(3) which outlines that the driver of a vehicle approaching a yield sign shall in obedience to such sign slow down to a speed reasonable for the existing conditions and if required for safety to stop, shall stop at a clearly marked stop line, but if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering the roadway, and then after slowing or stopping, the driver shall yield the right-of-way to any vehicle in the intersection or approaching on another roadway so closely as to constitute an immediate hazard during the time such driver is moving across or within the intersection or junction of roadways: PROVIDED, That if such a driver is involved in a collision with a vehicle in the intersection or junction of roadways, after driving past a yield sign without stopping, such collision shall be deemed prima facie evidence of the driver's failure to yield right-of-way. Lobos Linares did not allow Unit#2 to complete such movement before turning. I cited Lobos Linares in-person for failing to obey a Yield sign causing a collision and for Operating a motor vehicle without insurance. Both Unit#1 and Unit#2 were able to be driven away without further incident. All involved parties were provided a copy of the Exchange of Information.
