SP-237-78 LOCATION: " Vicinity of 3713 Talbot Road South.. • SUMMARY OF REQUEST: Applicant seeks approval of a special permit to allow construction of professional offices in a P-1 zone. SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Approval with conditions. • PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on November 15, 1978. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on November 21, 1978, at 9:40 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. David Clemens, -Associate Planner, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Vicinity Map Exhibit #3: Site Plan as submitted Exhibit #4: Site Plan with staff comments Exhibit #5: Restrictive Covenants filed with rezone of the subject property, dated June 23, .1975. The Examiner asked the representative for the applicant if he concurred in Exhibit #1. Responding was: Larry Gibson 143E Queen Avenue N.E. Renton, WA 98055 Mr. Gibson indicated his concurrence in the report. The Examiner noted that a landscape plan had not been submitted with the application and inquired regarding the proposed landscaping concept. Mr. Gibson reported existence of mature trees on the property which would not. be removed, and indicated that a 15-foot landscape buffer required by covenant along 5. 37th Street would be accomplished by construction of an earth berm to screen the subject site from adjacent residents. He stated that all .plans would be reviewed with the Planning Department. • • The Examiner inquired if the proposal conforms to requirements denoted in the Parking and Loading Ordinance. Mr. Clemens responded affirmatively. He also inquired why submittal of a landscape plan was not required by the Planning Department. Mr. Clemens referenced Section 4-710.3, P-1 District, of the zoning code,' which denotes requirements relating to structures, setbacks and access rather than landscaping. ,He indicated the • department's intent to coordinate all landscaping plans with the applicant on the site to enhance existing natural features subsequent to establishment of lot lines by survey. The Examiner requested further comments. Since there were none, the hearing on File No. SP-237-78 was closed by the Examiner at 10:10 a.m. SP-237-78 Page Two FINDINGS, CONCLUSIONS AND DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: • 1. The request is for approval of a special permit for a professional office building in a P-1 zone. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, (is uncontested) , and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official subject to conditions (attached to Exhibit #1) . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the setback and building height requirements of Section 4-710 (P-1) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The proposal Meets the criteria of the Parking and Loading Ordinance (Chapter 22) Title IV, Ordinance No. 1628, Code of General Ordinances, except for landscaping since a landscape plan was not submitted. _9. The existing house on the property is to be remodeled to accommodate the proposal. 10. On January 31, 1978, 'the subject site was a part of Short Plat 113-77. The property was rezoned to P-1 on July 11, 1975 (Ordinance No. 2944) . The rezone required restrictive covenants (Exhibit #5) and a condition was attached to the short plat. Restrictions that directly affect the proposal are: a. Detailed landscape plans, including existing vegetation to remain, shall be submitted to and approved by the Planning Department prior to development. b. Minimum 15-foot landscape buffer along South 37th Street is required. c. Existing vegetation is to be retained as much as possible, removal of which is to be approved by the Planning Department. d. A 40-foot minimum building setback along the north property line is required. e. Building height of two stories or 25 feet within 100 feet of the north property line is required. • e. Access to Talbot Road South via a 50-foot right-of-way serving all of the property. Access is not to occur to S. 37th Street. 11. Storm water drainage plans have not been submitted to the Public Works Department for review and approval per Ordinance No. 3174. 12. Improvements within the 50-foot street serving the subject site have not been completed pursuant to the Subdivision Ordinance. • CONCLUSIONS: 1. Section 4-710. 3 requires that the Examiner ascertain and determine ". . .that the general design and development conform with the adjacent surroundings. " Testimony was not provided regarding the exterior of the existing house. Therefore, it must be assumed that the exterior will be retained. This appears to meet the foregoing requirement. The site plan, Exhibit #4, seems to conform to the character established in the area and particularly in the recently developed southeasterly abutting parcel. The four lots created in the.short plat are intended for offices and/or medical clinics. This character appears to be continued by the proposal. • SP-237-78 Page Three Without benefit of a landscape plan it is impossible to determine if this portion • of the proposal conforms to the aforementioned requirement. However, the applicant did state that great care would be exercised in preserving existing trees and complementing them with supplemental landscaping. This intent appears sufficient to satisfy the requirement since the Planning Department will review the landscape plan in detail for conformance to the requirement and covenants. 2. Access to the site is via the 50-foot road which has not yet been completely improved to city standards. • 3. The site plan as amended by staff (Exhibit #4) meets all zoning, parking, covenant and short plat requirements. DECISION: Approve the special permit subject to: 1. Revision of the site plan per Exhibit #4. 2. Submittal of a landscape plan for review and approval of the Planning Department for conformance with Conclusion No. 1 and restrictive covenants. 3. Completion of the 50-foot access road including all improvements. 4. Submittal of storm drainage plans for review and approval of the Public Works Department. PURPOSE OF REQUEST : To allow development of a medical clinic complex on the site . D . HISTORY/BACKGROUND : The subject site was annexed into the City of Renton by Ordinance #1743 dated April 15 , 1959 . The Comprehensive Plan in the area was studied and amended on October 22 , 1974 . The subject site was rezoned to P-1 on July 11 , 1975 , by Ordinance No . 2944 . Certain restrictive covenants dealing with retention of the natural character of the site and ravine area , together with certain developmental requirements , were filed on July 23 , 1975 , and run with the land . It was also part of the Vallis Investors Short plat of January 31 , 1978 . E . PHYSICAL BACKGROUND : 1 . Topography : The site slopes downward from east to west at a 5- 10% grade. an e ff e c t un—e x i b L i ►ry—sur►u p r indirectly through increased employment opportunities in the area . PLANNING DEPARTMENT PRELIMINARY REPORT TO HEARING EXAMINER PUBLIC HEARING : BOSMAN COMPANY , FILE NO : SP-237-78 NOVEMBER 21 , 1978 PAGE FOUR 4 . The conceptual site plan provides adequate parking (31 stalls ) to exceed the parking requirement ( 16 stalls ) for the proposed building . The submitted plan does not meet the requirements of the covenants requirement for a 15 ' landscaped buffer along the north property line . A revised site plan meeting all ordinance and covenant requirements is attached . 5 . A 50-foot dedicated public right-of-way was required to serve the property as per the Hearing Examiner ' s approval of the short plat. Off-site improvements will be required along this. right-of-way as part of site development . Curb cuts and the driveway access will need Traffic Engineering Department approval , 6 . Proper drainage control measures will be needed in conjunction with site development . 7 . The Fire Department advises that a new hydrant will need to be installed for adequte protection of the present structure . 8 . In addition to the restrictive covenants which specifies a 15-foot landscape buffer be provided along South 37th Street , these covenants also require that existing vegetation be maintained as much as possible . Existing vegetation shall be removed only by approval of the Planning Department prior to any further development or clearing on the site . An additional 5-foot landscaped strip will be required adjacent to the, new public right-of-way . A detailed landscape plan will need to be submitted and approved by the Planning Department . 9 . The site is proximate to the hospital and similar clinics in the area . The low profile and visual appearance of the existing structure render it compatible with both area residential dwellings and the existing clinics . Given these and other criteria , the site is well suited for the proposed clinic use. P . PLANNING DEPARTMENT RECOMMENDATION : Recommend approval of the special permit request for the proposed clinic subject to the following conditions : 1 . Final Planning department approval of detailed landscape plans to be submitted at the time of the building permit application . 2 . Final Public Works Department approval of detailed drainage plans , including adequate storm water retention and oil /water separation facilities . 3 . Provision of off-site improvements including curb , gutter , sidewalk , and landscaping along all the public right-of-way adjacent to the subject site. 4 . The subject site is presently zoned P-1 ( Public Use ) , which provides for professional service office uses by special permit . Restrictive covenants were applied to the rezoning of the subject property and copies of the covenants are attached . 2 . The subject proposal is compatible with the existing land uses and zoning the general vicinity. A campus-style arrangement is developing in the area and similar clinic-type structures are proposed as subsequent development . 3 . The existing building on the southeast portion of the site is planned as the physical facility for the proposed use . This structure will need to meet all code requirements of the Building Division . The conceptual site plan provides adequate parking (31 stalls ) to exceed the parking requirement ( 16 stalls ) for the proposed building . The submitted plan does not meet the requirements of the covenants requirement for a 15 ' landscaped buffer along the north property line. A revised site plan meeting all ordinance and covenant requirements is attached . 5 . A 50-foot dedicated public right-of-way was required to serve the property as per the Hearing Examiner ' s approval of the short plat . Off-site improvements will be required along this right-of-way as part of site development . Curb cuts and the driveway access. will need Traffic Engineering Department approval:. 6 . Proper drainage control measures will be needed in conjunction with site development . . 7 . The Fire Department advises that a new hydrant will need to be installed for adequte protection of the present structure . 8 . In addition to the restrictive covenants which specifies a 15-foot landscape buffer be provided along South 37th Street , these covenants also require that existing vegetation be maintained as much as possible . Existing vegetation shall be removed only by approval of the Planning Department prior to any further development or clearing on the site . An additional 5-foot landscaped strip will be required adjacent to the new public right-of-way. A detailed landscape plan will need to be submitted and approved by the Planning Department . 9 . The site is proximate to the hospital and similar clinics in the area . The low profile and visual appearance of the existing structure render it compatible with both area residential dwellings and the existing clinics . Given these and other criteria , the site is well suited for the proposed clinic use. • P .
