"P SUMMARY OF REQUEST: Applicant seeks approval of. a& special permit for fill and grade
of.approximately +25,000 cubic yards on a four-acre site along
N.E. 44th Street east of FAI-405 for possible future development
of a motel complex.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions.
Hearing Examiner Decision: Approval with conditions. .
PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on April 5, 1979.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
•
The hearing was opened on April 10, 1979 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building.
•
Parties wishing to testify were affirmed by the Examiner. •
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department report, and the report was entered into the record as Exhibit #1.
Steve Munson, Planning Department, reviewed Exhibit #1, and entered the following additional
exhibit into the record: • •
Exhibit #2: Site Development Plan

Mr. David Clemens, Associate Planner, corrected line three of Section L.4 of Exhibit #1
• to read ". . .bottom being one foot below" in lieu of ". . .bottom being one inch below" as
denoted in the report.

The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

Mr. Kosteniuk indicated concurrence in the. recommendations contained within the report.
The Examiner then requested testimony in support or opposition to the' request. There was
no response. He then inquired if the proposed landfill operation conforms to requirements
contained within the Mining, Excavation and Grading Ordinance. Mr. Munson indicated that
conformance is indicated.
The Examiner requested further comments. Since there were none, the hearing on File No.
SP-321-79 was closed by the Examiner at 10:07 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
• Examiner now makes and enters the• following:
FINDINGS:
•
1. The request is for approval of a special permit for landfill and grading of 25,000
cubic yards on four acres of B-1 zoned property in preparation for a potential motel
complex.
•
•
2. The Planning Department report accurately sets .forth the issues, applicable policies
• and provisions, findings of fact; and departmental recommendations in this matter, is
'uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by
reference as set forth in full therein. ' '
•

3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
•
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development and no adverse comment was expressed.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the requirements of Chapter 23 (Mining, Excavation
and Grading) of Title IV, Ordinance No. 1628, Code of General Ordinances.
8. According to the Environmental Checklist contained in the file of record, the landfill
operation will encompass approximately four months. Upon completion of grading of
the landfill, the area will be hydroseeded (Exhibit #2) .
9. The storm drainage ane erosion control methods to be used have been reviewed by the
Public Works Department and approved (Exhibit #1) .

10. The proposal must conform to Section 4-2312 (Work in Progress) .
11. Per Sectibn, 4-2303.2.0 the final plan for development on the landfill must be approved
by the Examiner pursuant to a public hearing.
CONCLUSIONS:
•
1. The landfill and grading operation conforms to the Comprehensive Plan and does not
appear to ". ...be an unreasonable detriment to the surrounding area." (Section
4-2303.2.B) .
2. The annual license from the Planning and Public Works Departments (Sections 4-2307.2.B. ,
4-2307.4. , 4-2310 and 4-2309) that is required is sufficient to guarantee compliance
with Chapter 23 and the Examiner's decision.

3. Access to the site should be reviewed by the Public Works Department to insure adequate
traffic safety on N.E. 44th Street. , 110th Avenue S.E. and N.E. 43rd Place. Of
particular concern is the curved configuration of N.E. 44th Street. Points of access
should be approved by these departments.
4. Since methods of dust and mud control were not proposed or specified, these mitigating
method's, must be approved by the Public Works Department prior to the beginning of the
operation.
5. Hydroseeding and other fill stabilization measures must be approved by the Planning
Department. Their consideration should include existing vegetation that might assist
in this stabilization.
DECISION:
•
Approval of Exhibit #2 subject to:
1. Approval of access point(s) by the Public Works Department.
2. Approval of dust and mud control measures by the Public Works Department.
• 3. Approval of hydroseeding and fill stabilization methods. by the Planning Department.
4. Compliance with these conditions prior to beginning the landfill operation.
5. Compliance with all other applicable provisions of Chapter 23 and other regulations
and ordinances of the City of Renton.

be filed in writing on or before April 23, 1979. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, errOr
in judgment, or the discovery of new evidence which could not be reasonably available at
the prior hearing may make a written request for review by. the Examiner within fourteen
• (14) days from .the date of the Examiner's decision. This request shall set forth the
specific errors relied upon by such appellant, and the Examiner may, after review of the
record, take further action as he deems proper.
., An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
• other specified requirements. Copies of this ordinance are available for inspection in

C. HISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinance 1823 dated
April 21 , 1960 .
D. PHYSICAL BACKGROUND :
1 . Topography : The site rises from west to east. at a grade
varying from 4-5 . 5% . Some portions in the center of the site
are below street grade.
2 . Soils : Norma Sandy Loam ( No) . Permeability is moderately
rapid . The seasonal water table is at or near the surface.
Runoff is slow and the erosion hazard is slight . This soil
is used mostly for pasture . Drained areas are used for row

crops . Kitsap silt loam, 8- 15% slopes ( KpC) . Runoff is
medium, and the erosion hazard is moderate to severe .
This soil is used for timber and pasture. Ragnar-Indianola
association , sloping ( RdC) . Permeability is moderately
rapid to rapid. Runoff is slow to medium, and the erosion
hazard is moderate to severe . These soils are used for
timber. ' Bellingham silt loam ( Bh) . Permeability is slow .
The seasonal water table is near the surface during the
rainey season . Runoff is slow, and the hazard of erosion
is slight . This soil is used mostly for pasture . A few
areas are used for row crops .
3. Vegetation : Medium growth deciduous trees are found in the
westerly one-third of the site with the remainder consisting
of low to medium-growth shrubs and some areas which have
been graded .
4. Wildlife : Existing vegetation may provide suitable habitat
for birds and small mammals .
5. Water : Standing water was observed in the central and west
central portion of the subject site .
6 . Land Use : The site itself and vicinity east of the freeway is '
presently undeveloped .
E . NEIGHBORHOOD CHARACTERISTICS :
The area east of FAI-405 is largely undeveloped with the existing
uses composed principally of single-family dwellings . To the
south is a printing shop and to the west of the freeway , the
land uses are a mixture of industrial , commercial , and some multi -
ple family uses .
F. PUBLIC SERVICES :
1 . Water and Sewer: Six and eight-inch water mains run east-west
on N. E. 44th Street along the southern boundary of the subject
site . A 12 -inch main extends north-south on Lincoln Ave . N . E .
on the easterly border, and an 18-inch sewer main is located
along the same street.
2 . Fire Protection : Provided by the Renton Fire Department as per
ordinance requirements .
3. Transit : Metro Transit Route #240 operates along Lake Washing-
ton Boulevard North within 200 feet to the north of the subject
site .
4 . Schools : Not applicable .
5. Recreation : Not 'applicable.

ment controls and procedures , these impacts can be mitigated .
2 . Population/Employment : The fill and grade permit will have no
direct impact on employment. However, future commercial use
of the filled property will have to be addressed upon specific
development .
3. Schools : Not applicable .
4 . Social : Not applicable .
5 . Traffic : Assuming 25 cubic yards per truckload , 25 ,000 yards
would require 1 ,000 truckloads , or 2 ,000 total truck trips .
J . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the City of Renton ' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , as amended , RCW 43-21C, a
declaration of non-significance has been issued for the subject
proposal . This negative declaration is further based on proper
development procedures per City ordinances and the provision of
suitable landscape areas to help reduce the resulting loss in
vegetation by site development.

L . PLANNING DEPARTMENT ANALYSIS :
1 . The subject site is presently zoned B-1 , Business Use-, which
will permit future commercial development on the site . The
applicant ' s general proposal for a motel would be consistent
with the comprehensive planning and zoning for the area .
2 . No specific development plan for the subject property has been
submitted at this time . However, the applicant ' s proposed
future development will be subject to City of Renton require-
ments including the Hearing Examiner ' s site plan approval per
Section 4-2303 . 2C of the Mining , Excavation , and Grading
Ordinance.
3. The proposed ±25 ,000 cubic yards of fill will be placed on the
site to establish an elevation of 36 feet. The existing eleva-
tions range from a low point of ±28 feet in the south central
portion to a high point of ±50 feet near the southeast corner.
4. The Engineering Division of the Public Works Department notes
that the temporary sedimentation pond is required to have a
150 cubic feet per acre capacity with the bottom being 1" below
the flow line of the outfall . Straw bales should be placed
against the outfall pipes to reduce downstream siltation .
5 . The Fire Department advises that for any future development ,
the required access and hydrants or any other fire protection
facilities will have to be installed prior to and during con-
struction . These facilities will be required to meet fire
flow and uniform fire code requirements for occupancy type.
6 . The Police Department indicates that the contractor will have
to keep the adjacent roadways clear and clean of debris , dirt ,
and rocks .

7 . Suitable utilities are available to the subject site.
Standard hook-up fees for water and sewer will apply. See
other comments .
8. Subject to compliance with all pertinent sections of Section
_4-2300 , and specifically the requirements of 4-2312 , this
permit should satisfactorily meet the objectives of the
Comprehensive Plan to encourage the "highest and best use
of property" while "protecting property values within the
community for the benefit of residents and property owners , "
Land Use Report , 1965 - Objectives .
9 . The Jones Avenue sewer crosses the site . The Engineering
Division advises that the easement for the sewer shall not
be used as a haul road . Further, caution must be taken
when tying the proposed fill into the existing fill over
the sewer line.
10 . Additional comments of other departments are attached for
consideration .
M. DEPARTMENTAL RECOMMENDATIONS :
Based upon the foregoing analysis , recommend approval subject to
the following conditions :
1 . At all times during the life of this permit , all public
roadways adjacent to and providing access to this site shall
be maintained in a clean and clear condition .
2 . Compliance with the temporary sedimentation and drainage
requirements of the Public Works Department.
3. Future development of the property shall be reviewed and
approved by. the Hearing Examiner pursuant to Section
4-2303-2C.
4. The applicant shall conform to Engineering Division require-
ments to protect the existing sewer line.

2 . Population/Employment: The fill and grade permit will have no
direct impact on employment. However, future commercial use
of the filled property will have to be addressed upon specific
development .
3. Schools : Not applicable. .

5 . Traffic : Assuming 25 cubic yards per truckload , 25 ,000 yards
would require 1 ,000 truckloads , or 2 ,000 total truck trips .
J . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the City of Renton ' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , as amended , RCW 43-21C, a
declaration of non-significance has been issued for the subject
proposal . This negative declaration is further based on proper
development procedures per City ordinances and the provision of
suitable landscape areas to help reduce the resulting loss in
vegetation by site development.

L . PLANNING DEPARTMENT ANALYSIS :
1 . The subject site is presently zoned B-1 , Business Use; which
will permit future commercial development on the site . The
applicant ' s general proposal- for a motel would be consistent
with the comprehensive planning and zoning for' the area .
2 . No specific development plan for the subject property has been
submitted at this time . However, the applicant ' s proposed
future development will be subject to City of Renton require-
ments including the Hearing Examiner ' s site plan approval per
Section 4-2303 . 2C of the Mining , Excavation , and Grading
Ordinance.
3. The proposed ±25 ,000 cubic yards of fill will be placed on the
site to establish an elevation of 36 feet. The existing eleva-
tions range from a low point of ±28 feet in the south central
portion to a high point of ±50 feet near the southeast corner.
4. The Engineering Division of the Public Works Department notes
that the temporary sedimentation pond is required to have a
150 cubic feet per acre capacity with the bottom being 1" below
the flow line of the outfall . Straw bales should be placed
against the outfall pipes to reduce downstream siltation .
5 . The Fire Department advises that for any future development ,
the required access and hydrants or any other fire protection
facilities will have to be installed prior to and during con-
struction . These facilities will be required to meet fire
flow and uniform fire code requirements for occupancy type.
6 . The Police Department indicates that the contractor will have
to keep the adjacent roadways clear and clean of debris , dirt ,
and rocks .
