Dear Council Members: In the Examiner's Report and Recommendation regarding the..'referenced request,' 'dated May 22, 1979, the Examiner recommended denial of the application for reasons denoted in the conclusions. A letter was also transmitted to the" City,Council from the Examiner on June 1.,' , 1979, regarding the Examiner's power to issue a special permit in situations beyond those specifically enumerated in various zoning provisions. A -request for reconsideration was received from the applicant on May 30, 1979, and following further review, it was determined by the'Examiner that the previous recommendation should be upheld.' On June 13; 1979, an appeal to the City Council was received. In accordance with ordinance requirements, the matter will be placed on the Council agenda on July 2, 1979. Read Special Permit. • Dear Mr. Read: • I have reviewed your request for reconsideration in the above entitled matter. I find that no new arguments have been advanced to cause me to modify my previous decision. • Again let me point out that if, the special permit were available to review any use for possible location in an otherwise less intensive • district, the use which you propose could conceivably be located in an R-2, R-3 or R-4 zone and quite possibly in any zone if designed and 'operated so that it is compatible. It is not my belief that the. Examiner,has been vested .with such power: The power to issue special permits is limited to those enumerated in the code, and any additional authorization must be extended by the City Council. • The decision of the Examiner in the above entitled manner stands.. Your right .to appeal to the City Council remains unaffected by this decision if you should wish to pursue that course. A new appeal period has been established to expire on June 15, 1979. Kaufman, Hearing Examiner City of Renton, Renton, Wa. 98055. re: File No. SP-338-79 Dear Mr. Kaufman, We request reconsideration of your denial of our application for special permit for an integrated office/storage use ( Renton Business Park) in a B-1 zone. We respectfully submit the following:- Sections 4-711 (B-1 Business District) and 4-712 (L-1 Light Industry District) do not specifically. refer to "self-service storage" or "mini-warehouses", and it was because of thislack of definition that we were advised by the Planning Department to seek a special permit as this process was installed to provide the flexibility of " use determination" under the code. Section 4-3101 (2), states the intent of the Renton Developmental Guidelines Ordinance, and includes seven basic guidelines for making consistent and ration- al decisions and recommendations, none of which limit the powers of the Hearing Examiner to grant' special permits for only those uses stated in your report, i.e. lumber yards and fuel yards 4-711 (7) and churches•4-706 (3). It is our position that it was not the intent of the ordinance to so severely limit the powers of the Hearing Examiner. Uses permitted in the B-1 zone include the following:- 4-711 (9) Parking lots 4-711 (11) Public garages... which are further defined in 4-702 (10) as " any premisesfor the storage or housing of more than three (3) towable or motor driven vehicles or where such vehicles are repaired or kept for hire or sale. 4-711 (14) Sales rooms or store rooms for motor vehicles or other items of merchandise. It is our position that self-service storage is a service business, serving the general public and is particularly suited to a B-1 district, especially if-that neighborhood has a high percentage of high density residential use such as condominiums, apartments ortrailer parks, as is so in this case. There is an . increasing demand for storage facilities to accomodate the personal belongings of the residents of these areas, as well as storage of trailers and boats for which on-street parking is prohibited. Item (3) in Section 4-3101 states the intent to " promote aesthetics, amenities and good design", which cannot be accomplished without careful consideration of new amenities that become apparent due to changing life-styles. It is also our position that the term warehouse as permitted outright in the L-1 zone is intended to mean the commercial use of such a building, i.e. one which is used for the storage or distribution of goods held as stock-in-trade or inventory for use in conducting a business. We sincerely hope that this will clarify our position and provide you with sufficient additional information to enable you to reconsider our application based on our intended use rather than on the nomenclature or the type of building involved. READ , SPECIALPERMIT File No. SP-338-79 The Planning and Development Committee has considered the appeal of the above-mentioned decision dated May 22 , 1979 , and recommends that the City Council reverse the decision of the Hearing Examiner based upon the following error of law: Conclusion No. 6 , 7 and 8 are in error in that the intended use, a self-service storage facility, is similar to the specific uses set forth in Section 4-711 (A) of the Zoning Code as to allow the use under the present B-1 Zoning Ordinance as a matter of right. The Committee recommends that the City Council find that the ' proposed use is a similar use to the specific uses allowed in the B-1 Zone, and conclude that the proposed use is allowed as a matter of right in the B-1 Zone. Read, Special Permit coe! lEOE6Zg2��� Dear Council Members: We wish to appeal the Hearing Examiner' s denial of our application, and subsequent request for reconsideration of the referenced application for a special permit for an integrated office/storage use (Renton Business Park) in a B-1 Zone, based on our assertion that the Hearing Examiner made errors in interpretation of both the intent and the letter of the law, and the facts of this particular case as outlined in the following: ERRORS IN THE HEARING EXAMINER'S INTERPRETATION OF THE SPECIAL PERMIT PROCESS 1 . In his Report and Recommendations dated May 22, 1979, he states that • (page 4, paragraph 1 ) "it appears that the issuance of a special permit is limited to those types of uses which are enumerated in Sections 4-711 .A. (7) i.e. lumber yards and fuel yards, and 4-711 .A. (20) mobile home parks." We can find no reference anywhere in the code to substantiate that conclusion. 2. He partially quotes 4-722(B) "a limited power to issue permits for such uses is vested in the Hearing Examiner following recommendation by the Planning Department," but in using that quote he omits the preceding phrase of 4-722(B) which says "depending upon the facts of each particular case. " This is a serious omission because it subverts the intent of 4-722(B) which is clearly to provide flexibility of the Hearing Examiner's powers in conjunction with the recommendations of the Planning Department. 3. Furthermore., Section 4-722(B) recognizes that there are certain uses of property that "may be detrimental to the public health, safety, morals and general welfare, etc. " and does not refer to specific uses such as lumber yards, fuel yards and mobile home parks. 4. The Hearing Examiner cites Section 4-3101 (2) using the words "the intent of the zoning ordinance is to limit incompatible uses and it is left to the Hearing Examiner to carry out this intent. " Whereas 4-3101 (2) contains seven (7) basic guidelines of which the above quote is only one. The other six guidelines are equally important and the intent of 4-3101 (2) implies a much broader interpretation. - Members of the City Council -2- June 12, 1979 Re: File No. SP-338-79 (continued) 5. The Hearing ,Examiner's conclusions (page 4, para. 2) quote other examples of "limited power" to issue special permits in zones other than a B-1 Zone. Our application only concerns the B-1 Zone, but the arguments presented above would apply equally well as far as the intent of the Code is concerned. The Hearing Examiner's conclusions (page 4, para. 3) are general in nature but are confusing and conflict with his prior statements. For instance, his statement that a Hearing Examiner might create wholesale rezoning or spot-zoning by permitting incompatible and non-conforming uses "without causing suffering to the public health, safety, morals and general welfare' would not be possible without complete subversion of duty by the Hearing Examiner. Such an event is not likely given the input from the Planning Department and the public hearing process. The Hearing Examiner's conclusions 4 and 5 appear only to reinforce an already confused and conflicting set of statements. THE INTENT OF THE ORDINANCE REGARDING THE SPECIAL PERMIT PROCESS The reason for including lumber yards and fuel yards, etc. it-1, 4.-711- (A) is to give examples of those uses in a B-1 Zone that are potentially incompatible and therefore subject to a special review and permit process. For instance, the potential incompatibility of a lumber yard could be due to large outside storage facilities, large storage buildings, movement of large-vehicles., etc. In reviewing a request for a special permit for such a use in a B-1 Zone the Hearing. Examiner's review process should be based 'on a logical determination of compatibility of use as suggested below. a. does the facility exist to provide goods/services to the general public on a daily basis. b. does the general public have continuing access to the facility. c. is the general public better served by having the facility located in a close-in B-1 Zone, or would they be inconvenienced by restrict- ing the facility to a more intensive zone outside the City. These determinations can be made based upon the input from the Planning Department recommendation and the testimony given at the public hearing. At this point we draw your attention to the PRELIMINARY REPORT OF THE HEARING EXAMINER dated May 15, . 1979, which contains the impact assessments of this File No. from the relevant City departments, including the Planning Department,,which all recommend approval subject to certain conditions, to which we have responded with complete cooperation. . CONCLUSION It is our conclusion, one in which we are supported by the Planning Depart- ment, that the Hearing Examiner's interpretation of the special permit provision is so narrow and restrictive as to render the intent of the ordinance and the hearing process itself to be severely compromised and incompatible with the 'function of the Planning Department and the requirements of rational land use. Members of the City Council -3- June 12, 1979 Re: File No. SP-338-79 (continued) ERRORS IN THE HEARING EXAMINER'S INTERPRETATION OF THE FACTS OF THIS APPLICATION 1 . In his report (pages 4, 5. paragraphs 6, 7, 8) the Hearing Examiner concludes that a self-service storage facility is not a "similar use" to those permitted outright in a B-1 Zone, i .e. one 'normally frequented by the general public," but is more analogous to "warehousing" which is a permitted use in a L-1 (Light Industry) Zone. We would like to draw your, attention to some of the uses permitted out- right in a B-1 Zone. 4-711 (9) Parking lots 4-711 (11 ) Public garages: . . (which are further defined in 4-702(10) as "any premises for the storage or housing of more than three (3) towable or motor driven vehicles or where such vehicles are repaired or kept for hire or sale 4-711 (14) Sales rooms or store rooms for motor vehicles or other items of merchandise. We submit that all the uses involved in a self-service storage facility are contained in the above three permitted uses. It is our position that self-service storage is a service business, serving the general public, and is particularly suited to a B-1 district, especially if that neighbor- hood has a high percentage of multiple residences such as condominiums, apartment or mobile home parks., as is so in this case. The development of such areas creates an increasing demand for storage facilities to accommodate the personal belongings of the residents, as well as storage of motor vehicles, trailers and boats for which onsite parking is limited and on-street parking is prohibited. Item (3) in Section 4-3101 :states the intent to "promote aesthetics., amenities and good design," which cannot be accomplished without careful consideration of new amenities that become apparent due to changing lifestyles. 2. We also submit that the term "warehouse" as permitted outright in an L-1 Zone, 'is a premises to which the general public does not have access and is intended to mean .the commercial use of such a building, i.e. one which is used for the storage and/or distribution of goods held as stock- in-trade or inventory for conducting a commercial business enterprise. Therefore, 'we must conclude that the Hearing Examiner has not judged. our application on the "compatibility of use" but more on the "termin- ology" which only does further injustice to the intent of the ordinance. It is our intention that the Renton Business Park be a seven and one-half acre business park providing a large range of services to the general public on a day-to-day basis, within easy reach of the local residents. The project has been designed by Kenneth D. Long., A.I.A. , who has been a leader in providing some of the most aesthetically outstanding business buildings in our area. The Examiner advised the probable necessity of clarification of the city's policy regarding the proposed use within the zoning code. Referencing Section I.2 of Exhibit #1 which reflects employment estimates for office/ retail use, Mr. Read advised that retail use is not proposed on the site and employment figures should be revised to reflect substantial reduction of impact upon traffic volumes in the area: He indicated concurrence in recommendations contained within Exhibit #1 with the exception of Section M.2 which requires dedication and provision for future improvement • • of a public street to serve properties to the north along the west property line, and advised that unsuccessful attempts have been 'made to acquire said property, and the applicant would prefer to provide a 30-foot setback on the northern boundary to accommodate future provision of access at such time as the city can obtain the necessary property. He also requested clarification of Section M.4 which states that the applicant shall participate in the provision of a two-way left_ tur-n lane on N.E. 4th Street fronting the subject property. 'Warren Gonnason, Public Works Director, advised that the city has recently completed a signalization and channelization project at the intersection of Monroe Avenue N.E. and N.E. 4th Street and is currently in the process of programming a similar. improvement at the intersection of Union Avenue N.E. and N.E. 4th Street east of the subject site. He noted that in view of the expanded development located between these intersections., provision for left turn movement will be. essential for the economic welfare of these properties, and a suggestion to widen the street by 12 feet to provide a fifth lane for turning movements is included in the .Six-Year Street Program; although he stated that participation by the applicant may be burdensome because other properties in the vicinity have been allowed to develop without such a provision, and it may be preferable to provide access to Monroe Avenue N.E. to the west. Mr. Gonnason also. advised that the City Council has recently discussed the possibility of installation of a raised curb in the center of N.E. 4th Street to prohibit left turn movement altogether. The Examiner inquired if the City Council had yet proposed legislation to prohibit left turn movements. Mr. Gonnason advised that such legislation may be a possibility. Mr. Read inquired regarding method of assessment for the Local Improvement District for roadway improvements. Mr. Gonnason indicated that assessments are estimated in accordance with benefit or front footage. Mr. Read, advised the applicant's willingness to participate in the proposed project. The Examiner referenced the concern of the Planning Department regarding the landlocked situation of properties located north of the ,subject site and the 'proposal for additional north-south access along the western boundary of the site, and inquired if the applicant could be required to dedicate certain land for access although 150 feet of the western frontage is not owned by the applicant. Mr. Gonnason indicated the departmental preference for provision of east-west access westerly to Monroe Avenue N.E. since provision Of additional access to N.E. 4th Street would be redundant. • Mr. Read indicated concern regarding the lack'of guidelines within the zoning code to - enable the Examiner to review and approve a special permit for the proposed use. He advised that prior to application, review with the Planning Department staff had occurred and because specific reference to self-service storage use is not found in the B-1 zoning • provisions, a special permit had been determined necessary. He noted that a tremendous demand for storage facilities to accommodate personal belongings of apartment and condominium dwellers has recently occurred as well as storage of trailers and boats for which on-street parking is prohibited. He 'supported approval of the application for the facility which will provide a necessary service to the public. The Examiner inquired regarding differences between self-service storage facilities and mini-warehouses. Mr. Read advised that a small storage unit of 5 'feet by 10 •feet with a single door will accommodate personal effects, and the facility will also provide covered parking. He noted that the power transmission easement covers approximately an acre of property, of which half will be utilized for public or employee parking, and half for provision of vehicle storage. Responding to the Examiner's inquiry regarding the 23-foot building height, Mr. Read advised that the flexible internal design of the building will accommodate a variety of needs and demands as they become apparent. The Examiner requested testimony in support. or opposition to the application. There was no response. He then requested additional comments from-the Planning Department representative. Mr. Clemens stated that although the applicant has indicated in good faith the proposed use on the site, dependent upon changes in development in the vicinity or change of ownership of the property, the use may change, and therefore, 'the concern of the Planning Department of impact upon traffic should be considered. ' He indicated concurrence in the.proposal of the Public Works Department for an east-west access to Monroe Avenue N.E. but felt that the matter of access should be addressed'prior to development. Regarding review of the application through, the special permit process, Mr. 'Clemens indicated the departmental opinion that the applicant is attempting to meet the intent of the B-1 zoning district, ' and review of the matter is within the Examiner's purview if justification for the request is evident. PLANNING DEPARTMENT • The Planning Department preliminary report was received by the REPORT: Examiner on May 10, 1979. • . PUBLIC HEARING: After reviewing the Planning Department report, examining ' available information on file with the application, and field checking the property and surrounding area, the Examiner ' conducted a public hearing on the subject as follows: The.hearing was opened on May 15, 1979 at 10:20 a.m. in the Council 'Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and .reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. David' Clemens, 'Associate Planner, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Site Plan as submitted . Exhibit #3: Site Plan with staff comments • Exhibit #4: Elevations and Landscaping Plan Exhibit #5: Floor Plan for• Buildings 5 and 6 , The Examiner asked Mr. Clemens for the proposed height of the storage buildings ,from grade level. Mr. Clemens indicated that height of proposed structures would be approximately 22 feet except a portion of. one building to be utilized for office space 'or security eniployees•which,is proposed at approximately 31 feet. The Examiner inquired if development of Phase I .would_occur prior to Phase II in view of landscaping requirements on Phase I property abutting N.E. 4th Street. Mr. Clemens recommended that development occur in phasing order beginning at the southern or front portion of the site and developing northerly . ' to the• rear of the property. He advised that if development proceeds from north to south, • screening landscaping will be initially required adjacent to N.E. 4th Street. The Examiner requested testimony by the applicant. The applicant indicated willingness to dedicate this land if necessary. 13. Other access problems were discussed because of the large traffic volumes along N.E. 4th Street and the expected growth along this corridor. The record indicates that the applicant is prepared to join in the formation of a Local Improvement District for the alteration of N.E. 4th Street. 14. During the public hearing on the above captioned matter, the Examiner expressed his belief that,the special permit process was probably an inappropriate method of introducing the so-called "self-service storage" facility into the Business (B-1) District (Section 4-711) . 15. The zoning code provides specific enumerations when a special permit may be issued. Section 4-711, the B-1 District, itself has two subsections which provide for the issuance of a special permit. These are Sections 4-711. (A) . (7) - lumber yards and 'fuel yards; and Section 4-711. (A) . (20) - mobile home parks. • Similarly, in the R-1 District, Section 4-706. (3) provides that churches may be permitted within that zone by special permit, and in the R-3 District, Section 4-709.A. (3) provides for a number of uses which may be permitted by special permit. CONCLUSIONS: SPECIAL PERMIT 1. After further consideration of this issue subsequent to the public hearing, it appears that the issuance of a special permit in the B-1 District is limited .to those types of uses which are enumerated in Sections 4-711.A. (7) , lumber yards and fuel yards, and 4-711.A. (20) , mobile home parks. The procedure to be followed if one of these enumerated uses was proposed is then subject to the criteria listed in Section 4-722.B, the special permit provision. Any other interpretation would permit the incursion into any •district, uses which are otherwise incompatible and not permitted. The intent of the zoning ordinance is to limit incompatible uses and it is left to the Examiner to carry out this intent (Section 4-3101. (2)) . Only "a limited power to issue permits for such uses is vested in the Hearing Examiner. . ." (Section 4-722. (B) ) . This limited power is subject to the particular constraints imposed by the particular districts and should not be used by the Examiner to permit any type of use ih any district. 2. Other examples of this "limited power" to issue special permits are given below to indicate that the policy appears to strictly limit the issuance of a special permit to those uses enumerated and any power of the• Examiner to issue special permits beyond those enumerated would subvert the policy and intent of the zoning code. In a Residence Single Family (R-1). District, churches may be permitted by special permit '(Section 4-706. (3) ) . In the R-3 Residence District, Section 4-709.A. (3), provides for a number of uses which maybe permitted by special permit. 3. If the provisions of the special permit section were to overlay any district allowing any use in any district, there could be wholesale rezoning or "spot zoning" of parcels within districts for uses which would otherwise be deemed incompatible. This could be done upon a finding by the Examiner that the incompatible and non-conforming use could be carried out so that the public health, safety, morals and general welfare did not suffer. This cannot be the intent of the City Council and such an interpretation of the special permit provisions of the zoning code would totally subvert the separate and distinct use districts which the City Council created after thorough deliberation. 4. To read the provisions which grant the Examiner the power to approve a special permit in any other way would cause those sections which specifically enumerate uses where a special permit may be issued to be meaningless. In other words, if the Examiner may grant a special permit at any time the factual situation warrants, then why should the code list specific instances when the Examiner may grant a special permit. 5. A special permit is therefore not available to introduce the proposed use, a self- service storage facility into a B-1 zone as the intended use is not one of the enumerated specially permitted uses. SIMILAR USE 6. The denial of the special permit raises a second issue. This is whether the intended use, a self-service storage facility, more familiarly (if not accurately) described as amini-warehouse, is a "similar use" to those permitted outright in the B-1 District (Section 4-711. (A) ) . • Th'e intended Use by whatever name does not appear to be "similar" • to those permitted in the B-1 zone.' 1 t • • SP-33b-79 Page Three the northern boundary. Mr. Read indicated his concurrence with the understanding that the ' dedication would be limited to the northern 30 feet of the site. He also advised that due to the topography from the northwestern corner of the site along the'entire northern boundary, provision of-a street may not be possible. • The Examiner requested further comments. Since there were none, the hearing on File No. SP-338-79 was closed by the Examiner at 11:10 a.m. FINDINGS, CONCLUSIONS, & DECISION: Having reviewed the record in this matter; the Examiner now makes and enters the following: • FINDINGS: 1. The request its for approval of a special permit to permit the establishment of a self- service storage facility in a Business (B-1) District. 2. The, Planning Departnient. report accurately sets forth the issues, findings of fact, and departmental recommendations in this matter, and is hereby attached as- Exhibit #1 and incorporated in this reportby reference as set forth in full therein. 3. Pursuant to the City -of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, R.C:W: 43.21.C. (as amended), a Declaration of lion-Significance has been issued for. the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. - • 5. There was no opposition to the proposal expressed. 6. All existing utilities -are available and in close proximity. 7. The proposal is compatible with the required setbacks, lot coverage and' height . ' , - . • requirements of Section 4-711 of Title 'IV, Ordinance No. 1628, Code of General Ordinances. 8. The -development is to include offices, parking. area for on-site storage of recreational vehicles -and boats, and two self-service storage, facilities. It is this, latter use which is the object of the application for a special permit. 9. The self-service storage buildings are both to be approximately 21 feet in .height, and 185 feet by 140 feet in area. These buildings are to be locatedon the eastern portion of the site. The ,office buildings will be located in both the western half of :the site and the southeastern corner of the -site. ' • The.office buildings will cover, approximately 38,000 square- feet.- The recreational vehicle parking will cover about 60,000 square feet, and the self-service storage facility will cover approximately 29,000 square feet. ' • 10. The applicant indicated that contrary to the Planning Department report there are no plans- to operate any retail sales operation-on the subject site. The space not dedicated to R.V. storage and self-service storage will be used exclusively for office use. • The Planning- Department indicated, that while that is the present intended use, the • permitted uses would enable the- establishment of retail sales oh the subject property. In view of that 'possibility, they indicated the "worst case" results of traffic circulation which is greater for retail sales operations. . 11. The applicant indicated his willingness to landscape the site in consultation with the ' Planning Department, including during the phased development of the subject site. The applicant.also indicated that he would maintain as many of the existing trees as possible at the north and west property lines. • 12. The applicant proposes to construct the multi-purpose facility set back off of N.E. 4th Street. Access to 4th Street will be via two multi-lane, landscaped extensions of the applicant's property 150 feet south (see attached map) . Besides these two methods of ingress and egress, a possible entrance/exit was suggested along. the west property line.. The apparent reason for 'this additional roadway is the existence of some landlocked parcels. located north.of the- subject site. , The applicant , ; indicated that he had attempted to acquire the right-of-way indicated but that the owner was unwilling to either sell the property or convey an easement in it. .,to The Publi.c .Works Department noted that a possible east-west roadway running along the north property line toward Monroe Avenue N.E. would .be suitable for access to the I • ti SP-33u-i9 Page Five • 7. The permitted uses are all either of a retail sales, personal .service of business ' office nature. Each of these uses appears to provide the type of facilities which • are either required by the ordinary shopper or are required for the conduct of clerical and professional type businesses. • The "storage" facility proposed by the applicant is not usually the type frequented by • shoppers on routine buying or repair trips. The proposed use is visited only for the purpose of storing personal effects for "long-term" by those who do not have enough personal storage space at their dwelling's. The use is more analogous to warehousing although On an individualized self-service level. Warehousing is a permitted use in the Light Industry (L-1) District (Section 4-712. (A) . (20) ) . It would therefore appear that the appropriate district in which to locate the proposed facility would be an District,. The proposed use would also use up land which is presently intended for the direct distribution of goods and services needed on a daily basis by the general public. • 8. If, as the applicant maintains, this is a new type of consumer oriented use and one • which should of necessity be located nearer the consuming public, that is in the more immediate B-1 zones, then it would. be up to the City Council to make that determination. The Council can do that either by specifically permitting this "new" use outright in a B-1 zone or allowing a "Special Permit" to be issued for such a use. HISTORY/BACKGROUND : The subject site was part of the original plat of the City of Renton . It was rezoned to B-1 from S-1 by Ordinance #1510 dated March 8, 1955 . D. PHYSICAL BACKGROUND : 1 . Topography : Much of the site is a manmade terrace to the east, however , a substantial depression/swale extends diagonally through the site from the southwest to north . 2 . Soils : Alderwood gravelly sandy loam (AgC) . Permeability is moderately rapid in the surface layer and subsoil and very slow in the substratum. Runoff is slow to medium and the erosion hazard is moderate . This soil is used for timber , pasture , berries , row crops and for urban development . PLANNING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING : MICHAEL N . READ , File Nos SP-338-79 MAY 15 , 1979 PAGE FOUR 4. The site is divided east/west by a power transmission line easement , as well as on-site topography. The proposal places office/retail space at the west , public parking and exterior RV storage under the power line , and storage buildings to the east. The storage uses are separated both by a central slope andlandscaped buffer from office/retail area . 5. Due both to topographic and foliage constraints , the applicant proposes to retain a substantial number of the existing trees within the development as well as in perimeter areas at the north and west. The applicant has also delineated in a schematic form landscaping for the interior portions of the site . The Building Division in its comments concurs in the applicant ' s pro posal to preserve the wooded character at the west of the site . 6. The proposed development has two points of access , the easterly of which will primarily serve the storage portion of this development. The central access will provide the major entry/exit opportunity for this development . Based upon the traffic analysis described in Section I , between 2000 and 4000 vehicle turning movements will occur through the central driveway each day. This heavy volume in conjunction with the current traffic flow on NE 4th , and poor sight visibility to the east , substantial traffic conflicts can be expected . It should be further noted that three parcels to the north and west of this site , and either zoned or shown, on the Comprehensive Plan for Commercial or Multiple Family use are landlocked by approval of this department. Future development of these properties which must gain access to NE 4th could generate about 1400 trips to the B-1 parcel , and 500 trips to the master planned , but not currently zoned , multiple family parcels . The combination of the subject development in conjunction with the adjoining parcels to the north clearly suggests the need for public street access through the subject site , or adjoining this site . .. There, is an existing utility easement of 30 ' in width adjoining the property line to the west of this site . Through provi si olv6f, right-of-way on the westerly side of the subject site , and conversion of the utility easement for public street purposes at some- future time , acceptable access could be ga-ined . However , - Public Works Department review and recommendation on traffic needs for this entire block should be sought. 7 . In addition to the question of traffic volumes , this development and future development along NE 4th will most certainly bring with it large numbers of vehicle turning movements . Provision of a two-way left turn lane between Union Avenue and extending westerly toward Monroe should be considered . 8. Traffic Engineering had no specific comments on this development . 9 . The Fire Depar-tment notes that the building construction must meet Fire Code requirements for occupancy and fire flow requirements . Type and number of fire protection devices shall be installed and maintained in accordance with Fire Chief requirements . Fire hydrants and access shall be installed and made serviceable prior to any building construction . 10. Based upon the current 19000 trips ' per day on NE 4th' the proposed use will add between 3% and 24% to the current traffic demand , J . • ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION : Pursuant to the City of Renton 's Environmental Ordinance and the State ' En-vironmental Policy Act of 1971 , as amended , RCW 43-21C , a- declaration of. non -significance has been issued , based upon provision of. adequate access , retention of the existing evergreen tree cover to the maximum extent feasible , and preservation of the master planned/ integrated- approach to this development. • K. DEPARTMENTAL RECOMMENDATIONS : Based upon the above analysis and the unique nature ,of ;tbis proposed integrated use to be approved by special permit, recommend approval subject to the following conditions : 1 . If the development is to, occur in phases , any phase including building 5 shall also include buildings 2 and 3 to be developed concurrently. If both building 5 and 6 are contained in one phase buildings 1 through 3 are. likewise required to be developed concurrently. 2 . The applicant shall dedicate and provide for future improvement of a public street to serve properties to the north of a width to the approval of the Public Works Department. along the 'west property line or suitable location . 3 . . The central access shall consist of two in-bound and two out-bound traffic lanes , rather than 3 out-bound lanes as proposed . Turning movements from 3 lanes would be confusing , and could lead to further traffic congestion . 4. The applicantshall participate in the provision of a two-way left turn lane in NE 4th fronting this property . 5 . • Phased development of the outdoor RV storage area shall include all landscaping and screening facing NE 4th and adjoining the area to the east and west. HISTORY/BACK'GROUND : The subject site was part of the original plat of the City of Renton . It was rezoned to B-1 -from S-1 by Ordinance #1510 dated March 8, 1955 . D. PHYSICAL BACKGROUND: 1 . Topography : Much of the site is a manmade terrace to the east, however, a substantial depression/swale extends diagonally through the site from the southwest to north . 2. Soils : Alderwood gravelly sandy loam (AgC) . Permeability is moderately rapid in the surface layer and subsoil and very slow in the substratum. Runoff is slow to medium and the erosion hazard is moderate . This soil is used for timber , pasture , berries , row crops and for urban development. The site is divided east/west by a power transmission line easement, as well as on-site topography. The proposal places office/retail space at the west , public parking and exterior RV storage under the power line , and storage buildings to the east. The storage uses are separated both by a central slope and landscaped buffer from office/retail area . 5. Due both to topographic and foliage constraints , the applicant proposes to retain a substantial number of the existing trees within the development as well as in perimeter areas at the north and west. The applicant has also delineated in a schematic form landscaping for the interior portions of the site . The Building Division in its comments concurs. in the applicant ' s pro• posal to preserve the wooded character at the west of the site . 6 . The proposed development has two points of access , the easterly of which will primarily serve the storage portion of this development. The central access will provide the major _entry/exit opportunity for this development . Based upon the traffic analysis described in Section I , between 2000 and 4000 vehicle turning movements will occur through the central driveway each day . This heavy volume in conjunction with the current traffic flow on NE 4th , and poor sight visibility to the east , substantial traffic conflicts can be expected . It should be further noted that three parcels to the north and west of this site , and either zoned or shown on the Comprehensive Plan for Commercial or Multiple Family use are landlocked by approval of this department. Future development of these properties which must gain access to NE 4th could generate about 1,400 trips to the B-1 parcel , and 500 trips to the master planned , but not currently zoned , multiple family parcels . The combination of the subject development in conjunction with the adjoining parcels to the north clearly suggests the need for public street access through the subject site , or adjoining this site . There - is an existing utility easement of 30 ' in width adjoining the property line to the west of this site , Through provision, ,of,.right-of-way on the westerly side of the subject site , and conversion of the utility easement for public street purposes at some future time , acceptable access could be gained . However , Public Works Department review and recommendation on traffic needs for this entire block should be sought. 7 . In addition to the question of traffic. volumes , this development and future development along NE 4th will most certainly bring with it large numbers of vehicle turning movements . Provision of a two-way left turn lane between Union Avenue and extending westerly toward Monroe should be considered . 8 . Traffic Engineering had no specific comments on this development . 9 . The Fire Department notes that the building construction must meet Fire Code requirements for occupancy and fire flow requirements . Type and number of fire protection devices shall be installed and maintained in accordance with Fire Chief requirements . Fire hydrants and access shall be installed and made serviceable prior to any building construction . 10. Water and utility plans must be approved by, Utility Engineering and standard service charges will apply . 11 . Engineering advises that storm water retention is required , and that completion of necessary off-site improvements on NE 4th is also required . Depending upon the mix of retail to office , the traffic impact could range from a high of 4500 trips per day to a low of 600 trips per day . DEPARTMENTAL RECOMMENDATIONS : Based upon the above analysis and the unique nature of this proposed integrated use to be approved by special permit , recommend approval subject to the following conditions : 1 . If the development is to occur in phases , any phase including building 5 shall also include buildings 2 and 3 to be developed concurrently . If both building 5 and 6 are contained in one phase buildings 1 through 3 are likewise required to be developed concurrently . 2 . The applicant shall dedicate and provide for future improvement of a public street to serve properties to the north of a width to the approval of the Public Works Department along the west property line or suitable location . 3 . The central access shall consist of two in-bound and two out-bound traffic lanes , rather than 3 out-bound lanes as proposed . Turning movements from 3 lanes would be confusing , and could lead to further traffic congestion . 4.
