MOVED BY CLYMER, SECOND STREDICKE, REFER ORDINANCE BACK TO THE WAYS AND MEANS COMMITTEE. CARRIED. Street Grades An ordinance was read establishing maximum street grades not to exceed 10% on major streets or 15% on public streets except by leave of the City Council. Following reading, it was MOVED CLYMER, SECOND STREDICKE, REFER 1HE ORDINANCE BACK TO THE • WAYS AND MEANS COMMITTEE FOR ONE WEEK. CARRIED. Fund Transfer An ordinance was read transferring $1 ,000.00, a donation of the Renton Soroptimis,ts International unto Senior Citizens Center Construction Fund to provide a drinking fountain near the center. WIEMANN FOR REZONE (File No. R-364-79 and SP-365-79) The Planning and Development Committee has considered the appeal of the above- mentioned decision dated August 6, 1979, and recommends that the City Council reverse the decision of the Hearing Examiner based upon the following errors of fact and law: 1. Finding No. 15 is in error in that there ;isno prohibition against mixing commercial uses with residential uses so long as the users are allowed in the particular zone. 2. Conclusions No. 1, 2 and 6__arejin error in that there does not exist any moratorium against conttruction_in the North Renton area which should be considered as a "de facto" amendment to the Comprehensive Plan. k 3. Conclusions No. 4 and 5 are in error in that the rezone and special permit requested enhance-the public health, safety, morals and general welfare. The predominant use in the area is similar to the proposed use. The Committee recommends that the City Council reverse the decision of the Hearing Examiner and approve the application for rezone of the property to R-3, and grant the request for a special permit to operate an optical clinic, subject to the following conditions: 1. That the1dcationo1f tine building, parking lot, landscaping, and screening be- required as -specified in the revised site plan. 2. That a detailed landscaping plan be approved by the Planning Department prior to the issuance of'an occupancy permit,/ 3. Since there was no,response, the hearing on File No•, R-364-79 and SP-365-79 was closed by the Examiner at 9:27 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for reclassification of +5,350 square feet from an R-2 (Duplex) designation to an R-3 (Medium Density Multifamily) designation together with a . Special Permit to permit construction of an optical clinic and separate apartment unit. 2. The Planning Department report sets forth the issues, applicable policies and provisions, findings of fact,. and departmental recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. ' 3. Pursuant to the City of .Reriton's Environmental Ordinance and the State Environmental policy Act of 1971, R.C.W. 43.21.C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. • 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. • 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the required setbacks, .lot coverage and height requirements of Section 4-709A of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The subject property is located at 110 Pelly Avenue N. in an area known as North Renton. 9. The site is presently developed with a single family residence. The adjacent property to the north is developed with another optometry clinic, while directly to the west across Pelly Avenue N. are a medical clinic and dental clinic. On the, north end of the block occupying a double lot is, a medical clinic and drugstore. The adjacent residence to the south is single family. • 10. The area is just north of the Central Business District across the Cedar River. The general area in which the subject property is located consists of-moderately priced homes which are generally well maintained. The new trail along the Cedar River and the Senior Citizens Center are some recent developments in the area. The block in which the subject parcel is located has undergone some redevelopment and consists of the various health-related facilities described above and some relatively new duplex development. • 11. The Comprehensive Plan would seem to indicate that the area is suitable for the development of medium density multifamily residential development. 12. The subject property was annexed into the .city by Ordinance No. 156 in 1909. The • . .R-2.zoning Was. applied to the subject property when the original zoning was enacted in 1953. PUBLIC HEARING: After reviewing the Planning Department •report, examining available information on file with the application, and field . checking the property and surrounding area, the Examiner • conducted' a public hearing on the subject as follows: The hearing was opened on July 31, 1979 at 9:00 a.m. in' the Council Chambers of the ' Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. . It was reported, that the' Hearing Examiner and the applicant had received and reviewed the Planning Department report and the supplement, and the reports were entered into the record as Exhibit #1. Roger Blaylock, Associate Planner, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: King County Assessor's Map Exhibit #3: Site Plan as submitted . Exhibit #4: Landscape Plan Exhibit #5: Building Layout Exhibit #6: Site Plan with staff comments ' • Exhibit #7: Letter from applicant, dated June 18, 1979 Mr. Blaylock read Exhibit. #7 into the: record. The letter- noted compatibility of proposed development with other uses in the area. Mr: Blaylock also advised a correction to the original staff report which stated that an existing building will be utilized for the proposed professional office use and rental unit, and noted that a new building will be constructed. • ' The Examiner inquired if the Declaration of Non-Significance which had been issued with the understanding that an existing building would be utilized had changed with the knowledge that anew building would be constructed. Mr. Blaylock indicated. th'at the .environmental significance would be minor due to'the small scale Of the proposal. The Examiner advised' that on July 23, '1979, the City Council had referred a proposed moratorium for new construction in the area of the proposal to the Planning and' Development Committee for study, and inquired if the Planning Department's analysis of the rezone would be ,affected.by action of the Council. David Clemens, Senior Planner, indicated his understanding that the matter 'had been referred to the Planning Commission for further study although the review period and the specific language of the moratorium is yet unknown, and therefore, the effect on the. applicant's proposal is also unknown. The Examiner asked the applicant if he concurred in Exhibit #1. The requested rezone and the Special Permit are at this juncture untimely. The application should be denied at least until the Planning Commission and the City Council have had the opportunity to study the North Renton area. After sufficient study they may make appropriate recommendations to either change the Comprehensive Plan for less intense use in the area or reaffirm the existing pattern for development. To permit the rezone at this time, would foreclose the opportunity to make a reasoned choice about the subject parcel and the nearby parcels which would be adversely affected by the more intense nature of the proposal. Further, reclassification and • subsequent establishment of the proposed clinic in the face of a changed Comprehensive Plan could create a non-conforming use. The applicant has reasonable use of his property as zoned .and is not by right entitled to a more intense use of the subject property if the public welfare would suffer thereby. Premature rezoning of the area in addition. to overconcentration of commercial use's in a residential zone by Special Permit ill serves the public welfare. At the July 23, 1979 meeting of the Renton City Council a request was made to reconsider the Comprehensive Plan for the North Renton area and institute a moratorium on building in the area. The Planning Commission has apparently begun consideration • of the area with,respect .to 'the..present 'Comprehensive Plan: At the same time the . City Council has referred the subject of the moratorium to the Planning and Development . Committee for consideration. . 14. The area is still predominantly single family residential. There has not been a. great demand to rezone portions of the area. Most rezones of the area have occurred on a single lot basis occurring over a period of about 10 years and occurring mainly between 1955 and 1967. . 15. There does ,not appear to be any modern precedent for mixing a commercial use with a residential use in the same structure. The only exception would be to establish the office of a professional person in his or her home (Section 4-706(4) (a)) .. CONCLUSIONS: . 1. The applicant for a reclassification must:demonstrate at least that the property is potentially ,zoned for the requested- change; or that it has not been .specifically considered at the last area land use analysis; or that significant and material changes have occurred either of a public or private nature in the area. . The applicant has to further demonstrate that the proposed reclassification is appropriate and bears a substantial relationship to the public welfare, both in . terms of location and timing (Section 4-3014(A) (2) ) . Both the timing and location Of the proposed rezone are.inappropriate. 2. _ While the applicant in this case has demonstrated that the present comprehensive Plan for the area appears to designate this area for medium density multifamily residential development, there are indications that the Comprehensive Plan for this area May be subject to change. . The Planning Commission, acting on City Council referral; has begun review.of the Comprehensive Plan for North Renton (Minutes, Renton Planning Commission, .July 11, 1979) . The City Council has also begun consideration of the issues involved in the North Renton area and has under study a possible moratorium on building in the .North Renton area. The.building moratorium has been referred to the Planning and Development Committee (Minutes, Renton City Council, July 23, 1979) . 3: There have been some rezones in the area but these have generally been 'Of an isolated nature and have generally occurred between 10 and 20 years ago. While these rezones .have been to the more intense R-3'and R-4 classifications and subsequent construction has been of. a conforming nature, the area remains one of predominantly moderately- priced, single,family homes." The new Cedar River Trail will probably revitalize the • area and stabilize the neighborhood. . • 4. There are four medically related -facilities developed on five lots On the block in which the subject parcel is located. Some of these facilities are developed on R-2 zoned property and were established when the Special Permit process could be used . to establish such clinics in R-2 districts. The City Council has since.limited the establishment of clinics and other professional office's to ,R-3 zones by Special Permit to prevent .the intrusion of such uses into the R-2' districts. Section 4-709A.A(3) 'was. specifically amended in 1976 to accomplish that aim. The rezoning of the subject lot to R-3 in the midst of predominantly R-2 zoning and uses would • defeat the purpose of' the amended ordinance: Subsequent, to a rezone, .the clinic would be located in an R-3 zone as permitted, but would be adjacent to R-2 zoning and ,Uses. The rezone would have the further potential of -driving out the less intense • single family uses remaining on the block. The predominant land use is single family residential of a transitional.nature and the R-2 zoning fulfills the transitional needs well. ' • 5. The applicant must also demonstrate that the proposed rezone will bear a substantial relationship to the public health, safety, morals, and general welfare (Parkridge v. Seattle,. 89 Wn. 2d 454,463, 1978) . A similar. finding :is required to approve a request for a Special Permit (Sections 4-709A.A(3) and 4-722(B)) . . The proposed rezone does not bear the substantial relationship necessary. The • public'welfare 'is not enhanced by an overconcentration' of a particular type of use • in. one area. This is especially the case when' the proposed use is of a commercial -nature and the area for the proposed use' is designated for residential purposes. The proposal is, to add a fifth clinic on a residentially. designated block, and. this • . would be inappropriate. Land Use: An existing single family dwelling is located on the site with an optometry clinic on the parcel to the north, a single family residence adjacent to the south, and single family residences and some multiple family units to the east. E. NEIGHBORHOOD CHARACTERISTICS : The surrounding properties contain a variety of land uses with the trend being a transition from older single family dwellings to a mixture of larger scattered single family homes, some small multiple family buildings, and medical/dental clinics. F. PUBLIC SERVICES : 1. Water and Sewer : 6" water mains are located on Pelly Avenue adjacent to the subject site and along N. 1st Street within 200 feet to the south. An 8" sanitary sewer running north/ south is located approximately 150 feet to the west. 2. Fire Protection : Provided 'by the Renton Fire Department as per ordinance requirements. 3. Transit : Metro Transit Routes 107, 155, and 240 operate along Park Avenue North approximately one block to the east of the subject site. 4. HISTORY/BACKGROUND: The subject site was annexed into the City by Ordinance 156 in 1909. D. PHYSICAL BACKGROUND: 1. Topography: The site is generally level. 2. Soils : Urban land (Ur) . This is soil that has been modified by disturbance of the natural layers with additions of fill material several feet thick to accommodate large industrial and housing installations. The erosion hazard is slight to moderate. No capability or woodland classification. 3. Vegetation: Lawn grass is the predominate feature with short to medium shrubs scattered around an existing single family dwelling and the perimeter of the site. The site plan shows provision for the required seven parking spaces. However, only two of those are usable, according to R.M.C. 4-2210. The two parking spaces accessing Pelly Avenue North do not have adequate maneuvering space on-site. Motor vehicles will have to back onto the street. The parking lot design at the rear of the building limits the maneuvering area allocated to three of the five parking spaces. A 20-foot wide aisle is created, where a 24-foot wide aisle is required. Six parking spaces could be provided on-site and meet the design standards. One parking space could be eliminated in the rear, and the parking spaces in front would have to be reoriented 90 degrees. • The additional parking space could be provided within 500 feet under a joint use agreement per R.M.C. 4-2204.6e, or the apartment use could be discontinued and the space used for dead storage space. 4. Landscaping and screening is shown on the site plan. Utilizing 44 feet of the 50-foot lot width for parking leaves inadequate area for landscaping. Fences must be used to meet the screen- ing requirement . Screening is used to buffer a more intense use from another. R.M.C. 4-2204. 8B( 1) establishes a minimum of a 42" fence for site screen , when minimum landscaping requirements cannot be met . M. DEPARTMENTAL RECOMMENDATIONS : The staff recommends that the request for a special permit to operate a clinic be approved subject to the following conditions : 1. Modification of the parking design to provide six parking spaces on-site per standards stated in R.M.C. 4-22. 2. Provide one additional parking space within 500 feet under a joint use agreement per R.M.C. 4-2204.6e. 3. That a four foot wide landscaping strip along with a five foot high solid board fence be provided along the southern property line adjacent to the single family residence. 4. That a two foot wide landscaping strip along with a 42" high solid board fence be provided along the northern property line adjacent to the existing clinic. 5. That detailed landscape plan be approved by the Planning Department prior to issuance of an occupancy permit . 6. The subject request for rezone to R-3 is generally consistent with the Comprehensive Plan Land Use Element , which designates the site and surrounding area as high density multiple family. 3. The proposed rezone and use is generally, consistent with the R-3 parcel adjacent to the north, the R-4 properties to the east , and the P-1 zoning and similar clinic uses to the west across Pelly Avenue. 4. The items addressed in #2 and #3 appear to indicate that the subject site is potentially zoned for the R-3 classification requested (Section 4-3014-B) . 5. The subject site has remained zoned R-2 since the Zoning Ordinance was adopted in 1953. This would seem to demonstrate that the designation has not been specifically considered in a previous area zoning or land use analysis (Section 4-3014-A) , other than the Comprehensive Plan adoption of 1965. 6. A letter from the applicant dated June 18, 1979 (copy attached) identifies some similar private developments in the subject area. These would appear to affirm (Section '4-3014-C) of the Land Use Hearing Examiner Ordinance. M. The following analysis and recommendation is submitted to replace that previously provided by the Planning Department concerning the special permit. PLANNING DEPARTMENT ANALYSIS: (SPECIAL PERMIT) 1. The applicant proposes to remove the existing structure and con- struct a new two-story building. The first floor will be used as an optical clinic and the second story as a two bedroom rental unit on the site addressed in the accompanying rezone application. 2. Off-street parking is proposed off of Pelly Avenue North and the alley. A total of 7 parking spaces are necessary for both the 1,000 square foot office and the apartment . 3. The site plan, as revised by the staff, shows provision for 7 usable parking spaces. The building has been moved back approxi- mately 9 feet to allow for the rearrangement of the parking spaces and a relocation of the curb cut . The parking stalls in the front of the building are only 18 feet deep. They utilize a two foot overhang into the landscaping on the north side of the property adjacent to the existing clinic. 4. The landscaping and screening shown ,on the revised site plan with staff comments complies with the landscaping requirement of R.M.C. 4-2204. 8. DEPARTMENTAL RECOMMENDATION: The staff recommends that the request for a special permit to operate a clinic be approved subject to the following conditions: 1.
