PLANNING DEPARTMENT The Planning Department preliminary report was received by

PUBLIC HEARING : After reviewing the Planning Department report; examining
available information on file with the application, and field
checking .the property and surrounding area, the Examiner
•
conducted a public hearing on the subject as follows:
The hearing was opened on February 5; 1980 at 9:55 a.m. in the Council Chambers of the
Renton Municipal Building. •
Parties wishing to testify were affirmed by the Examiner.
•
It was reported that the Hearing :Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
•

The Examiner requested testimony by the applicant: Responding was:

Dr. Reebs indicated concurrence with revisions denoted op Exhibit #4 recommended by the
Planning Department. Regarding estimated vehicle trips per day, -he anticipated a
maximum of 300 trips per day. Referencing Section L.10 regarding the preference of the
• Planning Department. for provision of an, L-shaped building in lieu of the,proposed
configuration, Dr.. •Reebs advised that the recommendation was considered but was found
to .be infeasible for internal design of the building and would not result in an increased
. number of available parking spaces on the site.'

The Examiner requested testimony in support or opposition to the application. There was
no, response. He then requested final comments from the Planning Department. Since there
were. no further. comments, the hearing regarding File No. SP-425-79 was closed by the
Examiner at 10:13 a.m.

FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
' FINDINGS: •
•
1. The request is for approval of a special permit to establish a.medical clinic on
approximately one acre of property in an'R-3 (Medium Density Multifamily Residential)
zone.
2. The Planning Department report sets forth the issues, applicable policies and•provision:
• and departmental recommendations in this matter, and is entered as Exhibit #l.
•
3. • Pursuant to the City of,'Renton's Environmental Ordinance.and the State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
•
• 5. No opposition to the proposal was expressed.
6. All existing utilities are available and in close proximity.
7. The proposal must meet the required setbacks, lot coverage and, height requirements of
Section 4-709A (R-3) of Title IV, Ordinance No. 1628, Code of General Ordinances.
8. The subject property is located on Talbot Road .S. , just south of S. 43rd Street. The
applicant' proposes establishing a medical clinic on the subject property. Pursuant
to Section 4-709A.A(3) , the 'applicant has applied for a special permit which is
required to establish a clinic in an R-3 zone.
9. The subject property was annexed into the city in March of 1968 and was rezoned from
G (General; Single Family Residential; minimum lot size 35,000 square feet) to R-3
in the same year.
•
10. The subject lot is one lot of a two-lot short plat request (File No. Short Plat 45'9-79)
as approved on February 14, 1980.
11. The subject lot slopes downward from east to west at approximately a 10% grade.
•
12. The Comprehensive Plan indicates. that the area in which the subject property is.
located is' suitable for the development of public and quasi-public uses.
13,. The general area in which the subject,property.is located is developed with a number
of medical clinics to the north and south. Valley General Hospital is located north
of the subject property. There is an .attorney's office located to the east, and the
East Valley Freeway is to the west. .
14. Zoning in the area consists of R-3 on the subject property, P-1 (Public) to the north
and south of the subject 'site, and G (General) to the east, south and west of the site.
•
15. The site plans submitted for the subject proposal Will require alteration because
of the changes required in the requested short plat. The 24rfoot driveway required
to service the southerly lot will remove that much property from the subject site.
•
16. The plans submitted with the request for the •special permit. indicate that the clinic
would present a one-story. aspect to traffic Along Talbot Road S. and a two-story
aspect from the west and rear. The plans specify a 10,344 square foot building and
parking for .56 vehicles whereas only 52 parking stalls are required. The building, •
would be finished in a brick. veneer and cedar trim.
• The plans would require a substantial amount of fill material and a retaining wall
varying in,height from, three to 12. feet on the west side of the property about 23
feet from the western property line.
• 17. The Planning'DepartMent recommended that landscaping be provided between the west
property line and the retaining wall. Five feet of landscaping is. required. along
Talbot Road South. Further landscaping is required by Section 4-2204(8)B(3) .
18. Off=site improvements will be required along .Talbot Road,.S. including widening of
• the' right-of-way, installation of sidewalks .(already installed) and installation of
. street trees along the right-of-way'. •
19. The Planning Department recommended that the'dumpster site be adequately screened 'arid

CONCLUSIONS:
1. The proposed medical clinic will be located in an R-3 zone, and, therefore, a special
permit is required. The clinic will be located on an approximately one acre parcel
lin an area which is sparsely developed with residential uses. The area in which the
proposed clinic will be located has developed into a rather large medical compound
providing a variety of medically related functions for the general public.
2. The use of,the subject property for a clinic will serve the public interest and the
general welfare of the community. The site is a small R-3 parcel located just south
Iof a large P-1 zoned district. The homes in the area, are generally,located on large
lots in the G zones and will not be adversely affected by the establishment of
another clinic.
3. ,1The establishment of a clinic on the subject property will not usurp land better
suited for residential purposes, and the Comprehensive .Plan designates the area in
which the subject property is located for public and quasi-public uses. The proposal
is consistent with the Comprehensive Plan.
4. The design will have to be altered pursuant to the decision on the associated short
plat (File No. Short Plat 459-79) , but the plans submitted by the applicant appear
to demonstrate that the facility will fit into the, area without being intrusive.
Therefore, the special permit should be approved subject to the submission of final
plans which shall be subject to review by the Planning Department. If the Planning
Department believes that a further review of the' plans is necessary a. site review
'may be held pursuant to Section 4-3010A'(6) by the Hearing Examiner.
5. The applicant will have to landscape the frontage along Talbot Road S. and provide
the required internal landscaping in the parking area pursuant to Section 4-2204(8)B(3) .
(Additional landscaping will also be required west of any retaining wall or structure
erected to support the required fill on the subject property.
6. ' Depending on the quantity of fill material required on the site, a fill permit may be
( necessary pursuant to Section 4-2305.
7. The off-site improvements required shall include but not be limited to the widening
of Talbot Road S. , the planting of street trees, and the installation of curbs,
gutters and sidewalks, or the completion of such installations.
8. The screening of the dumpster site area shall be subject to the approval of the
' Planning Department.
DECISION:
The special permit to construct and establish a medical clinic in an R-3 zone is approved
subject to the following:
1. IThe installation of off-site improvements including but not limited to the widening
iof Talbot Road S. , the planting of street trees, and the completion of the installation
lof curbs, gutters and sidewalks; as necessary. ,
2. The 'landscaping of five feet of frontage along Talbot Road S. , the installation of
landscaping pursuant to Section 4-2204(8)B(3) , and the installation of landscaping
between any property line and any retaining,structures erected to support necessary
fill..
3.' Site review pursuant to Section 4-3010.A.(6) if such, review is necessary after
, Planning Department review of the final plans and the adjustment of property lines
pursuant to the Examiner's decision on Short Plat 459-79.
4,. The screening of the dumpster site subject to the approval of the Planning.Department.
5. , Final approval of Short Plat 459.79' (expiration of appeal period on February 28, 1980) .
6. The special permit shall expire at the end of two years from thedate of decision
lif the applicant has not shown substantial progress towards the construction of the

the decision of the Examiner is based on erroneous procedure, errors of law or, fact,
error in judgment, or the discovery of new evidence which could not be reasonably
available at the prior hearing may make a written request for review by'the Examiner
within fourteen (14) days from the date of the Examiner's decision. This request shall
set forth the specific. errors relied upon by,such appellant., .and the Examiner may, after
review of the record, take further action as he deems proper.
An appeal to the City Council is governed by. Title IV,. Section 3016, which requires that

C. HISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinance #2394
dated March 26, 1968. It was subsequently rezoned from "G" to
R-3 by Ordinance #2433 of September 23, 1968. The site is
proposed Lot #2 of the Kay-Hubbard Short Plat request , File
Number 454-79 .
D. PHYSICAL BACKGROUND:
1. Topography: The subject site slopes downward from east
to west at approximately a 10% slope.
2 . Soils: Alderwood gravelly sandy loam, 6-15% slopes (AgC) .
Permeability is moderately rapid in the surface layer and
subsoil , and very slow in the substratum. Runoff is slow
to medium and the erosion hazard is moderate. This soil
is used for timber, pasture , berries, row crops and for
urban development .

3. Vegetation: Much of the site has been cleared. Some low-
growth deciduous shrubs are located along Talbot Road South
and addition,al'.trees are found in the westerly portion of.
"' 'the property.' '
-- - !4: ..'1Wildlife The' existing 'vegetation on the site provides a
small amount of area for suitable habitat for birds and
small mammals.
5. Water: No surface water was observed on the subject site
at the times of investigation on October 26, 1979 and
January 18, 1980.
6. Land Use: Vacant

E. NEIGHBORHOOD CHARACTERISTICS:
The surrounding properties have developed into medical and
professional uses with some scattered single family residences
on the fringes.
F. PUBLIC SERVICES:
• 1'. W?ter and Sewer: A 12 inch water main and an inch
sanitary sewer extend north-south on Talbot Road South
adjacent to the subject site. Since the site is lower
than the. water main adequate water pressure is available
' to the site.
2. Fire Protection: Provided by the Renton Fire Department
as per Ordinance- requirements.
3. Transit : Metro Transit Route #145 operates along SW 43rd
Street within 300 feet to the north of the subject site.
4. Schools: The subject site is not in close proximity to
any existing schools and the proposed project will not
have an effect on existing schools.
5. Recreation: The subject site is slightly over 1 mile
riot•-t- :TAgD of Talbot Hill Park. In addition, the grounds of
Valley General Hospital may provide some passive recrea-
tional opportunities.

1. - Natural Systems: Development of the site will disturb the

through proper site development controls 'and procedures these

opportunities may result from this new facility.
3., Schools: N/A
4. Social : Development of the site may result in increased
social interaction on the site as well as in thersurrounding
areas.
5. Traffic: The proposed development will generate approximately
780 daily trips (75 weekday trips / 1,000 square feet of gross
floor area X 10, 344 square feet) . 1978 traffic counts
indicate 6,016 daily trips on Talbot Road South. , Therefore,
the proposed development will result.: in approximately a 13%
traffic increase in the immediate vicinity.
J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton 's Environmental Ordinance and
the State Environmental Policy Act of 1971, as amended, RCW 43-
21C, a declaration of non-significance has been prepared for
the subject proposal by the responsible official.

L. PLANNING DEPARTMENT ANALYSIS:
1,. The subject proposal is consistent with the Special Permit
section of the R-3, Residence Multiple Family Zone which
provides for clinics and professional office use.
2. The proposed clinic is compatible with the existing land
uses and zoning in the vicinity. Similar clinic uses and
medical-dential facilities are located on adjacent properties."
3,. A two-story building is proposed to accommodate the clinic
uses, the building elevations indicate an exterior treatment
of brick veneer with cedar trim.
4. The site plan as submitted provides sufficient parking
(56 parking stalls) to exceed the parking requirement
52 parking spaces necessary. for the proposed 10,344
, square foot structure.
5. The parking lot will need a substantial amount of fill.
A retaining wall varying from 3 to 12 feet in heighth
will be necessary along the western edge of the parking
lot . Approximately 23 feet of the lot is west of this
retaining wall. This area should be planted with a
heavy stand of evergreen trees to provide a. landscaping
buffer to the "G" zoned property to the west .
6. A 5-foot wide landscaping strip is required adjacent to
the public right-of-way,-on Talbot Road South and 5 feet
is provided on site. Additional landscaping should be
placed at the end of the parking rows to fulfill the
requirements of Section 4-2204(8)B(3) as shown on the
site plan with staff comments .
7. The applicant will be required to construct off site
improvements including a 6 foot wide sidewalk and widen
Talbot Road South. The 6 foot wide landscaping strip
between the curb and the sidewalk will have to. be planted
with street trees. Specific landscaping plans for the
entire site should be reviewed by the Planning Department
prior to the issuance of a building permit .

8. The internal traffic circulation on the site requires
' use of a joint access easement on the south side of the
lot . Specific plans showing the Kay-Hubbard Clinic have
been attached to show the interdependency. The short
plat and site plan as submitted have 'been modified to
the location of the easement and new boundary line to •
meet the requirement .of Section 4-2204(2)A. To allow
easier access to the entrance two parking spaces should
be: removed in the southeast corner of the site as shown . '
on the site plan with staff comments.
9 . The site plan designates a location for the dumpster.
However, it does not address the problems of enclosure
and screening of the dumpster, A solid enclosure should
be constructed with gates along with specific landscape.,
screening treatment .
10. In retrospect the design does not appear to take the
most advantage of the site. Functionally many peculiar
shaped areas are created by the placement of the building.
An L-shaped building would provide more parking and increase
the square footage within the building.
M. PLANNING DEPARTMENT RECOMMENDATIONS:
Based on the foregoing analysis, the Planning Department
recommends that the Hearing Examiner approve the special
permit request, File Number SP-425-79, as submitted with
the following conditions:
1. Modification of the site plan to corresponded to the
short plat with adjusted 'lot lines and the creation of
a joint access easement as shown of the site plan with
staff comments.
2. i, Addition of landscaping islands at• the end of the rows
of parking.
3. , , Elimination of two parking spaces at the southeast
corner of the site to facilitate better access.
4. Landscaping of the western 23 feet of the site below
the retaining wall of the parking lot .
51 ' Review and approval of detailed landscaping plans by
the Planning Department prior to the issuance of a
building permit .
6. Approval and filing of the Kay-Hubbard Short Plat
prior to the issuance of a .building permit .
7. Construction of a solid sight obscuring trash enclosure
with gates along with landscaped screening on the three
sides without the gates.

C. HISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinance #2394
dated March 26, 1968. It was subsequently rezoned from "G" to
R-3 by Ordinance #2433 of September 23, 1968. The site is
proposed Lot #2 of the Kay-Hubbard Short Plat request , File
Number 454-79.
D. PHYSICAL BACKGROUND:
1. , Topography: The subject site slopes downward from east
to west at approximately a 10% slope.
2 . Soils: Alderwood gravelly sandy loam, 6-15% slopes (AgC) .
Permeability is moderately rapid in the surface layer and
subsoil, and very slow in the substratum. Runoff is slow
to medium and the erosion hazard is moderate. This soil
is used for timber, pasture , berries, row crops and for
urban development .

3. Vegetation: Much of the site has been cleared. Some low-
growth deciduous shrubs are located along Talbot Road South
and additional trees are found in the westerly portion of
the property.
4. Wildlife: The existing vegetation on the site provides a
small amount of area for suitable habitat for birds and
small mammals.
5. .Water: No surface water was observed on the subject site
at the times of investigation on October 26, 1979 and
January 18, 1980.
6. Land Use: Vacant

E. NEIGHBORHOOD CHARACTERISTICS :
The sLrrounding properties have developed into medical and
professional uses with some scattered single family residences
on the fringes.
F. PUBLIC SERVICES:
•
1. Water and Sewer: A 12 inch water main and an 8 inch
sanitary sewer extend north-south on Talbot Road South
adjacent to the subject site. Since the site is lower
than the water main adequate water pressure is available
to the site.
2. Fire Protection: Provided by the Renton Fire Department
as per Ordinance requirements.
3. Transit : Metro Transit Route #145 operates along SW 43rd
Street within 300 feet to the north of the subject site.
4.. Schools: The subject site is not in closecproximity to
any existing schools and the proposed project will not
have an effect on existing schools.
5. Recreation: The subject site is slightly over 1 mile
south of Talbot Hill Park. In addition, the grounds of
Valley General Hospital may provide some passive recrea-
tional opportunities.

1. Natural Systems: Development of the site will disturb the
soil and vegetation, increase storm water runoff , and have
an effect on traffic and noise levels in the area. However,
' through proper site development controls and procedures these
impacts can be mitigated.

opportunities may result from this new facility.

4. Social : Development ofthe site may result in increased
social interaction on the site as well as in the surrounding
areas.
5. Traffic: The proposed development will generate approximately
780 daily trips (75 weekday trips / 1,000 square feet of gross
floor area X 10, 344 square feet) . 1978 traffic counts
indicate 6,016 daily trips on Talbot Road South. , Therefore,
the proposed development will result.. in approximately a 13%
traffic increase in the immediate vicinity.
J. ENVIRONMENTAL ASSESSMENT/THRESHOLD" DETERMINATION:
Pursuant to the City of Renton 's Environmental Ordinance and
the State Environmental Policy Act of 1971, as amended, RCW 43-
21C, a declaration of non-significance has been prepared for
the subject proposal by the responsible official.

L. PLANNING DEPARTMENT ANALYSIS:
1'. The subject proposal is consistent with the Special Permit
' section of the R-3, Residence Multiple Family Zone which
' provides for clinics and professional office use. -
2. The proposed clinic is compatible with the existing land
uses and zoning in the vicinity. Similar clinic uses and
medical-dential facilities are located on adjacent properties.'
3. A•,'two-story building is proposed to accommodate the clinic
uses, the building elevations indicate an exterior treatment
of, brick veneer with cedar. trim.
4. The site plan as submitted provides sufficient parking
(56 parking stalls) to exceed the parking requirement
52 parking spaces necessary for the proposed 10,344
square foot structure.
5. The parking lot will need a substantial amount of fill.
A retaining wall varying from 3 to 12 feet in heighth
will be necessary along the western edge of the parking
lot . Approximately 23 feet of the lot is west of this
retaining wall.. This area should be planted with a
heavy stand of evergreen trees to provide a landscaping
buffer to the "G" zoned property to the west .
6.' A 5-foot wide landscaping strip is required adjacent to
the public right-of-way on Talbot Road South and 5 feet
is provided on site. Additional landscaping should be
placed at the end of the parking rows to fulfill ,the
requirements of Section 4-2204(8)B(3) as shown on the
site plan with staff comments.
7. . The applicant will be required to construct off site
improvements including a 6 foot wide sidewalk and widen
Talbot Road South. The 6 foot wide landscaping strip
between the curb and the sidewalk will have to. be planted
with street trees. Specific landscaping plans for the
entire site should be reviewed by the Planning Department
prior to the issuance of a building permit .

8. The internal traffic circulation on the site requires
use of a joint access easement on -the south side of the
lot . Specific plans showing the Kay-Hubbard Clinic have
been attached to show the interdependency. The short
plat and site plan as submitted have 'been modified to
the location of the easement and new boundary line to •
meet the requirement 'of Section 4-2204(2)A. To allow
easier access to the entrance two parking spaces should -
be removed in the southeast corner -of the site as shown
on the site plan with staff comments.
9. The site plan designates a location for the dumpster.
However, it does not address the problems of enclosure
and screening of the dumpster, A solid enclosure should
be constructed with gates along with specific landscape
screening treatment .
10. In retrospect the design does not appear to take the
most advantage of the site. Functionally many peculiar
shaped areas are created by the placement of the building.
An L-shaped building would provide more parking and increase
the square footage within the building. .
M. PLANNING DEPARTMENT RECOMMENDATIONS:
Based on the foregoing analysis, the Planning Department
recommends that the Hearing Examiner approve the special
permit request, File Number SP-425-79, as submitted with
the following conditions:
1. ,, ,Modification of the site plan to corresponded to the
short plat with adjusted 'lot lines and the creation of
I, a 'joint access easement as shown of the site plan with
staff comments.
2. . Addition of landscaping islands at. the end of the rows
of parking.
3. Elimination of two parking spaces at the southeast
corner of the site to facilitate better access.
4. Landscaping of the western 23 feet of the site below
` ' the retaining wall of the parking lot .
5. Review and approval of detailed landscaping plans by
the} Planning Department prior to the issuance of a
building permit .
6. , Approval and filing of the Kay-Hubbard Short Plat
prior to the issuance of a building permit.
7. Construction of a solid sight obscuring trash enclosure
with gates along with landscaped screening on the three
sides without the gates.

Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals. The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
