FIRST CHURCH OF THE NAZARENE (R-434-79, SP-433-79)
The Planning and Development Committee concurs in the recommendation of the Land
Use Hearing Examiner for approval of a rezone from G to R-1 .
' The Planning and Development Committee has considered the appeal of the above-
mentioned recommendation dated November 21 , 1979, and recommends that the City
Council reverse the recommendation of the Land Use Hearing Examiner and grant
the special permit requested, based upon the following errors of fact and law:
1 . Conclusion No. 6 is in error in that the applicant has
demonstrated that the proposed church complies with the
various requirements of. Section '4-706(3) (a) .
2. Conclusion No. 10 is in error in that the Zoning Code
requires a 100 foot setback between proposed churches
and lots which are developed with single family
residences.
The Committee recommends that the City Council reverse the recommendation of
the Land Use Hearing Examiner in relation to the special permit , and that the '
City Council grant the special permit.

SUBJECT: File No: R-434-79; SP-433-79; First Church of the Nazarene
Correction of Clerical Error
With reference to Finding No. 16, it appears that the zoning category for
the subject property was correctly identified in the Planning Department
Report as "G" (General; Single Family Residential; Minimum Lot Size -
35,000 sq ft) rather than the "GS-1" (General; Single Family Residential;
Minimum Lot Size - 35,000 sq ft) indicated in the above Finding.
The error was due to the use of an incorrect version of the Zoning Map.
The City's Zoning Map has since been corrected. (See attached) .
The error, after reviewing the Examiner's Decision, does not appear to
be substantive and therefore would not change the decision.

Mr. Magstadt stated that action regarding our special permit was "Considered
final", and was "being submitted to the City Clerk". . ."for permanent filing".
The hearing examiner mayhave made an 'error in processing. The church was not,.
nor is not,responsible that possible error.
Mr. Kaufman further states that the setbacks and landscaping required by Section
4-706 (3) (a) 3 and 4 were not complied with. This, too, is an error. I
would like to submit, as Exhibit !'B", 'the report of the Land Use Hearing
Examiner, dated',March 29, 1977. On page three of that report, under CONCLUSION:
• Number 3 states:'
The proposed facility has met the fallowing requirements:
a. Access
b. Lot Coverage
c. Setbacks
d. Landscaping
e. Parking '
f. Views
g. Surface' drainage
h. Provision for traffic..flow and circulation
i. Esthetic compatibility with surrounding area
j. Submittal of a landscape plan.
FINDINGS: 0 -
9. In this finding the Hearing Examiner made an error. He states that,
"the remainder of the parcel 'would' eventually be developed with single
family residences." The word "might", or "could'.' should have been used
since there are no intentions of development, of the easterly portion, at
this time. There has been some talk about a ball field as a possibility.
10. In this finding' the Hearing Examiner states that, "the existing residence
is 'proposed' to be used by the church as a parsonage". In fact, since we
purchased the property, this house has been used for nothing else:
Presently the minister. of Music and Youth, at the. Renton First Church of the
Nazarene, a full time, paid assistant, and his family live there. The only.
other possible usage of this house as a residence, would be for a custodian.
11 - 14. _ I am in agreement with the Hearing Examiner's findings. - However, the
property across Union Ave. N.E. to the west is not developed residential, but
in fact, it is a Public Park, namely< Kiwanis Park.
15. The building ,is to be" setback 18 feet which was determined to provide ,
adequate screening and landscaping next to a 'public school in 1977..
16. The property was zoned "G" not "GS-1" as the Hearing Examiner has stated,
as a result of the annexation in 1976. I would like to submit as Exhibit "C"
a letter from Mayor C. 3. Delarenti, to the .King County Boundary Review
Board, dated May 21, 1976. '
On page 4, Exhibit 7, Review of Chapter 36.93.170 R.C.W. AREA, ZONING AND
COMPREHENSIVE PLAN it states in the second paragraph:
Upon annexation the area, will assume a "G" zone which is a
large lot (35,000 square feet) single family holding. zone.
On pages 4 and 5 of the Report and Recommendation to, the City Council, under
CONCLUSIONS: the Hearing Examiner deals with the Special Permit.
6. The Hearing Examiner is in error when he states that "the applicant
has failed to demonstrate that the proposed church complies with the various
•• landscaped, setback and parking requirements.
I would like to submit as Exhibit "D"., the Planning Department's Preliminary
Report to the Hearing Examiner, . dated November 13, 1979.
It is the annalysis of Planning Department that we do comply. As to the ,
parking requirements: on page. 4. (L) 3, the last half of the paragraph states:
"the parking lot is still above the required 90 parking
spaces. The size of the sanctuary has not changed from
the original plans. Therefore, the parking required '
still remains the same, 90 parking spaces."

As to setbacks and landscaping the same paragraph states "The site plan complies
with the other requirements as designated in Section 4-706 (3) except for the
rear parking lot setback from the southern line."
It is our contention that the property to the south, the Honey Dew Elementary
School, is not zoned properly and is not an established single family residential
area that needs to be protected from the location of .a church. The school
is setback approximately 75 feet,thus providing more than adequate separation.
The Hearing Examiner is in error when he applies the.100 foot setback require-

ment from the H6ney Dew. Elementary School. The comprehensive planrthe
school site as public/quasi-public. -This point of view is supported by the
Planning Departments Analysis Point.L (.2) . On page 4 (L) 2 the last sentence ,
reads, ". . .it 'would appear that the church now has vested interests in the
site plan as approved, and the structure is a legal non-conforming structure
in regard to setback." . •
7. I am in agreement with the Hearing Examiner on this conclusion; .however,
the previous Hearing 'Examiner stated in Exhibit "B" page three, item 9: "The
church has gone through several planning revisions and modifications in order
to comply with the latest, amendment ,of the. residential zone regarding the
location and siting of churches, item 10: The plans have been reviewed by
all departments that are affected by the impact or construction of .this
facility." On that same page (3), under Conclusions: 3, the proposed facility
• has met the following requirements:
a. Access
•
b. Lot Coverage
c. Setbacks
d. Landscaping •
e. Parking
f. Views •
g. Surface drainage
h. Provision for traffic :flow and circulation
i. Esthetic, compatibility with surrounding area
j. Submittal of a landscape plan.
8. Please note the response to-item 7, since this conclusion is repetitive.
9. The Hearing Examiner is in error on this. conclusion. Since there is no
plan for development of the eastern (internal) portion -of the site and
since the Planning Department in their report, Exhibit "D", page 5 (L) 6
which states: "Many large significant evergreen and deciduous trees exist
on the property line. - Retention 'of the trees should be encouraged as part
of the total landscape and development plan." This conclusion is, irrelevant
to the Special Permit.
10. The Hearing Examiner is in error,• when he states that the property is
"too narrow to support the construction of the proposed church." As shown
in other parts of this appeal, the, previous Hearing Examiner ruled that
the property was not too narrow. In Exhibit "C", the letter from Mayor
C. 3. Delarenti, to the King County Boundary Review Board, dated May. 21, 1976,
on page 3, Exhibit 2, Background Information states: "The Woods Annexation
was initiated by Pastor Woods, of the Nazarene Church to be able to construct ,
a church." Obviously, prior to annexation into the city, the city was aware
of our intention. I can further document,City Council minutes and corre-
spondence between the city and the King County Council if necessary, but
why belabor the point.
11. The Hearing Examiner :isstill in error on this item, please patiently
note the facts that I have previously given to you on this repetitive item.
12. The Hearing Examiner is in error here as well, because I have shown -
that he is in error not once, but on several items. Therefore, I appeal his
decision that the Special ,Permit should be denied.
WHY 'I BELIEVE THAT -THE SPECIAL PERMIT SHOULD BE. ISSUED
Tn August of 1942, the Church of the Nazarene came to the City of Renton.
As the congregation grew the church built at 246 Wells Ave. North.
Through the years the congregation continued to grow, until it had outgrown
its facilities which covered more than 80% of its land. No adjacent
property has been available to us, nor is it now. Since we are on the
corner of two one-way streets, 3rd North and Wells Ave. North, coupled•
with the fact that we have no off street parking, both internal growth,

as well as service to our community became restricted. We need to relocate.
When the property immediatly north of the Honey Dew Elementary School became
available the church purchased it. Shortly thereafter we applied for
annexation to the City of Renton for the express purpose of building a
church building, Under Ordinance 3058, passed August 23, 1976, Published
August 27, 1976 and became effective 5 days later on September 1, 1976
the property at 850-856 Union Ave. N.E. became a part of the City of Renton.
Some 6.months prior to annexation in a letter dated March 11, 1976, Exhibit
"E", Mr. Warren C. Gonnason, 'P.E. wrote the Church of the Nazarene
regarding "Sewer Service to the New Church Site."
The church sought out a designer who designed a "steel building". It was
100 feet wide, 192 feet deep, and .2.2. feet high with a flat roof. Apparently,
because they had chosen a rectangular steel building, which would have
definite esthetic limitations, they requested a 300 foot set back from
Union Ave. N.E. Had the church applied for a 150 foot setback, approximently
even with the Honey Dew School, we would not be writing this appeal.
On March 29, 1977 the Hearing Examiner approved a special permit for
church facilities on the site (reference file SP-003-77) . There was NO
opposition from the community or anyone else. ,
After 2 years of design work, the church board,' of'.the Renton First Church
of the Nazarene, was not satisfied with the structure that we had taken
the Special Permit out to build. We became aware of factors that relate
to steel structures that we did not have before. . We went and looked at
a church building in Lynnwood, Washington, that is in fact, a Steel
Building. Our conclusion,was that the community would not be satisfied
with this kind of structure. It looked like a .warehouse or a heavy
equipment garage, not a :house of worship.
We further discovered that we could: build a beautiful house of worship,
out of conventional materials, that would be a tribute to our community,
that we are trying to minister to, a tribute to God-Almighty, and one `

that we would be pleased to say "that's where I worship", for about the
same amount of money.
We completely redesigned the appearance of. the building to one that we
believe, will enhance the neighborhood. We showed the drawings to some
of our neighbors, who were more than pleased.
On August 23, 1979, I wrote to the Office of Land Use Hearing. Examiner,
Exhibit "F" & "G", to see if simply moving the building forward on the
property; to have instead of a 300 foot setback from Union Ave. N.E. , a
150 foot setback (the requirement from Union Ave. N.E. is not more than
25 feet. ) ; would violate the intent of the first Special Permit. He
never wrote me back, nor called me on the telephone. He verbalized to
the Planning Department of the City of Renton, that since we were in a "C"
zone we would NOT qualify for a Special Permit in a residentual zone- as
the code states. Upon this advise.we applied for a Rezone from "G" to

"SR-1" and applied for a new Special Permit, only to have the rezone
granted and the Special Permit denied. Again there was NO opposition to
either the rezone or the Special Permit,
We have chosen to build our building in three phases. Phase One which
consists of an administrative wing, a large fireplace room, a multi-purpose
activity center which includes a full size gymnasium, a kitchen, showers
and lockerrooms, electrical and mechanical rooms,4.restrooms including
providing for the handicapped. On November 5, 1979 a building permit was
issued, because Phase One comes completely within the confines of the
Special Permit, SP-003-77. Our foundation for Phase One is complete.
It is our desire that you will grant to us this Special Permit so that we
can build Phases Two and Three. Phase Two includes the covered driveway,
the foyer, and the main restrooms. Phase Three includes the sanctuary and
classrooms.
We have done everything that we know to do to comply with the codes and

regulations of the City of Renton.

PUBLIC HEARING: After reviewing the Planning Department report ,
examining available information on file with the
application, and field checking the property and
surrounding area, the Examiner conducted a
public hearing on the subject as follows :
The hearing was opened on March 22 , 1977 , at 10 :25 a.m. in the Council
Chambers of the Renton Municipal Building. ,
Parties wishing to testify were sworn.
It was reported that the Hearing Examiner and Mr . Alfred Woods ,
representing the applicant , had received and reviewed the Planning
Department report, and the report was entered into the record as
Exhibit #1 . •
Michael Smith, Planning Department , reviewed Exhibit #1 , and- entered
the following addition"al exhibits into the record:
Exhibit #2 : Site Plan Map.
Exhibit #3 : Landscape Plan.
Exhibit #4 : Elevation Plan.
The Examiner inquired about access to the undeveloped portion of the
property for future expansion. Mr . Smith reported that access would
be through the westerly portion of the site.
The Examiner asked Mr. Smith if he had additional comments or exhibits
to enter . Mr . Smith reported receiving letters from various city
departments : Fire Department, Engineering Division , and Utilities
Division; and read the subject letters into the record.
The Examiner asked Mr. Woods if he concurred in Exhibit #1 , and Mr .
Woods indicated his concurrence. Responding was :

Mr, Woods briefly reviewed: the history of acquisition of the property ,
includina a recent annexation, and- indicated cooperation in fulfilling
obligations imposed by the Planning Department in order to construct .
the facility. '
In regards to •previous discussion about access to the undeveloped
portion of the property, Mr; Woods reported that. ingress and egress
for the proposed facility would be Onto ,Union Avenue N.E . with proposed
access for future expansion to be negotiated with property owners to
the back of the property. He indicated discussions had been held
with said property owners .in regard to future - access.
the Examiner asked if existing trees on the property would be '
retained , and Mr. WOods indicated that one tree would remain but
the other would be removed because of the placement of the structure
on the site; . .
The Examiner asked for additional testimony regarding the application.
Since there was none , .the hearing on Item #SP-Q03-77- was closed by
the Examiner at 10: 50 a.m.
FINDINGS , CONCLUSIONS & RECOMMENDATIONS : Having reviewed the record
inthis matter , 'the Examiner' now makes 'and enters the following.:
FINDINGS ; '
1 . The request is. to allow the construction of a proposed church
. , facility by special permit in' a single family residential zone.
The chinch and accompanying parking will consist of an area of
approximately 24 , 000 gross square feet. ,
2 . The subject site is primarily undeveloped; however, there are
i two existing single family residential structures located on the
1 property with various, accessory structures. ' Honey Dew Elementary
School and its accompanying playground is located directly to the
south of the site. There are. single family residences located to
the north of the site, and Kiwanis Park is located directly west
•
fronting Union Avenue N .E. .
3 . All existing utilities are available and are in close proximity .
4 . Pursuant to the City of Renton' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , as amended, R.C.W'. 43 . 21 .c ,
a Declaration of Non--Signif.icance has been issued for the subject
proposal by Gordon Y. Ericksen, responsible official..
5 . The structure is .compatible with required setbacks , lot coverage
and height requirements of Section 4-706 . 3 . . ;
(L6 . L--in. pi net as is indicated on the submitted plan is in compliance
with the code and seems to be sufficient to 'provide an adequate
buffer at the perimeter of the property to minimize adverse impacts .
. In reviewing the ' landscape plan, the Planning Department has
suggested several modifications regarding material types ; sizes ,
aryl location. .

The property was advertised and was posted in three conspicuous
. places near the subject site. There is no apparent opposition
to the proposed church, .

11. The Planning Department report accurately sets forth the issues ,
findings of fact, applicable policies and provisions , and
departmental recommendations in this matter, and this report
itself , being uncontested, is hereby attached as Exhibit #1 and ,
incorporated into this report by reference as set forth in full
herein.
CONCLUSIONS : •
1 . The applicant indicated that he had reviewed the Planning
Department staff - report and has concurred with staff ' s
recommendations. The Examiner has reviewed and concurs with
the acceptance of the design; and approves the location, and
finds. that the proposed use is in compliance with all provisions ,
regulations , and standards as set forth in Ordinance No. 3050.
' 2 . After a thorough examination, it is the conclusion of the
Hearing Examiner that the church and its incidental activities
will not be unduly detrimental to adjacent or surrounding
properties or the enjoyment thereof.

to be in the city. The two other property owners want to be in
the city in order to obtain basic utilities , especially sanitary
sewers to be able to develop ,at urban densities . .
The percolation in this general area is very poor so sanitary
sewers are necessary to develop. Without municipal utilities
there is a question whether any further development would be
allowed at anything approaching suburban densities .
All of the property owners favored annexation and signed the ,
annexation petition . The Letter of Intent was presented to the
City Council on February 9 , 1976 (minutes attached) and a meeting
was established for February 23 , 1976 (minutes attached ) . At
that public hearing the council voted to accept the Letter of
Intent , established conditions and authorized the circulation of
the annexation petition . The petition was circulated and pre-
sented to the City Council on March 15 , 1'976 (minutes attached )
at which a public hearing was established for April 12 , 1976
(minutes attached ) . At that public hearing the council. accepted . ' .
the annexation petition and authorized the Notice of Intention
be prepared for the King County Boundary Review Board .

. 1. Topography : The site is generally level.o
2. Soils : Alderwood gravelly sandy loam, ,6-15% slopes: (AgC) .
Permeability is moderately rapid in the surface layer and
subsoil and very slow in the substratum. Runoff is slow
to medium, and the erosion hazard is moderate. This soil , .
is used for timber , pasture , berries , row crops, and for
. urban development .
. 3. Vegetation : The bulk of the subject site has been cleared
but mixed stands of deciduous and conifer trees line the
perimeter.
' Wildlife : The existing vegetation does provide some
h• abitat for birds • and small mammals.
5. Water : No water was observed on the subject site
(October 17, 1979) .
6. Land Use: The subject site is primarily undeveloped. .
However, one existing single family residence is located
on the property together with various accessory structures.

1. In ,March, of 1977 , the Renton First Church of the Nazarene '
obtained a special permit from the' IIea.ring Examiner to
construct a church on a site just north of the. .Honeydew
Elementary School on Union Avenue N.E. The special permit
allowed for a church of approximately 20 , 000 squire feet
set back approximately 300 feet from Union Avenue n.E.
and 100 feet from the northern property line . The appli-
cant has modified the; .t plans by upgrading the quality of
tilo exterior treatment of the bUilding, moving the struc-
ture forward approximately 150 feet and increasing the
structure e by 6 , 800 square feet to allow a full sized
gymnasium. V
2. In- the original review in 1977, it appears that several
points may have not been adequately addressed.
First , a minimum of a 100 foot setback is required, from
any other developed lot which is zoned residential . The
Honeydew Elementary School site to the south is zoned
GS-1. The property was annexed in July ,of 1959 and given
a GS•-i zoning classification , even though the school was
pre-existing on the site. 'In 1965, the Comprehensive Plan
designated the site into a Public/Quasi-Public Land Use
Classification. The site was 'never rezoned to P-1 because
there was never any reason to. The school was already
existing. The G zone is still a residential zone. However,.

Section 4-700( 3)( a)4. requires a 25-foOt landscaping strip
along all pr- ope:rty lines. It would appear that this is a
code requirement that the Hearing Examiner may not have

4. The church construction has been divided into three phases .
Phase 1 is presently under construction. It is composed
of the multi-purpose room/gymnasium. It complies totally
with the special' pe'rniit 'issued in 1977. Phases 2 and 3
include the sanctuary and the foyer. These are intended
- to be extended to the west of the original building site.
The structure' was moved to the west because the exterior
treatment of the building was upgraded to cedar finish
instead of metal and to allow better' access for fire
fighting. '

Dear Sir:
On March 22, 1977, the First Church of the Nazarene in Renton, '
Washington, requested at a public hearing, a special permit for location
of a church within a single family residence district. There was no
opposition. On March 29, 1977, the Hering Examiner approved the request.
(The file number is SP-003-77) . ,-
. ' Since that time we have revised our building to what we believe, ,
will be more compatible with the surrounding residential neighborhood.
We believe that by maintaining the 100 ft setback from the north property , =
line, and the 18 ft setback from the south property line, as permitted ,
under the special permit; moving the building forward to have a setback .

of approximately 150 ft would be more eye appealing to the community.
This would make our building have the same setback as the Honey Dew
Elementary School which is next door to the south. r
Our reason for moving the building forward is not only for eye appeal
from Union Avenue, but also for easier access for fire protection. We :
have counseled with Chief Geissler and are in full agreement with his '.
desires. Correspondence is attached for you review. - s
We believe that the above mentioned change is for the betterment of
the community and the fire protection of the property. We believe that
this change is within the scope of the original permit. Your concurrence
will be greatly appreciated.

With reference to Finding No. 16, it appears 'that the zoning category for
the subject,property was correctly identified in the Planning Department
Report as "G" (General; Single Family Residential; Minimum Lot Size -
35,000 sq ft) rather than the "GS.-1" (General; Single Family Residential;
Minimum Lot Size - 35,000 sq ft) indicated in the above Finding.
The error was due to the use of an incorrect version of the Zoning Map.
The City's Zoning Map has since been corrected. (See attached) .
The error, after reviewing the Examiner's Decision, does not appear to
be substantive and therefore would not change the decision.

REPORT AND RECOMMENDATION TO THE RENTON CITY COUNCIL,
APPLICANT: First Church of the Nazarene FILE NO. R-434-79,

PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on November 9, 1979.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on October 30, 1979. Responding to the applicant's request for
additional time to prepare final elevation plans and drawings, the Examiner continued the
hearing until November 13, 1979.
CONTINUANCE:
The hearing was opened on November 13, 1979 at 9:00 a.m. in the Council Chambers of
the Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as
Exhibit #1. °
Roger Blaylock, Associate Planner, reviewed Exhibit #1, and entered the following
additional exhibits into the record:

Mr. Blaylock corrected the following errors in Exhibit #1: Page 5, Section M. , #6
should read: "Exterior loud speakers shall not be permitted". He also corrected
Section I, line 2 on page 3, Population/Employment to read: "It could impact
with development of the eastern portion of the site. This will be estimated at the
time subdivision is presented. " .
The leltter from the Fire Chief to Pastor Lowell Welker was read by Mr, Blaylock.
The Examiner requested information as to whether there is a single family home
on the lot at the present time that is 100 feet from the church. Mr. Blaylock
advised that the home is occupied by the associate minister and is considered H ;
`to be parsonage.
The Ex miner asked for clarification as to whether a special permit had been
applied for, stating it appeared that the applicant is not working under the
special permit already approved and that new conditions would be different.

Mr. Blaylock responded that a building permit had been issued and the building
is now under construction. He stated there is a possibility variances for ad-
dition to the church will be sought. The Examiner replied he thought a variance
might be appropriate, but he did not have the power to rule and the Board of
Adjustment would be the proper authority. Mr. Blaylock requested information as
to whether this would be considered a completely new application or would just be
an expansion of the church. The Examiner responded that it was his belief that
the applicant had chosen not to exercise the previous special permit and is ap-
plying for a new permit. He stated that the previous special permit had not been
approved by the City Council and that this approval is necessary.
The Examiner inquired as to the size of the lot if the applicant complies with set-
backs on the east side. Mr. Blaylock responded that it would be approximately
50 to 600 of the remaining portion of the lot.
The Examiner requested testimony by the applicant. Responding was:

Mr. Welker, Pastor of the church and president of the corporation, stated that there
are unique problems with the lot dimensions. The total lot is 218 feet while it is
1280 feet in depth. In 1977 when the special permit was taken out, the church
discovered that there was a 100 foot setback that applies only to churches. On
the property to the north there is only one residence that is at all visible and
that is on Union Avenue. The rest is a virtual jungle out in the county. Because
there are two small dwellings, it is considered residential land and requires the
church to set back 100 feet. In this event, only 18 feet would be left on which
to build. In 1977 the church had intended to build a steel structure, a square
box with a flat roof, but felt it was not attractive and they would not be satis-
fied with that type of structure. Also, the original plan did not meet the
current requirements for ramps for handicapped people. It was discovered that
the redesigning of the steel building would have cost as much as the price of a
new design. There was a request from the Fire Dept. that the building be moved
forward in order that they could more adequately service the building. The church
and the school are in the city and the rest of the property on Union is in the
county.
The Examiner responded that, according to the provisions of code, Section 4-706(3)
a. 3 and 4, setback and landscaping requirements, he does not have the ability
to vary requirements and that would have to be done through a variance by the
Board of Adjustment. He stated that he may be able to issue a special permit subject to
the approval of a variance by the board and also subject to final approval of
the proposal by the City Council.
Mr. Welker referred to a letter to the Hearing Examiner which stated that the reason
they have gone to a rezone is because the area is residential and, should they
desire to develop it in the future, it would be easier to take care of both at
one time.
The Examiner requested testimony in support. Responding was:

Mr. Zanoni stated that he is in support of the application as builder of the project.
The Examiner requested further testimony in opposition. There was none and there
were no further comments from the Planning Department. Mr. Welker remarked that
when the original permit was issued there was no opposition from neighbors or
the community and that the neighbors have seen the building and are much more
pleased.
The hearing was closed at 9:40 a.m.

FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a reclassification of ±6.5 acres of property from
GS-1 (General; Single Family Residential; 35,000 square foot lot size) to SR-1
(Single Family Residential; 7,500 square foot lot size) and approval of a special
permit to permit the construction of a church on the reclassified (SR-1) site.
2. The Planning Department report sets forth the issues, applicable policies and
provisions, findings of fact, and departmental recommendations in this matter,
(is uncontested) , and is hereby attached as Exhibit #1 and incorporated in this
report by reference as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The subject property is located in the Highlands section of the city. The subject
parcel is ±218 feet wide by ±1,278 feet deep. The site is generally level. The
front portion of the subject site has generally been cleared for building purposes.
The rear portion of the site has mixed stands of conifers and deciduous trees.
8. The subject site was annexed into the city by Ordinance No. 3058 in August of 1976,
and the present zoning classification was applied at that time. On March 29, 1977,
the Hearing Examiner approved a special permit to permit the construction of a
church on the subject site. On November 5, 1979, a building permit was issued for
one phase of construction.
The special permit was not approved by the City Council as required by Section 4-706 (3)
and the setbacks and landscaping required by Section 4-706 (3) (a) 3 and 4 were not
complied with.
9. The applicant proposes developing a church on the portion of the property fronting on
Union Avenue NE. The remainder of the parcel would eventually be developed with
single family residences.
10. Currently construction of a foundation for a proposed gymnasium is underway. The
site is also occupied by an existing residence and a temporary structure used as an
office for overseeing the various construction projects. The existing residence is
proposed to be used by the church as a parsonage.
11. The site is bounded on the south by the Honeydew Elementary School which is located
in the same GS-1 zone as the subject site. The northern boundary of the subject site
is also the boundary for the city limits. The property to the north is zoned for
single family residential use and a single family home is located on the adjoining
site to the north.
Across Union Avenue NE, to the west, the property is zoned S-1 (Single Family; 40,000
square foot lot size) , SR-1, and R-1 (Single Family, 7,200 square foot lot size) .
12. Traffic counts have not been derived for church related activities, but estimates
based on square footage, seating capacity and required parking indicate that
attendance at services would generate a minimum of approximately 180 trips per week
(based on the required 90 parking stalls) .
13. The Comprehensive Plan designates the area in which the subject property is located
as suitable for the development of single family residences.
Established lot size in the area varies from large multi-acre sites to the more
common range between 7,200 square feet and 15,000 square feet.

14. Churches meeting certain enumerated requirements are permitted by special permit in
residential, including single family zone, districts (Section 4-706 (3) ) .
Among those requirements is a setback of 100 feet from all developed property which is
located in residential zones; 25 feet of landscaping along all non-right-of-way
property lines; parking not less than 25 feet from developed residential lots; and
adequate provision for proper traffic flow and circulation (Section 4-706(3) (a) 3, 4, 5
and 8 respectively) .
15. The applicant proposes instead an 18 foot setback from the Honeydew School site to the
south; similarly only 18 feet of landscaping; and parking stalls less than 25 feet
from a residential lot are to be provided.
In addition, there has been no provision left for access to the rear portion of the
lot which the applicant proposes to develop separately. Access as presented in the
site plans (Exhibit #3) would have to be through the parking area and under a
covered drive immediately adjacent to the church.
16. The Planning Department report (Section A; Summary) identifies the zone as G whereas
the site is presently zoned GS-1.
CONCLUSIONS:
REZONE
1. The proponent of a rezone must demonstrate compliance with at least one of the three
criteria listed in Section 4-3014 which provides in part that:
a. The subject site has not been considered in a previous area-wide rezone or land
use analysis; or
b. The subject site is potentially zoned for the new classification per the Com-
prehensive Plan; or
c. There has been demonstrated changes in the development pattern in the area since
the last rezoning action.
The applicant has demonstrated that the necessary criteria to permit the rezone of
the subject property has been met.
2. The Comprehensive Plan designates the area in which the subject property is located
for single family development. The applicant proposes to use the property for a
combination of purposes, including the eventual construction of single family homes
on part of the site, and the construction ofa church on the remainder of the site.
Under terms of the zoning code, churches may be established in single family re-
sidential zones by special permit and therefore, both proposed uses may be per-
missable under the Comprehensive Plan.
3. Adjoining zoning districts in the vicinity are a mix of densities and the proposed
classification, SR-1, would be compatible with these surrounding zones. To the west
is another small SR-1 zone and an R-1 (Single Family, 7,200 square foot lot size)
zone. There is also a G-7200 (Single Family; 7,200 square foot lot size) zone just
south of Honeydew Elementary School.
4. The area has been the site of recent developments along Union Avenue NE and the
proposed change of zoning classification to SR-1 would be appropriate at this time.
Preliminary Hearing Examiner approval of a rezone, also to SR-1, and of a subdivision
just north of Kiwanis Park has occurred within the last six months.
5. The area is serviced by both water and sewer and therefore, the potential development
will not impact city services or the public health or welfare and the rezone from
GS-1 to SR-1 should be approved.
SPECIAL PERMIT
6. The applicant for a special peiiuit must demonstrate that the proposal is in compliance
with the provisions of the zoning code authorizing the issuance of a special permit.
The applicant has failed to demonstrate that the proposed church complies with the
various landscape, setback, and parking requirements of Section 4-706 (3) (a) . The
plans, in fact, demonstrate that the proposal fails to satisfy these requirements.

7. The church building will be located within 18 feet of the Honeydew Elementary
School property, which is located in the same GS-1 residentially zoned and
developed lot as the proposed church (Section 4-706(3) (a) 3) .
8. Also the landscaping and parking as proposed will not meet the requirements of
the zoning code. There will be only 18 feet of landscaping on the site along
the south property line adjoining the Honeydew site and parking is proposed to
be developed also within 18 feet of the property line. Both features violate
the requirements of the zoning code (Section 4-706(3) (a) 4 and 5) .
9. The proposed development of the eastern (internal) portion of the site with
single family residences will create potential traffic access and safety problems.
Currently there is no access to the rear portion of the subject property without
first passing through the site of the proposed church and passing under a covered
drive immediately adjacent to the church building. Section 4-706(3) (a) 8 requires
provision for both actual and anticipated traffic and access problems. The
present site development plans would create a landlocked parcel surrounded by
large parcels in separate ownership to the north and east, and a large school
site to the south. Access through the front portion of the site would be
circuitous and hazardous.
10. While the parcel is relatively large, it is too narrow to support the construction
of the proposed church. The parcel is only about 218 feet wide. The zoning code,
in deference to single family zoned land, requires an expansive 100 feet of setback
between proposed churches and single family zoned and developed lots. This re-
quires a total setback of 200 feet if adjoining lots on both sides are zoned
residential and developed.
The subject proposal requires under this provision 200 feet of setback, leaving 18
feet of building space. There is a single family home developed north of the subject
property in a King County residential zone and the Honeydew Elementary School
developed in a GS-1 residential site immediately south of the subject proposal.
The code does not exempt non-residential development from these provisions.
11. Similarly, the proposal cannot comply with the landscape and parking requirements
because of the lot size, again providing only 18 feet for parking setback and
landscaping.
12. The zoning code does not authorize nor permit the examiner to deviate from the
enumerated requirements and therefore the special permit should be denied.
RECOMMENDATION:
The reclassification of the subject property from GS-1 to SR-1 should be approved.
The special permit should be denied.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before December 5, 1979. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery of new evidence which could not be reasonably available at the
prior hearing may make a written request for review by the Examiner within fourteen (14)
days from the date of the Examiner's decision. This request shall set forth the specific
errors relied upon by such appellant, and the Examiner may, after review of the record,
take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection in
the Finance Department, first floor of City Hall, or same may be purchased at cost in
said department.

D. PHYSICAL BACKGROUND:
1. Topography: The site is generally level.
2. Soils: Alderwood gravelly sandy loam, 6-15% slopes (AgC) .
Permeability is moderately rapid in the surface layer and
subsoil and very slow in the substratum. Runoff is slow
to medium, and the erosion hazard is moderate. This soil
is used for timber, pasture, berries , row crops, and for
urban development .
3. Vegetation : The bulk of the subject site has been cleared
but mixed stands of deciduous and conifer trees line the
perimeter.
4. Wildlife : The existing vegetation does provide some
habitat for birds and small mammals.
5. Water : No water was observed on the subject site
(October 17, 1979) .
6. Land Use: The subject site is primarily undeveloped.
However, one existing single family residence is located
on the property together with various accessory structures.
Honeydew Elementary School is located directly to the
south of the subject site. There are existing single
family residences located north of the site and west of
the site across Union Avenue N.E. Kiwanis Park is located
north and west of the subject site across Union Avenue N.E.
E. NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties are primarily single family resi-
dential with some mixed public/quasi-public uses,
F. PUBLIC SERVICES :
1. Water and Sewer: A 12" water main and 15" storm sewer
run north-south on Union Avenue N.E. adjacent to the
subject site, while an 8" sanitary sewer extends east-
west on N.E. 10th Street within 700 feet to the north
of the property.
2. Fire Protection : Provided by the Renton Fire Department
as per ordinance requirements.
3. Transit : Metro Transit Routes 107 and 108 operate along
Union Avenue N.E. adjacent to the subject site.
4. Schools: The Honeydew Elementary School is adjacent to
the subject site on the south, while McKnight Middle
School is approximately 1i miles to the northwest , and
Hazen High School is within 3/4 of a mile to the north-
east .
5. Recreation: The grounds of the Honeydew Elementary
School and Kiwanis Park provide good opportunities for
nearby recreation.

The subject site was annexed into the City by Ordinance 3058
dated August 24, 1976 , at which time the present zoning classi-
fication was applied. On March 29, 1977, the Hearing Examiner
approved a special permit for church facilities on the site
(reference file SP-003,77) . A building permit was issued on
November 5, 1979, for one phase of the church. construction.

L. PLANNING DEPARTMENT ANALYSIS - SPECIAL PERMIT:
1. In March of 1977, the Renton First Church of the Nazarene
obtained a special permit from the Hearing Examiner to
construct a church on a site just north of the Honeydew
Elementary School on Union Avenue N.E. The special permit
allowed for a church of approximately 20 ,000 square feet
set back approximately 300 feet from Union Avenue N.E.
and 100 feet from the northern property line. The appli-
cant has modified their plans by upgrading the quality of
the exterior treatment of the building, moving the struc-
ture forward approximately 150 feet and increasing the
structure by 6 , 800 square feet to allow a full sized
gymnasium.
2. In the original review in 1977, it appears that several
points may have not been adequately addressed.
First , a minimum of a 100 foot setback is required from
any other developed lot which is zoned residential. The
Honeydew Elementary School site to the south is zoned
GS-1. The property was annexed in July of 1959 and given
a GS-1 zoning classification , even though the school was
pre-existing on the site. In 1965, the Comprehensive Plan
designated the site into a Public/Quasi-Public Land Use
Classification. The site was never rezoned to P-1 .because
there was never any reason to. The school was already
existing. The G zone is still a residential zone. ;, However,
in this particular case, it is not developed with residences.
Therefore, it is not seen as a requirement in the opinion
of the Planning Department .
Secondly, the Hearing Examiner in 1977 approved the build-
ing location only 18 feet from the southern property line.
Section 4-706(3)( a)4. requires a 25-foot landscaping strip
along all property lines. It would appear that this is a
code requirement that the Hearing Examiner may not have
had the authority to modify. However, a building permit
has been issued on the site for the construction of a
church as originally allowed, and it would appear that the
church now has vested interests in the site plan as
approved, and the structure is a legal non-conforming
structure in regard to setback.
3. The site plan complies with the other requirements as
• designated in Section 4-706(3) except for the rear parking
lot setback from the southern property line. It will have
to be set back 25 feet instead of the 18 feet shown. This
will reduce the parking by 4. However, the parking lot
is still above the required 90 parking spaces . The size
of the sanctuary has not changed from the original plans.
Therefore, the parking required still remains the same,
90 parking spaces.
4. The church construction has been divided into three phases.
Phase 1 is presently under construction. It is composed
of the multi-purpose room/gymnasium. It complies totally
with the special permit issued in 1977. Phases 2 and 3
include the sanctuary and the foyer. These are intended
to be extended to the west of the original building site.
The structure was moved to the west because the exterior
treatment of the building was upgraded to cedar finish
instead of metal and to allow better access for fire
fighting.

1.' Natural Systems : Rezone of the subject site will not have
a direct impact on the property. However, subsequent devel-
opment will remove the soils, disturbing the vegetation.

can be mitigated.

available for churches from the Traffic Engineering Divi-
sion. Therefore, given an estimate of two trips/week/
parking space, a total of 180 trips/week would result
(based on 90 required stalls) . It should be noted,' how-
ever, that these trips will all occur at the same time.
J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton ' s Environmental Ordinance and
the State Environmental Policy Act of 1972, as amended, RCW
43-21C, a declaration of non-significance has been issued
for the subject proposals (see attached) .

1. The proposed rezone from G to SR-1 is consistent with the

2. The subject site was annexed in 1976. Since that time ,
no area-wide or site rezoning requests have been considered
on the site.
3. Items 1 and 2 appear to comply with Section 4-3014 of the
Renton Municipal Code, thus substantiating the proposed
rezone.
M. DEPARTMENTAL RECOMMENDATION:
Approval of the requested rezone from G to SR-1 based upon the
compatibility of the proposed use with existing uses and the
fact that the site has not been previously considered by an
area--7ide zoning review, and being consistent with. the Compre-
hensive Plan land use element designation of single family
residential.

5. A revised landscape 'plan has not been submitted. However,
care should be taken to insure. that proper screening is
required to reduce the visual impact. The church has
been set back the same distance from Union Avenue N.E.
as the Honeydew Elementary School to be compatible with
the school instead of dominating that side of the street .
6. Many large significant evergreen and deciduous trees exist
on .the site from the house eastward to the property line.
Retention of the trees should be encouraged as part of the
total landscape and development plan.
7. A screen fence was suggested as a possible addition along
the northerly landscape strip; however, propery landscap-
ing will be more effective than a fence.
M. DEPARTMENTAL RECOMMENDATION:
Approval of the requested special permit , file number SP-433-79,
subject to the following conditions :
1., Revision of. the landscaping strip on the southern boundary
of the rear parking to a width of 25 feet.
2. Final Planning Department approval of detailed landscape
plans including the revisions noted in "L" and
the retention of existing. trees wherever possible.
Removal of trees shall be subject to prior approval of
the Renton Planning Department in accordance with detailed
landscape plans.
3. Final Planning Department approval •of screening methods
along the north and south property lines.
4. Posting of a bond or other approved means of insuring
proper landscaping installation and maintenance as per
ordinance requirements.
5. Parking lot lighting shall be of low height and intensity
tc reduce glare and light intrusion to adjacent single
family residence.
6. Exterior loud speakers shall be permitted.
7. The. portion of the site not developed at this time shall
be retained in its natural state, and any future plans •
for this area shall be approved by the Examiner.
The purpose of these requirements is to reduce the impact of the
proposed development in the adjacent single family residences
and retain the general character of the area.

Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCM, requires
all state and .local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals,. The Act also requires that an EIS be
prepared for all major,actions si,gffificantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
