Gordon, Manager Industrial Development and Property Management Department Room 700 Central Building Seattle, Washington 98104 RE: Burlington Northern, Inc. , Special Permit, SP-451-79 Dear Mr. Gordon: The Environmental Review Committee has considered your letter of February 12, 1981 , in response to our correspondence of February 6 , 1981 . The Environmental Review Committee does not share your conclusion regarding that you had pre-established rights to fill the sight by the fact of your original permit request. Environmental matters are considered at the time of the application for the permit request. Your action of withdrawing the request to fill the site to allow the City the opportunity to purchase the subject property is irrelevant to the environmental concerns of the City. It is the position of the Environmental Review Committee that the Burlington Northern Company has either the option of preparing the additional study on drainage or addressing the entire situation in a supplemental environmental impact • statement. Our comments are as follows: 1 . The proposed fill is inconsistent with the intent and purpose of the Valley Interim Policy and Regulatory Plan. The purpose of the plan is to minimize flooding and surface water problems in the Valley by preventing and/or restricting landfill in floodplain areas until flood protection projects (e.g. , East Side Watershed Project) are completed. Under condi- tions of the plan, this fill proposal would either be precluded all together since there already exists a large inventory of filled, uncle- , veloped land in the area or restricted to no more than half the site. Although the interim plan has not yet been adopted by the City of Renton, these considerations are no less important since the fill is proposed in the 100 year flood plain identified under the HUD Flood Insurance Program. 2. Local sponsors will soon. begin a program of right-of-way acquisition for the East Side Watershed Project including both permanent and temporary construction easements. Substantial acreages will be required for excava- tion disposal sites particularly in areas where major storage ponds are proposed, such as is the case in this area with the Renton wetland pond site to the immediate west. Increasing development along the channel right-of-way will continue to reduce options the local sponsors have to acquire these lands in close proximity to locations where channel/pond excavation occurs. Consideration should be given to the potential this fill will have for future development oh the site and how such development could affect local sponsors ability to acquire such lands in the future. 3. Efforts are currently underway by the Soil Conservation Service to begin preliminary engineering design and site planning for the Watershed Project. An important part of the design work will include analyses to determine o storage ponds such as the Renton wetland can be designed to enhance LLD i h and wildlife purposes.
