RE: Burlington Northern, Inc. , Special Permit, SP-451-79
Dear Mr. Gordon:
The Environmental Review Committee has considered your letter
of February 12, 1981 , in response to our correspondence of
February 6 , 1981 . The Environmental Review Committee does
not share your conclusion regarding that you had pre-established
rights to fill the sight by the fact of your original permit
request. Environmental matters are considered at the time
of the application for the permit request. Your action of
withdrawing the request to fill the site to allow the City
the opportunity to purchase the subject property is irrelevant
to the environmental concerns of the City.
It is the position of the Environmental Review Committee
that the Burlington Northern Company has either the option
of preparing the additional study on drainage or addressing
the entire situation in a supplemental environmental impact

RE: BURLINGTON NORTHERN INC.
SPECIAL PERMIT SP-451-79.
Dear Mr. Blaylock:
Please refer to your letter of February 6 concerning the Environmental
Review Committee's conclusion regarding our permit application to fill
approximately 24.35 acres of land between S.W. 27th and S.W. 30th
Streets.
I believe their recommendation overlooked the fact that our original
permit request was made prior to several other fill permits which were
issued for property north of ours and the only reason the property is
not filled today is because we withdrew the subject property from the
original fill permit application at the City's request to allow them
to see if they could fund the purchase of the subject property.
I feel that if the study is required as mentioned in the last paragraph
of your letter that it should be done by the City as a return to the
Railway Company for withdrawing the property from the original appli-
cation and as a result the Railway Company facing a much great cost
of development of its property.
Yours very truly,
lefIV

and grading permit by the Burlington Northern company on
a 24-acre site on the east side of Lind Avenue S .W. The
City of Renton has issued a declaration of significance for
the proposal .
The property was originally considered as an optional wetland
area adjacent to the City of Renton ' s wildlife habitat area
of approximately 20 acres . It was determined that this site
would have a substantial impact on the City of Renton ' s 20-
acre site and upon the floodway fringe in the Green River
Basin Drainage Program . The City of Renton wishes to take
a very cautious position concerning the filling of any additional
areas within the Green River Basin. Total impacts will have
to be evaluated in detail as each project is proposed .
Therefore , we request that the ,application for a flood control
zone permit be held until the applicant provides a detailed
environmental impact statement addressing the drainage problem .
Very truly yours,

RE : SPECIAL PERMIT APPLICATION FOR GRADING & FILL/SP-451-79
Dear Mr . Kretzer :
The City of Renton has issued a final declaration of significance
on the proposed project . The request to fill 24. 35 acres
with approximately 295 ,000 cubic yards of fill has been determined
to be within the floodway fringe as identified on the preliminary
flood boundary and floodway map from the Department of Housing
and Urban Development . The proposed fill will result in
significant modifications to the regional flood control program .
In addition , the fill substantially impacts the 20 acres
of wetland habitat owned by the City of Renton immediately
adjacent to the subject site on the west . At the time of
the original final plat approval in February of 1979 , the
subject site was identified as a optional wetland area to
possibly be used for wildlife mitigation. A detailed analysis
to determine the impacts of any development within this 39
acres was anticipated at that time .
Therefore , the City of Renton will hold the proposed application
until an environmental impact statement has been prepared
for the subject fill by the Burlington Northern corporation .
The environmental impact statement' is issued by the City
of Renton ; however , the applicant must bear the cost of providing
the impact statement . The Burlington Northern company can
suggest names of several environmental consultants to prepare
the impact statement and if the City concurs , the City will
actually be the employer of the consultant which prepares
the impact statement .
We have transmitted a copy of the declaration of significance
to King County Hydraulics in response to the application
for a flood control permit . It is our understanding that
King County will not proceed any farther with the application

until the environmental situation is resolved. Please contact

that there will be lengthly discussions concerning the preparation
of the environmental impact statement and the exact procedures

Subject: BURLINGTON NORTHERN FILL PROPOSAL
We have reviewed the subject application for a flood control zone permit
to place fill adjacent to the Renton wetland. Our comments are as follows:
1 . The proposed fill is inconsistent with the intent and purpose of the
Valley Interim Policy and Regulatory Plan. The purpose of the plan is
to minimize flooding and surface water problems in the Valley by preventing
and/or restricting landfill in floodplain areas until flood protection
projects (e.g. , East Side Watershed Project) are completed. Under condi-
tions of the plan, this fill proposal would either be precluded all
together since there already exists a large inventory of filled, uncle-
, veloped land in the area or restricted to no more than half the site.
Although the interim plan has not yet been adopted by the City of Renton,
these considerations are no less important since the fill is proposed
in the 100 year flood plain identified under the HUD Flood Insurance
Program.
2. Local sponsors will soon. begin a program of right-of-way acquisition for
the East Side Watershed Project including both permanent and temporary
construction easements. Substantial acreages will be required for excava-
tion disposal sites particularly in areas where major storage ponds are
proposed, such as is the case in this area with the Renton wetland pond
site to the immediate west. Increasing development along the channel
right-of-way will continue to reduce options the local sponsors have to
acquire these lands in close proximity to locations where channel/pond
excavation occurs. Consideration should be given to the potential this
fill will have for future development oh the site and how such development
could affect local sponsors ability to acquire such lands in the future.
3. Efforts are currently underway by the Soil Conservation Service to begin
preliminary engineering design and site planning for the Watershed Project.
An important part of the design work will include analyses to determine
o storage ponds such as the Renton wetland can be designed to enhance
LLD i h and wildlife purposes. The value of these sites for such multiple
'A poses will also be dependent upon the manner in which adjacent
a N 2 r perties are developed and the controls established to minimize the
adverse effects of that development on the wetland habitat. To that end,

if the site is to be filled, the applicant should submit both temporary and
permanent-erosion and sediment control plans demonstrating how these impacts
on the Renton wetland will be mitigated. These plans should be approved
prior to further permit approvals.

Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires •
• all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
•
Please answer the following questions as completely as you can with the information
presently available to you. Where explanations of your answers are required, or where
• you believe an explanation would be helpful to government decision makers , include your
explanation in the space provided, or use additional pages if necessary. You should
include references to any reports or studies of which you are aware and which are rele-
vant to the answers you provide. Complete answers to these questions now will help all
agencies involved with your proposal to undertake the required environmental review with-
out unnecessary delay.
The following questions apply to your total proposal , not just to the license for which
you are currently applying or the proposal for which approval is sought. Your answers
should include the impacts which will be caused by your proposal when it is completed,
even though completion may not occur until sometime in the future. This will allow all
of the agencies which will be involved to complete their environmental review now, with-
out duplicating paperwork in the future.
NOTE: This is a standard form being used by all state and local agencies in the State
of Washington for various types of proposals . Many of the questions may not apply to
your proposal . If a question does not apply, just answer it "no" and continue on to the
next question.

Pursuant to our previous conversation regarding the Plan-
ning Commission action on the Burlington Northern fill per-
mit for the Orillia Industrial Flat , we have further
reviewed the Planning Commission records regarding the
Burlington Northern fill permit for the Orillia Industrial

Commission specifically withheld approval of this wetland
area in order to provide flood storage within the basin
area until such time as permanent flood control measures
have been designed and implemented. Therefore, a new
application for fill permit for this area is required.
