The Planning Department has noticed several items
that appear to need attention . These include :
1 . The Scarsella Pond has been almost
totally filled . It appears that no
provisions for drainage control have
been provided , causing the flooding of
the adjacent property to the south . This
should be brought to the developer ' s
attention and corrected . -
2 . There also appears to be recent fill being
placed on the Welch property immediately
north of the Scarsella property. Have any
permits been approved for this fill ?
3 . The Ericksen Construction Company building
on East Valley Road still has not installed
the required landscaping , parking , and pav-
ing . The new sidewalks and curbs have been
installed and a detailed landscape plan
should be submitted and reviewed .

4 . The new Jonathan storage facility on East Val -
ley Highway proposed open paved parking/storage
area . We had previously suggested alternatives
that they may consider . What is the status of
this portion of the project?
5 . The new Bitney-Grouws warehouse at Lorreacres
Industrial Park on S . W. 16th St . does not
conform to the approved parking and landscape
plans . This should be corrected .
6 . It appears that Renton/ Issaquah Auto Freight
is using previously undeveloped property for
expansion of the truck/trailer storage opera-
tion, Plans for such use should be submitted
and. approved as per ordinance requirements .
7 . The Landscaping Contractor ' s storage area just
west of Lind Ave . and south of Grady Way has
not yet provided any landscape screening as
per ordinance requirements .
8 . It appears that Reimer: Auto Parts is prepar-
ing to develop or add to their existing opera-
tion. If so , . plans will need to be submitted .

Reference was made to a letter from the Soil Conserva-
tion Service at the public hearing meeting on Decem-
ber 15 , 1975 , regarding the above matter .
In actuality, the letter referred to was a memorandum
to the files from Mike Smith regarding a conversation
with Bill Cokely of the Soil Conservation Service
concerning the subject pond . Comments in the memoran-
dum are as reported by Mike , but this does not con-
stlitute an official comment or letter from the Soil
Conservation Service .

William G. Moran. Councilman Perry left the Council Chambers and took no part in any
Rezone • discussion nor in any action regarding this matter. Upon inquiry
Continued by Councilman Stredicke, Planning Director Ericksen noted rezone
would allow applicant to convert existing home to duplex and is
across the street from R-3 zoning; that if used for any other purpose

Isle & Lake Addn. Letter from Planning Director Ericksen further reported Planning Com-
Pickle Final Plat mission recommendation for Council approval of Final Plat of Lyle L.
#FP-846-75- Pickle for Isle and Lake Addition, a residential subdivision located
on the north side of N. 38th St. between Lake Washington Blvd. N. :and'
Park Ave. N. The letter noted existing use as one single family
residence with proposed use of nine lot single family residential•
subdivision, being in agreement with the Comprehensive Plan and '
noted conformance with the City's Subdivision Ordinance for the two
acres. MOVED BY CLYMER, SECONDED BY SCHELLERT, COUNCIL CONCUR IN
RECOMMENDATION OF THE PLANNING COMMISSION RECOMMENDATION AND REFER TO
THE LEGISLATION COMMITTEE FOR PROPER ORDINANCE. CARRIED.
Renton Management Letter from the Renton Management Association donated $100 for flood
Association relief to help alleviate suffering and hardship of community members;
Donation donation being forwarded to the Maple Valley Flood Relief Fund.
Street Vacation Letter from Public Works Director Gonnason reported cost analysis
N.W. 5th between used in determining fair value for that portion of N.W. 5th Street
Lind & Stevens N.W. between Lind Ave. N.W. and Stevens Ave. N.W. , proposed street vacation
requested by Gary Vigoren. The total 12,000 sq. ft. is listed at '
$5,800 with half testimated value $2,900, the cost for each of the
four abutting ,property owners is calculated at $725. MOVED BY
SCHELLERT, SECONDED BY GRANT, COUNCIL REFER THE MATTER TO THE LEGISLA-
TION COMMITTEE. CARRIED.
Flood Damage Letter from Public Works Director Gonnason submitted preliminary
Cedar River damaged caused by recent Cedar River flooding which is being coordi-
nated with State and Federal agencies to effect Disaster Fund applica-
tions. Bank erosion between Logan Ave. bridge and mouth of Cedar River
$50,000; bank erosion upstream from Logan Bridge $10,000; Park Depart-
ment landscaping $10,000; wash-out upstread from half-bridge $30,000
to $.40,000; gravel deposits at mouth of Cedar $300,000 to $400,000;
May Creek $50,000, total estimate from $450,000 to $560,000 food
damage. The letter reported preliminary investigations indicate no
structural damage to any of the City's major bridges and structures
, including -the Library and City Hall ; also reporting diversion works
around Springbrook Watershed operated successfully. The letter noted
the Department was hopeful that a substantial portion of repairs may
be accomplished by Disaster Relief Funds.

committee report recommended that the Council concur in the request

I talkgd today with Bill Cokely of the Soil Conservation
Service and asked him if they had received any additional
input or information regarding the Scarsella pond . He
said that he hadn ' t and that they still felt that it was .
a poteOtially valuable wildlife area . However, he indicated
that the Soil Conservation Service designations were only
recommendations of areas that are presently suitable for
wildlife habitat and that if the City Council approved the
filling of the pond with the idea of studying and recom-
mending specific acceptable alternate wetland areas , S . C . S .
would hot object. He said that the fact remains that a
decision has to be reached on these specific areas at some
point prior to the continuation of the S . C . S . Drainage
Project .
He further stated that because of the physical characteris-
tics of the Valley area , suitable wetlands areas could be
created on previously unfilled sites almost anywhere in
the Valley .. Because of this condition , he felt that the -
areas chosen would not necessarily have to be confined to
those shown on the S . C . S . wetland map . However , he did feel
that at some point in time a decision would have to be made ,
preferably before all the choice wetland areas are filled .
The industrial drainage and wetland area study now being
conducted by the Planning Department through H . U . D . will
answer; the critical questions regarding wetland wildlife

habitat and industrial drainage in the Valley area and will
give the City Council the necessary information to make the
specific determinations needed to comply with the require-
ments of the Soil Conservation Service Valley Drainage
Channel project .

regarding the request being in agreement with the Comprehensive
Plan, the amount of landscaping meeting requirement for the site,
location of the parking and storage areas, remarks were concluded.

CLOSED. MOTION CARRIED.
Moved by Grant, seconded by Stredicke, the matter of Appeal by
Scarsella Bros. , Inc. of the Planning Commission decision denying

December 8. Roll Call vote was requested and resulted as follows:

the Scarsella Bros. appeal be granted overturning the Planning Commission
decision to deny permit for entire parcel of property subject to con-
ditions set forth in letter of 9/26/75 authored by Michael Smith,
Assistant Planner. Amendment proposed by Stredicke for restrictions
was withdrawn when Planning Director advised final plans would necessi-
tate Planning Commission approval . After some lengthy debate, Perry
moved for the previous question, seconded by Delaurenti with roll call
as follows: Aye: 4, Delaurenti , Perry, Clymer and Bruce; No: 3,
Stredicke, Grant and Schellert. Motion failed lacking 2/3 majority
vote. Motion proposed by Stredicke that any development of the property
adhere to the E. I .S. 1975 plot plan, next to last page of that plan.
Motion failed for lack of second. Moved by Schellert, seconded by
Bruce, the previous question be put to vote. Roll call vote was
requested resulting as follows: Aye: 4, Delaurenti , Clymer, Bruce
and Schellert. No: 3, Perry, Stredicke and Grant. Failed for lack
2/3 majority vote.
Councilman Grant inquired as to specific aspects of knowledgeability
of the Council members in the matter. Mr. Austin noted that most of
the answers to the questions posed could be found in the E. I .S. , Council-

needing to be looked at, as well as that area approved by the Commission

Gentlemen :
The Planning Commission at its public hearing of
September 24 , 1975 , approved a partial permit with condi -
tions for Scarsella Brothers , Inc . for the westerly 300
feet of the proposed site . The conditions are defined
in detail in the staff letter of September 26 , 1975 , and
the Planning Commission committee. and staff reports . This
approval came only after extensive deliberations on the part
of the Planning Commission and the applicant and including
the preparation of both a Draft and Final Environmental
Impact S.tatements. _.due to the special nature of the site in
question.

The purpose of the Planning Commission approval was
to allow the applicant to proceed with initial development
of his property and at the same time preserve on an interim
basis the existing pond area on the site . The pond area in
question encompasses approximately three acres of the total
5 . 8 acre site and has -been designated by the Soil Conserva-
tion Service as part of the wetland areas to be retained
for mitigation purposes in the Green River Watershed Pro-
ject .
The proposed use of the site by the applicant is con-
sistent with existing City of Renton Comprehensive Plan
designating the area as manufacturing park and said prop-
erty being zoned to M-P in July 1974 upon recommendation

of the Planning Commission . The revised Comprehensive
Plan , as recommended by the Commission to the City Council
in June 1975, however , redesignates the pond area as green-
. belt. The intent of such greenbelt classification is to
preserve• the area as a permanent wetland wildlife habitat.
Recognizing inherent conflicts between existing and
proposed Comprehensive Plans and the recommendations of
the Soil Conservation Service , a request for a grant to
study the long-term effects of the Green River Watershed
Project on wildlife or wetland habitats in the City of
Renton was initiated and funds were received for such
prupose in September of this year. The study is pre-
sently in progress with the completion date scheduled for
the end of December of this year .
The Planning Commission in its deliberations felt the
applicant should be allowed to proceed with reasonable
development of his property, but at the same time felt
that granting approval of the entire site as requested
might result in further complications in the undertaking
of the Valley Drainage Project. Commission members further
felt that they were not in a position to make a determina-
tion which could potentially override the commitments
already made by the City Council .

RE : SCARSELLA BROTHERS APPEAL OF
PLANNING COMMISSION DECISION
The above matter will be coming before the City Council
for public hearing on Monday, November 17th . A basic
question to be considered by the Council is whether or
not the Planning Commission acted reasonably in approving
a partial permit rather than a permit for the entire fill
as requested .
The Planning Commission was concerned over the potential
conflict with Soil Conservation Service plans and the
recommended revised Comprehensive Plan for the Valley.
Since the revised Comprehensive Plan is presently under
study by your Committee and the H . U . D . Study is presently
in progress , referral to your committee 4nd detailed
study might be desirable prior to taking final action .
I would be happy to bring you up-to-date on the status
of this matter at your request.

Gentlemen :
The Planning Commission at its public hearing of
September 24, 1975 , approved a partial permit with condi -
tions for Scarsella Brothers , Inc . for the westerly 300
feet of the proposed site . The conditions are defined
in detail in the staff letter of September 26 , 1975, and
the Planning Commission committee and staff reports . This
approval came only after extensive deliberations on the part
of the Planning Commission and the applicant and including
the preparation of both a Draft and Final Environmental
Impact Statements due to the special nature of the site in
question .
The purpose of the Planning Commission approval was
to allow the applicant to proceed with initial development
of his property and at the -same time preserve on an interim
basis the existing pond area on the site . The pond area in
question encompasses approximately three acres of the total
5 . 8 acre site and has been designated by the Soil Conserva-
tion Service as part of the wetland areas to be retained
for. mitigation purposes in the Green River Watershed Pro-
ject.
The proposed use of the site by the applicant is con-
sistent with existing City of Renton Comprehensive Plan
designating the area -as manufacturing park and said prop-
erty being zoned to M-P in July 1974 •upon recommendation

of the Planning Commission . The revised Comprehensive
Plan , as recommended by the Commission to the City Council
in June 1975, however , redesignates the pond area as green-
belt. The intent of such greenbelt classification is to
preserve the area as a permanent wetland wildlife habitat.
Recognizing inherent conflicts between existing and
proposed Comprehensive Plans and the recommendations of
the Soil Conservation Service , a request for a grant to •
study the long-term effects of the Green River Watershed
Project on wildlife or wetland habitats in the City of
Renton was initiated and funds were received for such
prupose in Septemb.gr of this year. The study is pre-
sently in progress with the completion date scheduled for
the end of December of this year.
The Planning Commission in its deliberations felt the
applicant should be allowed to proceed with reasonable
development of his property, but at the same time felt .
that granting approval of the entire site as requested
might result in further complications in the undertaking
of the Valley Drainage Project. Commission members further
felt that they were not in a position to make a determina-
tion which could potentially override the commitments
already made by the City Council .

Planning Commission -of the City of Renton taken at their meeting
of September 24, 1975, on the application of Scarsella Brothers, Inc.
for approval of a filling and grading permit and site plan approval
per the application on file and the final Environmental Impact
Statement on file.
The action of the Planning Commission was to grant a partial
permit fot a westerly portion of the property and the undersigned
appeals from that action and the denial of the remainder of such
application for the easterly portion of the property.
The undersigned requests a public hearing before the City Council
on this appeal at the earliest possible date.

Public Hearing The Clerk read announcement from the Puget Sound Air Pollution Control
Puget Sound Air Agency that there will be a Public Hearing held Thursday, November 20,
Pollution Control 1975 to consider a proposal to replace Section 9.02 governing outdoor
Agency fires with Article 8 having the same outdoor fire requirements. The
Public Hearing will be held at 9:30 A.M. in the Commissioners Audito- _
rium, Port of Seattle, Pier 66, Seattle.
State Audits of Letter from Public Works Director Gonnason was read for informational
City Construction purposes on the State Audits of City Construction Projects and stated
Projects that during June and July of this year, the State performed audits of
nine completed UAB projects, including S. 2nd, S. 3rd and Main Ave,
which were in the CBD program. These audits involved $3,725,035.48
in Urban Arterial Trust Funds, and another $1 ,255,130.06 of matching
funds and the net results of the audits is that the City will receive
an additional payment of $6,797.41 for eligible project costs.
APPOINTMENTS Letter from Mayor Garrett requested concurrence in the appointment of
Police Dept. Ms. Mary Widmer, 18104 S.E. 136th St. , Renton, to the position of Clerk
in the Renton Police Department to fill a vacancy within the Communica-
Ms. Mary Widmer tion Center created by the absorption of a CETA employee, Ms . Widmer
Clerk having been certified by the Police Civil Service Commission, and sub-
ject to the customary six-month probationary period. The appointment
will be effective October 7, 1975. MOVED BY PERRY, SECONDED BY BRUCE,

Raymond Saude Letter from Mayor Garrett requested concurrence in the permanent appoint-

OLD BUSINESS Joint report of the Community Services Committee and the Board of Public
Clearview Cable Works was submitted by Councilman Clymer regarding Clearview Cable TV
TV Rate Increase rate increase and franchise, Clearview being advised to continue opera-
& Franchise tion on a month-to-month basis until new standard. franchises are pre-
pared to cover both TelePrompter, Inc. and Clearview Cable TV. Sample
Public Hearing ordinances are being secured from other agencies. The joint report
Set - 11/3/75 recommended that the proposed rate increase be approved. MOVED BY
CLYMER, SECONDED BY SCHELLERT, THAT THE COUNCIL CONCUR IN THE RECOMMENDA-
TION OF THE COMMITTEE AND THE BOARD OF PUBLIC WORKS. Discussion ensued
concerning the rates and regulatory powers of the Council granted by the
F.C.C. , citizen complaints , and the past events and studies undertaken
by Council committees and City personnel as concerns the franchises of
the two companies now operating in Renton. Moved by Grant, Seconded
by Stredicke, that the Board of Public Works negotiate with Clearview
Cable TV and have a section in the franchise regarding the increasing
of fees and that this be subject to Mayor and Council review, and that
the Council have a report back in thirty days. More discussion ensued
and Councilman Grant withdrew his motion. SUBSTITUTE MOTION BY GRANT,
SECONDED BY BRUCE, TO REFER THE RECOMMENDATION, ALONG WITH THE FRANCHISES,
TO THE BOARD OF PUBLIC WORKS FOR REVIEW AND REPORT BACK IN THIRTY DAYS.
It was noted that the F.C.C. requires some local programming, educational
films, etc. and that it was up to the companies to show the Council
why they need the increase and what they are doing for public programming.

FOR RECOMMENDATION. Councilman Stredicke noted that again this was a
piece of property on Union Ave. N.E. recommended for R-3 zoning, with
no protection for property owners under an R-3 zoning. Councilman Perry
noted that this was the reason it was referred to the Community Services

Special Permit Box 6205, Seattle, appealed the decision of the Planning Commission

Lighted Reader Letters from the Renton Municipal Arts Commission and the Renton
Board for CARCO Creative Arts - Bicentennial Committee both requested funding for
Theatre a lighted readerboard for the CARCO Theatre at ,the Maple Valley
entrance to Cedar River Park. Both letters emphasized the value of
such a sign to increase awareness and attendance at functions given
at the theatre and requested that money be appropriated in the 1976
budget for this purpose; the Renton Municipal Arts Commission request-
ing an appropriation of $8,000. It was Moved by, Perry, Seconded by
Grant, to refer both of these communications to the Finance and Personnel
Committee. Councilman Stredicke remarked that the appropriation should
be included in the preliminary budget. SUBSTITUTE MOTION BY STREDICKE,
SECONDED BY DELAURENTI , THAT THIS REQUEST BE REFERRED TO THE MAYOR'S
OFFICE FOR REQUEST TO BE INCLUDED IN THE PRELIMINARY BUDGET. Council-
man Grant remarked that $8,000 was a lot of money for a reader board
and the Council should look into the price and location. After some

Temporary ,Street Board of Public Works Chairman Del Bennett's letter noted that they

The Renton Planning Commission at its September 24 , 1975
public hearing approved your application for fill and grade
for the westerly 300 feet o:f the site or to the existing
top of the pond bank subject to the following conditions :
1 . Storm water and sedimentation control methods as
approved by the Public Works Department . ,
2 . Utilization of suitable erosion control methods as
approved by the Planning Department.
3 . Final landscaping plan subject to Planning Depart=
ment approval .
4. Suitable measures shall be used to control dust
and sand during the fill and grade operation .
5 . Establishment of suitable screening methods along
the north , south , and west sides of the property
for screening the construction equipment storage
area subject to final approval of the Planning
Department.
Decision on the remaining portion of the subject property is
contingent upon the final approval by the City Council of the
revised Comprehensive Plan for the Valley area . This Plan ,
when adopted , will establish the location greenbelt/wetland
areas to be retained in the Valley area pursuant to the Soil
Conservation Service resolution for the Valley Drainage Chan-
nel. Project.

The exception was considered to be appropriate because :
A. Although 25 feet is inadequate for the proposed 10-
lot subdivision , a 50-feet wide right-of-way would
be detrimental to the area . Fifty feet was considered
to be the minimum for such a 10-lot subdivision
because of the impacts of traffic on the area and
the street system..
B. A reasonable width that could handle a certain amount
of additional traffic from a reduced density together
with adequate shoulder and pedestrian/buffer widths
on each side was determined to be appropriate for the .
particular area , and would not be detrimental to -
adjacent properties .
C . The physical characteristics of the site and area
(i . e . , unique natural vegetation , proximity to a
major park , existing development in the area , and the
limited possibility of future development in the area )
are such that a reasonable exception is justified . J

Planning Commission was called .to order at 8 : 05 p . m . by Chair-
man Scholes . Approximately seventy-five people were noted as
being present in the audience . The Pledge of Allegiance was

Acting Secretary Mola introduced the item to the Commis •

sion at the request of the Chairman , and a briefing from
the staff was invited . Assistant Planner Smith pointed
out the location of the 5. 8' acre site situated between
the West Valley Highway and the Burlington-Northern
railroad tracks just north of S . W. 43rd St . He noted
that approximately two acres of the property contains a
ponding area suitable for wildlife habitat . He stated
that the applicant has requested permission to fill the

entire site with approximately 78 , 000 cubic yards of fill
material , an.d development plans included construction of
an office building , construction repair shop and outside
storage area at the east end of the site . A Final Environ-
mental. Impact Statement has been prepared , and comments from
interested parties have been reviewed by the Planning Com-
mission , Special Studies Committee , and staff . Mr. Smith
stated that a Shoreline Management Permit has been granted
allowing filling , grading , and development of the westerly
300 feet of the site or to the top of the existing pond -
bank , whichever is less .
Slides of the property were viewed , with special emphasis
on the ponding area , which were taken at all seasons of the
year . The topography of the property was described and
significant landmarks were identified . Mr. Smith reviewed
the progress of the application, noting that it
had been received on March 6 , 1974 , along with an applica-
tion for rezone from G to M-P . The request for rezone to
M-P had been granted in June 1974 .
The Chairman called for comment from the applicant .
Alan Austin of Montgomery , Purdue , Blankenship and Austin ,
a lawyer representing Scarsella Brothers , noted the pre-
sence of the applicant in the audience and referred the
Commission to the Final Environmental Impact Statement
that had been prepared to address the issues involved and
offered to respond to any questions from the Commission .
He stated that the basic problem concerns the request by
the Soil Conservation Service that 110 acres of wetlands
be maintained or mitigated in the Green River Valley by
the four municipalities of Renton , Kent , Auburn , Tukwila ,
and King County ; and hedisplayed a map published by that
agency indicating their recommendations regarding those
areas , including the Scarsella pond . He cited the City
of Renton ' s resolution of July 22 , 1974 , supporting the
program but indicating that no City funds were to be
expended for the purpose without prior approval of the
City . He referred to the recommendation by the Soil Con-
servation Service that not less than two percent of land
be preserved for wildlife and noted that in this situation
nearly sixty percent of the property was being designated
for this purpose . Mr. Austin noted that they have complied
with all City and State requirements and indicated it is
their desire to comply with the City ' s Mining , Excavation
and Grading Ordinance . Mr . Austin noted the issuance of
a partial Shoreline Management Permit and indicated that
it was their feeling that the Soil Conservation Service ,
U. S . Fish and Wildlife Service , and Washington Department \
of Game were telling them to continue to wait until someone •
else makes the decision regarding which wetlands to actually
include in •the 110 acres . It is their opinion that inasmuch
as the property was rezoned to M-P and is in agreement with
the Comprehensive Plan , intensive development should be
permitted . Mr . Austin said that $37 ,000 in sewer and water
assessments had been levied against the property by the City .
He stated there would be no decision required if the City
is going to acquire the property but indicated that it is
their belief that there has been no decision with regard
to the sharing of the 110 acres to be preserved by the
affected communities or the funding ' of those lands .
He requested a decision as to whether the City wants to
buy the property , condemn it , or grant the filling and
grading permit .

The applicant ' s representative described the formation of the
pond , claiming it was the result of drainage from fill to the
north and embankments of the railroad tracks to the east and
had no interaction with the Green River. He noted the pre-
sence of the West Valley Highway between the pond and the
River. He stated that Mr. Scarsella ' s lease at the present
location of his business has expired and is currently on a
month to month basis . He also noted that the business has
60 , 000 cubic yards of fill material stored in another area
on a limited time basis . He again offered to reply to
questions from the Commission .
The Chairman invited further input from the staff, but none
was offered . He called for comment from the audience , but
there was no response . The report from the Special Studies
Committee was then requested .
Commissioner Gibson , Chairman , stated that the Committee
had discussed the comments received in response to the Draft
Environmental Impact Statement , especially the reply submitted
by the Soil Conservation Service regarding the pond ' s rela-
tionship to the proposed wildlife mitigation areas and the
Agency ' s drainage channel project in which it was requested
that approval be obtained from the U . S . Fish and Wildlife
Service and the Washington Department of Game , should
there be a variance from their recommendation . They re-
viewed the proposed grading plan , site plan and Shoreline
Permit and felt that it was possible to allow much of the
project through a partial permit and yet satisfy the agencies
opposing the filling of the pond until other suitable miti -
gation areas are established . The Committee also noted that
a study of the effects of the P- 1 Channel system on the
' wetland areas in the Valley is presently in progress . Under
the circumstances , Mr. Gibson stated that it was their recom-
mendation that approval be granted of a special permit to
fill and grade the westerly 300 feet or to the top bank of
the pond , whichever is less , until such time as a final i

in accordance with Soil Conservation Service requirements
for the P- 1 Channel drainage project .

In response to Commissioner Ross ' inquiry regarding
offers for acquisition of his land , Mr. Scarsella stated
that he had received none from any private parties or
governmental agencies .
Commissioner Mola stated that it was his feeling that the
utilities assessment should not be levied to include the
ponding area , that an adjustment should be made , and that
Mr. Scarsella was being penalized in being asked to main-
tain more than two percent of his property for game and ,
wildlife . He indicated a need for a commitment from
the city , federal and state agencies involved regarding
the acquisition of these areas . He described the pond
as a mosquito infested area that would benefit from
filling in his opinion .
In reply to questioning from the Chairman , Mr. Scarsella
indicated that the assessment had been based upon square
footage of the entire site .
Discussion followed with regard to the economic issues
involved in relation to the land use concerns , with
Commissioners Wik , Scholes and Teegarden noting that
as a land use decision making body , the recommendations
of the Soil Conservation Service , State Departments of
Game and Fisheries , and King County which indicated
the area as ecologically valuable necessitated their
consideration . All agreed that an adjustment in the
assessment should be reviewed and noted the difficulty
in making the decision . Commissioner Teegarden referred
to the current study by the Planning Department to deter-
mine the effects of the drainage channels on the wetlands
and indicated that until that determination had been made ,
the Commission should not allow •filling , as it would be
an irrevocable action . Commissioner Walker queried
regarding the expected completion date of the special
study and was advised by Assistant Planning Director
Magstadt that the evaluation should be concluded by
December 31 , 1975 . Mr . Magstadt then briefly described
the program which will include certain mitigation mea-
sures to compensate for elimination of wetlands in
particular areas , recently specially funded by :the State
Department of Community Development . Methods of acquisi -
tion of the properties will not be a part of the study .
The Assistant Planning Director advised that the Council
Community Services Committee is presently studying the
Planning Commission ' s recommendation for revision of the
Comprehensive Plan in the Green River Valley and that
hopefully an answer to the matter of compensation will
be provided . He noted that some conservation groups
have indicated they may have money to loan or donate,
but acquisition has not been finalized at this time .
Further discussion ensued , with Commissioner Ross noting
that the pond was in existence at the time of the adoption
of the Comprehensive Plan , which has indicated for years
it is suitable for intensive use ; and , therefore , he
expressed his objection to its commitment as natural
habitat . Commissioner Teegarden responded that the
present Comprehensive Plan designates this property for
industrial use ; however , the Commission . has recommended
to the Council that it be changed for this area and
indicates the Scarsella ponding area as greenbelt .

The Chairman recognized Mr. Austin , who displayed a picture
of the Soil Conservation Service ' s plan which identifies areas
of wetlands in the Valley and stated that there are other
areas in it that are adequate for preservation . He asked
for a decision on the basis of the law that was in effect
at the time of the application . He stated the alternative
is for the affected communities on the basis of population
and area to come up with a plan for definite designation
of wetlands and their acquisition . He stated that they are
proposing to fill the pond and do not need to fill the area
being approved . He also asked that Commissioner Teegarden
disqualify himself from voting based upon his earlier state-
ment that in the proposed revised Comprehensive Plan the ponding
area has been designated as greenbelt . Chairman Scholes
responded , for the record , that he did not believe that
any Planning Commission member has prejudged the decision .
Following a brief discussion among the Commissioners relative
to the basis for a decision , IT WAS

Discussion followed , especially with regard to the lengthy
study of land use in the Green River Valley in connection
with the updating of the Comprehensive Plan , for which an
EIS was prepared . Chairman Scholes stated that it was his
opinion that every Commissioner has considered "land use in
the subject area for a long period of time , has studied
the material involved , visited the site , and has personal
viewpoints toward environmental issues . However , the Chair-
main said he did not believe there was anyone on the Com-
mission who could prejudge the outcome of the vote . Com-
missioner Ross indicated his confidence in Commissioner
Teegarden to make a decision that would be proper and unbi -
ased .

being studied by the City Council ' s Community .Services Com-
mittee , expressed the opinion that the City should be given

hearing and that the. Planning Commission does not conduct

he believed they had acted in an expeditious manner.

We are pleased to submit this application fora HUD
Local Planning Assistance Grant to assess special impacts
of an environmental nature in the Green River Valley . A
brief summary of events leading to this proposal may be
'helpful to your review .
The City of Renton adopted. its first Comprehensive
Plan in 1965 and made extensive revisions , primarily of .
an interpretive nature in 1968 . A great deal of the
philosophy regarding land development and public interest
has changed or is at least open to serious questioning
since the initial Comprehensive Plan was adopted . Special
interest groups have formed , demanding that environmental .
considerations be injected into the decision making pro-
cess . Land is now considered a finite and exhaustible
resource and therefore to be used wisely for the benefit
of all people . Legislation has been passed and courts
have rendered decisions requiring the' consideration of
many factors besides spatial relationships and economics
in land development . In short , attitudes , expectations
and involvement of people have changed .
Presently , most of the Green River Valley within the •
City of Renton is undeveloped . However , there are numerous
large parcels of land considered suitable for industrial
development. These undeveloped parcels are designated as
manufacturing park and heavy industrial on the City ' s
existing Comprehensive Plan . The Soil Conservation Service
• has proposed the ' construction of an extensive network of
fl.00d .control channels to drain the Valley , thereby facili -
tating development . For these reasons , and many more ,
there is a general belief that industrial .development is
imminent in the Valley .

After considerable encouragement from the public , the
City ha,s now undertaken to revise the Comprehensive Plan
for the Green River Valley . The City of Renton Planning
Commission has recommended the City Council adopt an amend-
ment to the Comprehensive Plan in the Green River Valley,
which includes revised maps and goals and objectives intended
to influence the type and quality of development desired in
the Valley . An important element in the proposed amendment
is the retention of 250 acres of wildlife habitat and green •
-
belt , or about 11 percent of the planning area . This repre •
-
sents an increase of about 185 acres over the existing Comp-
' rehensive Plan . Th.e Planning Commission has also requested
that certain industrial developers currently proposing devel -
opment in this area designate portions of their land for
retention as wildlife or wetland habitat . At this time we
are particulary concerned with the long term effects that the
channels will have on these adjacent natural areas .
Recognizing the importance of preserving a .representative
portion of the Valley in its natural state and the increasing
pressures for development there , the City is proposing to
initiate a study to investigate the possible long term impacts
upon wildlife and wetland habitats of the Green River Watershed
Projects drainage system. Not only would the study involve
the determination .of potential impacts upon the natural envir-
onment but would also consider mitigating measures or policies
the City might institute to minimize such impact .
We hope that the attached application will further clarify
our intent in conducting the proposed study and that , upon
review, your staff and the Governor ' s Advisory Committee on
Community Development will be able to assist the City of Renton
in this necessary supplement to its comprehensive planning
program in the Green River Valley .

In recent years, the conversion of agricultural to industrial land has accelerated
in that portion of the Green River Valley lying within the City of Renton (approx.
2200 acres) . Although most of the area (1600 acres) is undeveloped, it is designated
for manufacturing park or heavy industry on the City's existing comprehensive plan,
with about 65 acres designated as wildlife preserve or greenbelt. Since the initial
Comprehensive Plan was adopted, environmental considerations have become a major
part of the decision-making process and are reflected in the amendment to the City's
Comprehensive Plan-in the Green River Valley, now being considered by, the City Council .
Under the, proposed plan about 250 acres are designated as greenbelt to help mitigate
the loss of wildlife habitat. Also incorporated in the amended plan is the Soil
- Conservation Service's drainage plan for the Valley. The most serious impact of this
plan►maylbe the alteration. of the physical and biological characteristics of wildlife
habitats that would result from a lowering of the water table in the Valley. The
purpose of the study would be to determine the drainage projects long range effects
on wetland and wildlife areas, whether the provision of these areas for present and
future generations will be jeopardized and what mitigating measures or policies to
consider in minimizing impact.

d. Consultation with individuals having expertise in the fields of wildlife- and
plant biology, botany, zoology, geology and hydrology from various local ,

f. Consideration of alternative mitigating measures or policies to minimize impact

They will also benefit through the increased knowledge gained by man of the
impact of his actions upon their habitats. Benefiting also will be present
and future generations of the general public who derive recreational , educa-
tional , cultural and aesthetic value from the presence of such wildlife.

Don ' t worry about the fact that he says it is" a type' 4
and our maps shows type 3 because it has some of the
characteristics of both . Normally type 4 is deeper than
type 3 in the rainy season and there are minor differences
in vegetation .
• The area could be improved by knocking down some of the
trees and making more open water and is highly desirable
for preservation of wildlife that uses wet habitat.

- Following up on cur telephone conversation today I'd like to put dm."4/4/ 'C�
a few points on the value and use made of wetlands by ducks, in. LNG DE?P\
particular the wet area north of 180th and east of the West Valley _
Highway.
We typed this area as Type 4 due to the depth and permanency of the
water as well as the vegetation. .A Type 4 can, and does, go dry at
times, particularly during periods of long dry spells. I think we
can agree that this summer and fall has been such a period.
At first, this may seem to destroy the value of the area for ducks.
Not so, in all cases! While it is true that We would prefer a permanent,
year-round water area; such areas soon lose all their value as they
become overgrown and choked with vegetation such as cattails-, bulrushes
and often. willows Thus, it becomes necessary to clear out such vegetate
ticn to retain open water and cover in proper proportions. Periodic r9
. drying of the area, and even agricultural activities during these dry � --,
periods, has the beneficial effect of setting back the vegetation to
something less that a choked condition when it next fills up--thereby
benefiting the ducks.
In most cases, wetlands of this type are used both by breeding ducks,
and later as areas to raise the broods. Drying up of a Type 4 is most
often late enough in the season so that tha broods are flighted and can
fly to larger 'bodies of water still existing.
• Another fringe benefit of layering the water level and even drying up
wetlands, is the change in conditions that allows new plants to germinate.
Plants such as smartweed are common under these conditions. Seeds of
smartweed are high quality duck food and are eagerly sought when the
wet area fills up,
In summary, the drying up of wetlands is not a disaster to ducks; it's
a natural periodic occurance. In most cases the value of the area has
been realieed. --the hatching and rearing of a brood or broods of ducks.

Pursuant to our telephone conversation on September 25,
1974, we understand that the detailed draft environ-
mental assessment which you are preparing is near com-
pletion and will be submitted to this department in
approximately ten days.
We are hoping to receive this information shortly so
that the Environmental Impact Statement process can pro-
ceed and thus expedite a determination of environmental
significance. •
This information was presented to the Planning Commis-
sion, which will make its decision on Mr. Scarsella's
proposal upon completion of this environmental review
process.
We have not received the requested information from Soil
Conservation Service referred to-in our September--25, -
1974, telephone conversation. However, when we receive
it, we will notify you.
Attached are the Planning Commission minutes that you
wished to attain. If you need any more assistance or

We have yet to receive additional input in the form
of a detailed environmental assessment from the
applicant. This information will be utilized in

We have not to date received a reply.
We have also written the Soil Conservation Service
to receive their opinion as to the environmental
significance of the proposed action . They have
indicated that they will supply us shortly with

He also noted plans to place tanks on a site previously
approved for such usage .
Teresa McKay , 7800 S. 130th , Seattle , inquired as to how the
propane gas would be delivered to the facility. Mr. Hogland
responded that it would be delivered by tank trucks . Respond-
ing to Mrs . McKay, Mr. Hogland stated that it will require
about sixty tank truckloads to fill the station and that
operation should be accomplished within a . thirty to forty'
day period . He stated that they hope to never have to fill

Mr. McKay, 7800 S . 130th , Seattle , asked if in the last ten
years there had been any instances of fire .
Mr. Hogland responded there had been none . Responding again
to Mr. McKay, Mr. Hogland indicated that tanks are loaded
with a pressure piping connection into the tank loading facil -
ity pump and moves the product into the tanks internally ,
and there would be no vapor emissions .
Mr. McKay inquired if the area is on an earthquake fault.
Mr. Ericksen advised that there are fault lines along the
westerly slope of Talbot Hill and noted that the entire
. Puget Sound Basin is subject to earthquakes and the whole
area does have conditions that result in earth movement
under certain circumstances . Mr. Hogland stated that the
design takes into consideration earthquake faults .
Responding to Mr. McKay, Mr. Hogland indicated soil in the
area is glacial till and provides., a solid foundation .
Grover Shegrud , 18216 - 196th Ave . S . , Renton , noting that
the facility has some danger potential , pointed out that it
is located in the vicinity of several schools . He questioned '
if it was reasonable to expand an operation of this type at
this time and suggested continuance to allow public input.
Mr. Hogland stated that safety was a factor, when considering
any form of energy, and noted approximately twenty schools
in the area that have tankage of this size and capacity above
ground within fifty feet of their buildings .
Discussion among the Commissioners followed regarding the
questions that had been raised and time required • to resolve
them.

Upon inspection of the above mentioned property
on September 20, 1974, this is to advise you that this
ponding area has dried up. Would you please provide
us with a current evaluation of this wetland area
under its current condition and as to the importance
of including this portion of wildlife/wetland habitat
within the City of Renton's Mitigation Area.
As you are aware, Mr. Scarsella has a proposal
pending through the Planning Commission to fill this
site. Under the current circumstances, we request
your department to establish the value of this area
and respond to the impact that filling and elimina-
tion of this area for protection of wildlife would
have upon the Valley.
We would appreciate your .response' as soon as
possible, in order to assist the Planning Commission
in their review of the pending fill and grading of the

Pursuant to our conversation with you and Mr. Ericksen
on July 15 , 1974, the following items and schedules were dis-
,cussed:
1 . It appears feasible that the office , warehouse
and storage yard could be relocated on the exist- ,
ing fill area and a revised site plan under
M-P zoning should be submitted to the Planning
Department by September 4, , 1974 to be first heard
at the Administrative meeting September 11 , 1974
(no meetings are held the month of August) .
I was advised by Mr. Eubanks today that Mr. Scarsella plans
to proceed on the above item and will not need fill material in
excess of 500 cubic-yards to finish grade the existing filled
area. Mr. Scarsella still plans on proceeding with his appli
cation . for fill of the remaining site..
2 . Planning Commission action on the Special Permit
for fill and grading will occur after the approval
• of the Final Environmental Impact Statement by the
Planning Department. Procedures for submitting the
Environmental Impact Statement are as follows :

in suitable form as prescribed by state guide-
lines to the Planning Department for review and
acceptance.

mission and asked the Planning Director for a brief summary .
Noting that the site includes approximately 5 . 8 acres of
which approximately three comprise the Soil Conservation
Service ponding area , the Planning Director advised that
, the staff had requested continuance to allow for review of
the environmental assessment presented by the applicant and.
to make a determination whether or not an environmental impact
statement would be necessary. A letter in opposition had been
received from Thomas W. Mitchell , 3425 S . 176th , Seattle .
The Planning Director read a recommendation from Joan Lankford ,
Assistant Planner, Landscape Designer, that an environmental
impact statement be prepared for the following reasons :
1 . The impact not only on this property but also adja-
cent properties within the City lying within the
jInterurban Right-of-way and the Green River to the
north of S . W. 43rd should be considered on a total
basis .

2 . The filling and development of properties in
this area as presently being undertaken on a
piecemeal basis could result in significant.
impact on adjacent properties and possibly
place the City in liability if filling and
development were not properly conducted due
to water displacement and runoff to adjacent
properties .
3. The significance of filling the ponding area
and its loss as a wildlife habitat is unknown
in terms of the immediate and longrange effects .
If the ponding area is filled , alternatives
should be reviewed and recommendations made to
Soil Conservation Service .
4. There is a significant need for a coordinated
approach in the development of said property and
adjacent areas in terms of a total concept which
would meet the requirements of the Soil Conserva-
tion Service Green River Drainage Plan .
Mr. Ericksen advised that the City Council is considering
the adoption of a resolution to concur in the Soil Conser-
vation Service proposed Green River Drainage Plan . He stated
.that in view of the pending adoption of a resolution by
City of Renton , the staff felt it was necessary that an
EIS be prepared and that all of the questions be addressed .
Staff recommendation for partial development of the prop-
erty was noted by the Planning Director, who stated that
the site included 2 . 3± acres , or 100 ,000t square feet of filled
area in the westerly end ( total area 5 . 8 acres less 3
acres of pond and . 5 acre in NE corner) . He described
the proposed site development plan , which includes 1500
sq . ft. for -the office , 14 ,000 sq . ft. for the warehouse ,
and 7500 sq . ft. for parking . With 80 ,000 sq . ft. for
exterior storage , the area to be developed totals
103 ,000 sq . ft . , which seems to offer a reasonable oppor-
tunity for development under" M/P standards . He stated
that an application for site planyapproval has not been
submitted by the applicant at this time . He recommended
that a plan for the westerly portion be developed and
offered staff assistance .
The Chairman invited comment from the Commission . Commis-
sioner Humble , noting that the decision to request an EIS
precluded any action by the Planning Commission , advised
the members of the forthcoming public hearing on July 31
regarding possible changes to the Comprehensive Land Use
Plan , especially as it relates to the Green River Valley .
He stated that they should be able to act on the revised
plan , which will allow for state and federal requirements ,
and provide a basis for total rather than piecemeal action .
Responding to Commissioner Morrison , Mr. Ericksen pointed
out the pond on the map and indicated that it covers approxi -
mately 5 . 5 acres in total and extends onto property to the
south.
Commissioner Ross stated that he believed the pond is the
result of an unfinished construction program and noted that
construction permits in the Valley are being issued

by other municipalities to the west and. south . It was
noted that development of the Scarsella site can commence 1
while the impact statement is in process and being prepared .
The Chairman invited comment from the applicant.
Mr. Alan Austin , lawyer representing Scarsella Brothers ,
stated that Mr. Scarsella wished to fill the property
so he can use the entire site and have the availability
of the railroad trackage . The smaller site development
plan had not been considered , but the matter will be review-
ed with Mr. Scarsella ; and an amended plan will be submitted
if it is deemed appropriate . The applicant hopes to fill
the site during the summer while he has the material and the
weather is favorable . He stated that they would cooperate
in the preparation of an EIS .
Noting the damage occurs when filling a site , Mr. Teegarden
said he felt the Commission should seriously consider
the implications and investigate alternatives . He then
requested comment from the audience but received none .

REQUEST TO FILL BE CONTINUED UNTIL THE ENVIRONMENTAL
IMPACT STATEMENT IS AVAILABLE .
Discussion followed regarding the availability of the
EIS in order to give the applicant an indication of
Planning Commission action . Noting state requirements ,
the Planning Director stated that a minimum of three
of four months would be necessary before a final EIS
could be provided .
Commissioner Ross stated he intended to vote against
the motion., as he did not consider the request for
continuance valid.

received June 25 , 1974 , and the staff has not had an oppor
tunity to make an evaluation at 'this time .

He noted that environmental impact occurs at the time of. develop-
ment ; therefore , the staff recommends approval of rezoning to
M--P but continuance of the request for special permit to fill .
The Planni ng Director pointed out the ponding area on the map
and noted that it touches the proposed warehouse facility. It
is the staff ' s opinion that zoning of the property would not
preclude development of a portion of the property but granting
of the fill would create loss of the pond area . Mr . Ericksen
discussed the planned Valley Drainage Project and proposed.
provisions for its funding .
Comments were invited from the applicant. Mr . Allan Austin ,
attorney representing Scarsella Brothers , Inc . , 1515 Norton
Building , Seattle , stated that Mr . Cokely of the Soil Conserva-
tion Service had advised him that areas that they have mapped
for preservation are tentative and not defined by boundaries .
The pond was described as covering fifty to sixty percent of the
property during the wet season. He described the applicant ' s
reasons for seeking relocation of his business facilities , noting
that his lease at his present site expires in May 1975 . The
property has been owned by the Scarsella ' s for ten years and is
being sought for industrial use due to its proximity to the West
Valley Highway and 'the railroad .
Mr. Mola invited comments from the audience , but none were
received.
The Chairman then called for a report from the Zoning Committee .
Commissioner Ross , chairman , read his report which advised that
it was the conclusion of the committee that rezoning to M-P
would have no detrimental impact on adjacent properties .
Further comment by the Commission was invited by the Chairman ,

Further discussion ensued regarding the necessity of allow-
ing a minimum of thirty days for public study following'
publication of an EIS , which would preclude possible action
in July. Mr. Ericksen stated that . the City Attorney had
advised that regarding the applicant ' s proposal for a con-
ditional rezone that any such agreement would have to be .
subject to the outcome of the EIS . State law requires con-
sideration of the EIS before action may be taken by the
Planning Commission .

Committee , reported that the Committee had met but recom-
mended continuance , since they had not had an opportunity •
to review the environmental assessment .
Discussion followed regarding formal notification to the
applicant as to the requirement for an environmental

Discussion ensued regarding desirable locality for a wildlife
sanctuary and whether or not an EIS is appropriate. It was

3. ZONING COMMITTEE
Commissioner Ross , chairman , presented the committee ' s
recommendation regarding PARKING IN THE CBD and noted
that it eliminates the requirement for parking by pro-
viding an exemption district . Discussion followed re-
garding the committee ' s rationale . Responding to
Scholes , the Planning Director stated that the parking
and loading ordinance requires that if there is a change
of use , an occupant would be required to meet the park-
ing requirements for the new use. He indicated that a
number of alternatives to the parking problem in -the
CBD were considered ,. and it was decided that what is
proposed is probably the most logical solution .
ACTION:
FOLLOWING DISCUSSION, IT WAS MOVED BY SCHOLES, SECONDED
BY ROSS, TO DEFER THIS ITEM UNTIL THE MAY 22ND PUBLIC

Chester Jahns , Soil Conservation Service Assistant Project
Engineer on the Green River Watershed Plan , presented maps of
their proposed drainage system for the Green River Valley .
Said plan was adopted in 1966 and is presently in the environ-
mental stage . The project area is 16 ,000 acres , of which 110
acres are designated as "mitigated wetlands . " Of the eight
designated areas , three are located in Renton as follows :
one along the east side of the Valley freeway ; one situated
in Orillia ; and one located east of the West Valley Highway.
Estimated cost of work in the total Valley is $28,000 ,000 .
Mr. Jahns discussed the location and capability of planned .
channels and the types of wetlands found in this area . He
listed the following five points to be accepted by local jur-
isdictions before the project is begun :
1 . Acquisition of wetlands . ,
2 . Total land use treatment plan for the Valley.

3. Provision for upland habitat.
4. Provision for fish passage .
5 . Requirement for developers or industry to preserve
environmental quality of the land as much as possible .
Mr. Jahns responded to questions from the Commission, as
indicated below:
Gibson asked how land under private ownership would
be acquired for public ownership. Mr. Jahns stated
that the cities concerned would have to provide
that solution .
Gibson inquired if any objections had been noted
from the Steelheaders . Mr. Jahns indicated that
they had not , although they disliked the channeliza-
tion plans .. He observed that the water would be in
the channels rather than the soils .
Responding to Planner Smith , Mr. Jahns advised that
most of the enforcement would be up to local juris-
dictions .

Humble asked what assurance Renton would have that
funds would be available , should they be able to
meet the five points listed. Jahns answered that
Congress is still appropriating funds for work on
the environmental impact statement , indicating con-
tinuing interest.
Ross , inquiring about funding , asked if it is the
federal government ' s plan to fund the project , con-
struction of channels and pumps in total except for
those areas to be acquired and dedicated for public
use . Mr. Jahns replied that they plan to cover 94%
of the construction costs , and local jurisdictions
will have to provide the right-of-ways , estimated
to be 25% to 28% of total costs .
Mola inquired about the effects of the proposal on
land containing wetland areas which is under con-
sideration at this time for rezoning . Mr . Jahns
indicated that the Soil Conservation Service is asking
for 110 acres in the total Valley and that local
jurisdictions have the choice of changing the areas
where it is to be obtained .
Humble , noting that while wetlands can be moved
around and movement of right-of-ways would be more
difficult , asked if the City is looking at in-
creased cost of proposed right-of-ways , if rezoning
were granted. To this Mr. Jahns answered "
yes .
Responding to Wik ' s request that he explain what
effect the drainage system would have on the wetlands '
water table , Mr. Jahns replied that once the Soil Con-
servation Service knoWs where wetlands areas are to be
located , adjustments' in the plans for channelization
would be made . He stated that water tables would be
somewhat lower.

Humble pointed out that the type of soil in Renton does not
readily transmit water and noted that Renton appears to have
more than its share of wetlands . Mr. Jahns responded that
he. agreed and that the Soil Conservation Service may have to
adjust and put wetlands in other areas .
Mola stated that it was his opinion that planned closing, of
the culvert at the designated wetland area along Talbot by
Soil Conservation Service , as noted by Mr. Jahns , would worsen
an already bad area for breeding of mosquitoes .
Responding to Scholes , Mr. Jahns indicated that at this time
no cut-off date had been established for letters of intent,
regarding the five points plan .
Scholes asked what provision the Planning Commission has for
passing judgment on applications affected by potential chan-
nels , wetland areas , etc. Mr. Jahns indicated that he would
refer the question to the Soil Conservation Services Legal
Services . The Chairman requested that the information -be
conveyed to the staff and thence to the Planning Commission .
The Chairman then thanked Mr. Jahns for his presentation .
Ross requested that the staff provide a duplicate of the Soil

Chairman Teegarden , upon determining that a number of people in
the audience were interested in the Glencoe-Honeydew area , asked
the Commission for permission to depart from the agenda to pre-
sent Item 4.A. (2) , committee report regarding Glencoe-Honeydew

4. GLENCOE-HONEYDEW LAND USE AND CIRCULATION STUDY
Chairman Scholes of the Community Services Committee read their
report to the Commission . Indicating that it was the Commit-
tee ' s decision that the -vacation - of Whitman Court N . E. required
consideration of- a total circulation plan for the surrounding
area and review of existing and potential land uses in the
vicinity , Scholes stated that the Committee recommends the
following :
1 . Revision of the Comprehensive Land Use Plan , as indicated
in the map presented .
2. Technical recommendations by the Planning staff pursuant
to. the plan .
3. That Whitman Court N . E . not 'be vacated.
4. Rezoning of four parcels of land to agree with proposed
circulation plan and Comprehensive Land Use Plan revisions .
5 . A public hearing regarding these proposals prior to final
Commission recommendation .
Scholes pointed out areas involved on the map , noting the
study boundaries . He directed the •Commission ' s attention
to present and proposed zoning of the area concerned and
also present and proposed Comprehensive Land Use Plan des-
ignations for those areas . He stated that most of the
land planned for the proposed Honeydew Apartments is pre-
sently zoned R-3 .

Special Permit to Allow Filling and Grading .
The site plan review process and all allowable uses . in the
M/P Ordinance were discussed , and it was concluded that
these uses would have no detrimental impact on adjacent
developed or zoned properties . Examination of Exhibit B and
C of Resolution #1864 shows no public access right-of-way
through the subject property would be required , although a
utility easement may be desirable. The Committee recommends
approval of request for rezone to M/P . V
Request for filling and grading was discussed . The suggested
development of a wildlife sanctuary on a portion of the sub-
ject property was determined to be the paramount concern to
be reviewed. The location of a sanctuarya,should not have a
major arterial highway along one side and a main line rail -
road trackage on the opposite side . The sanctuary would not
benefit from the high cost of installed utilities and access
that now exist . The Committee feels the selection of sanctu-
ary site should be the result. of finding the site to be most
remote from major traffic thoroughfares and that it should
be planned into a compatible development that would best pre-
serve those amenities needed to nurture the existence of our
fellow creatures .
A survey -plan that does show the final grade elevation to be
compatible with abutting rights-of-way and adjacent proper-
ties should be of record ; if such a plan is submitted showing .
the final grade does conform with the Soil Conservation Serv- ;
ice specifications , the Committee would recommend approval to.
the Commission body.

Chairman Teegarden recommended that restrictive cove-
nants be drawn up at the time the request is presented
to the Council . Mr. Ericksen noted that the covenants
would have to be filed voluntarily by the applicant.
A five minute recess was declared by the Chairman at 10 :05 p.m.
The meeting resumed at 10 : 15 p .m. with the Secretary reporting all
members as being present.
REZONE AND SPECIAL PERMIT

feet north of S . W. 43rd Street on West Valley Highway.
The Chairman requested that the Commission consider both
the application for rezone and request for special permit
to allow filling and grading of this property simultaneously.
He asked for a presentation from the Planning staff.
Mr. Smith , Assistant Planner , pointed out the location
of the 5 . 8 acre site , which is situated east of the
West Valley Highway at S. W. 43rd . The area is adjacent
. to an existing M-P parcel . The site is presently unde-
veloped and includes a large ponding area , which will
require filling . Mr. Smith noted that the pond has been
under study by the Soil Conservation Service and has been
proposed for preservation as a natural habitat for water-
fowl . The proposed use is for an office building , ware-
house and outside storage area for construction equipment.
Slides and aerial photographs of the site were shown by
the Planning Director.
Mr. Teegarden invited comment from . the applicant. Antonio
Scarsella , president of the corporation , stated that they
would like to fill the site to allow for building or sale .
He indicated they plan to fill the entire site , raising
the grade so that it will drain toward the Green River
rather than the Milwaukee/Burlington Railroad tracks . He
described the pond as a breed,ing place for mosquitoes and
noted that it almost dries up in the summer months . At
this time they prefer to build a construction facility
for their business to replace the one presently located
off Highway 99. Landscaping and fencing will be provided .
They hope to complete construction some time this summer
and will comply with any City requirements .
Discussion followed regarding consideration of preserva-
tion of natural areas . The Planning Director advised
that there was no proposal for acquisition of the property
by the Soil Conservation Service . The site is part of an
area presently under study in the Valley Drainage Plan .
It will be incumbent upon local jurisdictions and indus-
trial owners to comply with the requirements of the Soil.
Conservation Service. Therefore , this is a factor to be
considered by the Planning Commission .
The Chairman requested that the Planning Director prepare
a briefing on the question of preservation of natural areas
to be presented at the April administrative meeting.

. The effects of the Shoreline Master Program on the applica-
tion were noted. A Shoreline Management Substantial Develop-
ment Permit will be necessary , and an environmental impact
statement may be required, It was also indicated that the
.Green River Valley one year moratorium on rezones and fills

residences , were pointed out . Off-site improvements would be
required , in accordance with City ordinance . The exception
to the Subdivision Ordinance requested earlier has been resolved .

tion of the duplexes was established to avoid traffic clutter,
at the end of the cul -de-sac . Each unit is designed and situ-

height of the property . He stated that N . E . 8th is a narrow
street , and he feels that 18 additional units will mean con-

prehensive Land Use Plan designates the area for medium
density, multi-family residential use. Discussion followed
regarding the conflict between theexisting B-1 use and the
proposed commercial use with the Comprehensive Plan . It
was noted that a change in the Comprehensive Land Use Plan
may be In order. The Coffi uission may also c®nsider the
extension of the present use or use of B-P (Business Park-
ing) zoning and the imposition of restrictive covenants

(/ Responding to an inquiry by Commissioner Scholes , Mr. Erick-
sen stated that the Commission recommendation to the City
Council for a one year moratorium on rezones in the Green
River Valley is presently being studied by the Council Com
munity Services Committee . It was also noted that the site
comes under the jurisdiction of the Shoreline Management
Act , inasmuch as it lies within 200 feet of the Green River.
Provisions of the Mining , Excavation and Grading Ordinance
relate to the site development, including the erection of .an
office building and construction repair shop and :.outsi.de stor-
age area , as some filling of the site will be required . The
proposed rezone is in agreement with the Comprehensive Land
Use Plan.
At this time , slides and aerial photographs of the proposed rezones
were shown by the Planning Director. .
