3. Total site consists of 5 . 8 acres, of which 2 . 8
acres is presently filled. Approximately 3 acres
are unfilled at present . The 87 ° area adjacent
to the freeway to remain in a natural state
would constitute approximately one acre . This
leaves the remaining 2 acres that could be
filled at this time. The area to be left in a
natural state would fulfill the S . C. S . 2%
requirement on an interim basis .
4. Given the fact that properties are filled on
both sides of the subject site, it is partially
filled itself, S . C . S. failure to recognize it
as a significant wildlife mitigation area, and
the relatively insignificant size of the marshy
area of the site, an environmental . assessment
was not felt to be necessary.

Discussion followed regarding the full agenda to be con-
sidered at. the July 24 , 1974 , meeting ; and it was MOVED BY
SEYMOUR , SECONDED BY SCHOLES , TO RECONSIDER THE PREVIOUS
MOTION . MOTION CARRIED UNANIMOUSLY .
Further discussion ensued regarding the necessity of allow-
ing a minimum of thirty days for public study following
publication of an EIS , which would preclude possible action
in July. Mr. Ericksen stated that the City Attorney had
advised that regarding the applicant ' s proposal for a con-
ditional rezone that any such agreement would have to be
subject to the outcome of the EIS . State law requires con-
sideration of the EIS before action may be taken by the
Planning Commission .

applicant. He noted the convenient location between a
railroad right-of-way and the West Valley Highway for
industrial use . He cited human uses in the area : trans-
portation facilities , a new sewer line , and availability
of water.
Commissioner Scholes , chairman o.f the Community Services
Committee , reported that the Committee had met but recom-
mended continuance, since they had not had an opportunity
to review the environmental assessment .
Discussion followed regarding formal notification to the
applicant as to the requirement for an environmental

Discussion ensued regarding, desirable locality for a wildlife
sanctuary and whether or not, an EIS is appropriate . It was
then MOVED BY SEYMOUR, SECONDED BY SCHOLES , THAT THE PUBLIC '
HEARING BE CONTINUED UNTIL JULY 24, 1974. A roll call vote
was requested with the following result :

Mr . Ericksen pointed out the 12 acre site located on the West
Valley Highway in the Green River Valley and noted that the pond-
ing area on the Scarsella Brothers property to the north extends
approximately 2 . 8 acres onto this site . While proposed use is
industrial , there is no site development plan at this time .
Staff recommends approval of M-P zoning , noting that if fill in
excess of 500 cubic yards is required for development purposes ,
a ' special permit from the Planning Commission would be neces-
sary. Possible environmental impact would be considered at
that time.
Commissioner Mola invited . comment from the applicant. Mr. M. W.
Lotto,. 7812 S . Sunnycrest Rd . , Seattle, stated that inquiries
regarding the property had been received and that water and
sewer easements were forthcoming .
Discussion ensued regarding the possibility of future environ-
mental assessment and the necessity for consideration of site
plans at the time of development. The Planning Director stated
that it, is the staff ' s position that it is possible to develop
the property without filling the pond but the matter will re-
quire further review.
The Chairman invited further comments from the audience but
none were received . It was then MOVED BY SEYMOUR, SECONDED BY
SCHOLES , THAT THE PUBLIC HEARING BE CLOSED . MOTION CARRIED
UNANIMOUSLY .
ACTION:
MOVED BY SEYMOUR, SECONDED BY ROSS, THAT THE PLANNING COMMIS-
SION RECOMMEND THE APPROVAL OF SUBJECT PROPERTY TO M-P ZONING
TO THE CITY COUNCIL AS THE REQUEST IS IN AGREEMENT WITH THE
COMPREHENSIVE LAND USE PLAN.
Discussion followed regarding right-of-ways for utilities ,
and it was noted that water is already installed and sewers
are forthcoming . Commissioner Seymour of the Comprehensive
Plan Committee stated that it is the Committee ' s intention to
include a comprehensive plan relating to arterials in their
study of the Green River Valley.

Commissioner Humble noted that the Comp,rehensive Plan Com-
mittee had made its report, also recommending approval sub-
.jec,t, to retention of the 87 ' easterly strip . Should the
drainage channel be relocated to the other ,side of the free-
way, the area could be eventually filled .'
Discussion followed regarding other reasons for not filling
the easterly 87 ' of the site , including drainage , wildlife
sanctuary and need for future setbacks .,
Comments were invited from the applicant by Commissioner
Mola .
Mr . Gary, Merlino , 8630 Fauntlee Cr. 'S . W. , ,Seattle , stated
that adjacent property owners had filled easterly portions
of their sites .
Responding to Commissioner Morrison , , the Planning Director
indicated that it, would be the public - agency `.s- responsi -
bility to remove dirt from filled areas planned for the
drainage channels . Mr. Ericksen also 'stated' that the Com-
mission can require development plans to be ;submitted
regarding ultimate use of the property', i`n``'a-ccordance`'with
the Mining , Excavation and Grading Ordinance .
Mr. .. 'Merl.ino cited rising costs as a reason for filling the
area now. Responding_ to 'Commissioner Humble , he stated

Chairman Humble advised that it is the committee ' s
request that a special public hearing be held on
July 31 , 1974, in order to obtain citizen input
regarding possible changes in the Comprehensive
Land Use Plan. in the Green River Valley and the area in the vicinity of Valley General Hospital on the
hill to the east: '

BE HELD JULY 31 , 1974, FOR THE SPECIFIC PURPOSE OF
CONSIDERING POSSIBLE CHANGES IN THE COMPREHENSIVE
LAND USE PLAN IN THE GREEN RIVER VALLEY AND THAT
AREA IN THE VICINITY OF THE VALLEY GENERAL HOSPITAL.
HE REQUESTED THAT INTERESTED GROUPS BE NOTIFIED AND
THAT A NOTICE OF PUBLIC HEARING BE PUBLISHED.
2 .. COMMUNITY SERVICES COMMITTEE
OLYMPIC PIPE LINE PROPOSAL
Noting City Council action declaring that the Olym-
pic Pipe Line project had a negative environmental
impact in the City of Renton and the Council ' s
earlier referral of the proposal to the Planning
Commission regarding possible environmental impact,
Commissioner Scholes , chairman, described the route
of the proposed second pipeline . It was the com-
mittee ' s unanimous opinion that if the terminus of
the pipeline is planned for Renton , then an environ-
mental impact statement should be provided by the
Olympic Pipe Line Company, as it is their feeling
that locating the terminus in Renton implies addi -
tional storage potential . He also stated that it
is the unanimous recommendation of the committee
that an EIS not be required, if the terminus does
not end within the City limits . Scholes stated
that he had been advised by the Olympic . Pipe Line
Company that there is no foreseeable extension of
the pipeline.
Discussion followed regarding the potential for
additional storage facilities , the reasons for an
environmental impact statement, and appropriateness
of possible action by the Commission.
Commissioner Gibson left the meeting at this time ,
having - been previously excused.
ACTION:
MOVED BY SEYMOUR, SECONDED BY SCHOLES, THAT THE
PLANNING COMMISSION SEND A LETTER TO THE PUBLIC
WORKS DIRECTOR EXPRESSING THEIR RESERVATIONS IN
REGARD TO THE COUNCILS ACTION AND STRONGLY RECOM-
MENDING THAT AN ENVIRONMENTAL IMPACT STATEMENT BE
REQUIRED FOR THE OLYMPIC PIPE LINE PROJECT- BECAUSE ,
OF THE POTENTIAL IMPACT OF THE TERMINUS BEING
LOCATED IN THE CITY OF RENTON AND THAT A COPY OF

special permit to allow filling and grading in B-1
and R-3 zones ; property located at southeast corner,
Union Ave . N . E . at N. E. 4th Ave.
The Assistant Planner pointed out the 1 . 88 acre site
located on the southeast corner of N . E. 4th Street and
Union Ave . N. E . , noting that G residential zoning , sur-
rounds the property. The site is zoned B-1 with the
south 75 ° of the property zoned as R-3. Ninety-nine
hundred, cubic yards of fill are planned and approxi -
mately 3900 cubic yards of cut. Proposed development
is planned in three phases : Phase one includes a
retail store and a tavern and also some other retail
or office space ; phase two involves extra retail and
office space ; and phase three provides for additional
office space into the R-3 zoned area . Plans for reuse
of the site , site development and landscaping have been
• submitted.
WAIVER OF OFF-SITE IMPROVEMENTS:
C° MARTINSON , E . J . ; Appl . No. W-776-74 ; request for
waiver of off-site improvements in G7200 zone ;
property located west of Kennydale Memorial Hall
on 27th N . E .
Planner Smith reminded the Commission that this site was
recently rezoned from P-1 to G-7200 in accordance with
Living Memorial Association ' s request and pointed out
the location of the 38,000 square foot site between
N. E . 27th Street and N . E. 28th Street. The planned
division of the property into four lots was described.
Because there is an absence of off-site improvements
on N . E . 28th , the applicant is requesting a waiver of
off-site improvements along his property on that street.
At this time he plans to build on the front two lots
only , saving the remaining two lots for his children .
FIELD TRIP:
It was decided to visit the sites on an individual basis
rather than schedule a field trip.

Oakdale Avenue and would appreciate a presentation by the

He informed me that he did receive the information that we
previously sent him regarding the proposed project . He said•

This' would be approximately 87 feet west. of the westerly right-
of-way of SR 167 . He aid that if this :wer.e ._accomplished
and the addition of the 2% landscaping suitable for bird
habitat his agency would have no objections to the project.

I talked with King County Department of Hydraulics today re-
garding the above mentioned project . They had received the
information about the project which we had previously s.ent
them. They indicated that they had been in contact with our
Public Works Department regarding the flood control permit for
the proposed project. As a result, of this correspondence and
their review they had recommended approval of the permit to
the Department of Ecology subject to the, retention of the
87 ° feet for the drainage channel purposes west of the westerly
right-of-way line of SR 167 . This area was not to be filled .
They indicated that they had no other comments regarding this
matter.

noting other development in the vicinity . He stated
that the site was partially filled prior to adoption
of the Mining , Excavation and Grading Ordinance ; and
there is existing fill to the south and north . Fifty
thousand cubic yards of fill are planned . He noted
recommendation by the staff for continuance to allow
for additional study regarding proposed development
and possible environmental assessment.
The Chairman invited comment from the applicant. Mr .
Gary Merlino , 8630 Fauntlee Cr. S . W . , Seattle , ques-
tioned the need for additional study , stating that
the season for this type of work was limited.

Discussion followed regarding the necessity for a flood-
plain permit from the King County Department of Hydraulics ,
consideration of the Soil Conservation Service position
regarding fills in the area and potential location of a
drainage channel in the vicinity. Mr. Merlino stated
that filling had been accomplished on a haphazard basis
in accordance with agreement from the City of Renton prior
to enactment of Ordinance 2820 .
Following discussion , it was determined that the appli -
cant planned to accomplish the work starting in early
July.

Mr. Ericksen pointed out the site on the map and noted
that the planned development of two townhouse duplex units
is a revision of a plan previously approved by the Planning
Commission . He described the proposal and displayed the
plot plans . He noted that the Offsite Improvement Ordi -
nance would apply and that on the original request a wai -
ver of improvements until completion of construction had
been granted . He stated that the staff felt the proposal
is an improvement over that previously approved but that
additional consideration should -be given to landscaping
and public right-of-way improvements .
Mr. Ericksen reported the receipt of a communication from
Mr. Lawrence S . Saviage , a neighbor, regarding complaints
concerning street improvements and sidewalks affecting
the neighborhood of Mr. Kirkman ' s present development and
hardships endured by neighbors during sewer and water con-
struction .
The Chairman invited comment from the applicant , but he
was noted as not being present. A request for comments
in favor received no response .
Speaking in opposition , Mr . Donald A. Lowe , 1411 Queen
Ave. , N . E . , Renton , described unfinished street and side-
walk conditions which have existed for three years .

SUBJECT : Gary Merlino Special Permit for Fill
I talked with Gary Merlino regarding his proposed fill .
I informed him that the unfilled portion of the site
could be considered a fragile area . As a result of
this , he may be required to supply additional informa-
tion in the form of an environmental assessment. He
said that his first intention was to develop the prop-
erty as an office/storage facility for his construction
company and other contractors .
He has since purchased a new site for these purposes
in another city and now would like to develop this site
in a manufacturing park situation to compliment the pro-
posed Burlington Northern Industrial Park west of his
property.
I told him that this was the type of use anticipated by
the Commission for this area and that he may want to enter
an agreement with the City in form of covenants that when
such time as he has specific development plans he would
present them to the Planning Commission for their approval .
Also certain setbacks , landscaping and screening could be
handled in this manner.
There is also the possibility of rezoning the property to
an M-P classification .

The Chairman called for committee reports .
1 . COMPREHENSIVE PLAN COMMITTEE
Commissioner Humble , chairman , reported that the
committee has met several times and is preparing
a land use proposal for THE VALLEY AREA. A meet-
ing was scheduled for May 15 , 1974 , to again con-
sider the subject and the Shell Oil Company pro-
posed development.
Regarding the REQUEST OF THE SEATTLE AUDUBON SOCIETY
for re-evaluation of the Renton Comprehensive Land
Use Plan , the committee is already studying the
question of land use in the Green River Valley.
2 . COMMUNITY SERVICES COMMITTEE
Commissioner Scholes , chairman , brought the group
up-to-date on the HONEYDEW APARTMENTS ' PROPOSAL .
Mr . Ericksen advised the Commission regarding Coun-
cil plans to conduct a public hearing on a revised
plan on May 13 . He indicated that the Public Works
Department and Planning Department had met with the
applicant in an attempt to answer some of the con-
cerns in order to provide the best type of develop-
ment for the immediate community and the City.
Scholes requested that an opinion from the City
Attorney be obtained relative to jurisdiction of
SHORELINE MANAGEMENT regarding fill in the Valley.
Scholes reported that the committee had met jointly
with the Council Community Services Committee regard-
ing the OLYMPIC PIPELINE REFERRAL . He noted that an
environmental assessment is being considered regard-
ing a proposed trail system over the pipeline right-
of-way which runs through the City from May Creek on
the north to the Mobil site on the south .

Mr. Ericksen pointed out the 2 . 3± acre site located on the
West Valley Highway and advised the Commission that the
City Council had approved the applicant ' s request to rezone
the property to M-P. He noted its relationship to the Green
River and other development in the area . Planned fill is
6 ,000 cubic yards . Proposed use is for an office/warehouse .

The Planning Director noted the location of the site on the
map , indicating landmarks and surrounding zoning in the area .
The site is zoned R-2 and requires approval for construction
of apartments. This is a revision of a previous plan ap-
proved by the Planning Commission to construct duplexes .
This revised plan provides for two townhouse duplex units of
new configuration and placement. The plan meets with require-
ments of the Zoning Ordinance .

intends to devote seven percent of the site for landscaping
purposes . They will meet the Soil Conservation Service re-
quirement for two percent preservation of natural areas .

The Planning Director displayed elevations of the proposed

ation . The proposed use complies with the M/P zone and the
Comprehensive Land Use Plan .

Thank you for the opportunity of reviewing`.the subject appli-
cation.
Mr. Merlin has made application to the City of Renton for
review and for the appropriate permits. The matter presently
is under study ,•,nd no permits have been issued.
The proposed fill extends cite close to State Highway 167,
which would encroach into the proposed drainage ditch running
parallel with Highway 167 and the owner should be instructed
regasrding this. The proposed fill will follow the same con-
tours as the adjoining property both north and south. We
have made a preliminary review of the proposal and have no
objections to the issuance of the Flood Control Zone permit.

Gary Kruger and I met today with Mr. Gary Merlino
regarding his proposed fill . We reviewed the vari -
ous requirements of the Mining , Excavation and
Grading Ordinance (Sec. 5 and 4-2316 ) . We informed
him that we needed plans that were clear , accurate
and of a sufficient scale to be understandable and
readable by the Commission . We asked him to be
as thorough and clear as possible in his applica-
tion so that there would be no undue delays in the
Planning Commission review process .
