Renton Municipal Building.
Parties wishing to testify were sworn.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following
additional exhibits into the record.

Mr. Smith reported receiving an oral request from the Engineering Division for
dedication of an additional 20 feet of right-of-way on Duvall Avenue N.E. to accommodate
the widening of Duvall Avenue N.E. northward to Sunset Boulevard.
The Examiner asked the applicant if he concurred in the Planning Department report.

Petet reported his intent to retain all fir trees but requested permission to remove
certain alders and fruit trees to accommodate the proposed structure. He also objected
to the request from the Engineering Division to dedicate an additional 20 feet of right-
of-way, stating that the location of the proposed building would be difficult to change.
The Examiner reported that the Planning Department had reviewed the location of existing
trees on the property, and indicated that removal of alders and fruit trees was not an
issue. Mr. Smith concurred.
The Examiner stated that the existing water main running along Duvall Avenue N.E. was
of insufficient size and asked Mr. Petet if he agreed to participating on a future LID.
Mr. Petet indicated that he would not object to sharing the cost on an equitable basis.

The Examiner asked for additional comments from the Planning Department staff. Mr. Smith
stated that the Engineering Division should be contacted regarding the status of the
roadway prior to filing of the plat in order to ensure proper width. He indicated that
approval of the short plat request would preclude any future short platting within five
years under the subdivision regulations.
The Examiner asked Mr. Smith if he had received a response from the King County Health
Department in regards to future sewers. Mr. Smith indicated he had not received a
response but that the soils would most likely accommodate such an installation.
The Examiner asked the applicant if he had contacted King County in the same regard.
Mr. Petet indicated that he had made contact and that the property had passed a percolation
test.
The Examiner asked for further testimony. Responding was:

Mr. O'Neil reported that as a property owner in the immediate area he wished to record
his approval of the project. He also indicated that sewers had been installed on a
similar parcel of property in the past several years and had functioned successfully
due to the soils. He encouraged progress in the area.
The Examiner registered concerns with the status of the roadway and final approval by
the King County Health Department and asked Mr. Petet if he would concur in closure
of the hearing with the final decision pending review of responses from the subject
agencies. Mr. Petet indicated his concurrence.
The Examiner asked for further comments. Since there were none, the hearing on Item
Short Plat 047-77 and W-048-77 was closed by the Examiner at 9:35 a.m.
FINDINGS, CONCLUSIONS AND RECOMMENDATIONS: Having reviewed the record in this matter,
the Examiner now makes and enters the following:
FINDINGS:
l. The request is for approval of a two-lot short plat and a waiver of off-site
improvements.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
and is hereby attached as Exhibit #1 and incorporated in this report by reference
as set forth in full herein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C., the subject proposal was
determined by Gordon Y. Ericksen, responsible official, to be exempt from the
threshold determination and EIS requirements of SEPA.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development and no adverse comment was expressed.
5. There was no opposition to the proposal expressed.
6. The proposal conforms to the required lot area requirements of Section 4-729G of the
Code and the other applicable regulations of zoning and the Comprehensive Plan.
7. With the exception of sanitary and storm sewers, utilities are available and in
close proximity to the site. Sanitary sewers are available in approximately 700
feet from the site. The Subdivision Ordinance, Section 9-1108.14, requires
installation of sanitary sewers when such are available within 1000 feet. However,
this may be waived or delayed per the requirements of Section 9-1105.6. The
applicant is requesting a waiver of off-site improvements since such improvements
do not presently exist in the immediate area.
Septic tanks must be installed if a sanitary sewer is not provided. Section 9-1108.14
requires that septic tanks be approved by the Seattle-King County Health Department.
To date, that approval has not been received; however, the applicant has stated that
the property passed the percolation tests.

The existing water main along Duvall Avenue N.E. is of unsufficient capacity and requires upgrading in response to the needs of the general area served by that
water system. The additional water requirement of the proposal will not adversely impact the system. An LID will be required in the future.
Storm sewers are not available at or near the site.
Duvall Avenue N.E. is an improved, two lane arterial which connects to King County and Bellevue to the north. Future plans are to widen the arterial north of Sunset Boulevard. In order to accommodate this future widening, a 20-foot dedication for right-of-way would be required of the applicant. The King County and City of Renton maps indicate this needed right-of-way on both sides of Duvall Avenue N.E.; however, the applicant stated that the additional right-of-way has
never been dedicated on his property.
Several conifer trees exist on the site which preferably should be retained. The
applicant stated that these trees would be retained.
CONCLUSIONS:
Le The short plat conforms to applicable city ordinances and to similar development in
the area. In addition, the applicant has considered the long range implications
of the configuration by a design which permits an ultimate configuration of future
access and additional lots. The applicant is claiming the same development rights
as others have previously in the area.
Section 9-1105.6 specifies that all utilities are to be provided; however,
subparagraph B provides for waiver of this requirement upon finding by the Examiner
that any of these conditions are found:
a. ..."Absence of such improvements located within a reasonable distance..."
(9-1105.6B).
b. "That there are special physical circumstances or conditions affecting said
property such that the strict application of the provisions of this Ordinance
would deprive the applicant of the reasonable use or development of his land;"
(9-1109.1.A.).
c. "That the exception is necessary to insure such property the rights and
privileges enjoyed by other properties in the vicinity and under similar
circumstances;" (9-1109.1.B.).
dad. "That the granting of the exception will not be detrimental to the public
welfare or injurious to other property in the vicinity." (9-1109.1.C.).
If improvements are not waived, they can be deferred per the requirements of
Section 9-1108.21 which stipulates submittal of a performance bond to the city in
the amount specified by the Board of Public Works. The time period of the
deferment is specified by the Board in one year (maximum of two years).
The attached memorandum from the Public Works Department indicates that improvements
to and along Duvall Avenue N.E. would occur in the future. It is possible that
the improvements will not occur within two years. Since this is past the time limit
for deferment, the city must proceed against the bond for installation of the
improvements at the end of the two year period for installation of all improvements.
This seems unreasonable since the design of the arterial may not be established at
that time.
Additional right-of-way is required in order to widen Duvall Avenue N.E. to a design
similar to that portion south of Sunset Boulevard. A dedication of 20 feet is
Planned from each side of Duvall Avenue N.E. To date, a portion of this dedication
has been accomplished. If 20 feet were dedicated from the Petet property, the
existing house would become nonconforming since it would then lie ten feet from
the new property line. It appears that an arterial improvement project will not
be formed within the two-year deferment period; therefore, the dedication and/or
improvement must be implemented or waived. The cost of implementation seems
unreasonable for imposition upon this single property owner and unwarranted in
view of adding only one lot to the street. Such improvements and dedication are
not located in the near vicinity, the cost would probably prevent the applicant
from subdividing the single lot or the rest of his property similar to others in
the area, and the applicant would be making his home nonconforming without apparent
due process available during a normal arterial widening project. It is reasonable
to waive dedication of the 20-foot right-of-way and the improvement of Duvall Avenue

N.E. The applicant can reasonably be expected to participate on an equitable basis
in the formation of any LID or improvement project for widening Duvall Avenue N.E.
based upon applicable laws. This waiver will not be detrimental to the public
welfare or other properties.
Section 9-1108.14.A requires installation of a sanitary sewer since a public sewer
main is available to the Petet property within 1000 feet (the property is located
700 feet from the sewer main at N.E. 23rd Street and Duvall Avenue N.E.). Therefore,
the applicant would be required to post a bond and/or install the sewer line to
serve the proposed one additional residential lot. It seems that such a requirement
is unreasonable since residents of the area are on septic tank systems, that the
700 foot length of sewer line to serve only one lot would necessitate the applicant's
individual expenditure thereby probably preventing subdividing the one lot and
potentially the remainder of his property, that other properties in the vicinity
have been similarly subdivided, and that utilization of septic tanks would not be
detrimental to the public or neighbors' health, safety or welfare. Therefore the
installation of sanitary sewers should be waived until an LID is formed in the
area for equitable participation by the applicant of his fair share as established
by applicable laws.
While the water main along Duvall Avenue N.E. is of insufficient size to serve the
area, it is reasonable to not defer this improvement as well. The problem can
only be solved via an LID for the whole area at which time all property owners
would share the costs on an equitable basis. Again, it is probable that this LID
would not be formed within the two year period for deferment, thereby placing the
improvement in the waiver category. The problem lies beyond the applicant's
control and therefore should be waived in order to give the applicant reasonable
use of his land similar to other owners in the area which will not be detrimental
to the public welfare or other properties.
RECOMMENDATION:
1. Approval of the short plat in Exhibit #2.
2. Approval of the waiver of off-site improvements until an LID or improvement project
is formed whereby the applicant will contribute his fair share on an equitable basis
per applicable laws with other property owners in the area for installation of the
improvements.
3. Approval is conditioned upon approval by the Seattle-King County Health Department
of the septic tank system.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before July 25, 1977. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law of fact, error
in judgment, or the discovery of new evidence which could not be reasonably available
at the prior hearing may make a written request for review by the Examiner within
fourteen (14) days from the date of the Examiner's decision. This request shall set
forth the specific errors relied upon by such appellant, and the Examiner may, after
review of the record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires
that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and
meeting other specified requirements. Copies of this ordinance are available for
inspection in the City Clerk's office, first floor of City Hall, or same may be
purchased at cost in said office.

Several years ago King County established a future R/W width for 138th Ave.
S.E. (Duvall) as 100 feet, 50 feet on either side of center line.
Right of way has been acquired in the Plats of Briers Terrace and Eastwood Park.
The city is requiring R/W from Farrell's Ist. Therefore adequate pre¢ident
has been set.
When traffic volumes and funding is available the widening and improvement
will be accomplished.
It is not uncommon in a project of this nature for a structure to become
non-conforming with regard to set backs. There is not much that can be
done about this problem.

C. PURPOSE OF REQUEST:
To allow construction of a single family dwelling on the 3+ acre Parcel
"B." An existing single family dwelling is presently located on Parcel
"A." Parcel "A" consists of a 35,000 square foot lot, which meets the
minimum lot size for the "G" zone classification.
D. HISTORY/BACKGROUND:
The subject site was annexed to the City on July 7, 1975, by Ordinance No. 2945.
E, PHYSICAL BACKGROUND:
1. Topography: The site is relatively level.
2. Soils: Alderwood (AgC) Gravelly Sandy Loam. Permeability is moder-
ately rapid in the surface land and sub-soil. Runoff is slow to
medium and hazard of erosion is moderate. This soil is used for
timber, row crops, and urban development.

3. Vegetation: The westerly one-half of the site has been previously
cleared and contains lawn and garden-type vegetation. The easterly
one-half contains many existing fir trees and woodland-type brush
and vegetation.
4. Wildlife: The existing vegetation on the site provides suitable
habitat for birds and small mammals.
5. Water: Surface water and streams are not apparent on the subject
site.
6. Land Use: There is an existing single family dwelling located at
the northwest corner of the subject site. The general vicinity
around the subject site consists of a mixture of low density single
family residences and undeveloped properties.
NEIGHBORHOOD CHARACTERISTICS:
Generally low density single family residences are:combined with much
undeveloped property. .
PUBLIC SERVICES:
1. Water and Sewer: An existing 3 inch water main is located along
Duvall Avenue N.E. Sewer is not available. The nearest sewer is
located approximately 700 feet north of the subject site at N.E.
23rd and Duvall Avenue N.E. Storm sewers are not available in the
area.
2. Fire Protection: Provided by the Renton Fire Department as per
ordinance requirements. Any future development will be subject to
City ” Renton standards. (See memo from the Renton Fire Depart-
ment.
3. Transit: Transit Route 42 operates along Sunset Boulevard approxi-
mately two miles west of the subject site.
4. Schools: The site is within one mile of Hazen High School, two miles
of McKnight Middle School, and within one mile of Sierra Heights Ele-
mentary School.
5. Parks: The subject site is within one mile of the proposed King County
Park west of Sierra Heights Elementary School and within one mile of
Kiwanis Park on Union Avenue N.E.

PLANNING DEPARTMENT ANALYSIS:
1. The subject short plat is compatible with existing zoning and the
Comprehensive Land Use Plan.
2. Applicant proposes to build one house on Lot "B" (129,454 sq. ft.).
The house should be situated to allow flexibility for potential
future subdivision and provision for an access road.
3. There are no off-site improvements in the general area. (curbs,
gutters, and sidewalks) These improvements would be more appro-
priately timed when an LID is formed for the entire area, or when
this segment of Duvall Avenue N.E. is designed and widened as a
street project. Also the property will most likely experience
futher subdivision in the future. These improvements should be
installed at the time such a major plat occurs. However, the City
should not waive the requirement to install these improvements at
the appropriate future time.
4. The site contains significant trees and natural vegetation which
should be retained as part of the short plat approval.
5. Sewers are approximately 700 feet from the subject property.
Deferral of this requirement to allow septic tank systems must be
approved by King County Health Department prior to filing of plat.
6. Fire protection facilities must be approved by the Renton Fire
Department prior to construction of any residence.
PLANNING DEPARTMENT RECOMMENDATION:
Recommend approval of the short plat subject to Planning Department
approval of the proposed house location to provide maximum flexibility
for possible future major platting of the property and to retain as
much existing trees as possible.
No significant trees shall be cut on the site without prior approval
of the Planning Department.
Recommend denial of waiver request and approval of an indefinite ;
deferral of the off-site improvements subject to the signing and filing
of covenants running with the land which state that the property owner
shall not oppose a future LID or City initiated action for installation
of such improvements. The use of septic tank sewage disposal must ‘be
