WHEREAS, the owner(s) of said described property desire to
impose the following restrictive covenants running with the land as
to use, present and future, of the above described real property.
NOW, THEREFORE, the aforesaid owner(s) hereby establish,
grant and impose restrictions and covenants running with the land
hereinabove described with respect to the use by the undersigned,
their successors, heirs, and assigns as follows:
INSTALLATION OF OFF-SITE IMPROVEMENTS
The owner(s) of the above described property, their suc-
cessors, heirs and assigns, hereby agree and covenant to
participate in, sign a petition in support of, and accept
any future Local Improvement District (LID) or city initia-
ted proposal, and pay their fair share therefore, for the
purposes of providing the necessary off-site improvements
required by the Renton Subdivision Ordinance. Said improve-
ments shall include but may not be limited to the installa-
tion of curbs, gutters, sidewalks, street paving, sanitary
sewers, storm sewers, undergrounding of utilities, and
street lighting.
These covenants are imposed in lieu of Section 9-1105(6)
of Title IX of Ordinance #1628 of the City of Renton.

DURATION
These covenants shall run with the land and expire on
December 31, 2025, If at any time improvements are
installed pursuant to these covenants, the portion of
the covenants pertaining to the specific installed improve-
ments as required by the Ordinances of the City of Renton
shall terminate without necessity of further documentation.
Any violation or breach of these restrictive covenants may be
enforced by proper legal procedures in the Superior Court of King
County by either the City of Renton or any property owners adjoining
subject property who are adversely affected by said breach.

No questions were offered by the Commission, and there were
no responses to an invitation for comment in favor or opposi-
tion from the audience. IT WAS THEN MOVED BY GIST, SECONDED
BY WIK, THAT THE PUBLIC HEARING BE CLOSED. MOTION CARRIED.
Commission discussion followed relating to appropriateness for
M-P use, reasoning for the granted variance, and applicability
of the Comprehensive Plan.
On the question to close the public hearing, mMOTron CARRIED.
Following further brief discussion, IT WAS
ACTION:
MOVED BY WIK, SECONDED BY GIST, THAT THE PLANNING COMMISSION
RECOMMEND APPROVAL OF THE DUANE A WELLS REZONE REQUEST TO THE
CITY COUNCIL, AS IT MEETS M-P ZONE REQUIREMENTS, IS IN AGREEMENT
WITH THE COMPREHENSIVE PLAN, IS COMPATIBLE WITH EXISTING USES
IN THE AREA, AND THERE ARE ADEQUATE UTILITIES IN THE AREA.
MOTION CARRIED.
SITE APPROVAL:
Mr. Wells was asked to describe his proposal further to the
Commission.
Mr. Wells distributed photographs of a building in Spokane which
is similar to the structure proposed. He discussed parking,
access, and landscaping and inquired regarding staff recommenda-
tions pertaining to them. The Planning Director and Associate
Planner responded relative to ordinance requirements regarding
these items and reasons for their recommendations. Due to the
questions expressed by the applicant. it was requested that the
matter be continued to December 8th to allow time to resolve
these questions. IT WAS THEN
ACTION:
MOVED BY GIST, SECONDED BY TEEGARDEN, THAT THE PUBLIC HEARING
BE CONTINUED UNTIL DECEMBER 8, 1976, UNTIL THE STAFF AND APPLI-
CANT CAN WORK OUT APPARENT PROBLEMS RELATING TO THE SITE
APPROVAL APPLICATION. MOTION CARRIED.
Commissioner Mola indicated his concern regarding the need for
appropriate landscaping on the southern part of the site due
to its abutting Grady Way. It was indicated that the staff
would review the adequacy of the landscaping proposed.
WAIVER OF OFF-SITE IMPROVEMENTS:

The Planning Director introduced the item and requested review
by the Associate Planner.
Associate Planner Smith noted property location and size, pro-
posed subdivision, and a request for waiver of off-site improve-
ments as required by ordinance. He indicated that there are no
similar improvements in the area. It was decided not to view
slides of the neighborhood.
The Vice-chairman called for comment from the applicant.
Douglas Weston, 21318 - 109th Ave. S.E., Kent, advised that
there are no off-site improvements in the area, that there is
a row of trees along Meadow Ave. No. that he does not want to

disrupt, that installation of sidewalks could possibly affect
the grade of Meadow, and that he is willing to file restrictive
covenants agreeing to participation for a future L.I.D. should
a waiver be granted.
As there were no questions of the applicant, the Vice-chairman
invited comments in favor of the application from the audience.
None were offered. She then called for comments in opposition.
Jerry Davis, 2407 Meadow Ave. No., inquired regarding the spe-
cifics of the application. Mr. Ericksen explained the proposal,
noting ordinance requirements and willingness of the applicant
to agree to covenants requiring participation in an L.I.D. ata
later date. Mr. Davis then indicated that he was not opposed
to the request.
Discussion followed regarding the lack of off-site improvements
and a street elevation system for the area, and IT WAS MOVED BY
TEEGARDEN, SECONDED BY MOLA, THAT THE PUBLIC HEARING BE CLOSED.
MOTION CARRIED. The following action ensued:
ACTION:
MOVED BY MOLA, SECONDED BY TEEGARDEN, THAT THE COMMISSION APPROVE
AN INDEFINITE DEFERRAL OF OFF-SITE IMPROVEMENTS SUBJECT TO THE
FILING OF RESTRICTIVE COVENANTS REQUIRING PARTICIPATION IN A
FUTURE L.I.D. INITIATED BY THE NEIGHBORHOOD OR CITY INITIATION
OF OFF-SITE IMPROVEMENTS.
There was further discussion regarding the character of the area
and justification for the request. On the question, MOTION CARRIED, Gist dissenting.
6. ADMINISTRATIVE:
A, COMMITTEE REPORTS
1. LAND USE COMMITTEE
Chairman Teegarden advised that the committee had met
on November 3rd with the Kennydale community representa-
tives regarding the Comprehensive Plan in the No. 30th
and Park Ave: No. area, and a written report to the
Commission will be forthcoming shortly. Commissioner
Teegarden advised that a memorandum is being sent to
the Special Studies Committee relative to the Glen
Norwood rezone request in the area advising them of

impose the following restrictive covenants. running with the land as
to use, present and future, of the above described real property.

grant and impose restrictions and covenants running with the land

INSTALLATION OF OFF-SITE IMPROVEMENTS
The owner(s) of the above described property, their suc-
cessors, heirs and assigns, hereby agree and covenant to
participate in, sign a petition in support of, and accept
any future Local Improvement District (LID) or city initia-
ted proposal, and pay their fair share therefore, for the
purposes of providing the necessary off-site improvements
required by the Renton Subdivision Ordinance. Said improve-
ments shall include but may not be limited to the installa-
tion of curbs, gutters, sidewalks, street paving, sanitary
sewers, storm sewers, undergrounding of utilities, and
street lighting.
These covenants are imposed in lieu of Section 9-1105(6)
of Title IX of Ordinance #1628 of the City of Renton.

DURATION
These covenants shall run with the land and expire on
December 31, 2025, If at any time improvements are
installed pursuant to these covenants, the portion of
the covenants pertaining to the specific installed improve-
ments as required by the Ordinances of the City of Renton
shall terminate without necessity of further documentation.
Any violation or breach of these restrictive covenants may be
enforced by proper legal procedures in the Superior Court of King
County by either the City of Renton or any property owners adjoining
subject property who are adversely affected by said breach.

no responses to an invitation for comment in favor or opposi-
tion from the audience. IT WAS THEN MOVED BY GIST, SECONDED
BY WIK, THAT THE PUBLIC HEARING BE CLOSED. MOTION CARRIED.
Commission discussion followed relating to appropriateness for
M-P use, reasoning for the granted variance, and applicability
of the Comprehensive Plan.
On the question to close the public hearing, MOTION CARRIED.
Following further brief discussion, IT WAS

MOVED BY WIK, SECONDED BY GIST, THAT THE PLANNING COMMISSION
RECOMMEND APPROVAL OF THE DUANE A WELLS REZONE REQUEST TO THE
CITY COUNCIL, AS IT MEETS M-P ZONE REQUIREMENTS, IS IN AGREEMENT
WITH THE COMPREHENSIVE PLAN, IS COMPATIBLE WITH EXISTING USES
IN THE AREA, AND THERE ARE ADEQUATE UTILITIES IN THE AREA.
MOTION CARRIED.
SITE APPROVAL:
Mr. Wells was asked to describe his proposal further to the
Commission.
Mr. Wells distributed photographs of a building in Spokane which
is similar to the structure proposed. He discussed parking,
access, and landscaping and inquired regarding staff recommenda-
tions pertaining to them. The Planning Director and Associate
Planner responded relative to ordinance requirements regarding
these items and reasons for their recommendations. Due to the
questions expressed by the applicant. it was requested that the
matter be continued to December 8th to allow time to resolve
these questions. IT WAS THEN
ACTION:
MOVED BY GIST, SECONDED BY TEEGARDEN, THAT THE PUBLIC HEARING
BE CONTINUED UNTIL DECEMBER 8, 1976, UNTIL THE STAFF AND APPLI-
CANT CAN WORK OUT APPARENT PROBLEMS RELATING TO THE SITE
APPROVAL APPLICATION. MOTION CARRIED.
Commissioner Mola indicated his concern regarding the need for
appropriate landscaping on the southern part of the site due
to its abutting Grady Way. It was indicated that the staff
would review the adequacy of the landscaping proposed.

The Planning Director introduced the item and requested review
by the Associate Planner.
Associate Planner Smith noted property location and size, pro-
posed subdivision, and a request for waiver of off-site improve-
ments as required by ordinance. He indicated that there are no
similar improvements in the area. It was decided not to view
slides of the neighborhood.
The Vice-chairman called for comment from the applicant.
Douglas Weston, 21318 - 109th Ave. S.E., Kent, advised that
there are no off-site improvements in the area, that there is
a row of trees along Meadow Ave. No. that he does not want to

disrupt, that installation of sidewalks could possibly affect
the grade of Meadow, and that he is willing to file restrictive
covenants agreeing to participation for a future L.I.D. should
a waiver be granted.
As there were no questions of the applicant, the Vice-chairman
invited comments in favor of the application from the audience.
None were offered. She then called for comments in opposition.
Jerry Davis, 2407 Meadow Ave. No., inquired regarding the spe-
cifics of the application. Mr. Ericksen explained the proposal,
noting ordinance requirements and willingness of the applicant
to agree to covenants requiring participation in an L.I.D. ata
later date. Mr. Davis then indicated that he was not opposed
to the request.
Discussion followed regarding the lack of off-site improvements
and a street elevation system for the area, and IT WAS MOVED BY
TEEGARDEN, SECONDED BY MOLA, THAT THE PUBLIC HEARING BE CLOSED.
MOTION CARRIED. The following action ensued:

MOVED BY MOLA, SECONDED BY TEEGARDEN, THAT THE COMMISSION APPROVE
AN INDEFINITE DEFERRAL OF OFF-SITE IMPROVEMENTS SUBJECT TO THE
FILING OF RESTRICTIVE COVENANTS REQUIRING PARTICIPATION IN A
FUTURE L.I.D. INITIATED BY THE NEIGHBORHOOD OR CITY INITIATION
OF OFF-SITE IMPROVEMENTS.
There was further discussion regarding the character of the area
and justification for the request.
On the question, MOTION CARRIED, Gist dissenting.

Chairman Teegarden advised that the committee had met
on November 3rd with the Kennydale community representa-
tives regarding the Comprehensive Plan in the No. 30th
and Park Ave: No. area, and a written report to the
Commission will be forthcoming shortly. Commissioner
Teegarden advised that a memorandum is being sent to
the Special Studies Committee relative to the Glen
Norwood rezone request in the area advising them of
the Kennydale residents position on the matter.
The next meeting of the Land Use Committee is scheduled
