Please find attached Restrictive Covenant's form for the Denny' s
Restaurant development at N.E. 44th St. and Lake Washington Blvd. , r
on the east side of 1-405 above Port Quendall . The developer was
given a deferral by the Board of Public Works for curb, gutter
and street improvements, together with the right to build across
both of his parcels "A" and "B" a large storm detention pond.
This covenant ties up the pond area to be preserved as a storm/111
flood control pond until future downstream improvements are made.
The agreement also defines the developer's responsibility to build,
at some future time, a 48" storm trunk sewer across Lake Washington
Boulevard.
As pointed out by the City Attorney, the developer has provided us
with a limited liability title report that shows that the owners
have clear title to the property. We have made two changes to the
form supplied by the developers:
1 . Clarification of the process for installation of
the 48" storm line to the lake.
2. Deletion of the words that waiver our future techni-
cal review of the proposed storm drainage improvements.
Please initial the changes on the document and sign and notarize
at the end of the document where indicated.
If you have any questions, please feel free to contact us to
explain this rather complex agreement.

DECLARATION OF RESTRICTIVE COVENANTS
WHEREAS, Paul A. Butrim, G. Harlan Lewis, and Arne R.
Mortensen, are the owners of the following real property in the
City of Renton, County of King, State of Washington, described
as Exhibit 'A' attached hereto.
WHEREAS, the owner (s ) of said described property desire
to impose the following restrictive covenants running with the
land as to use, present and future, of the above described real
property; and
WHEREAS, the City of Renton, in coordination with the
owners of said property has determined that the existing combined
storm water retention capacity of Parcel 'A' , Parcel ' B' and the
adjoining right-of-way is 100 , 000 cubic feet; and
WHEREAS, the owners of said property wish to redistribute
said capacity and establish separate requirements for retention
capacity for Parcel 'A' and for Parcel ' B" and
WHEREAS, the City of Renton wishes the owners of said
property to participate in future installation of storm drainage
pipe that will eventually reduce the need for said storm drainage
retention requirements ;
NOW, THEREFORE, the aforesaid owner( s ) hereby establish ,
grant and impose restrictions and covenants running with the land
hereinabove described with respect to the use by the undersigned,
their successors, heirs, and assigns as follows :
STORM WATER RETENTION REQUIREMENTS
1 . The owners of said Parcel 'A' , their successors , heirs
and/or assigns , and the City of Renton hereby agree
and covenant that any and all development of Parcel
A' and the adjoining right-of-way shall provide
37 , 500 cubic feet of storm water drainage retention
capacity and provisions for said capacity shall be
installed to City standards in conjunction with said
development at no expense to the City.
2 . The owners of said Parcel ' B' , their successors , heirs
and/or assigns and the City of Renton hereby agree
and covenant that any and all development of Parcel
B' shall provide 62 , 500 cubic feet of storm water
drainage retention capacity and provisions for said
capacity shall be installed to City standards in con-
junction with said development at no expense to the
City.
INSTALLATION OF PIPE TO INCREASE FLOW TO LAKE
The owners of said Parcel ' B' , their successors , heirs and/or
assigns and the City of Renton agree and covenant that when

said Parcels 'A' and ' B' and Lake Washington to increase storm
drainage flow from said Parcels 'A' and 'B' to Lake Washington
that said owners of Parcel ' B' , their successors , heirs and/or
assigns shall install , at no expense to the city, a maximum
of seventy feet of 48-inch diameter storm drainage pipe across
Lake Washington Boulevard N.E. right-of-way adjoining said
Parcels and shall install in said right-of-way, at no cost
to the City, open ditches or conduit constructed to City stan-
dards , along frontage of said Parcels so that storm water will
flow to said 48-inch diameter storm drainage pipe.
DURATION
These covenants shall run with the land in perpetuity. Upon
installation of said storm drainage pipe across Lake Washing-
ton Boulevard N.E. right-of-way adjoining said Parcel ' B' ,

REPORT AND DECISION,
APPLICANT: Denny's , Inc.FILE NO. SA-050-82
LOCATION: East side of Lake Washington Boulevard N. and north of N.E.
44th Street.
SUMMARY OF REQUEST: The applicant seeks site plan approval for construction of a
6,300 square foot restaurant on the subject site.
SUMMARY OF ACTION:Building & Zoning Department Recommendation: Approval with
conditions.
Hearing Examiner Decision: Approval with conditions.
BUILDING & ZONING The Building & Zoning Department report was received by the
DEPARTMENT REPORT:Examiner on August 3, 1982.
PUBLIC HEARING: After reviewing the Building & Zoning Department report,
examining available information on file with the application,
and field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as follows :
The hearing was opened on August 10, 1982 at 9:20 a.m. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
Roger Blaylock, Zoning Administrator, presented the Building & Zoning Department report,
and entered the following exhibits into the record:

A correction to the last line of Section 1 .5 to indicate the square footage of the proposed
facility as 6,300 was denoted by Mr. Blaylock. Responding to the Examiner 's request to
designate location of proposed retention ponds , Mr. Blaylock referred to Exhibit #2,
noting that detention ponds are outlined in black and are located almost entirely on public
right-of-way.
The Examiner requested testimony by the applicant. Responding was :

Mr. Freiheit stated his concurrence in the staff report; however, he referenced Condition
No. 1 of the recommendation which requires moving the southern property line 17 feet to the
south, and requested the following three alternatives in lieu of that condition: either
move the property line 17 feet, obtain a variance, or modify driveway location, parking
and driveways on site to meet staff requirements . Mr. Blaylock agreed to the modification.
Referencing Condition No. 4, design and construction of intersection improvements at S.E.
76th Street and Lake Washington Boulevard N. to meet public works standards, Mr. Freiheit
indicated concurrence in providing required off-site improvements , but felt that it is not 111
within the scope of the developer to design the intersection. He suggested instead that
the developer conform to the city's design.
The Examiner requested further testimony in support of the application. Responding was:

Mr. Butrim clarified several matters regarding sewer line extension, water mains and storm
drainage retention. He noted that the Denny's site is a one-acre separate legal lot, and
provision of utilities to the entire 13-acre site at this time would create an unreasonable

burden on the remainder of the property owners . Storm drainage requirements have been met
in accordance with the special permit approved some time ago, and the three retention
ponds will serve the Denny's facility and are part of the total requirement placed on the
property by the city. Responding to the Examiner's inquiries regarding whether the three
ponds are at the end of the drainage chain or the beginning, Mr. Butrim advised that the
ponds constitute the end of the chain prior to channeling water under Lake Washington
Boulevard, and they are capable of accepting water from the other 70 acres in the area as
required by conditions of the fill permit.
Addressing the subject of sewer and water utilities, Mr. Butrim noted that a 12-inch water
line exists down S.E. 76th to Lake Washington Boulevard and then to the north, which is of
sufficient capacity to serve the Denny's facility; and, therefore, Condition No. 6, which
requires extension of sewer and water mains from N.E. 44th to S.E. 76th, is excessive at
the current time. He also noted approval of a sewer LID in the area two to three years
ago which provides capacity for the subject site, and a pump system can be designed by the
applicant for submission to the city to provide installation in connection with the
development.
The Examiner noted that storm drainage ponds are built on state right-of-way, and if the
state rejects the request for construction of those facilities, they would require
construction on the subject site. Mr. Butrim advised agreement by the state to transfer
that property to the city, and a letter of intent has been written for transmittal at this
time. He noted that if roads require widening in the future to include that retention
area, further solutions such as extending large pipes under Lake Washington Boulevard and
1-405 to tie in with the Quendall development are available.
The Examiner requested testimony in opposition to the proposal . Responding was:

Although Ms. Huson indicated she is not in opposition to the proposal , she is concerned
regarding potential sliding in the area due to the proposed development. She cited
previous incidents of slippage due to location of a large fault approximately 2,000 feet
above the subject site, and advised that the area is designated on sensitive area maps of
King County as a land slide area which contains elevations in excess of 15 degrees. Ms.
Huson concluded her comments by requesting assurance that as a result of the development
and change in pervious surfaces that similar land slides do not recur.

Responding to the discussion regarding storm water retention, Mr. Bergstrom explained the
history of the area, noting that existing pipes which were installed by the Department of
Transportation under 1-405 are inadequately sized to accommodate rainfall . Consequently,
the applicant was requested not to fill the areas next to the highway which retain
approximately 100,000 cubic feet of storage to which the applicant complied. Currently,
negotiations with the Department of Transportation are occurring to transfer ownership
of that portion of Lake Washington Boulevard N. back to the city. He also indicated that
further discussions with property owners may be required to assure conformance with public
safety requirements regarding sanitary sewer and maintenance of the storage ponds.
Responding to the Examiner's inquiry regarding the water main on S.E. 76th, Mr. Bergstrom
advised that the water main had been installed through a Local Improvement District formed
in 1975. Responding to the Examiner's inquiry regarding the desire of the applicant to
pump to an existing sewer line, Mr. Bergstrom stated that it would be possible for the
applicant to pump to the sewer line in N. E. 44th Street; however, the design will require
review. A north-south line crosses the N.E. 44th Street interchange ramp which turns east
at the south property line, and is a closer connection. Mr. Butrim submitted the Jones
Avenue Sanitary Sewer LID 284, which on page two illustrates the exact location of the
sewer line. The document was entered into the record by reference as Exhibit #4 by the
Examiner.
The Examiner asked Mr. Bergstrom to respond to Ms. Huson's concerns. Although Mr.
Bergstrom did not have a professional opinion, he felt that the possibility was remote
that the project site could trigger uphill sliding. However, the Department of Public
Works can consider the matter upon receipt of further soils information.
The Examiner requested final comments from Mr. Blaylock. In view of testimony by the
applicant, Mr. Blaylock indicated that the department would have no objection to
modification of Conditions No. 2 and 6, eliminating the requirement for approval of
storm drainage plans by the Department of Public Works, and deleting reference to N.E.

44th Street in No. 6 if the city currently has capacity in its pump system.

Since no further comments were offered, the hearing regarding File No. SA-050-82 was
closed by the Examiner at 10:03 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1 . The applicant, Denny's, Inc. , filed a request for site approval for the constructionofarestaurant.
2. The application file containing the application, SEPA documentation, the Building &Zoning Department report, and other pertinent documents was entered into the record
as Exhibit #1 .
3. Pursuant to the City of Renton 's Environmental Ordinance and the State EnvironmentalPolicyActof1971 , RCW 43.21C , as amended, a Declaration of Non-Significance has beenissuedforthesubjectproposalbytheEnvironmentalReviewCommittee (ERC) , responsibleofficial .
4. Plans for the proposal have been reviewed by all city departments affected by theimpactofthisdevelopment.
5. The subject site is located on the east side of Lake Washington Boulevard N. , northofN.E. 44th Street.
6. The subject site has been filled and graded and is therefore level , although it slopes
up to the north and east. The site served as a conduit for water flowing from thenorthandeast, and therefore detention/retention ponds were constructed to serve the
site. The ponds were accidentally constructed on state right-of-way.
The city is attempting to acquire the right-of-way and could take over maintenance
operations of the ponds if they are constructed to city standards.
7. The site is zoned B-1 (Business/Commercial ) and the aera in which the site is located
is designated by the Comprehensive Plan for business and commercial uses.
8. The applicant proposes constructing a 6,300 square foot restaurant on the 44,700
square foot lot. The applicant proposes constructing 65 parking stalls.
9. While the applicant is constrained by the location of the retention ponds, they aretobeincorporatedasafocalpointforthedevelopment. The applicant proposes
landscaping around the ponds and along Lake Washington Boulevard.
10. The areas surrounding the subject site are a mix of uses and vacant land. Commercial
and industrial uses are located south and west of the site. Multifamily units are
east of the site. Single family uses are also located east and north of the site on
the hillside east of the site and 1-405.
The staff recommends the site and roof of the building be screened by evergreen
vegetation and architectural additions , respectively, from the residential uses near
and topographically above the site.
11 . The site will have to be served by a combination of utility extensions according totheDepartmentofPublicWorks. Water lines are north of the site and a pump stationwouldservethesite's sewer needs.
12. The subject site is only one portion of the larger acreage involved in the previousfillandgradepermit. The applicant's predecessor in interest indicated the current
applicant should not have to bear the entire burden of utility extensions.
13. The areas above and east of the subject site are subject to slippage, but developmentofthesubjectsitewouldnotappeartohaveanyphysicalimpactsontheseupslope
areas.

14. The southerly driveway is improperly located, and the applicant will have to changeitslocationorperformsomeotheradjustmentormodificationtcpermitittomeet
code requirements.

CONCLUSIONS:
1 . The proposed reuse of the filled and graded site appears to serve the public use and
interest as well as permitting the applicant to make reasonable use of the site.
2. The site at the N.E. 44th Street interchange of 1-405 is well located for the
restaurant, but in keeping with the goals of the Comprehensive Plan, this highly
visible site must be adequately screened as recommended by the staff.
The site is visible from both the west along 1-405 and the residential areas north
and east. It must be screened differently for different effects and to minimize the
site's visual impact , especially to the east. Plantings such as evergreens approved
by the city's landscape architect must be utilized to shield the site constantly on
the east, while smaller flowering trees can be used on the Lake Washington Boulevard
property line.
3. The ponds now located on state right-of-way must be constructed to city standards ,
and the right-of-way acquired.
4. The development will require certain standard improvements of the right-of-ways
abutting the site.
Additionally, while only a portion of the total grade and fill site is under review,
utility lines must be extended in an orderly fashion pursuant to the Comprehensive
Plan. It is not unusual or unreasonable for the first developer in an area to
extend utilities as determined necessary to service an area and apply for latecomers '
fees. Therefore, the applicant will have to provide those utilities and easements
determined necessary by the Departments of Public Works and Policy Development.
5. Rather than constrain the applicant's site plan, the applicant will be required to
modify whatever aspects of the proposal they determine necessary to correct the
south driveway's improper location abutting a property line.
6. The roof which will have roof mounted equipment will have to be screened to preserve
the views of the upslope residential areas.
DECISION:
The subject proposal is approved subject to the following:
1 . The site will have to be landscaped to permanently screen the site on its east and
enhance the views on the west along Lake Washington Boulevard as approved by the
landscape architect.
2. The roof machinery will have to be enclosed.
3. The driveways will have to meet city requirements.
4. Utilities will have to be extended as determined by the Public Works and Policy
Development Departments .
5. The land upon which the retention ponds are located must be successfuly acquired
by the city, but any costs associated with such acquisition and any necessary
changes to the pond system must be borne by the applicant.

C. HISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinance #1823 dated
April 21, 1960. Tract #184 and the South 160 feet of Tract #185 was
rezoned from G-9600 to B-1 by Ordinance #2487 of July 18, 1969, and
the remainder of Tract #185 was rezoned from G-9600 to B-1 by Ordinance
2592 of October 23, 1970. On March 10, 1980, the Hearing Examiner
approved a Special Permit for fill and grade on the subject site.

D. PHYSICAL BACKGROUND:
1. Topography: The subject site slopes downward from east to west
with a slight slope downward from north to south.
2. Soils: Bellingham Silt Loam, less than 2% slopes (Bh). Permeability
is slow, runoff is slow, and the erosion hazard is slight. This soil
is used mostly for pasture and a few areas are used for row crops.
Kitsap Silt Loam, 8-15% slopes (KpC). Runoff is medium and the
erosion hazard is moderate to severe. This soil is used for timber
and pasture.
3. Vegetation: Scrub grass is the dominant feature in the west and
central portions of the property with some medium height shrubs
and blackberries near the easterly extreme. Scattered Doublas Fir
and some deciduous species are also present.
4. Wildlife: The existing vegetation provides suitable habitat for
birds and small mammals.
5. Water: A spring is located to the northeast of the subject site
flowing in a southwesterly direction across the property.
6. Land Use; The subject site is vacant.
E. ' NEIGHBORHOOD CHARACTERISTICS:
The area east of FAI-405 is primarily undeveloped with the existing uses
comprised principally of single family dwellings except for one large
multiple family project near the subject site on the east. Properties
to the south have been filled while those to the west of FAI-405 are
a mixture of industrial , commercial , and some multiple family.
F. PUBLIC SERVICES:
1. Water and Sewer: A twelve-inch water main extends along Lake Washington
Boulevard N.E. and six-inch and eight-inch mains run east-west on
N.E. 44th Street. A twelve-inch sanitary sewer is located on N.E.
44th Street along the southerly border of the site.
2. Fire Protection: Provided .by the Renton Fire Department as per
ordinance requirements.
3. Transit: METRO Transit Route #240 operates along Lake Washington
Boulevard N.E. adjacent to the subject site.
4. Schools: Not Applicable.
5. Recreation: Not Applicable.

I. IMPACT ON THE NATURAL OR HUMAN ENVIRONMENT:
1. Natural Systems: Construction on the site will remove the vegetation,
disturb the soils, increase storm water runoff, and have an affect on
traffic and noise levels in the vicinity. Through proper development
controls and proceedures, however, these impacts can be mitigated.

2. Population/Employment: Some increased opportunities for employment
will be available for area residents.
3. Schools: Not applicable.
4. Social: Increased opportunities for social interaction may
result for patrons and employees of the proposed facility.
5. Traffic: The proposed restaurant would generate an additional
1035 average daily trips for the area streets. (164.4 trips/
1000 square feet for a b,300 square foot facility.)
J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMIINATION:
Pursuant to the City of Renton's Environmental Ordinance and the
State Environmental Policy Act of 1971, as amended, RCW 43-21C,
a Final Declaration of Non-Significance was issued for the subject
proporsal by the ERC on July 5, 1982.
K. AGENCIES/DEPARTFENITS CONTACTED:

L. DEPARTMENT ANALYSIS:
1. The proposal generally complies with the Comprehensive Plan
designation of Commercial for the subject site and the •B-1,
Business Use zoning.
2. The site plan approval is a result of a previous application
to fill and grade, SP-402-79. At the time of the original
request for fill and grade, the activities were unknown, therefore,
any future uses were to be reviewed under site plan approval
by the Land Use Hearing Examiner.
3. The proposal is to construct a 6,300 square foot restaurant
on a 44,700 square foot lot. Sixty-five parking spaces are 1
provided of which two are handicapped parking spaces.
4. Review of the original special permit to fill and grade, and
the subsequent development of the site, is specifically limited
by the location of the retention ponds necessary to continue
on-site storm water storage that existed prior to the original
filling of the subject site. The Environmental Review Committee
has specifically conditioned approval of the State of Washington
to allow the retention ponds to remain on their property.
It appears that after the approval of the original drainage
plan and construction of the retention ponds, an error was
discovered in the original survey which, in actuality, placed
the majority of the retention ponds upon the State right-of-way.
The City of Renton is presently attempting to acquire those
rights-of-way to be directly under City control and review.
The site itself is a commercial site of high visibility.
This is primarily the reason that Denny's Restaurant chose
the location to develop. However, the site also focuses upon
the retention ponds and special consideration needs to be
given to all phases of site planning in relationship to the
storm water issue. The Public Works Department sees the storm
water runoff and storage issue as a critical part of the entire
project. They recommend that the pond here and on the adjacent

Sea-Belle properties be upgraded and built to City standards
by the developer. The intent is that the City then can take
over the maintenance of the storm water storage pond, since
it is on public right-of-way. The assumption of maintenance
of retention/detention facilities is specifically delineated
under Section 4-2913 of the Renton Municipal Code.
5. The primary issue of the entire storm water drainage system
was the limitation of the outfall from the site. Presently,
there is an eighteen culvert which runs underneath Lake Washington
Boulevard. It may be necessary to increase this culvert depending
upon the final drainage plans. In addition, the plans show
the public sidewalk adjacent to the detention ponds. If the
slope is over a certain percentage by design manual criteria,
then a handrail or guardrail will be required to protect pedestrians
and the general public.
6. The Public Works Department advises that both water main and
sanitary sewer extensions will be necessary. In the case
of the water main, it will be required along Lake Washington
Boulevard from S.E. 76th Street to N.E. 44th Street. Sanitary
sewer extensions will be required along the east lot lines
to S.E. 76th Street from the existing sanitary sewer on N.E.
44th Street.
7. The site plan only addresses a portion of the required public
improvements. The property fronts on both Lake Washington
Boulevard and S.E. 76th Street. The intersection of S.E.
76th Street needs to be improved and will be required as a
condition of the building permit. The applicant has not specifi-
cally requested a waiver from those improvements to the Hearing
Examiner or deferral from the Board of Public Works.
Lake Washington Boulevard N.E is envisioned as a three ,lane
street intersecting with a three lane intersection for S.E.
76th Street. Intersection plans need to be approved by the
Public Works Department prior to issuance of the building
permit. In addition, the sidewalk should be continued around
the intersection corner to the northeastern property line.
The applicant shows in their plot plan widening of Lake Washington
Boulevard which would appear to be sufficient to meet the
immediate needs of the restaurant. Some widening will have
to take place as the State of Washington develops their property
on the west side of Lake Washington Boulevard into a Park-n-Ride
lot.
8. Both the Building Division and Policy Development Department
are concerned with the landscaping treatment of the subject
site. The subject site can be viewed from the north and east
by single family residential uses and immediately to the north
is a proposed multiple family residential use. Specific care
should be taken to buffer the site with landscaping. Policy
Development recommends that the northern and eastern property
lines be screened with evergreen trees instead of the deciduous
trees proposed on the landscaping plan. The Building Division
envisions a similar problem with maintenance and landscaping
of the detention ponds. Instead of hydroseeding the detention
ponds, the Building Division recommends that the ponds be
sodded and maintained in grassy areas as part of the landscaping
for the restaurant complex. In any case, some landscaping
treatment should be utilized along the public right-of-way
to buffer the ponds and blend them into both the street scape
and the building site. It is possible to utilize some type
of dwarf flowering tree immediately behind the proposed sidewalk
on Lake Washington Boulevard. This would not limit the visibility
of the restaurant from the interstate, but provide a more
tranquil setting and buffer between the land uses.

9. The parking lot as proposed meets dimensional requirements
for both parking stalls and aisle. However, the curb cuts
do not meet the recommended width required per comments from
the Public Works Department. These will have to be increased
from 24 feet to 30 feet to allow adequate ingress and egress.
In addition, the plot plan shows a common driveway on the
southern property line with a curb cut on the property line.
This is specifically not allowed by the Parking and Loading
Ordinance and the applicant has not sought a variance. Therefore,
approval must be conditioned upon moving the property line
17 feet to the south to comply with City standards. It is
also recommended that the five feet along the southern property
line then be landscaped with some type of temporary material
such as photenia to buffer the site until development occurs
on the southern lot.
10. Since the subject site is adjacent to residential uses, extra
care should be taken for both visual and light intrusions
from the site into the residential areas.
The Policy Development Department recommends that all lighting
be directed inward away from the northern and eastern property
lines. Based upon the site plan, it appears that the applicant
has accomplished this. In addition, replacing the deciduous
landscaping along the northern and eastern property lines
with evergreen landscaping would limit the diffusion of the
light if the standards were kept below 25 feet in height.
In most cases, the City has not been concerned about the visual
screening of roof mounted equipment. However, in this specific
case, single family residences will be looking directly onto
the roof of the subject building, therefore, all roof mounted
equipment should be enclosed within a structure.
M. DEPARTMENT RECOMMENDATION:
Based upon the above analysis, it is recommended that site approval
for Denny's Restaurant, SA-050-82, be approved subject to the following
conditions:
1. Moving the southern property line 17 feet to the south.
2. Approval of storm drainage plans by the Department of Public
Works which may include increasing the size of the culvert
underneath Lake Washington Boulevard.
3. Modification of the landscaping plan to include evergreen
landscaping along the northern and eastern property lines
and dwarf fruit trees along the street frontages adjacent
to the sidewalk.
4. Design and construction of intersection improvements at S.E.
76th Street and Lake Washington Boulevard N.E. to meet Public
Works standards.
5. Redesign of the curb cuts to be a minimum of 30 feet in width.
6. Extension of sanitary sewer mains and water mains from N.E.
44th Street to S.E. 76th Street.

3. When Sea Belle properties was given a fill permit, they were required
to maintain the volume •ofstormwater storage that naturally existed onthesite. This storage, including retention for the property, amounted
to approximately 100,000 cubic feet. This requirement was necessary
because the downstream system is inadequate to handle the runoff from
the upstream basin. Any proposed changes should not decrease the amount
of storage available or alter the hydraulic characteristics of the sys-
tem. Also, a decision needs to be made regarding using the publicright-of-way for most or all of this required storage, If the use of
the public right-of-way is allowed, provisions will be needed for main-
tenance of the pond by one of the adjacent property owners.
10. If the required storage is not maintained the risk of flooding increasesandwouldresultintheclosureofLakeWashingtonBlvd. during highwaterconditions. Besides the loss of access to the north and possi-ble property damage, the roadway is susceptible to structural damage
when it is overtopped and the subgrade is saturated.
16. The plans submitted do not provide adequate detail as to how sewer ser-
vice is to be provided and if the necessary rights across private prop-
erty have been secured. The storm drainage is of major concern and
will require careful evaluation. Off-site improvements would be
required on S.E. 76th St. to the east property line plus modifications
to the intersection as deemed necessary by Traffic Engineering.
The following represent questions or unknowns which need to be resolved in
conjunction with this project. The Committee might provide direction to
the applicant on some of these questions:
1 . Who will maintain pond?
2. Where will pond be located?
3. Denny's does not control entire frontage. How is entire storage
amount to be distributed?
4. Is the required storage amount still available?
5. If right-of-way is used for drainage, is a use permit required?
6. Provide detailed storm drainage calculations supporting proposedrevisionstosystem.

In addition to the memo submitted by Don Monaghan, I would like to
make these comments:
1 . Sanitary Sewer and Water main extensions required. Water main
installation required from S.E. 76th St. along Lake Washington
Blvd. south to existing watermains on N.E. 44th St.
Sanitary sewer extension required north along east lot line
to S.E. 76th St. from existing sanitary sewer on N.E. 44th St.
2. Street Improvements. Street improvements are required on Lake
Washington Blvd. and S.E. 76th St. including curb, gutter, side-
walk, storm drainage, street lighting and intersection improve-
ments. The southerly portion of Lake Washington Blvd. still
remains in the ownership of the Washington State Department of
Transportation. The City Public Works staff has been discussing
transfer of this right-of-way from WSDOT to the City.
3. Storm Run-off & Storage. The storm detention and flood storage
elements are the critical part of this project. The elements of
size of flood water storage, location, maintenance, accommodation
with street use can be best accommodated by this proposal :
The major pond here and on adjacent Sea-Belle properties, be
up-graded and built to City standards by the developer, either
by developer or L. I .D. procedures. The City will then take over
and maintain the pond with City forces .

3. When Sea Belle properties was given a fill permit, they were required
to maintain the volume •ofstormwater storage that naturally existed on
the site. This storage, including retention for the property, amounted
to approximately 100,000 cubic feet. This requirement was necessary
because the downstream system is inadequate to handle the runoff from
the upstream basin. Any proposed changes should not decrease the amount
of storage available or alter the hydraulic characteristics of the sys-
tem. Also, a decision needs to be made regarding using the public
right-of-way for most or all of this required storage, If the use of
the public right-of-way is allowed, provisions will be needed for main-
tenance of the pond by one of the adjacent property owners.
10. If the required storage is not maintained the risk of flooding increases
and would result in the closure of Lake Washington Blvd. during high
water conditions. Besides the loss of access to the north and possi-

when it is overtopped and the subgrade is saturated.
16. The plans submitted do not provide adequate detail as to how sewer ser-
vice is to be provided and if the necessary rights across private prop-
erty have been secured. The storm drainage is of major concern and
will require careful evaluation. Off-site improvements would be
required on S.E. 76th St. to the east property line plus modifications
to the intersection as deemed necessary by Traffic Engineering.
The following represent questions or unknowns which need to be resolved in
conjunction with this project. The Committee might provide direction to
the applicant on some of these questions:
1 . Who will maintain pond?
2. Where will pond be located?
3. Denny's does not control entire frontage. How is entire storage
amount to be distributed?
4. Is the required storage amount still available?
5. If right-of-way is used for drainage, is a use permit required?
6. Provide detailed storm drainage calculations supporting proposed
revisions to system.

In addition to the memo submitted by Don Monaghan, I would like to
make these comments:
1 . Sanitary Sewer and Water main extensions required. Water main
installation required from S.E. 76th St. along Lake Washington
Blvd. south to existing watermains on N.E. 44th St.
Sanitary sewer extension required north along east lot line
to S.E. 76th St. from existing sanitary sewer on N.E. 44th St.
2. Street Improvements. Street improvements are required on Lake
Washington Blvd. and S.E. 76th St. including curb, gutter, side-
walk, storm drainage, street lighting and intersection improve-
ments. The southerly portion of Lake Washington Blvd. still
remains in the ownership of the Washington State Department of
Transportation. The City Public Works staff has been discussing
transfer of this right-of-way from WSDOT to the City.
3. Storm Run-off & Storage. The storm detention and flood storage
elements are the critical part of this project. The elements of
size of flood water storage, location, maintenance, accommodation
with street use can be best accommodated by this proposal :
The major pond here and on adjacent Sea-Belle properties, be
up-graded and built to City standards by the developer, either
by developer or L.I .D. procedures. The City will then take over
and maintain the pond with City forces.

C) Liability Policy. The person constructing the facility shall maintain a liability
policy during such private ownership with policy limits of not less than one
hundred thousand dollars ($100,000.00) per individual, three hundred
thousand dollars ($300,000.00) per occurrence and fifty thousand dollars
50,000.00) property damage, which shall name the City of Renton as an
additional insured without cost to the City and which shall protect the City
of Renton from any liability, cost or expenses for any accident, negligence,
failure of the facility, omission or any other liability whatsoever relating to
the construction or maintenance of the facility. Said liability policy shall be
maintained for the duration of the facility by the owner of the facility,
provided that in the case of facilities assumed by the City of Renton for
maintenance pursuant to Section 4-2907 of this Ordinance, said liability
policy shall be terminted when said City maintenance responsibility
commences.
4-2913: CITY ASSUMPTION OF MAINTENANCE: The City of Renton is
authorized to assume the maintenance of retention/detention facilities
after the expiration of the three (3) year maintenance period in connection with the
subdivision of land if:
A) All of the requirements of Section 4-2909 have been fully complied with;
8) The facilities have been inspected and approved by the Department after
their first year of operation;
C) The surety bond required in Section 4-2912 herein has been extended for
one year covering the City's first year of maintenance;
D) All necessary easements entitling the City to properly maintain the facility
have been conveyed to the City;
E) It is recommended by the Public Works Director and concurred in by the
City Council that said assumption of maintenance would be in the best
interests of the City.
The owner of said property shall throughout the maintenance period notify the City
in writing if any defects or improper workings of the drainage system has come to
his notice. Failure to so notify the City shall give the City cause to reject
assumption of the maintenance of the facility at the expiration of the three (3) year
maintenance period, or within one year of the discovery of the defect or improper
working, whichever period is the latest in time.

COMMENTS:
Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
Please answer the following questions as completely as you can with the information
presently available to you. Where explanations of your answers are required, or where
you believe an explanation would be helpful to government decision makers , include your
explanation in the space provided, or use additional pages if necessary. You should
include references to any reports or studies of which you are aware and which are rele-
vant to the answers you provide. Complete answers to these questions now will help all
agencies involved with your proposal to undertake the required environmental review with-
out unnecessary delay.
