13 COMES NOW the CITY OF RENTON and for complaint against the
14 Defendants, alleges as follows:
15 I.
16 Plaintiff is a municipal corporation, organized and exist-
17 ing under the laws of the State of Washington.
18 II .
19 CLARKRICH, INC. is a Washington corporation, doing business
20 in the State of Washington, including specific projects within
21 the city limits of the City of Renton. Defendant HERITAGE
22 INSURANCE COMPANY OF AMERICA is a foreign insurance corporation
23 doing business in the State of Washington.
24 III.
25 Defendant CLARKRICH, INC. installed certain developments
26 within the city limits of the City of Renton. As a -require-
27 ment of that development, CLARKRICH, INC. was required to
28 install certain improvements. Upon request by Defendant

1 CLARKRICH, INC. , the City agreed to defer the installation of
2 certain of those improvements, as required by City law, upon
3 condition that a bond be provided to the City of Renton.
4 Such bond was provided to the City by Defendant HERITAGE
5 INSURANCE COMPANY OF AMERICA by means of a document entitled
6 Deferral Performance Bond - Bond No. H 33833 , a copy of which
7 is attached hereto and incorporated by reference as if fully
8 set forth.
9 IV.
10 The bond required that the work to be performed be com-
11 pleted and accepted by the City of Renton on or before
12 March 1, 1985 . That work has not been completed.
13 V.
14 The City has made demands on the bonding company and
15 CLARKRICH, INC. to perform without any results to date.
16 WHEREFORE, the CITY OF RENTON prays for judgment against
17 Defendants as follows:
18 1 . For judgment in the amount of $65, 000 .00 ; to install
19 the improvements as required at 520 Union Avenue N.E. and the
20 Union 670tproject;
21 2 . For the City' s costs and fees herein;
22 3 . For reasonable attorney' s fee permitted by law;
23 4 . For such other and further relief as deemed just and
24 equitable in the premises.

The condition of the foregoing obligation is such that the
above described principal must construct the improvements described
in attached Exhibit "A" and have them accepted by the City of Renton,
on or before the 1ST day of MARCH 1985 . This bond
is specifically given to induce the City of Renton to defer these '
improvements until the above mentioned date and this bond serves

as security for the installation of those improvements .
The principals of this bond agree to the following terms
and conditions: Said improvements and their appurtenances thereto
shall be constructed in accordance with approved plans and as per
City of Renton standards and APWA standards where applicable.
It is hereby expressly agreed that this bond is also given
and made as a guarantee against defective materials or workmanship
in the construction of said improvements , provided, however, that
no suit or action or proceeding by any reason of any defect whatever
shall be brought upon this bond after one year following the final
acceptance of said improvements by the City.
The condition of this obligation is such that if the
principal shall not construct said improvements in accordance
with the terms and conditions set forth herein within the time
limits prescribed, then the City can make demand upon the surety
to complete said improvements . If the surety declines to construct
the improvements at its sole cost and expense, then the surety
shall be liable under this bond for the full amount of this bond,
or the actual expense necessary for the City to install said
improvements, whichever sum is less.

The Board of Public Works, at the February 8, 1984 meeting, approved the
request for off-site improvements, i.e. storm drain/detention system,
sanitary sewer, asphalt driveways/curb cuts for driveways in right-of-ways,
sidewalks at N.E. 5th St. (south side) and roadway restoration on N.E.5th Street
subject to your posting a $79,000 bond and further that the deferral be for
a one-year period. It was further noted that the recording of the plat would
not take place until the bond was posted with the Public Works Department
this office).

ORDINANCES AND RESOLUTIONS continued
Additional An ordinance was read amending a portion of Chapter 7, Title IV
Zoning Building Regulations) relating to zoning by adding zoning
Classifications classifications P-1 , Public, and 0-P, Office Park. Chairman Clymer
P-1 , O-P) advised receipt of a letter from the Planning Commission Ordinance
Development Committee, dated March 3, 1983, concerning retail sales
in the Office Park zone as a conditional use, and recommending
revision of proposed Section 4-720(B) (3) (F) as follows: 1 ) In two
2) story buildings, retail sales may be located only on the first
floor and where they do not, in the aggregate, exceed fifty (50)
percent of the gross floor area of the building; and 2) In multi-
story buildings, three (3) stories or more in height, retail sales
space may be located on any floor of the structure and where they
do not, in the aggregate, exceed fifty (50) percent of the gross
floor area of the building.
Continued Councilman Hughes objected to restrictive nature of the provision
regarding retail sales in two story buildings. Roger Blaylock,
Zoning Administrator, explained intent of the ordinance to allow
retail sales in upper floors only as a support to the major office
function; otherwise, a commercial zoning designation may be more
appropriate if retail sales are the major function of the building.
Following lengthy discussion, it was moved by Stredicke, seconded by
Reed, Council accept the wording suggested by the Planning Commission
as a replacement to proposed Section (3) (F) of the ordinance, with
one additional stipulation that retail business in other than ground
floor locations be related to office park function. SUBSTITUTE
MOTION: MOVED BY ROCKHILL, SECONDED BY HUGHES, COUNCIL ACCEPT
THE WORDING OF PART 2 OF THE PLANNING COMMISSION RECOMMENDATION,
BUT DELETE THE WORDS "THREE (3) STORIES OR MORE IN HEIGHT" FOR
MULTI-STORY BUILDINGS. MOVED BY MATHEWS, SECONDED BY STREDICKE,
AMEND SUBSTITUTE MOTION TO ADD: RETAIL SALES LOCATED ON OTHER THAN
FIRST FLOOR BE LIMITED TO THOSE BUSINESSES WHICH WOULD SERVE OFFICE
PARK FUNCTION. MOTION ON AMENDMENT CARRIED. SUBSTITUTE MOTION AS
AMENDED: COUNCIL ACCEPT THE WORDING OF THE PLANNING COMMISSION
RECOMMENDATION AS FOLLOWS: IN MULTI-STORY BUILDINGS, RETAIL SALES

Landscaping An ordinance was read amending a portion of Chapter 7, Title IV
Ordinance Building Regulations) by adding a section relating to landscaping
and amending Section 4-2204(8) . MOVED BY CLYMER, SECONDED BY
STREDICKE, CONCUR IN THE RECOMMENDATION OF THE WAYS AND MEANS
COMMITTEE AND REFER THIS MATTER BACK TO COMMITTEE FOR ONE WEEK.
CARRIED.
Ways and Means Committee Chairman Clymer presented a report
recommending the following resolutions for reading and adoption:
Resolution #2496 A resolution was read approving nine-lot final plat for McWilliams
McWilliams Final (Clark-Rich, inc.) , File No. FP-074-82,, for property located on the
Plat FP-0 east side of Union Avenue N.E. between N.E. 4th Street and N.E. 6th
Union 600 Street, extended. MOVED BY CLYMER, SECONDED BY HUGHES, COUNCIL
ADOPT THE RESOLUTION AS PRESENTED. CARRIED. Councilman Stredicke
requested his "no" vote be recorded.
A resolution was read grantingapproval of the transfer of franchiseResolution #2497 PP
Clearview TV of Clearview TV Cable to Group W Cable. MOVED BY CLYMER, SECONDED BY
Cable Franchise REED, COUNCIL ADOPT THE RESOLUTION AS PRESENTED. Councilman Stredicke
Transfer to questioned whether a construction schedule is currently included in
Group W Cable Group W Cable franchise. City Attorney Warren confirmed inclusion of
the schedule. MOTION CARRIED.
NEW BUSINESS Council President Trim announced an Executive Session following
Executive the audience comment portion of the Council agenda to discuss personnel
Session matters.

Other Adult Councilman. Rockhill asked for an approximate date of submittal of
Entertainment information regarding other adult entertainment uses from the City
Uses Attorney. Mr. Warren advised several ordinances from other jurisdictions
will be transmitted to the committee within two to three weeks for review.
Agreement Councilman Stredicke asked for status report regarding proposed
With Water interlocal agreement with Water District No. 58. Mayor Shinpoch
District No. explained alternatives for transferring water system for Ponderosa
58 Estates plat from that water district to City of Renton system,
noting discussion with Public Works Department staff and direction
from City Council necessary. (See later action.)
Signs Posted Responding to Councilman, Stredicke's inquiry regarding enforcement
in City of the Sign Code, Mr. Blaylock advised that "for rent" signs posted !
Right-of-Way in city right-of-way are in violation of the ordinance and will be
removed.

SB 4196 -Councilman Stredicke discussed Senate Bill 4196, $750 million public
Infrastructure works infrastructure bill scheduled for executive action in the
Bond Issue Legislature. It was MOVED BY STREDICKE, SECONDED BY MATHEWS, CITY
OF RENTON GO ON RECORD IN SUPPORT OF SB 4196. Mayor Shinpoch explained
short notice given by A.W.C. of legislative action and lack of I
opportunity to poll Council members regarding the matter. Councilman
Rockhill questioned source of funds, noting his preference for the II
city to sell its own bonds rather than relying on the state for
distribution. MOTION CARRIED.
HB 235 - Gas Councilman Stredicke also expressed support of House Bill 235, gasoline
Tax Package tax package which will include increases in July of 1983 and July of
1984 to be shared by cities on a formula basis. Kay Johnson, Manager,
Renton Chamber of Commerce, explained support of the bill by the
Chamber only if larger portion proposed for cities having high
maintenance costs for heavily traveled state arterials. Councilman
Stredicke noted that without the additional gas tax, urban arterial
projects will receive no funding at all , and encouraged support of the
bill for that reason. It was subsequently moved by Stredicke, seconded
by Mathews, that the City of Renton go on record in support of HB 235, d
and that the Legislature be notified of the city's concern that the d
formula be increased for local municipalities bisected by state 1
arterial roads receiving full traffic impact. SUBSTITUTE MOTION:
MOVED BY ROCKHILL, SECONDED BY HUGHES, THE) CITY OF RENTON GO ON RECORD
IN SUPPORT OF HB 235 IF THE FORMULA IS INCREASED FOR LOCAL MUNICIPALITIES
WHICH ARE BISECTED BY STATE ARTERIAL ROADS RECEIVING FULL TRAFFIC
IMPACTS. CARRIED.

WHEREAS a petition for the approval of a final plat for th(

SPECIAL Battalion Chief James Matthew introduced the newest member of the
PRESENTATION Fire Department, a mechanical fire hydrant operated by remote control ,
Renton Fire donated by Renton Rotary Club for purposes of fire safety instruction
Department in schools, churches and other public and private institutions.
Demonstrates Rotary Club officers and members George Lewis, Bryant Parker, Don
Fire Prevention Morrison and Bob McBeth were introduced, and sincere gratitude was
Bureau Robot expressed on behalf of the Fire Department and city for the club's
generosity. The robot, yet unnamed, entertained the audience and
officials with the assistance of Camille Radcliffe, Fire Code
Inspector, and Ken Walls, Fire Inspector/Investigator, operator of
the controls. The robot concluded the presentation by requesting
suggestions for an appropriate name be sent to the department.
CONSENT AGENDA The following items were adopted by one motion which follows the
items included:

McGrory Claim Claim for damages in the amount of $62.60 filed by Terence R. McGrory,
for Damages 16206-190th S.E. , Renton, for alleged improper automobile impoundment
CL-06-83 by Renton City Police on 2/25/83. Refer to City Attorney and
Insurance Carrier.
MOVED BY TRIMM, SECONDED BY CLYMER, COUNCIL ADOPT THE CONSENT AGENDA
AS PRESENTED. CARRIED.
CORRESPONDENCE Letters and petitions containing 93 signatures (26 Renton citizens)
Anti-Porno were presented supporting the city's action to prohibit showing
Support adult filmfare in downtown movie theatres.
OLD BUSINESS Community Services Committee Chairman Reed presented a report
Community concurring in the recommendation of the Parks Department to resolve
Services street tree problems in the downtown Central Business District.
Committee The recommendation includes removing eight trees in planters on
CBD Street 3rd Avenue; pruning four trees in sidewalks on 2nd Avenue which
Tree Project are blocking traffic lights; and removing London Plane trees from
Rainier to Burnett on 3rd Avenue, which are breaking sidewalks,
cracking buildings, clogging sewers and growing into lights and
signs, and replacing them with a different variety. The report
further recommended the Parks Department continue to work closely
with the Downtown Merchants Association and the Community Services
Committee on the matter. MOVED BY REED, SECONDED BY MATHEWS,
COUNCIL CONCUR IN THE RECOMMENDATION OF THE COMMUNITY SERVICES
COMMITTEE. John Webley, Parks Director, clarified that trees will
be removed or relocated because either they are impeding traffic
safety or were inappropriately located for the type of growth
anticipated. MOTION CARRIED. .

OLD BUSINESS continued
Community Community Services Committee Chairman Reed presented a report
Services concurring in the recommendation of the Parks Department to replace

SERVICES COMMITTEE. Councilman Trimm inquired if the project will
go out for bids. Parks Director Webley.advised receipt by Puget
Power of one bid from Holmes Electric in the amount of $31 ,673.30
with the option available to request additional bids following
review of those specifications. MOTION CARRIED.

City of Renton standards and APWA standards where applicable.
It is hereby expressly agreed that this bond is also given
and made as a guarantee against defective materials or workmanship
in the construction of said improvements , provided, however, that
no suit or action or proceeding by any reason of any defect whatever
shall be brought upon this bond after one year following the final
acceptance of said improvements by the City.
The condition of this obligation is such that if the
principal shall not construct said improvements in accordance
with the terms and conditions set forth herein within the time
limits prescribed, then the City can make demand upon the surety
to complete said improvements . If the surety declines to construct
the improvements at its sole cost and expense, then the surety
shall be liable under this bond for the full amount of this bond,
or the actual expense necessary for the City to install said
improvements , whichever sum is less.

REPORT AND DECISION.
APPLICANT: CLARK-RICH REALTY, INC. FILE NO. FP-074-82
LOCATION: East side of Union.Avenue N.E. between N.E. 4th Street and
N.E. 6th Street (extended).
SUMMARY OF REQUEST: The applicant seeks final plat approval of a 9-lot subdivision.

BUILDING & ZONING The Building & Zoning Department Report was
DEPARTMENT REPORT: received by the Examiner on February 24, 1983. In
accordance with Section 4-3010, Duties of the Examiner (as
amended), the Examiner shall receive and examine available
information, prepare a record thereof and enter findings of
fact and conclusions based upon those facts, together with a
recommendation to the City Council, for final plat
applications. No public hearing is held in conjunction with
final plat applications..
FINDINGS, CONCLUSIONS & RECOMMENDATION: Having reviewed the record in this matter,
the Examiner now makes and enters the following:
FINDINGS:
1. The applicant, Clark-Rich Realty, Inc., filed a request for approval of a 1.88 acre final plat
consisting of 9 lots.
2. The application file containing the application, SEPA documentation, the Building and Zoning
Department report, and other pertinent documents, was entered into the record as Exhibit
1.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, RCW 43.21C, as amended, a Declaration of Non-Significance has been
issued for the subject proposal by the Environmental Review Committee (ERC), responsible
official.
4. Plans for the proposal have been reviewed by all city departments affected by the impact of
this development.
5. The subject property is located on the east side of Union Avenue N.E. between N.E. 4th
Street and N.E. 6th Street (extended).
6. The subject site is generally level. The site is covered with scrub brush, Alder and Douglas
Fir trees. The subject site is vacant.
The subject site was annexed into the City in November of 1966 by Ordinance No. 2290. The
G-1 classification was applied at that time. The site was reclassified to R-3 by Ordinance
No. 3651 in August of last year. The preliminary plat was approved by the City Council in
October of 1982.
8. The land use element of the Comprehensive Plan designates the area in which the subject
site is located as suitable for the development of commercial and office park type uses. At
this time, the zoning code has not been amended to provide for an office park district.
9. Immediately north of the subject site are four older single-family homes. Immediately south
of the subject site are an additional three older single-family homes. A single-family
subdivision is located west of the subject site across Union Avenue N.E. There are also
vacant properties in the vicinity of the subject site. South of the three single-family homes
south of the subject site is a twelve-plex constructed on R-3 property.
10. Applicant has posted a bond to assure the installation of the required improvements pursuant
to a deferral granted by the Board of Public Works.
11. The plat design reflects the conditions imposed upon the preliminary plat by the City Council
and the ERC.
CONCLUSIONS:
1. The plat appears to serve the public use and interest. The plat will allow the development as
proposed by the applicant of up to 18 units of multi-family housing which is consistent with
the R-3 zoning of the subject site.
2. The plat will create additional multi-family housing opportunities in this area, which is
located near a growing commercial node along N.E. 4th Street and Union Avenue N.E.
3. While not immediately adjacent to other multi-family housing, there is similar development
to the south, and this will permit an extension of same on the subject site.
RECOMMENDATION:
The final plat should be approved by the City Council.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be filed in
writing on or before March 16, 1983. Any aggrieved person feeling that the decision of the
Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the
discovery of new evidence which could not be reasonably available at the prior hearing may make
a written request for review by the Examiner within fourteen (14) days from the date of the
Examiner's decision. This request shall set forth the specific errors relied upon by such appellant,
and the Examiner may, after review of the record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that such
appeal be filed with the City Clerk accompanying a filing fee of $75.00 and meeting other
specified requirements. Copies of this ordinance are available for inspection or purchase in the

The subject site was annexed into the City by Ordinance 2290 of November 23,
1966. The subject site was rezoned to R-3, Residential, on August 11, 1982, by
Ordinance 3651.
D. PHYSICAL BACKGROUND:
1. Topography: The subject site is essentially level.
2. Soils: Alderwood Gravelly Sandy Loam 6-15% slopes (AgC). Permeability
is moderately rapid in the surface layer and subsoil and very slow in the
substratum. Runoff is slow to medium and the erosion hazard is moderate.
This soil is used for timber, pasture, berries, row crops, and for urban
development.
3. Vegetation: The property consists primarily of scrub brush with some alder
and a few Douglas fir interspersed.

mammals.
5. Water: No surface water was observed on the subject site.
6. Land Use: The subject site is undeveloped at this time as are the parcels to
the east and south. Single family:subdivisions are located to the north and i
the west.
E. NEIGHBORHOOD CHARACTERISTICS:

The surrounding properties are largely single family residential or undeveloped.
F. PUBLIC SERVICES:
1. Water and Sewer: A 12-inch water main and an 8-inch sanitary sewer
extends north-south on Union Avenue N.E. adjacent to the subject site.
2. Fire Protection: Provided by the City of Renton as per ordinance
requirements.
3. Transit: METRO Transit Route #107 operates along Union Avenue N.E.
adjacent to the subject site.
4. Schools: The Honeydew Elementary School is located approximately 1/2
mile to the north of the subject site while McKnight Middle School is
slightly over 2 miles to the northwest and Hazen High School is within 3/4
of a mile to the northeast.
5. Recreation: Kiwanis Park is within 1/4 of a mile to the north of the subject
site.

I.IMPACT ON THE NATURAL OR HUMAN ENVIRONMENT:
1. Natural Systems: Development will remove the vegetation, disturb the
soils, increase storm water runoff and have an effect on traffic and noise
levels in the area. Through proper development controls and procedures,
however, these impacts can be mitigated.
2. Population/Employment: Construction of 9 duplex units would increase the
area population by approximately 45 persons.
3. Schools: The 9 duplexes would add 4 students to the schools in the vicinity.
4. Social: Increased opportunities for social interaction would be available for
the residents of the new units.
5. Traffic: Nine duplex units would result in an additional 142 average daily
trips on Union Avenue N.E.
J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton's Environmental Ordinance and the State
Environmental Policy Act of 1971, as amended, RCW 43-21C, a Memorandum of

L. DEPARTMENT ANALYSIS;
1. The applicant is seeking final plat approval for a proposed 9-lot subdivision
approved under the McWilliams Preliminary Plat, file PP-031-82.
2. The final plat has been redesigned to reflect the Environmental Review
Committee's condition to allow access to the east through the plat.
3. Road and utility plans including storm drainage, sanitary sewers, water
supplies, street and pump station plants, have been approved by the City
along with a temporary erosion control plan. The Board of Public Works
granted a deferral for these plat improvements on February 2, 1983.
Proper security was submitted to the City of Renton on February 15, 1983
to cover the cost of the deferred improvements in the amount of
155,000.00. This amount is a reduction from that originally estimated by
the Public Works Department on December 6, 1982.
4. The final plat mylar has been revised to include an utility easement along
the common property lines of Lots #7 and #8, thus complying with the
Condition No. #5 of the Engineering Department comments. Tract. "A"
have been eliminated to provide for road access to the east. Therefore,
Condition No. #6 of that same comment is no longer applicable.
5. The other departments restate the requirement of compliance with the
condition of the Environmental Review Committee, which was to provide
access to the east.
6. The mylar has been checked for closure and appropriateness and found to be
complete.
M. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that the Final Plat, FP-074-82,
be recommended for approval to the City Council.

1 . Post bond of $285,000.

Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires

13) Transportation/Ciro{ ;ion.
The proposed 18 housing units could add approximately 180 vehicle trips
each day to the vicinity road network, based on ITE nationwide average statis-
tics . Most of this traffic will likely be coming or going through the Union
Avenue/N.E. 4th Street intersection south of the site. For the 21-month period
ending in April 1981 , this intersection averaged 2.75 accidents per million
vehicles, compared to the state average of 0.9. At this high rate, the statis-
tics indicate that the accidents are probably caused by the characteristics of
the intersection.
In, April 1981 improvements were made at, this intersection in the forms
of left-turn signal phasing of the light and the addition of left-turn pockets.
In the three months following the installation of these, there were no accidents
at this intersection. William E. Popp Associates, in a traffic study for a
separate nearby development, noted that most of the accidents prior to the im-
provements involved vehicles turning left from 4th onto Union and that the
addition of signal phasing and turn pockets caused a "dramatic reduction in
accidents. " (Northward PUD Transportation Impact Analysis , March 1982. ) The pm
peak hour level of service (LOS) at this intersection in 1981 was "C" .
Another traffic concern in the vicinity includes N.E. 4th west of Union to where
it becomes N.E. 3rd and then intersects Sunset Boulevard, which provides the pri-
mary access to I-405 for the site and its vicinity. East of Duvall Avenue, 4th
become SE 128th St. , and this arterial NE 3rd/NE 4th/SE 128th would be the major
distributor of the project's expected 180 ADT. The intersection of NE 3rd and
Sunset experienced a large number of accidents (21/year) through July 1981 , but
for the volume of traffic this number is not critical . In 1981 this intersection
operated at LOS "C".
The City has proposed to widen NE 4th/NE 3rd from Union to Sunset to a continuous
five-lane roadway with a two-way left turn lane. This work would also include
resurfacing, curbs , gutters, sidewalks and drainage, and it is scheduled to begin
in 1982.
Traffic from the proposed project (180 ADT) would have no measurable effect on the
operations of these roadways and intersections.
16 (d) Sanitary Sewer
The proponent intends to install a lift station to pump sewage under
Union Avenue to an existing manhole about 250 feet south of the site. The pro-
ponent will construct and maintain this lift station. The proponent will also
install a "dry" sewer at his front property line that will later be connected
to an anticipated gravity system that will flow from about 1500 feet north of
the site south past the site and adjacent properties . When this line is com-
pleted through to the south, or at least to a connection at N.E. 4th , the devel-
oper will abandon his lift station. Completion of the line depends on develop-
ment of other nearby property.
