CITY OF RENTON
REPORT AND DECISION.
APPLICANT: J. CLIFFORD GRAY FILE NO. SA-005-83
LOCATION: 1120 Lind Avenue S.W.
SUMMARY OF REQUEST: The applicant requests site approval to allow the
construction of a 4,600 square foot warehouse for the
storage of business forms and supplies.
SUMMARY OF ACTION: Building and Zoning Department
Recommendation: Approval, subject to conditions.

BUILDING & ZONING The Building & Zoning Department Report was
DEPARTMENT REPORT: received by the Examiner on April 5, 1983.
PUBLIC HEARING: After reviewing the Building and Zoning
Department Report, examining available
information on file with the application and
field checking the property and surrounding
area, the Examiner conducted a public hearing
on the subject as follows:
The hearing was opened on April 12, 1983, at 9:00 a.m. in the Council Chambers of the Renton
Municipal Building. Parties wishing to testify were affirmed by the Examiner.
The following documents were entered into the record by the Examiner:
Exhibit #1: Yellow application file containing the
Building and Zoning Department report
and other pertinent documents.
Exhibit #2: Site Plan Map showing staff comments.
Roger Blaylock, Zoning Administrator, presented the Building and Zoning Department report,
indicating that the Environmental Review Committee has issued a Declaration of
Non-Significance, the appeal period for that declaration having expired on April 4, 1983, and
that there has not been an appeal filed within the given time period.
The Examiner asked if the present site plan shows compliance with the City ordinances. Mr.
Blaylock indicated the site plan was in compliance with respect to landscaping.
The Examiner then inquired if the Lind Avenue Bridge would be widened as a result of this
proposal. Mr.Blaylock indicated that it would be realigned.

Mr. Blaylock concluded his report by stating that the Building and Zoning Department
recommends approval of SA-005-83, subject to the following conditions:
1. Relocation of landscaping along Lind Avenue S.W. to comply with the proposed site plan.
2. Relocation of the eastern most curb cut on S. W. 12th Street to be a minimum of fifty (50)
feet from the intersection.
The Examiner then called for testimony from the applicant. Testifying was:

Mr. Gray asked what would be identified as being positive outflow for the storm drainage. Mr.
Blaylock stated that it was a technical matter that the Engineering Department would have to
approve and that was why it was left as an open consideration.
The Examiner stated that he was not certain what was intended, but it probably means it has to
go someplace, rather than just into a standing system. It probably would have to exit into an
actual storm drainage system where the water is carried away from the site. He suggested Mr.
Gray talk with Don Monaghan in the City Engineering Department for clarification of this
matter.
Mr. Gray asked what the schedule was for the moving of the Lind Avenue Bridge.
Responding was: Gary Norris

Mr. Norris indicated that the intent of the realignment of the bridge is to provide adequate
width for the new high occupancy vehicle lanes that are being developed on I-405; the timing for
this project would be the fall of this year, but whether or not the bridge is going to be right in
alignment with that or not is not certain at this time.
The Examiner indicated that if the plans are approved, they will probably be approved subject to
providing the positive storm drainage; he advised Mr. Gray to confer with the Engineering
Department to determine where the storm drainage should be placed now so that there would
not be any interference with them in the future.
Mr. Gray then indicated he had no disagreement with the report.
The Examiner called for further testimony in support or opposition to the application. There
being none, the hearing was closed at 9:20 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
1. The applicant, J. Clifford Gray, filed a request for approval of a site plan for the
development of a warehouse.
2. The application file containing the application, SEPA documentation, the Building and
Zoning Department report and other pertinent documents, was entered into the record as
Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, RCW 43.21 C, as amended, (a Declaration of Non-Significance has been
issued for the subject proposal by the Environmental Review Committee (ERC),
responsible official), the subject proposal has been determined exempt by the ERC.
4. Plans for the proposal have been reviewed by all city departments affected by the impact
of this development.
5. There was no opposition to the proposal expressed.
6. The subject site is located at 1120 Lind Avenue S.W. at the intersection of Lind Avenue
and S.W. 12th Street. The site is north and west of the SR-167 and I-405 interchange.
7. The subject site is level and contains a vacant single family dwelling. The vegetation on
site consists of lawn grass, some medium growth scrubs and a larger Cedar tree.
8. The subject site was annexed into the City in April of 1959 by Ordinance 1745. A recent
designation change changed the original G-1 (General Single Family) to R-1 (Single Family
Residential; minimum lot size - 7,200 sq. ft.). The site was then reclassified to L-1 (Light
Industrial) by Ordinance 3666 in October of 1982.
9. The Comprehensive Plan and the Green River Valley Comprehensive Plan designate the
site as suitable for the development of manufacturing park type uses.
10. The applicant proposes erecting a 4,600 sq. ft. warehouse building on the approximately
304 acre site. The warehouse would be used in conjunction with an existing office.

11. The area contains a mix of uses, including a single family dwelling immediately adjacent
to the east; an abandoned single family residence to the north and two new office buildings
northeast of the site.
12. The applicant has proposed dense landscaping for the six feet of property located adjacent
to the single family dwelling. Staff indicates that landscaping will have to be provided
along S.W. 12th Street between the sidewalk and the roadway. The landscaping proposed
for the Lind Avenue property line complies with Section 4-716 pertaining to arterial
landscaping.
13. The site and surrounding area suffer from storm water drainage problems which must be
corrected by the applicant pursuant to the ERC's decision.
14. Traffic Engineering has indicated that the driveway nearest Lind Avenue must be
relocated further to the east so as not to create turning conflicts at the intersection.
Further, left turns to or from the alley north of the site to Lind Avenue S.W. must be
prohibited to avoid interference with Lind Avenue's arterial function.
CONCLUSIONS:
1. The site plans appear to serve the public use and interest. The plans incorporate the
setbacks and landscaping required by the building and zoning code.
2. The proposal also complies with the restrictive covenants imposed at the time of the
rezone mandating additional setbacks similar in nature to those required in the Green
River Valley manufacturing park areas.
3. The applicant will have to provide profiles and plans for off-site drainage. The area is
subject to ponding and some definitive drainage plans will be mandatory prior to
development.
Similar safety reasons require that the driveway located on S.W. 12th Street be moved
away from the Lind Avenue intersection subject to the approval of the Traffic Engineering
Division.
5. The plans appear to adequately buffer the existing single family home located immediately
adjacent to the subject site to the east.
DECISION:
The site plan is approved, subject to the following conditions:
1. Left turns be prohibited to or from Lind Avenue S.W. via the alley at the rear of the
subject site.
2. The westerly driveway be moved easterly away from Lind Avenue S.W. as approved by the
Traffic Engineering Division.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be filed
in writing on or before May 6, 1983. Any aggrieved person feeling that the decision of the
Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the
discovery of new evidence which could not be reasonably available at the prior hearing may
make a written request for review by the Examiner within fourteen (14) days from the date of
the Examiner's decision. This request shall set forth the specific errors relied upon by such
appellant, and the Examiner may, after review of the record, take further action as he deems
proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that such
appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other
specified requirements. Copies of this ordinance are available for inspection or purchase in the
Finance Department, first floor of City Hall.

C. HISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinance #1745 of April 1, 1959, at
which time it was zoned G-1. This classification was replaced by the R-1 zoning
designation with the adoption of the new zoning map by Ordinance #3634 of June
13, 1982. The R-1 zoning classification was replaced by the L-1 designation by
Ordinance #3666, effective October 27, 1982.
D. PHYSICAL BACKGROUND:
1. Topography: The site is essentially level
2. Soils: Urban Land (Ur) is soil that has been modified by disturbance of the
natural layers with the addition of fill upto several feet thick to
accommodate industry or housing.

3. Vegetation: The bulk of the site consists of grass with some medium growth
shrubbery and one large cedar tree.
4. Wildlife: The existing vegetation provides some habitat for birds and small
mammals.
5. Water: No surface water was observed on the subject site.
6. Land Use: The subject site is undeveloped at this time. An office building is
adjacent on the west while to the north is an abandoned single family
residence and another office structure. A second single family dwelling is
located to the east and the properties to the south remain undeveloped.
E. NEIGHBORHOOD CHARACTERISTICS:
The neighborhood is a mixture of residential and business uses along with
interspersed vacant lots. Some transition of uses from a former residential
character to business uses is in evidence with concentrations of non-residential uses
primarily along Grady Way.
F. PUBLIC SERVICES:
1. Water and Sewer: The water line adjacent to the subject site is undersize. A
ten-inch water main exists approximately 600 feet away on S. W. Grady Way.
An eight-inch sanitary sewer is available approximately 150 feet west of Lind
Avenue S.W.
2. Fire Protection: Provided by the City of Renton as per ordinance
requirements.
3. Transit: METRO Transit Route #145 operates on S.W. Grady Way and Route
150 operates on Rainier Avenue S. and SR-167.
4. Schools: Not applicable.
5. Recreation: Not applicable.

L. DEPARTMENT ANALYSIS;
1. The applicant is seeking site plan approval to allow the construction of a
4,600 square foot warehouse for the store e of business forms and supplies in
conjunction with an existing office building located on the northeast corner of
Lind Avenue S.W. and S.W. 12th Street.
2. The subject property was rezoned in 1982, with specific restrictive covenants
placed upon the property. Specifically, the covenants established setbacks
and sit plan reviews.
3. The proposed site plan shows compliance with the six (6) foot landscaped strip
along the eastern property line and the ten (10) foot wide landscaped setback
along S.W. 12th Street has been provided.
Chinese Blue Column Junipers, twelve (12) to fifteen (15) feet in height, are
intended to be planted in the six (6) foot wide eastern landscaped strip. This
provides immediate buffering of the proposed warehouse facility from the
adjacent single family residential use.
4. The five and one-half (5-1/2) foot landscaping strip between the sidewalk and
roadway on S.W. 12th Street will have to be landscaped by the applicant.
5. The site plans specifically show the widening of Lind Avenue S.W. to a full
width of fifty-six (56) feet. In addition, sidewalks are shown on both Lind
Avenue S.W. and S.W. 12th Street. This redesign of landscaping areas
complies with the special setback requirements along arterials designated
under Section 4-716. The design also calls for the illumination of some of the
landscaping areas to the north of the existing office building. This is a result
of the relocation of parking spaces to meet the minimum requirements of the
Parking and Loading Ordinance for both the proposed warehouse and the
existing office building.
6. The Engineering Department advises that plan and profiles will be required
for all off-site improvements including the street, road and alley
improvements, which will have to be constructed to city standards. These
improvements will also include a median barrier on Lind Avenue S.W. to
eliminate left turns from the alley onto Lind Avenue. This was a requirement
or the Environmental Review Committee. In addition, a positive outflow for
storm drainage shall be provided which may entail downstream improvements
off the subject site.
7. The Traffic Engineering Division advises that the western most curb cut on
S.W. 12th Street will have to be at least fifty (50) feet from the edge of the
pavement of Lind Avenue S.W. This will require a slight readjustment but not
significantly affect the site plan.
8. Other department comments are attached for the Examiner's and public's
review.

M. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that the Hearing Examiner
approve the requested site plan approval, SA-005-83, subject to the following
conditions:
1. Relocation of landscaping along Lind Avenue S.W. to comply with the
proposed site plan.
2. Relocation of the eastern most curb cut on S.W. 12th Street to be a minimum
of fifty (50) feet from the intersection.

Introduction The State Environmental Policy Act of 1971 , Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
Please answer the following questions as completely as you can with the information
presently available to you. Where explanations of your answers are required , or where
you believe an explanation would be helpful to government decision makers , include your
