To date we have had no further reply from your office. We wish to advise
that if said Covenants , properly signed and notarized, are not received by
this office within fourteen (14) days of the date of this letter, the shor

Dear Mr. Kaufman:
Enclosed please find our proposed changes and additions
to the Declaration of Restrictive Covenants in the above-
referenced matter. A number of minor changes were made in
an attempt to clarify the situation.
Specifically, the conveyancing paragraph was rewritten
to emphasize the goal of perpetual preservation of the
natural vegetation on Lot 2 and its direct tie to the Culver
property. A proviso, however, was added to assure that the
covenant in and of itself did not limit the possibility of a
future short plat of the Culver property within the confines
of future land use regulations. As stated in your letter to
the Culvers on April 4, 1984, future short platting of their
property will depend entirely on their ability to meet
future requirements.
I have also described proposed Lot 2 of the Short Plat
fully for your records. Lastly, the Culvers own a parcel of
land in Section 32, not Section 31, as originally noted on
Exhibit A of the Restrictive Covenant prepared by your
offices . This appears to be a simple typographical error.

Dear Mr. Kaufman,
Regarding Norm Culver's restrictive covenant conditions:
Your verbage.. ."assuring the perpetual preservation of the natural
vegitation on the proposed Lot #2, together with a restriction filed
on the applicant's orginal King County Lot and a similar one tied to
the proposed Lot #2 requireing that they shall only be conveyed as a
totality, and that neither may be conveyed without simultaneous convey-
ance of the other."
Norm Culver called me and asked my interpretation of that statement
regarding future short platting of his property. I told him I didn't
think it would have any bearing on a future short plat other than to
tie lot 2 of the subject short plat like a rider on the western most
lot of a future short plat. The only other factor would enter at such
time as City of REnton might annex all of Norm's property then I would
suppose that the frontage of Lot 2 could be figured into the minimum
frontage requirement of a new lot provided all the improvement specifi-
cations would be met at that time.
Norm Culver would like to have your interpretation of these possibiLit
with his file on the property should he at some future date make applic
tion to plat his property. Twenty years from now, no one may remember
the particulars and an interpretation of future platting restrictions
might prove helpful.

Dear Dr. Culver:
In response to your letter of April 10th, the Building and Zoning Department sees the
intent of the Hearing Examiner's decision to assure that the newly created lot (Lot 2) is
preserved as an area of natural vegetation. The intent to tie the proposed lot together
with your property, which is presently in King County, is to assure that the
non-buildability of Lot #2 never becomes an issue.
Your question of whether a future short plat could be done is academic in a way. In any
case, the codes that would be applicable at the time of that request would have to be
utilized plus the present complication of part of it being in the City and part of your
property being in the County. The key to the situation is that there are no restrictive
covenants stating that a future subdivision can not be accomplished. The problem of
today is, of course, the legal technicalities of utilizing two jurisdictions. My own
professional belief is that, at the time of future subdivision of your property, proposed Lot
2 would have to be transferred or included in that short plat to the new property owners
possibly in the form of a perpetual easement to preserve the natural vegetation.
The bottom line answer that I can give you is that these conditions do not preclude
platting in the future, but they do not assure platting based upon those future standards.

This office...suggests consultation with the Building and Zoning Department "
What Norm Culver wants to know is the Hearing Examiner's Report and
Decision dated January 31, 1984 gives approval to the short plat subject
to the filing of restrictive covenants. . ..requiring that they shall
be conveyed as a totality and that neither may be conveyed without
simultaneous conveyance of the other. ... How does this conditional
approval affect his future ability to short plat his property?
I think I can speak for Norm Culver by saying he is not asking you to
project future lot size minimums, or future lot width, length ratios
or future road requirements and access width requirements. What he
wants to know is . ..conveyedas a totality.. .could this ever be construed
to mean his 'entire parcel is covenanted to forever be conveyed as a totality
and never be allowed to be short platted.

The City cannot place itself in the position of providing a legal description without takir

Mr. Blaylock further stated the area is designated as greenbelt and single-family on the
Comprehensive Plan; that Lot #2 is intended to be used as a buffer of the property to the ast
which is located in King County; that the City Atorney has been contacted to see if the 'ity
could create a non-buildable lot and found that this was the only solution for dividing the
property. The applicant wants to get control of this small parcel in fee simple, to fence it and
preserve its sensitive nature.
The Examiner inquired if a final plat would be required for development of the remaining one
lot. Mr. Blaylock stated that it would be required.
Mr. Blaylock stated staff recommends approval of the requested short plat and variance su' ect
to filing of restrictive covenants to design Lot #2 as a permanent greenbelt and stipulating hat
the two lots would have to be sold together if ever there was a sale of the property.

A question arose as to whether there would be a problem with overlapping jurisdic Tonal
boundaries, since some of the applicant's property lies in King County.
The Examiner called for testimony from the applicant or representative. Responding was:

Mr. Culver stated he believes the staff report covers the issue and that he merely ants
additional land adjacent to his home to protect the seclusion they now enjoy and to prote the
immediate area from logging operations.
The Examiner asked if the applicant would object to tying the two parcels together in caF of a
future sale of the property. Mr. Culver stated that would be preferable to him also.
The Examiner called for further testimony in support of the application. Responding was:

Mr. Hayes stated his property is due south from Talbot Road and abuts the two lots in que jtion.
He stated he is not speaking against the proposal, and that a lot of the evergreen trees i Ithis
area are being lost to logging operations. He did ask, however, if Lot #1 is developed, } here
would the sewage go. Mr. Hayes asked that consideration be given to this problem i the
property should be developed. He noted the back of his property is greenbelt now an the
property behind him is preparing to develop to the east. He stated perhaps a precedent is eing
set here on the basis of setting up a greenbelt strip along the adjoining properties. Furthe Mr.
Hayes stated this request would serve to the advantage of the area.
The Examiner called for testimony in opposition to the request. There was none. The he pring
was closed at 11:18 a.m.
FINDINGS, CONCLUSIONS & DECISION:
Having reviewed the record in this matter, the Examiner now makes and enters the
following:
FINDINGS:
1. The applicant, Norman Culver, filed a request for approval of a 2-lot short plat of
approximately 1.84 acres of property, together with variances and a waiver of
required off-site improvements.
2. The application file containing the application, the State Environmental Policy Act
SEPA) documentation, the Building & Zoning Department Report, and other
pertinent documents, was entered into the record as Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C,
1971, as amended), the subject proposal has been determined to be exempt from the
threshold determination by the Environmental Review Committee (ERC).
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. The subject proposal met with no opposition from the public.
6. The subject site is located at 5280 Talbot Road S. The site is owned by Jack Martz.
7. The site slopes upward from west to east with grades varying from 5% to 25%. The
easternmost 30 feet contains the steepest slopes and is heavily wooded.

8. The property immediately to the east of the subject site is located in King County
and is owned by the applicant.
9. The applicant, in conjunction with the property owner, proposes subdividing the
subject site into two lots. The easternmost parcel, proposed Lot #2, is encumbered
by an easement in favor of the applicant providing preservation of the trees and
slope for a natural buffer.
The westernmost parcel would be proposed Lot #1.
10. Proposed Lot #2 would be 30 feet wide and approximately 341 feet long, for
approximately 10,230 sq. ft. in area. The proposed lot would violate the length to
width ratio, the minimum lot size requirements, and the access requirements of the
subdivision ordinance.
The applicant has therefore requested variances from those various provisions.
11. The 30 foot wide lot is proposed to serve as a natural buffer for the applicant's
property located upslope and east of the site. As indicated, an easement has been
granted the applicant for the proposed use, but the property remains in the
ownership of his neighbor. Taxes are assessed on the lot to the neighbor and title is
confused by the limitations imposed by the easement.
The segregation would allow the outright purchase of the lot clearing tax and title
records. The complicating factor is the divided jurisdiction. The applicant's
ownership is located in King County, while proposed Lot #2 and the entire subject
site is located within Renton. A simple replat appeared to be outside the normal
scope of either jurisdiction.
12. The applicant proposes executing restrictive covenants assuring the preservation of
the lot in its natural state, assuring that no construction would occur on the
substandard lot and further tying the purchase/sale of proposed Lot #2 to the sale of
the easterly King County lot.
13. The proposal is not expected to generate any additional traffic, population,
employment, or school age children as no additional construction is contemplated.
14. The subject site is zoned G- 1 (General; Single Family Residential; Minimum lot size
35,000 sq. ft.). The area in which the subject site is located is designated for
single family uses and greenbelt in the Comprehensive Plan.
15. The area is generally quite rural, densely wooded, and with only scattered single
family development at the extreme south end of Renton, south of the Valley General
Hospital.
16. The applicant's request to vary or waive the survey and filing requirements of the
ordinance cannot be considered as they are part of the documentation required for a
short plat and no hardship unique to the property would or could be expected to
interfere with such documentation. While a survey is expensive, an accurate legal
description and survey protects all parties and the city from potential errors and
will be necessary to record any plat or covenants with the county.
17. An easement from Talbot Road S. serves the subject site permitting access over
three existing lots to the west.
CONCLUSIONS:
1. While the request appears out of the ordinary, the public use and interest would
apparently be served by the proposed short plat, and the Comprehensive Plan's
objectives would be satisfied.
Record keeping alone will be simplified by approval of the short plat.

2. In addition, the proposed short plat and protective covenants would preserve the
steep slopes of the subject site in conformance with the Comprehensive Plan which
indicates dual purposes for the area - - single family uses and greenbelt.
3. The unique extremely steep topography of the site, coupled with its designation in
the Comprehensive Plan and location on the boundary between jurisdictions, appears
to warrant the variance relief requested.
Because of the unique location and topography, the approval does not appear to
create any unwarranted precedents.
4. Although similar property lies north and south of the site, the granting of the
variance would not adversely affect either of those properties nor grant the subject
site an unwarranted privilege vis- a vis those properties. The easement protecting
the property already has served to distinguish these various properties.
5. The area is extremely rural and since no additional development is proposed as a
result of this short platting, a waiver of the off-site improvements required at this
time appears justified. This waiver does not address any needs beyond this request
and is not effective if at some latter time a new request to short plat the remaining
acreage is proposed.
DECISION
The proposed short plat, variances, and waiver are approved subject to:
1. The filing of restrictive covenants assuring the perpetual preservation of the natural
vegetation on the proposed Lot #2, together with a restriction filed on the
applicant's original King County Lot and a similar one tied to proposed Lot #2
requiring that they shall only be conveyed as a totality, and that neither may be
conveyed without simultaneous conveyance of the other.
2. The releasing of that portion of the access easement serving proposed Lot #2 to
preclude any through traffic.

The subject site was annexed into the City by Ordinance #3268 which became
effective December 13, 1978. The property was zoned G-1, General Use upon

D. PHYSICAL BACKGROUND:
1. Topography: The subject site slopes upward from west to east with slopes
varying from 5% to 25%. The steepest portion of the lot, the eastern most
thirty (30) feet of the lot, will be retained as a buffer.

2. Soils: The subject site consists of Alderwood Gravelly Sandy Loam (AgD).
The portions of the property which have slopes under 15%, the permeability is
moderately rapid in the surface layer and subsoil, and very slow in the
substratum. Runoff is slow to medium and the erosion hazard is moderate.
This soil is used for timber, pasture, berries, row crops and urban
development.
Those portions of the property with 15% or greater slopes, the runoff is
medium and the erosion hazard is severe with a moderate potential for
slippage. This soil is used for timber and pasture.
3. Vegetation: The subject site is heavily forested.
4. Wildlife: The existing vegetation provides suitable habitat for birds and small
mammals.
5. Water: No water was observed on the site.
6. Land Use: The site is presently undeveloped.
E. NEIGHBORHOOD CHARACTERISTICS:
The subject site is basically surrounded by densely forested undeveloped property
and scattered single family residences.

1. Utilities:
a. Water - A sixteen-inch water line runs north/south along Talbot Road
South approximately 1,000 feet of the subject site.

L. DEPARTMENT ANALYSIS;
1. The applicant, Norman Culver, is seeking a short plat of 1.84 acres into two
2) lots. The sole purpose of the request is to create a non-buildable, thirty
30) foot wide lot to be utilized as a natural buffer. The request is the most
unusual subdivision request ever submitted to the City.
2. In addition, the applicant is requesting the following five (5) variances:
a. Lot size
b. Width/length ratio
c. Installation of improvements
d. Access by easement
e. Survey of property.
3. The short plat request complies with the intent of the Comprehensive Plan
designation of "Greenbelt" and "Single Family Residential." The owner will
place, by restrictive covenants, a "permanent greenbelt" designation on
proposed Lot #2.
4. On very rare occasions, a particular request does not fall within the
prescribed procedures of the law while common sense and logic suggest
governmental relief. This particular case is so unusual that it is critical to
present all of the following historical facts:
a. The subject property was subdivided into its present configuration prior
to being annexed into the City (1979).
b. The parcel is accessible solely by a thirty (30) foot easement (Auditor's
file numbers #6093904 and #6093903). These were created prior to
1971 and the effective date of the City's short subdivision ordinance.
c. The eastern property line is also the city limits.

d. Norman Culver owns Lot #1 of short plat SP873028, located in King
County immediately east of the proposed short plat.
e. In 1982, Mr. Culver acquired an exclusive thirty (30) foot easement for
greenbelt" over proposed Lot #2. The easement was acquired instead
of title because of the administrative "red tape" to process a boundary
line adjustment between one piece of property located in King County
and one within the City of Renton.
f. The present easement only partially accomplished Mr. Culver's goal of
creating a natural buffer. It gives him a right, but it can only be
enforced through private law. In addition, the property taxes were still
the responsibility of the adjacent property owner.
VARIANCES
5. The shape of proposed Lot #2 is a result of its purpose to become a natural
vegetative buffer to screen Mr. Culver's residence located to the east. The
30' X 341' strip has only 10,230 square feet. The G-1, General Use zone
requires a minimum lot size of 35,000 square feet. In addition, Lot #2 can
not comply with the 1 to 2-1/2 width/length lot ratio [Section
9-1108(23)(F)(3)(a)].
Normally, a subdivision is requested to create two (2) or more buildable lots.
This request would actually decrease the potential development of the 1.84
acres. In the past, the City has approved irregularly shaped lots or tracts for
special purposes that do not comply with size and dimensional requirements
Hi-Gate, PP-403-79 and Highbury Park, PP-420-79).
6. The applicant is also seeking a variance not to install off-site improvements.
Since there is no street frontage. it would appear this requirement is not
applicable; however, to cover all possible points the request was included. In
addition, the short plat will not increase the traffic or population which is
generally the catylist for requiring public improvements.
7. 1 he fourth variance is to allow access by easement. The property in question
has been landlocked since the late 1960's when the easements for access were
created under documents filed in Auditor's File Numbers #6093903 and
6093904. Since the proposal is not increasing the potential residential
capacity. it can not be considered detrimental upon the ability of the
easement to provide access to the buildable lot.
8.The fifth variance is a request to waive the requirements of surveying and
filing a short plat mylar with King County. Neither State law or the City
ordinance differentiates between "buildable" and "non-buildable" lots. This
appears to be a procedural requirement that can not be varied unless both the
Revised Code of Washington and City Code are changed.
9. The applicant's request to create Lot 01 as a greenbelt is also based upon the
physical characteristics of the site. The thirty (30) foot strip is heavily
wooded and very steep. Both the steepness of the area and the natural
vegetation were specifically taken into consideration by the Comprehensive
Plan and designated "Greenbelt."
10. Granting of the first four variance requests complies with the variance
criteria under Section 4-722(G)(3).
a. The variances are a result of lot shape, topography, natural vegetation.
and subdivision history.
b. Approval will not be materially detrimental, but it will protect adjacent
properties from future development intrusions and comply with the
intent of the Comprehensive Plan.

c. Approval of these variances does not grant a special privilege. In fact,
it takes away possible development rights without the chance of using
Lot #2 in a residential development if the greenbelt remained as an
easement.
d. The intent is to create a "greenbelt" and this would be the minimum
necessary variances.
M. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that the short plat request, file
Short Plat-082-83, be approved subject to filing of restrictive covenants
designating Lot #2 as a "Greenbelt", and that the first four parts of variance
request, file V-083-83 be approved.

SUBJECT: Short Plat, File 082-83 and Variance, File V-083-83
This department has reviewed the above referenced application and finds it to be
incomplete and inaccurate in two respects. The subject application calls for variances
from the following standards:
1. Minimum lot size.
2. Width/length ratio.
3. Installation of improvements.
4. Access by easement.
5. Survey requirements for short plats.
The subject application fails to include the required filing fee for each of the five
separate variance applications. The applications as submitted are attempting to blanket
the issue and are wholly inappropriate. Until the application fees are properly received
and the application properly modified, the subject application is incomplete and should not
be processed.
Further, my understanding of the provision of variances in the City's Code, and as
generally accepted as planning practice, only applies to substantive development
requirements. Variance Application #5, related to the survey requirements, is not a
substantive development requirement. This is a processing requirement just as the
acceptance of an application form and the filing of a proper filing fee. This is not an
application which can be varied and should be rejected. We urge the Building and Zoning
Department to do so promptly so as to not further complicate this already messy
application.
With regard to the remaining four variance applications, this department believes, as the
application notes, that the proper solution to the desires of these property owners in this
case is the use of a lot line adjustment. We appreciate the problem that the King County
Assessor is faced with in regard to splitting a parcel between County and City
jurisdiction. However, we believe that the circumstances do not justify approval of the
variance for the four provisions requested, in that a private easement between the two
properties can accomplish the same purpose for some interim period until such time as all
parcels in question are located in the city of Renton, and a lot line adjustment application

can be accomplished. Granting of an easement between the two parties can transfer all
necessary rights and responsibilities to the thirty feet in question. We believe that
accepting the applicant's proposal would be bad practice and poor development policy on
the part of the City.
Recommendation:
At a minimum, Variance #5 for the survey requirements must be rejected.
The filing requirements for the remaining four variances must be updated including,
appropriate filing fees.
We do not believe that the variance applications proposed are the minimum variance
necessary to accomplish the desired need. An easement, rather than fee title transfer,
will resolve this issue until such time as a lot line adjustment can be accomplished after
some future annexation.

VARIANCE Request to accompany Norm Culver Short Plat App ication:
This is a blanket variance request to include all normal requirements
of short plat approval which require physical work to the site to bring to
city standards, including roads,utilities, bonding to forstall certain improve-
ments. This variance is to include the above but not be limited to the follow lg
specific exclusions:

able 30 foot lot 10,250 square feet.
2. The thirty foot strip resluting from short plat approval willnot meet
minimum frontage depth requireemnts or two and 2 times depth/width ratios.
Proponent requests variance from those requirements.
3. Proponent requests variance from any requirements dealing with sizse,
ownership, surfacing, drainage conditions of access roads leading to subjec
property.
4. Proponent requests variance from any requirements to show or provide al ,
utility service or street lighting to subject properties.
5. Proponent requests variance from survey requirements normally accompan _ng
short plat recording. Enclosed is a copy of recorded survey which recentl\
established corners of the entire property. Proponent has measured off tht
30 foot from the survey corners with a tape and Jack Martz has agreed in
writing to accept the the new stakes as exact boundaries.
JUSTIFICATION:
The applicant is suffering undue hardship and the variance is necessary be( Tiuse
the strict application of code is depriving him of rights and privileges enjoye( by
other property owners in the city.
Under normal conditinos a property owner could solve applicants ownership
problems with a lot line adjustment Norm Culver is attempting is to enlar
his adjoining 22 acre parcel by thirty feet for purposes of privacy buffer
Mr. Culver's 22 acres is located in King County and the 30 foot buffer is - )sated
in the City of Renton. The County assessor will not accept a lot line adji ;tment
which would yield a portion of the new lot in the city and a portion in cot ity.
The Granting of the variance will not be materially detrimental to the public w( ifare
or injurious to the property or improvements in the vicinity and zone in which abject
property is situated.
Applrant plans to use the subject property merely as a privacy buffer and
willinto to covenent tree small lot as such. The remaining parcel is well over
acre and a half in size and the approval of the short plat will allow no me -e
building permits than the site is eligible for as the property exists now.
The approval does not constutute a grant of special privilege inconsistent with .he
limitation upon uses of other properties inthe vicinity and zone in which the st )ject
property is situated.
Other property owners looking to enlarge their lots by thirty feet in that area
would probably enjoy the lot line adjustment application. No new building
permit eligibilties will be created.
The approval as determined by the Hearing Examiner is a minimum variance that w: Ll
accomplish the desired purpose.
The approval by the hearing examiner will have the same effect as the lot Lne
adjustment approval in terms of every area except the creation of a new loi .
The non buildable covenant will nullify that creation to accomplish the mil Lmum
variance to the thirty foot strip.
