Satisfied
PLN - Hearing Examiner Condition
1. A detailed landscape plan, including but not limited to, an on-site 10-foot landscape strip along all street frontages and
meeting the requirements of RMC 4-8-120D.12 shall be submitted at the time of Construction Permit review for review
and approval by the Current Planning Manager.
Comments: The applicant submitted landscape plans which was reviewed by the Current Planning Project manager
during the civil construction review process. A portion of the interior street landscape plantings have been deferred
under deferral permit DEF24004903 during building permit construction to reduce potential for landscaping damage.

2. A final tree retention and replacement plan shall be submitted at the time of Construction Permit application for review
and approval by the Current Planning Project Manager.
Comments: The applicant submitted a tree retention and replacement plan which was reviewed by the Current
Planning Project manager during the civil construction review process. See Civil Construction Permit (C18006046),

3. Driveway access to Lots 5 and 6 shall be provided via the hammerhead easement. A note to this effect shall be
recorded on the face of the final plat. Comments: Driveway access to Lots 5 and 6 is provided via a hammerhead and easement. A note has been
provided on the final plat stating stating "Access to Lots 5 and 6 shall be provided via an ingress & egress easement
shown over and across the southeasterly portion of lot 5 and the southwesterly portion of lot 6 and is hereby granted to
the owners of lots 5 and 6. The owners of said lots shall be responsible for the maintenance of the access facilities
they have benefit of use and shall equally share in the maintenance of that portion of the access facilities used in

4. A Homeowners Association shall be established prior to final plat approval for the maintenance of any shared
improvements and/or landscaping. A draft of the CC&Rs for the Homeowners Association shall be submitted for review
and approval prior to the recording of the final plat.
Comments: Draft Conditions, Covenants, and Restrictions (CC&Rs) documents were submitted and reviewed and
approved by the Current Planning Project Manager during the preliminary plat and final plat application process. The
final plat map and CC&R's identify that all common facilities not dedicated to the City are permanently maintained by
the Home Owner's Association. Notes are provided on the final plat that in the event the HOA does not properly
maintain the facilities in a responsible manner, maintenance costs and responsibilities fall onto the the lot owners of
lots 1-11. CC&R's will be recorded with the final plat. See project final plat documentation (LUA24-000196), which

5. Any proposed retaining walls shall be required to comply with the maximum height of seventy- two inches (72”),
provided that adjacent to the public right-of-way, the maximum height permitted shall be forty-eight inches (48”) and there
shall be a 3-foot (3’) landscaped setback between the public right-of-way and the base of the wall.
Comments: The project did not propose or construct any walls adjacent to the right-of-way and interior walls to the lots
have a maximum height of 48". See Civil Construction Permit (C18006046), which include approved grading plans at

6. Any proposal to convert the stormwater vault within Tract A to a stormwater detention pond shall be considered a Major
Plat Amendment subject to the requirements outlined under RMC 4-7-080M.2.
Comments: The project installed a stormwater vault within Tract A. See Civil Construction Permit (C18006046),
which include approved vault plans at

7. The proposed stormwater vault within Tract A shall be located entirely below ground. Engineered construction plans
showing the vault entirely below ground shall be submitted to the Engineering Plan Reviewer at the time of Construction
Permit review for review and approval.
Comments: The stormwater vault was constructed entirely below ground and the plans were reviewed by the
engineering plan reviewer for compliance during the civil construction permit process. See Civil Construction Permit

8. The applicant shall dedicate land for right of way, if necessary, to comply with City street and right of way standards
along the project frontage of 106th Avenue SE. Comments: The existing right of way width of 60' along 106th Ave SE contains sufficient width to comply with City
street and right of way standards along the project frontage and was reviewed during the civil construction permit

9. The applicant shall design and install the water distribution system, including the placement of hydrants, in accordance
with the Fire Department requirements
Comments: The water distribution system was designed and installed in accordance to Soos Creek Water and Sewer
District and Renton Regional Fire Authority requirements. See Civil Construction Permit (C18006046), which includes

10. The City shall approve all proposed street names.
Comments: Street names were reviewed and approved by the City's Technical Services staff. See project final plat

11. All proposed utilities shall be underground and constructed in a manner which will permit the planting of trees. Any
cable TV conduits shall be undergrounded at the same time as other basic utilities are installed to serve each lot and shall
be constructed in accordance with RMC 4-7-200(E).
Comments: All utilities for the project, including the existing overhead utility lines along the project's 106th frontage
were installed underground in accordance with City requirements and was reviewed by the City's engineering reviewer

12. The subdivider shall install all street name signs necessary in the subdivision.
Comments: Street name signs were installed in accordance with City requirements and was reviewed by the City's
