The subject site was annexed into the City by Ordinance
No. 1745 on April 15, 1959,' at which time the present
zoning classification was applied. It is also part
of the Leroy Bowen Short Plat 138-80 (Lot #1) approved
by the Hearing Examiner on February 2, 1981. A rezone
request from G to MP , Manufacturing Park was heard by
the Hearing Examiner on February 24, 1981.
DD. PHYSICAL 4 A CKCRB®RDRJD:
1 . Topography :The subject site slopes slightly
downward from south to north.
2. Soils : Urban land (Ur) is soil that has been modified
by disturbance of the natural layers with additions
of fill material several feet thick , to accommodate
large industrial and housing installations. The
erosiob hazard is slight to moderate.
3. Vegetation: Scrub brush and blackberries are the
principal features of the site .I
4. Wildlife: The existing vegetation may provide
some habitat for birds and small mammals.
5. Water : No surface water was observed on the subject `,
site (February 6, 1981) .
6. Land Use: The site itself is presently undeveloped .
Previously it had been used as railroad tracks.

The surrounding properties are developing into light 1
commercial and office park uses. The olider residential '
area to the south side of S.W. Grady Waytis in transition
to commercial and office uses .

J . IENVltR®NMIEMTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton ' s Environmental Ordinance
and the State Environmental Policy Act of 1971, as amended,
RCW 43-210 , a declaration of non-significance was issued
for the subject proposal by the Environmental Review
Committee on February 22, 1981.

L . PLANNING DEPARTMENT ANALYSIS:
1 . The applicant is proposing constructing of a 4200
square foot building to provide a testing facility
for vehicle emissions per state law. The facility
must ,open on January 2 , 1982 , to meet the regulations .
2. The site design shows four emission stations with
adequate parking for individuals during the con-
sultation phases of the testing. In addition,
there is 150 feet of queuing space provided on
site .
3. The applicant has requested a variance from the
60 foot setback required along Southwest 10th Street.
The building proposed for the site is a standard
building used in six other applications in the
State of Washington for testing facilities.
4. The site itself is limited by a 60 foot power line
easement along the southern property line along
with a 20 foot oil pipeline easement near the eastern •
boundary of the subject site . The applicant ' s
justification for granting the rezone is based
on the shape of the lot in relationship to two
streets and the subsequent imposition of the 60
foot "setback from both streets . The end result
is that the building area on site is only 40 feet
wide . This is a reduction of approximately 50
percent of the total on-site buildable area when
considering similar lots to the east of the subject
site along Southwest Grady Way. In both cases
the lots were created out of a combination of power
line easements and railroad right-of-way. However,,
in the sites east of Rainier Avenue South, the
access is solely onto Southwest Grady Way and there
is no public street on the northern property boundary.

Therefore, the hardship created is not a result
of the applicants own action but a result of location
of Southwest 10th Street only 160 feet from Southwest
Grady Way . In most Manufacturing Park areas inside
the City of Renton, the blocks created are much
larger and are not constrained as with the subject
site. This unique situation extends only for a
length of approximately 4 blocks along Southwest
Grady Way. There appears to be no other examples
of such constrained property under this specific
condition . Therefore , the first criteria is met
because of the shape and location of the public
streets in relationship to the subject property
Section 4-722(3) (a) (4) . The second _ criteria is
that the granting of the variance will not be
materially detrimental to the public welfare or
injurious to the property where improvements in
the vicinity and the zone in which the subject
property is situated. " The applicant ' s justification
shows that the facility will maintain the intent
of the Manufacturing Park zone by providing a well-
landscaped site with spacious setbacks from the
public streets. The Planning Department would
agree with the argument presented by the applicant
in this case .
5. Criteria No. 3 states "that approval shall not
constitute a grant of special privilege inconsistent
with the limitations upon uses of other properties
in the vicinity and zone in which the subject property
is situated . The granting will not ' constitute
a special privilege because a nearby property to
the east of the subject site was granted a variance
in 1977 to reduce the setbacks from both Southwest
Grady Way and Southwest 10th Street. ; (V-321-77,
Dwayne A. Wells-Val Bain)
In that specific case , the building ;was a three-story ;
building which visually imposed upon the setbacks
more than the proposed one-story building on the
subject site.
6. Criteria No. 4 states "that the approval as determined
by the Examiner or Board of Adjustment is a minimum
variance that will accomplish the desired purpose. "
The applicant ' s request is based solely upon the
internal technical design of the structure., The
design is being used in seven locations throughout
the State of Washington .to provide this mandated
service to the citizens of the State. The equipment
design and functioning . of the facility is specifically
limited by its ultimate role ; therefore , the request 1
is a minimum that can..be accomplished to meet the
desired purpose of locating the testing facility
upon this specfic parcel of property .
7. The a pLicant has addressed all facets of bothPP.,
the architectural and site plan drawings in detail.
The building treatment will blend inAvith the typical
small manufacturing building in the area. Basically
with the ultimate intent that after the program
is finiahed, the building can be utilized for. another
purpose. The internal circulation and parking

pattern is designed specifically for vehicles to
enter ..he site , proceed through the testing lanes, '
and then if there is a subsequent problem, to park
and address the technician in the offices. Redevelop-
ment in the future is covered by the present ordinance
which would call for another site plan approval
when this operation was finished.

8 . The lan-dscaping plans prepared provide for heavy
screenings of evergreens and evergreen shrubs along '
Southwest Grady Way and the use of london planes
to blend in with the. theme of the Manufacturing
Park development along Southwest 10th Street.
All of the sizes and spacing appear appropriate
except for the Shore Pine along Southwest Grady
Way . The trees are anticipated to be four to five
feet in height and will not provide a substantial
visual barrier since Shore Pines are very slow
growing in nature . Therefore , it is recommended
that the trees be a minimum of six to eight feet
in heighth when planted.

APPENDIX A
GRADY WAY
I. BACKGROUND
6. The proposed State vehicle emission test facilityistobeoneofsixlocatedintheSeattlemetro-
politan area. These facilities are the direct
result of the State of Washington's efforts to
meet pollutant standards in nonattainment areas.
The Seattle region currently exceeds Federal
standards for carbon monoxide and hydrocarbons.
Clark County, in southwest Washington, exceeds
standards for hydrocarbons only.
The State has contracted with Vehicle Test Technol-
ogy, Inc. (VTTI) , to locate, construct, end operate
seven testing facilities (six in the Seattle areaandoneinClarkCounty) . The inspection stations
will begin operating on January 2, 1982, and
continue for a minimum of 5 years.
Vehicles in the Puget Sound region must meet the
minimum standard for hydrocarbons, carbon monoxide,
and carbon dioxide. The test includes: hook upandautomaticallycalibratetestequipment; idle
test to measure hydrocarbons, carbon monoxide, and
carbon dioxide; compare measured values to standards ;
and removal of test equipment. The post-test
includes the issuance of a Certificate of Complian e
or Acceptance, or an inspection report for failed
vehicles. Results will be explained to the owner
before the vehicle exits the facility. The projec ed
total time on site will average 5 minutes. Hours
of operation are 10 a.m. to 8 p.m. , Tuesday throughFridayand9a.m. to 5 p.m. on Saturdays. The
facility will be closed Sundays, Mondays, and
holidays.
The proposed project will serve the Southcenter
area with four inspection lanes. The inspection
facility will be approximately 4 ,200 square feet
with a maximum height of 20 feet (to accommodate
trucks) .
The test station building will contain public
restrooms and an information office for vehicle
owners who have questions about the inspection
process and for those who need to process Certifi-cates of Acceptance. The employee area will
consist of locker rooms, restrooms, a manager' s
office, and a general purpose room serving as atrainingroom/lunchroom.
On-site parking 1411 be provided at the rate of
one space per employee and two spaces per inspec-tion bay. Queuing space will be provided at the
minamum rate of 150 feet per inspection lane. One
of ;the four lanes will be a spare operational baytoprovideforemergenciesandpeakdemand.
7. Location of Proposal
The site is situated in southwest Renton in a flat
alluvial valley bottom between Grady Way and SW10thStreetjusteastofThomasAvenueSW.
The specific location contains abandoned railroad
berm paralleled by an electrical transmissionline, both running east-west. These two rights-of-
way are bounded on the north and south by east-west
running streets that have been built on fill .
The electrical transmission line right-of-way is 1,
low-lying and wet, with tall grass being the majorformlofvegetation.
The railroad berm is characterized by gravelsoils. Blackberry and hawthorn are the predominanttypesofvegetation.
II. ENVIRONMENTAL IMPACTS
lb. The railroad berm will be excavated approximately8feetandtheelectricalright-of-:way will befilledapproximately6feettobringthesite to
street level .
1c. The depression under the electrical right-of-waywillbefilledwithmaterialfromtherailroadbermItocreatealevelsitewhereapproximately 14feetofreliefpresentlyexist.
2. The purpose of this project is to bring the Seattle
and Clark County areas into attainment for pollu-tant standards. While the local effect may be thedeteriorationofambientairqualityduetoidling
vehicles, the long-term areawide effect will be
the reduction of pollution levels by correctingthosevehicleswhichviolateemissionstandards.
3. Water flowing in an existing ditch will be routedthroughnewpipes. Paving the site will increasetherateofrunoff; however, this increase will
not cause any flooding problems.
4. The project landscaping will enhance the visual
qualities of the site and appearance of the gener 1area. The design meets the intent and in many
cases exceeds the landscape requirements of the
manufacturing park zone .
5 . Although some habitat for animals such as rabbits,
mice, moles, and snakes will be eliminated, the
proposed landscaping will mitigate this loss ofhabitattosomeextent.
7 . Site lighting will be provided but it will be
directed away from adjacent streets.
8 . The project site is currently zoned general ("G") ,
and it is located in an area designated for manufac-turing park • (MP) uses on the City's current compre-hensive plan map. Approval of the proposed rezonfromGeneralzoningtoManufacturingParkzoningwillplacethepropertyincompliancewiththe
comprehensive plan and will allow developmentthatisbothconsistentandcompatiblewith
adjacent land uses.
North of the site between 10th and 7th Streets and
Linde and Powell Avenues is a recently constructedindustrialparkconsistingofabout15large
warehouses. The proposal site lies in the vacated
Northern Pacific right-of-way on the south side of10thStreet. The only other occupied portion of
the right-of-way is an office building to the eastattheintersectionof10thandLind . South ofthesiteacrossGradyWayisavacantlot, a boatand (trailer parking lot, and Cummins and BoeingCompanyofficesandwarehousing. Several of the
properties in the surrounding area have been
rezoned in recent years from "G" to "MP." Southwest10thStreet, located on the northern boundary ofthesite, has recently been improved to serve the
manufacturing park uses in the area.
10. "A" size cylinders of HC will be stored and used
on site for the calibration of equipment. These
cylinders will be chained securely to the wall and
handled in accordance with all applicable fire and
safety codes.
13. The project site is primarily served by three
streets: 10th Street SW, Lind Avenue, and SW
Grady Way. Tenth Street, which will provide
direct access to the site, is a recently improved
local access street with a high percentage ofIltrucktraffic. Lind Avenue, a north-south secondary
arterial links Grady Way to 10th Street. Grady
Way serves as a primary bypass of I-405 between
Interurban Avenue to the west and Rainier Avenue/
East Valley Freeway to the east.
The proposed project will serve approximately
105 vehicles during the evening peak hour in the
peak month. It is estimated- that 25 percent of
these vehicles will already be traveling in the
area for other trip purposes and therefore do not
represent a net addition to the traffic volume on
the overall road system. The traffic generated bytheprojectwouldrepresentnewtrafficon10thAvenuebecauseof. its "local access" status. The projected
traffic volume for the test facility, as compared
to existing volumes at the intersection of Grady
Way and Lind Avenue, amounts to less than 5 percent.Therefore, it is not expected that development of
the project will have a significant adverse impact
on the level of service of the adjacent overall
road system.
The project will provide on-site parking for
customers and employees, for a total of 8 customer
and 14 employee spaces. Nearly 700 feet of queuing
space will be provided for the facility.
Mitigating Measures
1
The project includes mitigating measures for
potential traffic problems:
o An operational backup/spare lane will be
available in the event of an equipment
outage and for peak inspection times.
This will ensure a quick and efficient
testing procedure at all times.
o On-site queuing lanes totaling 695 feet
will assure that customer traffic does
not back up onto 10th Street SW. The
State has the authority to impose a fine
on VTTI should queuing traffic become
excessive. It is also anticipated that
drivers would not attempt to join a
queue which is unreasonably long. Mos -
people would normally choose to return
at another time.
o The hours of operation (10 a.m. to
8 p.m. , Tuesday through Friday) are such
that there is no contribution of site-
generated traffic to the a.m. peak hour.
The facility is also to be open on
Saturdays to help in the temporal distri-
bution of the traffic.
15. The building is designed to meet Washington State
Energy codes.

TRANSPORTATION ANALYSIS
EXISTING CONDITIONS
The existing transportation services which may be impacted
by the proposed project in' the Grady Way epicenter include
primarily three facilities: 10th Street SW, Lind Avenue ane
SW Grady Street.
Tenth Street SW is a recently improved local access street
serving a developing manufacturing park including warehous-
ing and office activities. The street currently deadends at
Powell Street to the west of the project site. There is no
direct connection between 10th Street SW and Grady Way to
the south. The street is within a 60- to 70-foot public right-
of-way and consists of a 40-foot curb and gutter section.
Tenth Street ISW is controlled at Lind Avenue with a stop
sign providing preferential treatment on Lind Avenue.
Because of the warehouse activity in the area, traffic on
this street has a high percentage of trucks as compared to
other local access streets. Tenth Street is signed at Lind
Avenue for "local traffic only" with additional words of
violators will be prosecuted" to discourage nonessential
traffic on 10th Street. Tenth Street is well lighted with
40d-watt mercrrury vapor luminaires, including poles, in the
immediate proximity of the project site. There are limited
segtions along 10th Street with sidewalks; however, no side-
walk provisions exist along 10th Street in front of the proj-
ect site. Current traffic volumes ( 2-way traffic) on the
street are estimated at approximately 500 to 1,000 vehicles
per weekday. Major access to the MP area is via 7th Avenue
to the north of the project site rather than by 10th Street.
It is estimated that truck traffic conservatively accounts
for approximately 20 percent of this traffic.
Lind Avenue is classified by the City of Renton as a second-
ar' (principal) arterial . The street north Of Grady Way is
a 4-lane section and is approximately 48 feet wide with gravel
shoulders and provides primary access into the industrial
park area to the north of the project vicinity. Lind Avenue
is also the only overcrossing of I-405 providing direct con-
nection to the rapidly developing industrial and commercial
areas to the south of I-405. The bridge section itself and
southerly approach to Grady Way are estimated to be 24 feet
wide. Lind Avenue serves as a primary circulation link
be ween SW 7th Street to the north and SW Grady Way. Recent
Ci y of Renton counts (1980) show Lind Avenue in the vicinity
of SW 10th Street as carrying approximately 9 , 700 cars per
we kday. South of I-405 the volume increases slightly to
10, 300. Lind Avenue and 10th Street are both posted for

25-mph speed limits. Lind Avenue crosses a series of rail-
f
road tracks between 10th Street and Grady Way. These rail-road tracks have been abandoned; however, the railroad streetcrossingsthemselveshavenotbeenremoved .
Southwest Grady Way is classified by the City of Renton as a
secondary (principal) arterial . It is included in the PSCOG
Regional Transportation Network as an analysis arterial and
is shown to serve as a primary bypass of I-405 between Inter-urban Ave to the west and Rainier Ave/East Valley Freeway totheeast. It currently carries approximately 15,000 cars
per weekday with a peak-hour two-way traffic volume of 1,100
to 1,200 vehicles per hour. The city has no records as to
truck traffiic; however, a spot check indicates the truck
traffic to he on the order of 5 to 10 percent of the dailytraffic. This reflects the industrial and manufacturinglandusesintheareawhichitserves. Unlike 10th Street
SW and Lind Avenue, Grady Way is planned for improvements.
Major bridge rennovation to the east is anticipated to occur
in 1981-82, which will result in a 5-lane section. This
section can be expected to ultimately extend to Rainier Ave-
nue. This section would front the project site. The street
to the west of Lind Street currently consists of a basic
2-lane narrow section consisting of two 10-foot lanes with
gravel shoulders on both sides. To the east of Lind Avenue,
the roadway consists of a 5-lane section. There is ample
right-of-way (100 feet) for future improvement. A signal
was recently installed approximately 1 block west of the
project site, primarily for the purpose of accommodating the
Boeing office building parking facility located between GradyWayandI-405. There currently are no pedestrian facilities
along Grady Way with the exception of the gravel shoulders
and pedestrian signals at Grady Way and Lind Avenue. Little
bicycle or pedestrian traffic has been observed in this area.
This is reflective of the narrow roadway and high percentage
of truck traffic on this facility. Grady Way is posted for35mph.
The intersection of 10th Street and Lind Avenue is a "T"
configuration and is estimated to operate at level of serv-
ice "A" under existing conditions. The critical movement
e.g. , left-turns off of 10th Street onto Lind Avenue) cur-
rently operates at level of service "C" while all other move-
ments operate at level of service "A" .
The intersection of Lind Avenue and SW Grady Way is a fully
actuated 5-phased signalized intersection that is operated
by the City of Renton on its computer controlled traffic
system. Loop detection is provided on all approaches. The
north leg on Lind Avenue for this intersection consists of
two lanes; however, no separate left-turn phase is provided .
The approach on the south leg of Lind Avenue is also widened
to accommodate two lanes to the northbound approach, again

with no separate left-turn lane. GradyWayitselfIP
i provides
two through lanes for each approach plus a separate left-turn
phase for each approach. The intersection is lighted with
400-watt mercury vapor luminaires. There are also provisions
for pedestrian-actuated controls as well as WALK, DONT-WALK
signalizationJ Calculations for the 4 to 5 p.m. peak hour
indicate that this intersection currently operates at a bor-
derline leve' of service "C01 and frequently at level of
service "B.00 Pedestrian movements are generally light in
all of these areas, indicative of the industrial manufacturing
nat re of the area. Both local and express transit serviced
five routes) exist along Grady Way. The regional transpor
tation plan identifies the future need for a bus-only lane
along Grady Way.
Accident Patterns
The intersection of Lind Avenue and Grady Way has a greater
number of accidents than the Lind Avenue and 10th Street
intersection. The number of accidents is directly related
to the traffic volumes encountered. Accidents primarily
consist of right-angle collisions or rear-end accidents,
which are normally encountered at signalized intersections .
The accidents at Lind and 10th Street are generally right-
angle, or side-swiping, indicative of a "T"-intersection
operation. Discussions with city staff indicate that no
accidents have involved fatalities nor have they involved
pedestrians or bicyclists.

FUTURE CONDITIONS
The location and layout of the proposed development together
with an estimated distribution pattern for project-related
traffic are shown in Figure 1. All vehicles will gain access
to the inspection center via the westerly driveway along
10th Street SW. This access will require use of the inter-
section of Grady Way and Lind Avenue. Because of the heavy
traffic volumes along Grady Way, the narrow nature of the
roadway section, and in anticipation of future widening of
this arterial , no provisions have been made or incorporated
into the design for access to Grady Way. However, upon com-
pletion of the future improvements, "right-turn in" or "right-
turn out" maneuvers may be justifiable and will be investigated
at that time as a means to expedite traffic through the test
center, as well as to improve accessibility to the project
site. Two improvements would serve to better distribute the
traffic loads from the project site to the arterial network:
1) the provision of a two-way left-turn (as proposed by the
City) along Grady Way; (2 ) signalization on Grady Way that
would cause platooning of traffic during peak hours in order
to allow left-turn maneuvers from the site. However, based
on discussions with city staff and the potential future role
of Grady Way as a reliever arterial to Interstate 405, it is
concluded that access to Grady Way will be severely restricted
in order for it to serve as a primary through facility.
Discussions with city staff also indicate the potential exists
for extending Powell Street west of Thomas through to Grady
Way creating a formal intersection. This improvement is
predicated upon the proposed development of the area to the
northwest of the project site. This development is not
expected to significantly impact 10th Street in the vicinity
of the project site.
Traffic/Circulation
On the basis of detailed analysis and simulations provided
by VTTI, it has been estimated that the proposed project
will service approximately 105 vehicles during the evening
peak hour in the peak month. It is also estimated that at
least 25 percent of these vehicles will already be traveling
in the area for other trip purposes and therefore do not
represent a net addition to the traffic volume on the overall
road system. However, since much of the property along 10th
Street is undeveloped at this time, the additional traffic
on this section of the street system would, in fact, repre-
sent new traffic. Figure 1 presents the assumed distribu-
tion of theIone-way trip ends onto the surrounding street
system using the estimated traffic distribution patterns.
Adding the assumed site-generated trip to the traffic that
already exits on Grady Way and Lind Avenue is not expected
to alter the current level of service "B. " This is supported

2 .18 in 1990 ig no improvements were made, and at 0.68 in
the 1990 plan.

The relatively small amount of traffic at
this intersection attributable to the project site is less
than 5 percent. This figure can be assumed to be included
as part of the future growth of the area, and therefore no
separate detailed analysis was done to reflect future con-
ditions with or without the project. It is estimated that
it will take a 42 percent increase in traffic at this inter-
section during the p.m. peak hour for the critical approaches
to reach level of service "D. " This would represent appro i-
mately an 8 .4 percent increase each year for the next 5 years.
The intersection of Lind Avenue and 10th Street would continue
to1operate at LOS "A" overall; however, the added project
traffic would raise the left-turn movement from 10th Street
tol Lind Avenue from LOS "C00 to LOS "D. " The peak period
traffic volumes shown in Figure 1 are based on 1986 vehicle
poi ulations. They therefore represent a somewhat conservative
projection. The determination of intersection capacity
estimates utilizes the Critical Movement Analysis procedure
as defined in the Transportation Research Circular 212 (Trans-
portation Research Board 1980 ) . Level of service "C" or " "
is generallyconsidered an acceptable level of service for
an urban/suburban area as is characteristic of the project
site. Therefore, it is concluded that the proposed develo ment
wiill not, in and of itself, have a significant adverse impact
on the operation of the intersection of Lind Avenue and Grady
Way or with Lind Avenue and 10th Street SW.
All employee and customer parking will be provided on site.
The customer parking will be provided at a rate of two spaces
per inspection lane for a total of eight spaces. In addition,
ore space for each employee will be provided within the project
area for a total of 14 spaces. Employee parking will accom-
modate both shifts and will provide for handicapped parking
spaces.
Accident Patterns
The additional daily traffic that is generated by the pro-
posed vehicle inspection center (one-way trip ends per daY)
represents a relatively insignificant addition to the tot 1
traffic volume that currently travels throughout the area
and especially at the intersection of Lind Avenue and 10t
and at Lind Avenue and Grady Way. As previously presentee ,

In 1977 the federal government mandated through the Clean Air Act that cert in
states, including the State of Washington, undertake a program of vehicle emissio
inspection to mitigate unacceptable air pollution conditions within their jurisdi -
tion. The 1979 Legislature passed a law to implement this program.
Starting January 1, 1982, a valid certificate of compliance or a certificat
of acceptance issued at an official motor vehicle emission inspection facility wi 1
be required in the State of Washington before the license of any nonexempt vehicle
registered in the designated emission contributing areas will be issued or renewed.
Vehicle Test Technology, Inc. (VTTI) , a Washington corporation, has been con-
tracted by the State of Washington to establish and operate the official motor
vehicle emissions inspection facilities under existing statutes (Chapter 70.120 CW,
Motor Vehicle Emission Control) and Washington Administrative Code 173-422. These
facilities will be located in the Puget Sound and Clark County emission contribu ing
areas as mandated by the Federal Clean Air Act.
VTTI is required to provide inspection sites in the greater Seattle and Clark
County areas of the state. The sites selected should provide the maximum convenience
for the vehicle owners in the testing areas. State specifications require that
inspection stations be located so that 80 percent of the registered vehicles are
housed within five miles of a station and 100 percent of the registered vehicles
are housed within 12 miles of a station.
We would like to request any assistance you may be able to provide to VTTI in
the siting a d construction of these official state motor vehicle emission inspe tion
facilities.

lease revie the attached applications for a rezone, variance and site
plan approval. The proposed project is a State of Washington Vehicle
fission Tesk Facility at SW 10th Street and Thomas Avenue. The
acility will .be operated by Vehicle Test Technology Incorporated,
under contract to the Washington State Department of Ecology. This
facility, mandated by the federal government, will test carbon
monoxide and hydrocarbon emissions of passenger vehicles in the
Southcenter area to help bring the Puget Sound region into attain-
ment for federal pollutant levels. The project must be in operation
by January 2, 1982; therefore, time is a critical factor in the
processing of land use applications.
in the interest of expediting our application, we request you reviewtherezone, variance and site plan approval together and that approyal
Of the variance be conditioned on the final approval of the rezone by
the City Council.
We feel the rezone request is appropriate at this time to support the
emerging manufacturing park character of the area. The variance is
Iliecessary because of the narrow configuration of the site and its
frontage betFreen two streets. Required setbacks in the MP zone in this
circumstance are 60 feet from each street. This removes 120 feet
If the 160 foot lot depth from the site's buildable area. SimilarOf
and variances have been granted along this strip of land between
Grady Way and SW 10th Street in the recent past.
In our design of the facility, we have made every effort through
landscaping and selection of building materials to enhance the
character of the area. If you have any questions or require more

8 . Why can 't the property be developed within the requirements
of the odinance?
a) The rear of the property (Grady Way) is encumbered with
a 60 foot power line easement which prohibits any building
construction underneath it.
b) There is a 20 foot petroleum easement through the easterly
porltion of the property which prohibits building
con truction over it.
c) Further, as result of the widening of 10th Street, the
10 h Street'r'ght-of-way jogs 10 feet south abutting 11
th' s property which makes the property narrower than the
adjoining lands to the east {The Wells/Bain property to
th east was granted a setback variance in SA-061-77} .
Th easements and narrow configuration constrain
the property from being developed as intended by the
zoning classification.

JUSTIFICATION FOR VARIANCE
A. The v riance is necessary because of the narrow configuration of the
site and 'ts frontage between two streets. The required setbacks in the
proposed zone in this circumstance are 60 feet from each street. This
removes 20 feet of the 160 foot lot depth from the site's buildable area,
leaving only a 40 foot wide strip of land which can be used for structures.
Other prdperties in the MP zone are generally of a shape that allows the
spacious setbacks which are intended in this zone without restricting
building size. Property to the east which is similarly constrained between
Grady Way and SW 10th Street has been granted a variance to allow
construction of an office building.
B. The granting of the variance will not be detrimental to the public
welfare because:
1. Substantial 40 to 45 foot setbacks will be maintained
2. Large interior and perimeter areas of the site will be landscaped.
The building will be low and small. These measures will help
achieve the objectives of the required setbacks in less space.
3. Unless the Setbacks are slightly reduced it is extremely difficult
to provide a functional design on a site of this depth.
4. The extra landscaping will help assure compatibility with adjacent
uses in ad ition to providing open space and wildlife habitat.
C. The approval of this variance will be consistent with other variances
granted on similar property to the east.
D. The building has been designed to optimize its internal functional
characteristics and has been placed on the site in a manner to minimize
the amount of setback reduction.
