AN ORDINANCE OF THE CITY OF RENTON , WASHINGTON CHANG-
ING THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES
WITHIN THE CITY OF RENTON FROM RESIDENCE DISTRICT
R-2 ) TO RESIDENCE DISTRICT ( R-3 ) . WOODCOCK

WHEREAS under Chapter 7 , Title IV (Building Regulations) of
Ordinance No . 1628 known as the "Code of General Ordinances of the
City of Renton" , as amended , and the maps and reports adopted in
conjunction therewith , the property hereinbelow described has
heretofore been zoned as Residence District ( R-2 ) ; and
WHEREAS a proper petition for change of zone classification
of said property has been filed with the Planning Department on or
about February 19, 1981 , which petition was duly referred to the
Hearing Examiner for investigation , study and public hearing , and a
public hearing having been held thereon on or about March 24 , 1981 ,
and said matter having been duly considered by the Hearing Examiner
and said zoning request being in conformity with the City ' s
Comprehensive Plan , as amended , and the City Council having duly
considered all matters relevant thereto , and all parties having been
heard appearing in support thereof or in opposition thereto , NOW
THEREFORE
THE CITY COUNCIL OF THE CITY OF RENTON , WASHINGTON , DO ORDAIN
AS FOLLOWS:

Request for Letter from Nick Kuntz, 301 NW 6th St. , reported recent request
Street Sign for caution sign installation at NW 6th St. because of lack of
NW 6th St. sidewalks and children/adults must use side of street. MOVED
BY CLYMER, SECOND STREDICKE, refer request to the Transportation
Committee. Stredicke asked all streets without sidewalks be
reviewed. Mayor Shinpoch recalled prior requests and advising
Mr. Kuntz that "children at play" sign for the Woody Glenn cul-de-
sac area could have more dangerous repercussions rather than pro-
tecting the children, as advised by Traffic Engineer Gary Norris.

Golf Course and set the stage for potential negotiations.

County buy the golf course property, being adjacent to County
park, so that maintenance costs could be reduced. MOVED BY

Travel Request Cheryl Bersch asked denial of travel request, that Council con-

Ms. Bersch noted the ERA ratification time limit of one additional
year (commitment made 4/78) . MOVED BY HUGHES, SECOND ROCKHILL,
authorize Fire Marshall to attend conference in Nevada. Discussion
ensued. Fire Chief Geissler explained need for attendance. ROLL

Maplewood Heights Ray Griffin, 14306 144th SE, claimed storm drain outfall on
Erosion SE 4th P1 . is eroding Maplewood Heights community green belt and
asked the outfall be relocated. Griffin requested reply in writing.
NE 4th Traffic Griffin also requested limited ingress and egress to NE 4th St.
SE 128th) , citing heavy traffic and problems. Councilman Stredicke
noted proposed plan for 5th lane (turning lane) .

Cedar Ridge Land Use Hearing Examiner recommends approval with special condi-

Claim for Damages Claim was filed by Gregory M. Fontaine, 903 NW 6th St. ,
Damages in amount of $350 for damage to bicycle, alleging City car backed
over bike in Park Department parking lot. Refer to City Attorney

Court Case Superior Court Summons and Complaint has been filed by Scott A.
S.A. Jarvis Jarvis against the City (James Phelan, Hugh Darby and Donald
Persson) claiming deprivation of his Constitutional rights.

Subdivision Acting Planning Director Clemens requested amendment to the Sub-
Ordinance division ordinance to provide alternatives to public streets in
some Short Plat applications and to specify procedures for lot line
adjustments. Refer to Planning and Development Committee for
report and recommendation.
Utility Plant Letter from Ted Bennett, Acting Finance Director, advised Utility
Value Plant Value as of 12/31/80 is $23,955,083.63; provided to use for
1982 in lieu of tax payment (service charge) paid by the Utility
to the Current Fund. One and 1/2 percent of plant value is the
maximum which can be Paid ($359,326) . Refer to the Mayor and
Council Budget Committee for budget purposes.
Latecomer's Letter from Acting Public Works Director Houghton reported Utilities
Agreement Committee approval for request for Latecomer' s Agreement (S-305)
McCaslin Joepete McCaslin, sewer line NE 20th St. (Referred 5/11/81 ) .
Authorize Mayor and City Clerk to execute agreement. Concur.

Fence Height Council President Stredicke reported receipt of Board of Adjust-
ment report, noting one of items having most Board action during
the year was requests for variance relative to fence height.

Pursuant to your memorandum of April 20, 1981 regarding
the above request for reconsideration, it would seem to
be a satisfactory solution to allow a reduction of the
landscape buffer from ten to six feet as the applicant
has proposed.
It is my belief that the intensity of the landscaping
proposed within the six foot strip would be sufficient
to screen the adjoining single family home and still
allow enough space for interior landscaping to abut the
clinic. I would further recommend the addition of
approximately three trees within this strip as an
additional mitigation measure for the screening. These
should be canopy type trees such as a maple or oak, and
be placed on 30 foot centers.

This office has received a request for reconsideration in the above
entitled matter in regard to landscape treatment necessary to
buffer an adjoining single family home.
Would you please review the attached alternative plans and the
original recommendation of this office. The applicant wants to
landscape the north side of the clinic facility between the parking
lot and the clinic. The recommendation concentrated the landscaping
next to the single family residence located immediately to the north
of the proposed parking lot.
Please feel free to make suggestions on carrying out both purposes ,
if possible, but concentrating on buffering the single family home.
Both landscaping and fencing may be utilized for this purpose.
There are dimensional constraints, so please consult with the Planning
and Building Departments in this matter.

Dear Mr. Kaufman:
We wish to request reconsideration of the above referenced project
in regard specifically to the 10 ' landscape buffer that has been
required by your office as part of your approval of our re-zone
and special permit .
It is my feeling that the 10' landscape buffer on the north side
of the parking lot would almost totally eliminate any landscaping
next to our building and tend to reduce the quality of the over-
all project. I appreciate your concern for the 10' buffer but
wonder if we couldn ' t solve it in one of the following three methods:
Alternate #1 : Reduce the buffer to 6' and intensify the landscaping
both by specie as well as quantity.
Alternate #2 : Provide one of the schemes as recommended by the
Planning Department.
Alternate #3 : Allow us to proceed with our scheme as presented
with the addition of an attractively designed site
screening cedar, stained fence, approximately 4'
high on the property line .

SUMMARY OF REQUEST: The applicant requests a rezone of the subject site from R-2 to
R-3 and approval of a special permit to use the subject site as
a parking lot to service an existing clinic.

PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on March 18, 1981 .
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on March 24, 1981 at 9:30 a.m. in the Council Chambers of the Renton
Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department preliminary report. Roger Blaylock, Associate Planner, presented the
report , and entered the following exhibits into the record:

Mr. Blaylock advised that the modified parking lot design would require pruning of an
existing spruce tree located at the northeast corner of the site. Referencing Section
M. 1 of the special permit recommendation, the Examiner noted that covenants precluding
subsequent sale of Lot No. 4 would not be necessary if the entire property were replatted
and the three lots were consolidated into one parcel . He then inquired regarding the
total number of required parking spaces. Mr. Blaylock advised that 19 stalls would be
required. The Examiner noted that once the building is brought into conformity with
required parking, the use would be conforming and parking could not be eliminated through
the sale of Lot No. 4. Mr. Blaylock corrected Section M.3 of the Planning Department
report, second line, to reference Section L.5, not L.4.
The Examiner requested testimony in support of the application. Responding was:

Mr. Nelson stated that parking space is inadequate in the area and approval of the special
permit would be beneficial both to the subject property and the surrounding neighborhood.

He supported the proposal to consolidate the three lots into one parcel in order to conform
to the applicant ' s site plan, Exhibit #4, which he preferred to the alternative site plan
submitted by the Planning Department. Mr. Nelson indicated that resale of the property
would be difficult if sufficient parking is not provided. He also advised concurrence in
retaining the existing spruce tree which will buffer the new parking lot from the adjacent
residence.
Responding to the Examiner' s inquiry regarding proximity of the residence to the south to
the subject site, Mr. Blaylock advised that from 10 to 15 feet separate the two. Mr.
Nelson clarified that due to the operating hours of the clinic from 9:00 a.m. to 6:00 p.m.
at the latest, problems with headlights shining into adjacent residences would be minimal ,
and if complaints were received in the future, a small fence could be erected as part of
the landscaping program.
The Examiner requested testimony in support or opposition to the application. Since there
was no response, the hearing regarding File No. SP-016-81 was closed by the Examiner at
9:45 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATION: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1 . The request is for approval of a reclassification of approximately 5,000 square feet
from R-2 zoning (Duplex Residential) to R-3 zoning (Medium Density Multifamily)
together with a special permit to establish an accessory parking lot for a
professional clinic.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton 's Environmental Ordinance and the State Environmental
Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance has
been issued for the subject proposal by the Environmental Review Committee, responsible
official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The subject property is located at 123 Pelly Avenue N. The property is located about
midblock on the west side of the street. The site is essentially level . An existing
single family home located on the subject site will be removed if the requests are
approved.
8. The subject site was annexed into the city by Ordinance No. 156 in 1909. The site
was classified R-2 upon adoption of the initial zoning ordinance in 1953.
9. The Comprehensive Plan designates the area in which the subject site is located as
suitable for the development of medium density multifamily housing.
10. The applicant proposes establishing a parking lot on the subject site to serve as
accessory parking for the adjoining clinic operated by the applicant. In order to
establish the clinic or its accessory uses on the subject site the applicant has
requested that the property be reclassified to R-3. An R-3 zoning designation permits
the establishment of clinics and accessory uses after approval of a special permit
Section 4-709A(A) (3)) •
11 . The area in which the subject site is located has a variety of uses. The adjacent
lot to the north is used for a single family home. Immediately to the south is the
clinic operated by the applicant. Similar clinics and a duplex are established on
the east side of Pelly Avenue in this vicinity. Other single family uses are located
to the rear (west) of the site adjacent to the alley.
12. The subject site is at the extreme southern part of a large multiblock R-2 zone. The
clinic to the south is part of a three parcel P-1 zone. Across from the clinic and
slightly southeast of the subject site is a two parcel R-3 zone with a duplex
residence.
13. The proposed parking lot is intended to serve the adjoining clinic which has

insufficient parking both for its needs and for current city requirements. The
clinic is now a legal non-conforming use. Ten additional parking spaces are proposed
for the subject site for a total of 20 stalls for the clinic. Nineteen stalls are
still required (Section 4-2208(2) (A) ) .
14. Since the subject site is a separate legal lot, the driveway serving the proposed
parking lot may not be less than five feet from the adjoining property line. Either
a variance from Section 4-2208(2) (A) or a replatting of the subject lot and the
adjacent clinic property would permit the driveway as proposed. The applicant
indicated that replatting the property was a strong possibility. Replatting the
property would perpetually tie the parking lot to its principal use in conformance
with the Parking and Loading Ordinance.
CONCLUSIONS: (Rezone)
1 . The proponent of a rezone must demonstrate that the request is in the public interest
and will not impair the public health, safety and welfare in addition to compliance
with at least one of the three criteria listed in Section 4-3010 which provides in
part that:
a. The subject site has not been considered in a previous area-wide rezone or land
use analysis; or
b. The subject site is potentially designated for the new classification per the
Comprehensive Plan; or
c. There has been material and substantial change in the circumstances in the area
in which the subject site is located since the last rezoning of the property or
area.
The applicant has demonstrated that the necessary criteria have been met to permit
the reclassification of the subject property.
2. The R-3 classification requested by the applicant is compatible with the designation
in the Comprehensive Plan. The area is designated in the Comprehensive Plan as
suitable for the development of medium density multifamily housing which is permitted
by the R-3 zoning requested.
3. The area was zoned R-2 in 1953 upon enactment of the original zoning ordinance.
Since that time, there have been no further zoning analyses of the area or of the
subject parcel .
4. There was a similar request in 1979 (File No. R-364-79) for R-3 zoning on the other
side of Pelly Avenue N. In that case that applicant also wanted to establish a
clinic. The City Council in granting an appeal reversed the Hearing Examiner and
granted R-3 zoning and the special permit to allow a clinic.
5. While the R-3 zoning is not especially compatible with either the R-2 zoning which
predominates in the area nor the P-1 zoning just south of the subject property, the
Comprehensive Plan does designate the area for medium density multifamily uses, and
therefore the request would not be spot zoning.
6. The property to the north is still used for single family housing and should also
be protected from the proposed higher density zoning and uses which may be potentially
established on the subject parcel . Unless the single family use is protected by
substantial landscaping and fencing, the property value of this adjoining parcel will
be impaired in violation of the goals and objectives of the Comprehensive Plan.
Therefore, the appropriate city agency should review and approve all landscape plans
for the subject site in order to provide a consistent policy of adequately buffering
the single family uses from higher intensity uses similar to the subject site's R-3
zoning. Adequate buffering shall consist of not less than 10 feet of landscape
treatment.
Special Permit)
7. In order to approve a special permit, the applicant must demonstrate that the proposed
use, which is otherwise prohibited in the zone requested, will not adversely affect
the general health, safety or welfare and will not adversely affect neighboring
properties.
While the proposal would impose a parking lot immediately adjacent to a single family
use, adequate screening of no less than 10 feet of landscaping may serve to buffer and
protect the single family home from the light, noise, glare and odors generated by
the proposed parking lot.

8. The clinic is already an existing non-conforming use as to parking, and the proposal
amounts to creating a parking lot for the clinic on the subject site. Parking lots
are not only accessory uses to clinics but required by the Parking and Loading
Ordinance. The establishment of the parking lot will enable the applicant 's clinic
to attain a legal and conforming status under the Zoning Code. Once such status is
established, the applicant may not remove or otherwise separate the parking lot from
the clinic. For this reason the applicant should replat the subject lot and the
adjoining clinic property into one parcel . This would permanently couple the
required parking and the clinic use. This consolidation would also eliminate any
need for a variance from the provision of the Parking and Loading Ordinance with
reference to driveway/lot line distance.
9. There are additional questions raised as to promotion and protection of the public
interest in both preserving property values and preserving the pool of land designated
for multifamily residential purposes within the city, especially the urban core. The
current application is a further example of the pyramiding permitted by the Zoning
Code. Such pyramiding permits usurption of land designated for one purpose by another
mutually exclusive use. In this case, land designated for residential purposes is
converted to parking for a clinic.
The area in which the subject site is located is generally zoned for duplex residential
development, but there are a number of clinics in the area. While the Comprehensive
Plan indicated that such professional uses may be compatible with multifamily housing
Page 11 , Land Use Report) , the purpose of such inclusion is to permit some professional
offices in residential neighborhoods but not to permit the conversion of residential
neighborhoods to professional parks.
Since this pyramiding effect may, in fact, be causing an adverse effect on the
available supply of land of certain types within the city, the City Council may wish
to study this issue in more detail .
10. While generally the City Council only passes upon the rezone request contained within
this report, the second matter is closely associated with the rezone and cannot be
approved without approval of the rezone, and, therefore, both matters have been
forwarded to the City Council for review.
RECOMMENDATION:
The City Council should approve the reclassification of the subject property from R-2 to
R-3 subject to provision of a 10-foot landscape buffer, the planting treatment subject to
review by the appropriate city agency.
The special permit to establish an accessory use, a parking lot, for a clinic in an R-3
zone should be approved subject to approval of the above reclassification request and
subject to replatting the subject lot and adjacent clinic into one parcel .

The subject site was annexed into the City of Renton
by Ordinance No . 156 in 1909.
D. PHYSICAL BACKGROUND:
1 . Topography : The subject site is level .
2 . Soils : Urban Land (Ur) This is soil that has
been modified by disturbance of the natural layers
with additions of fill material several feet thick
to accommodate large industrial and housing installa-
tions . The erosion hazard is slight to moderate.
3 . Vegetation : Some lawn and a few shrubs are the
principal features on the site.
4. Wildlife : The existing vegetation does provide
some habitat for birds and small mammals .
5. Water : No surface water was observed on the subject
site (March 6, 1981) .
6 . Land Use : An existing single family dwelling is
located on the subject site with similar uses to
the north and west . A clinic is adjacent to the
south with single family dwellings, a duplex , and
another clinic to the east .
E . NEIGHBORHOOD CHARACTERISTICS:
The surrounding properties are a combination of clinics
and single family dwellings .

1 . Water and Sewer : A 6" water main runs north-south
on Pelly Avenue North along the east side of the
street while an 8 inch sanitary sewer also runs
north-south along the westerly border of the property .

3. Transit : Metro transit Routes No . 107 , 155, and
240 operate along Park Avenue North approximately

and the State Environmental Policy Act of 1971 , as amended,
RCW 43-21C , a declaration of non-significance was issued
for the subject proposal by the Environmental Review
Committee on March 4 , 1981 .

L . PLANNING DEPARTMENT ANALYSIS:
REZONE
1 . The rezone request is generally consistent with
the high density multiple family designation of
the Comprehensive Plan for the site and surrounding
area .
2 . The proposed rezone and use is generally consistent
with the R-3 parcels and clinic use on the east
side of Pelly Avenue and the P-1 zoning and similar
clinic use on the property adjacent to the south .
3 . The subject site has retained its R-2 classification
since the zoning ordinance was adopted in 1953.
This would suggest that the designation has not
been specifically considered in a previous area
zoning or land use analysis other than the Compre-
hensive Plan of 1965 .
4. On November 19, 1979 , a rezone from R-2 to R-3
was approved at 110 Pelly Avenue North for a clinic
and associated parking) use to the east of the
subject site. (R-364-79 )
5. Items L-2 through L-4 appear to indicate that the
subject site is potentially zoned for the R-3 classi-
fication requested (Section 4-3014-C) .

SPECIAL PERMIT
1 . The applicant proposes to remove the existing dwelling
on 123 Pelly Avenue North and utilize the space
for additional parking stalls associated with the
clinic use at 115 - 121 Pelly Avenue North .
2 . The existing clinic of +3, 800 square feet requires
19 parking stalls . The site plan as submitted
indicates that 20 stalls will be provided.
3 . Section 4-2204-8B( 1 ) of the Parking and Loading
Ordinance requires a minimum five foot landscape
buffer between those sides of a parking lot that
are adjacent to land used and/or zoned for residen-
tial purpose . The property adjacent to the north
is so classified and the site plan indicates such
a buffer . However , the Engineering Division has
advised that the new curb cut for Lot No . 4 must
be located 5 feet from the property line. In order
to meet this standard, the landscaping requirement,
the 24 feet aisle and the 20 feet stall length
provisions of the Parking and Loading Ordinance,
it will be necessary to reverse the parking stall
alignment . Such an adjustment would bring the
site plan into compliance with these standards .
See exhibit for illustration) In addition , a
detailed landscaping plan will have to be submitted
to and approved by the Building Department.
4. The parking lot should be considered as an integral
part of the medical clinic , since it brings the
facility into compliance with the Parking and Loading
Ordinance. If the property were covenanted to
require that Lots 2 , 3 , and 4 could only be sold
together, modification of the parking lot would
not be required per Section 4-2204( 2)A which addresses
driveway locations . This has the advantage over
reversing the parking lot in that it saves a major
spruce tree (40 feet high ) at the northeast corner
of the site .
5 . Storm drainage installation and improvement of
the alley from the subject site to North First
Street will be required as per Engineering comment.
Also the existing driveways in front of Lots 2
and 3 must be closed.
M. DEPARTMENTAL RECOMMENDATION:
REZONE
Based upon the above analysis, it is recommended that
the requested rezone be approved .
SPECIAL PERMIT
Based upon the above analysis, it is recommended that
the requested special permit be approved subject to

Introduction The State Environmental Policy Act of 1971 , Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.

The purpose of this letter is to justify a rezone of Lot 4,
Block 24, Renton Farm Plat No . 3 C 123 Pelly North ] from its
ex .sting R-2 zoning to R-3 , and then to obtain a special permit
in order to add a parking area to the dental clinics on 115- 121
Pe._ly North. The R-2 zoning has not been changed since 1953 .
Tha parking requirements were minimal when the clinics were con-
structed in 1960.
Since the construction of these clinics the methods of prac-
ticing dentisty and numbers of people that can be treated by a prac-
titioner have changed significantly. Dentists are much more effi-
cient now than 20 years ago and many more patients come through the
dour in a given day. As a result of this , problems with substandard
parking in this area have been many. Some of the problems are as
follows:
1 . Patient complaints during peak hours from not being
able to find street parking and not being able to
manuver in the small stalls between the building.
2. Damage to the building and other structures from
autos parking and leaving.
3 . 8-10 auto parking accidents per year to staff , patient ,
and neighbors autos.
4. Poor entry and exit into existing stalls.
5 . Inadequate street parking during the work day.
The existing house on 123 Pelly is in failing condition due to
its age and not attractive from the street. The rental cash flow
situation is poor and remodeling the house is contraindicated. This
area is changing. One can see the emergence of new duplexes and four
plexes as well as a relatively new dental clinic on 3rd and Pelly.
The proposed changes will not only up date our present complex ,
but will be an attractive plus for neighbors in the area from the
standpoint of esthetics and street safety.

The changes proposed would be in harmony with the designated
high density multi-family use. It is apporpriate as it will
harmoniously annex with the existing properties on Lots 2 and 3 ,
and timely, considering the present condition of the existing
house and the need for better parking.
