CALL TO ORDER Mayor Barbara Y. Shinpoch led the Pledge of Allegiance to the
flag and called the meeting of the Renton City Council to order.

SPECIAL Mayor Shinpoch presented for viewing, gifts to the City from
PRESENTATION Renton's Sister City, Nishiwaki , Japan. The gifts consisted of
two Japanese dolls hand made by special techniques and delivered
by young visitor from Nishiwaki 's Mayor. Mayor Shinpoch explained
she would be sending Indian art objects to Japan.
CONSENT AGENDA The following items are adopted by one motion which follows the
business matters included:
For-Hire Letter from O. K. Cab Co. President Leslie Funderburg requested
License changes in the for-hire license of new cab drivers to dispense
with the physical examination as done by Seattle and King County.
The letter also requested reduction in fees, noting Seattle and
King County are $16 per year. Refer to Public Safety Committee.
One Valley Place Hearing Examiner Fred Kaufman recommended approval with restrictive
Rezone covenants for One Valley Place Properties Rezone R-046-81 , G to
P-1 to allow office and commercial space; located southwest of the
Talbot Rd. S and SW 43rd St. intersection. Refer to Ways and
Means Committee.
Consent Agenda MOVED BY STREDICKE, SECOND CLYMER, APPROVE THE CONSENT AGENDA
Approved AS PRESENTED. CARRIED.
OLD BUSINESS Council President Stredicke made inquiry re notification of
LID #313 citizens involved in July 20, 1981 letter/petition before Council
Talbot Road S from Talbot Rd. S residents requesting review and revision of
Street LID #313. Council President Stredicke requested petitioners
Improvements be notified of City Attorney and Public Works Dept. findings.
Mayor Shinpoch reported advice that LID #313_ not be reopened.
MOVED BY STREDICKE, SECOND CLYMER, ADMINISTRATION NOTIFY PEOPLE
FILING PETITION,DATED 7/16/81, OF THE CITY ATTORNEY OPINION REGARD-
ING LID #313 AND THE PURPOSE OF LID #313 AND ANY CHANGES WOULD
HAVE TO BE MADE AT PUBLIC HEARING; THAT COUNCIL HAS NOT CHOSEN TO BE-
HOLD PUBLIC HEARING. CARRIED.
Tiffany Park Council President Stredicke asked for update of plans for Tiffany
Walkway Park Walkway improvement re costs, etc. , noting letters have been

Community Services Community Services Committee Chairman Reed presented committee
Committee report which explained for informational purposes, their meeting

Housing Authority The report explained the site selection is a two-acre area east of

Authority. Following discussion, Acting Planning Director Clemens
noted HUD has not given final approval of the site, that assisted
housing does exist within the census tract. Council noted concern
for adequate bus transportation.
Parking Tickets Councilman Shane asked that parking tickets be cancelled that were
issued in the downtown area on Saturday during Western Days due
to streets being cleared. Mayor Shinpoch and Police Representative
Persson noted no complaints have been received.
Ways and Means Ways and Means Committee report recommended concurrence in the
Committee adoption of the proposed policy statement for reimbursement of
Chaff man: Clymer travel and per diem expenses for candidates competing for
Recruitment of selected positions in the City. MOVED BY CLYMER, SECOND ROCKHILL,
Department Heads - ADOPT THE REPORT AND REFER TO THE ADMINISTRATION AS POLICY STATE-

Public Safety The Public Safety Committee report recommended the City enter
Committee into an agreement with the City of Normandy Park for the housing
Chairman: Hughes of their prisoners and the Council authorize the Mayor and City
Normandy Park Clerk to sign the agreement. MOVED BY HUGHES, SECOND ROCKHILL,
Prisoners CONCUR IN COMMITTEE REPORT. CARRIED.
Automatic Response The Public Safety Committee recommended the City and neighboring
Mutual Aid cities and Fire Districts (such as Bellevue, Kent, Tukwila,
King County #20, #25, #40) enter into mutual aid and automatic
response agreements. The report stated rendering of assistance
under this agreement would be of mutual benefit to all jurisdic-
tions for emergency medical aid and fire supression situations
and requested referral to the Ways and Means Committee for proper
form. MOVED BY STREDICKE, SECOND HUGHES, CONCUR IN COMMITTEE
REPORT. CARRIED.
Planning and Planning and Development Committee report noted review of appeal
Development by Dominic Colasurdo of Hearing Examiner's decision for denial
Committee ; of a Special Permit for filling and grading of a site located
Chrm: Rockhill at the southeast quadrant of the intersection of NE 4th and
Appeal Union Ave. SE. The Committee concluded that the Examiner was in
Dominic Colasurdo error and the committee found that the drainage feature crossing
Special Permit the subject property is not a "stream" requiring preservation
SP-024-81 pursuant to Section 4-2313-4 of the Mining, Excavation and
Grading Ordinance. The Committee recommended the Examiner's
decision regarding SP-024-81 be reversed and the permit be
granted subject to compliance with the City's Mining, Excavating
and Grading Ordinance. Councilman Stredicke inquired re defini-
tion of stream and was advised by Councilman Rockhill that stream
had permanent source of water; that committee felt this was drain-
age situation subject to rain. MOVED BY ROCKHILL, SECOND SHANE,
CONCUR WITH FINDINGS OF THE COMMITTEE. CARRIED.

SUBJECT: APPEAL OF REMAND DECISION BY HEARING EXAMINER
COMINIC COLASURDO/FILE NO. SP-024-81
FACTS :
1 . The applicant ' s appeal of the remand decision by the
Hearing Examiner is based on four points :
a. "No other definition is given in support of the
Hearing Examiner ' s decision. "
b. " . . that the feature" (meaning ditch or intermittent
stream bed)"conveys the run-off from approximately
400 acres is erroneous . "
c. "An examination of the authorities relied on by the
Examiner in his decision make it clear that this is
not a ' stream' or 'water course ' . "
d. The applicant has met its burden of showing that
there will be no harm to the public welfare.
2. These statements are not supported by facts from the
Hearing Examiner 's report .
a. The Hearing Examiner specifically gives a definition
from page 1590 of Black' s Law Dictionary. The
reference by the appellant to "all definitions"
is 'erroneous in itself .
b. In 1962 the U. S..G'.'5.. conducted an aerial survey
of the City and a topographic map was subsequently
developed. This map used as the base for an early
land use study clear shows the "feature" as an
intermittent stream, which provides drainage to

more than the estimated 400 -acres in Section 10 and
15 of T.23 North, R. 5 W.M. The drainage basin extends
from approximately 1, 200 to 1 , 500 feet north of the
subject site south to the Cedar River. This is the
same drainage basin as the Cascadia Annexation is
located. in.
c. The appellant ' s statement is incorrect . As defined
by Black, a "stream" is always a "water course" , but
a "water course" is not always a "stream" . A "water
course" could be of intermittent character .
d. The question of public welfare is generally established
based on the communities ' goals and policies . These
clearly support the protection of natural drainage
features. The question of whether it is intermittent
or continuous is irrelevant ; it is a natural water
course. In addition, the applicant did not submit
any plans showing the use of the site. Therefore,
he has not proven that the public welfare will be
harmed ifathe "water course" remains .
RECOMMENDATION:
The appellant has not proven that the Hearing Examiner has
made an error in fact or law. The Examiner has made a
decision based upon accepted legal definitions that can
always be refuted with other legal definitions .
THE EXAMINER'S DECISION SHOULD BE AFFIRMED.

PUBLIC HEARING This being the date set and proper notices having been posted,
Tiffany Park published and mailed as required by law, Mayor Shinpoch opened
Walkway the public hearing to consider the Tiffany Park Public Walkway.
Vacation The walkway is 10 feet wide public right-of-way in Block 2 of
the Tiffany Park Div. 2 extending from Index Avenue S.E. to Lake
Youngs Way S.E. and lying north of S.E. 17th Court and south of
Kirkland Court. Councilman Reed did not participate in discussion
or action, declared a possible conflict of interest and left the
Council Chambers. Correspondence was read from Richard Houghton,
Chairman of Board of Public Works , recommending the walkway be
vacated at no charge and to retain utility easements on the property.
Correspondence was read from Dick Weller, 2609 Lake Youngs Court
S.E. , a concerned property owner in the area, asked for reconside-
ration on final closure of walkway. Persons present: Dorwin Cook,
1608 Pierce S .E. , a concerned parent of children which use the
walkway as a short cut to school , presented a survey taken from
nearby residents of the area resulting in the support to improve
the walkway. Cindy Hutchinson, 1621 Index S.E. , representing
three others in attendance, favored keeping path open and re-
quested research on area before closing, volunteering assistance
in payment for improvements. Morris Biddulph, 1662 Monroe Court,
favored keeping the path open. Charles Morgan, 1620 Pierce S.E. ,
was concerned about safety of children using other means than
walkway. Leslie Crump, 1629 Index Avenue S.E. , expressed adults
useage of the walkway. Roger Sathers, 1672 Lake Youngs Way S.E. ,
adjacent property owner, requested improvement of the walkway as
it is unsafe in present condition. MOVED BY STREDICKE, SECOND
ROCKHILL, THAT THE PUBLIC HEARING BE CLOSED. CARRIED. After

Dominic Colasurdo hereby appeals the decision of the
Land Use Hearing Examiner in the above referenced matter. '
This appeal is based upon the following errors of law,
fact and judgment:
1. The. Examiner has .erroneously concluded that the
surface water in question is a stream or water
course. It is neither. All definitions exclude
this type of flow. No other definition is given
in support of the Hearing Examiner' s decision.

2 . It is submitted that the contention that the
feature conveys the run-off from approximately
400 acres is erroneous.
3. The Examiner concludes that rain is a permanent
source of supply which qualifies this as a
"stream" . In fact, all authorities distinguish
streams from surface waters (which are not protected)
on the- basis -that the source of surfac.t. waters is
periodic rain. An examination of the authorities
relied on by the Examiner in his decision make
it clear that this is not a "stream" or "water
course" .
4 . The applicant has met its burden of showing that
there will be no harm to the, .public welfare by
granting the permit.

Dear Mayor and City Council:
We are owners of approximately 8 acres near the northeast quadrant of the inter-
section of NE 4th Street and Union Avenue NE. It has come to our attention that
the Renton Hearing Examiner has required the preservation of a small drainage
ditch which crosses a portion of our property, as a condition of granting a
request to fill certain property along the ditch near the southeast quadrant of
the intersection (Mr. Colusurdo).
We wish to express concerns and opposition to such a condition and our support
of Mr. Colusurdo's appeal.
We are not opposed to the preservation of significant streams and natural areas
within the city. However, it appears that the preservation of this particular
insignificant man-made ditch which is dry most of the year would not be in the
best interests of the public, and is contrary to other city actions along this
particular ditch and along other more significant water bodies. Preserving such
a small unattractive ditch would create a nuisance and safety problem, as well
a hindrance to site development.
It appears that the most logical and reasonable alternative in this particular
instance is to allow the proper incorporation of the ditch into the storm
drainage systems required by city ordinance for Mr. Colusurdo's property and
future development along its course.

SUMMARY OF REQUEST: The applicant originally sought approval of a special permit
to fill and grade an existing drainage ditch and install storm
drains on the subject site. A public hearing was held on
March 31 , 1981 , and the Examiner's Decision of denial was
published on April 6, 1981 . The matter was subsequently
appealed to the City Council , and following consideration,
it was remanded to the Examiner for further review.

PLANNING DEPARTMENT A letter reviewing the nature of the drainage in this
SUPPLEMENT: vicinity and its effect on the subject permit application
was received by the Examiner on June 10, 1981
PUBLIC HEARING: After reviewing the Planning Department letter, examining
available information on file with the original application,
and field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on June 16, 1981 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
Roger Blaylock, Associate Planner, reviewed background of the matter and the City Council 's
intent in remanding it to the Examiner for further review following his original denial .
Mr. Blaylock entered the following exhibits into the record:

The Examiner requested testimony by the applicant. Responding was:

Mr. Hanis referenced the letter to the Hearing Examiner from the Planning Department,
dated June 10, 1981 , and corrected reference to Section 4-2313-4, noting that the concern
of the City Council pertained to Section 4-2316 of the Mining, Excavating and Grading
Ordinance which refers to making every effort to preserve natural water courses, and the
matter had been remanded back to the Examiner to make a specific determination.

a ditch as a natural water body. ;-
Mr. Hanis referenced McQuillin, Municipal Corporations, Section 53. 132, which defines a
watercourse as distinguished from surface waters, as a stream of water flowing through
a well-defined bed or channel with sides or banks and a permanent source of supply. He
advised that the City Attorney had also acknowledged this reference as a definitive
authority on municipal law. Mr. Hanis advised that other policy elements can be met
through placement of occasional water flow in pipes to allow development of the property for
B-1 , business purposes, and he assured that permeability and on-site retention requirements
will be complied with.
The Examiner inquired if there is any reason why the stream could not be protected and the
property also developed concurrently for business purposes. Mr. Hanis agreed that the
possibility exists, but a large bank of dirt is pushed up to it, and water is contained
in pipes both north and south of the subject site. The Examiner observed that the city is
not required to perpetuate previous action, and the map submitted by the Planning Department
indicates that the water course serves approximately 400 acres. Mr. Hanis stated that it
is difficult to believe that the ditch serves that acreage because of its insigificance
in size and visibility on the site.
The Examiner stated that natural absorption of the stream bank and bed is lost as water
flows into a pipe. Mr. Hanis felt that the loss would be insignificant and could be
mitigated with other engineering features utilized on the property. He concluded by
stating that it is not the appellant's position solely that he should be allowed to do
what other property owners have been allowed, but also that he can comply with the
requirements of the city through installation of pipe on the site.
The Examiner requested testimony in support of the matter. There was no response. He
then requested comments in opposition. Responding was:

Mr. Griffin, resident in the area of the site, indicated the concern of.the community
over the long term effect of eliminating a natural drainage way which serves as storm
water retention in the area. He noted that siltation from fill projects is already
apparent from S.E. 128th Street, and such siltation kills vegetation and fish downstream.
He also stated that water which is piped cannot be monitored for flow or content. Mr.
Griffin advised that King County has identified the stream as a Class I fish and wildlife
habitat, and he referenced King County Ordinance No. 1840, Policy WH 12.D, which discusses
protection of wildlife habitat and open space. As a resident of the Maplewood Heights
community, Mr. Griffin advised that residents have dedicated greenbelts and perpetuate
an ongoing fish enhancement and stream program in the area. He emphasized the need for
the city to protect waterways within the city limits, particularly when residents are
actively involved in protecting greenbelts and fish habitat. Responding to the Examiner's
inquiry regarding the exact location of Mr. Griffin's residence, Mr. Blaylock designated
the location on a topographic map submitted by the speaker. The map was entered into the
record by the Examiner as follows:

Ms. Ryan, representing the owner of a five-acre parcel to the east of the subject site,
indicated her client's support of the proposal to fill the ditch since he plans a similar
fill project in the near future. She noted that if the ditch were covered, an existing

site plans have not been submitted to prove that the fill project would cause insignificant
impact.
The Examiner requested final comments. Since there were none, the hearing regarding the
matter was closed by the Examiner at 9:32 a.m.
REMAND DECISION:
The matter was brought before the Examiner as a result of an appeal to the City Council and
of a remand by that body to hear further testimony and collect further evidence as to the
natJre of a water course traversing the subject site in a generally north to south direction.
The topographical feature has variously been referred to in testimony and reports as a
drainage ditch, water course, waterbody, drainage feature and stream, and each of these
terms has been variously modified by the term, intermittent or periodic.
Topographic and land use maps demonstrate that, at least for the last 20 years, the
topographic feature in question does, in fact, convey water through the site. Further,
the feature in question conveys water to a ravine and dedicated greenbelt area north of
the Cedar River in the Maplewood Heights Subdivision and thence to the Cedar River.
Exhibits #3 and 4 indicate by use of a standard symbol , that the feature in question
conveys water intermittently. The symbol is denoted by a dashed and dotted. line. Such
symbols on topographic maps indicated periodic or intermittent flow.
The feature also serves as a channel to convey the runoff from an approximately 400 acre
drainage basin.
The water course feeds the water flow further down the channel to an area adjacent to
Maplewood Heights. The creek flowing in the vicinity of Maplewood Heights is undergoing
stream enhancement. Whether water flows perennially or intermittently, it serves to
perio9dically recharge the areas at lower elevations. Culverting the feature will cause
the atural recharge of both surface and subsurface water to be altered. Water would be
more rapidly conveyed over the subject site with concommitant erosion of the banks of the
stream further downstream. Also natural percolation on the subject site into the channel
would be altered by culverting and could change the storage potential of the subsurface
recharge area.
The Mining, Excavating and Grading Ordinance provides that "every effort shall be made to
preserve perennial and intermittent streams and their surrounding vegetation" (Emphasis
supplied) .
The applicant 's reliance on the definition contained in McQuillin is unfounded. A water
course is defined as follows: "to constitute a water course as distinguished from surface
waters, it is necessary that there be a stream of water flowing through a well-defined bed
or channel with sides or banks and a permanent source of supply" (McQuillin, Municipal
Corporations, Section 53. 132) , and said definition does not eliminate the subject stream
from the definition of a water course.
The stream course is visible on on-site inspection as a distinct low area running north
to south across the subject site and the same is visible from observation of aerial
photographs of the subject site. The feature is also indicated on topographic maps of
the site. Further review of topographic maps indicates that the intermittent stream runs
southward and enters a more defined gully or canyon.
A permanent source of supply is distinct from a continous source of supply. The winter
rains serve as a generally permanent, albeit intermittent source of water. A "stream"
is defined in Black's Law Dictionary as: "A water course having a source and terminus,
banks, and channel , through which waters flow at least periodically, and it usually empties
into other streams, lakes or the ocean, but it does not lose its character as a water course
even though it may break up and disappear." (Black's Law Dictionary, page 1590)
And a "water course" is defined as: "A running stream of water; a natural stream fed

The Washington Supreme Court stated that surface waters "may be said to form a 'water
course' at a point where they begin to form a reasonably well-defined channel , with bed,
banks, or sides and current, although the stream itself may be very small and the waters
may not flow continuously." Alexander v Muenscher, 7 Wn.2d 557, at 559 (1941) . (Emphasis
supplied)
The applicant had the burden of demonstrating that the grade and fill requested would
not adversely affect the public health, safety or welfare. The applicant has not
demonstrated that culverting the water course on the subject site will not adversely
affect the public health, safety and welfare.
The recent addition to the Comprehensive Plan indicates that natural drainage ways should
be retained and even enhanced. Past action concerning culverting should not foreclose
future or current action. Natural .drainage patterns should not be altered without strong
justification.
The water course at least intermittently conveys water to a more permanent creek downstream.
It was not demonstrated that the current channel does not, in fact, continuously convey
water below its visible surface to that downstream creek. That creek flows into the Cedar
River. That portion of the creek below the subject site and above the Cedar River is part
of a stream and salmon enhancement program. Under the circumstances, the water course
on the subject site should not be culverted, nor the natural vegetation along its banks.
altered. Culverting the stream on the subject site may only tend to exacerbate problems
of downstream enhancement. Past land use practices which permitted unwise culverting of
natural water features. do not have to be perpetuated without a showing that reasonable
use of the property is otherwise impractical .
In summary, the record now demonstrates that the feature in question feeds a larger flow
and is actually, as indicated by the topographic map, part of the upper reaches of one
continuous channel . While the flow of the feature on the subject property may not be
evident on the surface during the dry months, it serves to recharge the lower reaches of
the stream and directs water to the lower reaches of the stream. That stream is part of
the dedicated greenbelt of the Maplewood Heights Subdivision. That same stream flows
through the greenbelt, is recharged by the channel on the subject site, is part of a
stream enhancement program, and serves as a feeder creek of the Cedar River.
No evidence was presented that the channel could not be incorporated into a well planned
development and serve as an asset to the development and the community.
While the issue should be decided on the sole merits of whether or not the culverting of
the stream is in the public interest, and that question has already been answered above
in the negative, there remains the issue of rights accruing to others along that water
course. The applicant has _failed to submit drainage releases as provided for in Section
4-2318(4) , signed by downstream property owners or other governmental agencies. Culverting
of the stream will change percolation patterns, rates and volumes, and will also alter the
velocity and silt content of the stream and affect sedimentation rates.
DECISION:
The original decision to deny the grade and fill permit stands.

Pursuant to Title IV, Section 3015 of the City' s Code, request for reconsideration must
be filed in writing on or before July 6, 1981 . Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error
in judgment, or the discovery of new evidence which could not be reasonably available at
the prior hearing may make a written request for review by the Examiner within fourteen

RE: REMANDED PUBLIC HEARING; SP-024-81 COLASURDO
The above referenced special permit was remanded to the Hearing
Examiner by the City Council following consideration of an
appeal of the Examiner' s denial. The Council specifically
requested further consideration of Section 4-2313-4 which
states "Every effort shall be made to preserve perennial
and intermittent streams and their surrounding vegetation. "
The Council desired further consideration of the nature of
the drainage in this vicinity, and its effect on this permit
application.
1 ) The subject site crosses a drainage feature that serves
a drainage basin to the north containing approximately four
hundred (400) acres.
2) The drainage feature crossing this site is a natural
drainage feature which has been illustrated on City of Renton
topographic maps since at least 1960 (see attached) . No
earlier maps are available to illustrate the condition of
the drainage at this site.
3) The Public Works Department confirms that the stream
course at this location approximates the natural drainage-way
of this basin.
4) The Public Works Department confirms that the subject
drainage flows are intermittent in nature, flowing only during
the rainy season and immediately following.
5) The Public Works Department confirms that it is feasible
from an engineering standpoint to either underground or retain
the current above ground drainage.
6) The Planning Department has considered possible uses
of the property which incorporates the drainage feature,
and concludes that a well designed and landscaped drainage
feature would be an asset to future development of the property.

7) The Planning Commission in its deliberations on the Northeast
Quadrant Comprehensive Plan shows in two of the three alter-
natives for this immediate area, the preservation of this
stream as a Greenbelt (see attached) .
8) The Comprehensive Plan POLICY ELEMENT 1 .C. 2 recommends
preservation of natural waterbodies for open space. Further,
1 . C.4 recommends open space elements to separate major land
use elements. This drainage feature approximates the separation
between the Commercial and Multiple Family uses shown on
the Comprehensive Plan. 1 .G. 1 recommends that the storm
drainage systems incorporate natural drainage features.
RECOMMENDATION: Based upon the testimony at the previous
public hearing, the appeal text provided by the applicant ,
and the analysis contained above, the Planning Department
recommends that the Examiner affirm its prior denial - of this
special permit application.

At the Planning and Development Committee meeting of May 14th,
the Committee asked the status of the drainage feature which
passes _through the subject property . This department has researched
both the USGS and City of Renton topographic basemaps to try
to shed additional light on this subject. The USGS maps do not
indicate this area as containing a water course, although the scale
of the maps is such that a definitive conclusion can not be drawn .
The City of Renton basemaps (prepared in the early 1960 ' s) clearly
indicate a water course passing through the vicinity of the
subject site, although it is unknown whether the location may
have been slightly altered by development in the intervening years .
Attached for your information are copies of both the USGS and Renton
topographic base maps for your consideration.

RE: APPEAL OF DENIAL, SP-024-81 , COLASUrDO
ISSUES OF THE APPEAL:
The applicant is appealing the Hearing Examiner ' s decision
denying the right to place natural streambed in an underground
system, and subsequently fill the subject site.
Filling of the subject property was previously considered
by the Examiner under SP-032-80. That permit was conditioned
upon preservation of the stream channel. The applicant failed
to appeal the Examiner' s previous decision. The subject
application is a request to modify the prior Examiner decision.
The appellant argues that the stream is intermittant, has
been filled in other, areas , and is not designated as a sig-
nificant stream on the Comprehensive Plan.
The Examiner concluded and the Planning Department concurs
that the Mining, Excavation and Grading Ordinance requires
preservation of the stream (4-2316) .
The Planning Department in its recommendation identified
four policies contained in the 1981 revisions to the POLICIES
ELEMENT of the Comprehensive Plan which call for the preservation
of streams and other water related areas.
The Planning Commission is considering amendments to the
Northeast Area of the Comprehensive Plan, including the desig-
nation of the subject stream as a Greenbelt.
The applicant states in his appeal that retention of the
stream would be detrimental to his future development. This
department feels that such a conclusion is unsupported by
the recor-d_ and. that there are numerous examples of commercial
developments oriented toward streams and other water amenities.
RECOMMENDATION:
The appellant has failed to identify. an error in fact or
law significantly effecting the Examiner' s decision. Therefore,
the Examiner' s decision to deny SP-024-81 should be affirmed.

RE : ADDITIONAL INFORMATION, COLASURDO APPEAL
At the Planning and Development Committee meeting of May 14th,
the Committee asked the status of the drainage feature which
passes ._through the subject property. This department has researched
both the USGS and City of Renton topographic basemaps to try
to shed additional light on this subject. The USGS maps do not
indicate this area as containing a water course , although the scale
of the maps is such that a definitive conclusion can not be drawn .
The City of Renton basemaps (prepared in the early 1960 ' s) clearly
indicate a water course passing through the vicinity of the
skect site, although it is unknown whether the location may
have been slightly altered by development in the intervening years .
Attached for your information are copies of both the USGS and Renton
topographic base maps for your consideration .

letter from the Public Works Department reported one protest has
been received representing 47.26% of the total assessment roll
(60% required to terminate the L. I .D.) . Letter from Paul W. Houser .
Jr. , Attorney representing Clarence Jones, 2625 NE 27th St. , re-
quested his name be withdrawn from the petition, claiming Mr. Jones '
property was not specifically benefitted as already served by water.
Clarence Jones was in attendance and opposed the L. I .D. , claiming

The Planning and Development Committee has considered the appeal of the
decision of the Hearing Examiner dated April 6, 1931 in the above mentioned
matter and is unable to make a recommendation to the City Council concerning
the disposition of the appeal . The two members of the Committee present at
the committee meeting were unable to agree upon whether the Hearing Examiner
was correct in determining as a matter of fact that the subject intermittent
stream is a natural stream for which every effort must be made to accomplish
its preservation as required by Code Section 4-2313(4) .

Special Permit #SP-024-81
Dear Mayor and City Council:
We are owners of approximately 8 acres near the northeast quadrant, of the inter-
section of NE 4th Street and Union Avenue NE. It has come to our attention that
the Renton Hearing Examiner has required the preservation of a small drainage
ditch which crosses a portion of our property, as a condition of granting a
request to fill certain property- along the ditch near the southeast quadrant of
the intersection (Mr. Colusurdo).
We wish to express concerns and opposition to such'a -condition and our support
of Mr. Colusurdo's appeal.
We are not opposed to the preservation of significant streams and natural areas
within the city. However, it appears that the preservation of this particular
insignificant man-made ditch which is dry most of the year would not be .in the
best interests of the public, and is contrary to other city actions along this
particular ditch and along other more significant water bodies. Preserving such
a small unattractive ditch would create a nuisance and safety problem, as well
a hindrance to site development.
It appears that the most logical and reasonable alternative in this particular
instance is to allow the proper incorporation of the ditch into the storm
drainage systems required by city ordinance for Mr. Colusurdo's property and
future development along its course.

enton Village Planning and Development Committee Chairman Rockhill presented
eterinary committee report regarding appeal of Renton Village Veterinary
upply Co. Supply Co. Rezone R-137-80 and Variance V-007-80 referred to
Rezone R-137-80 committee 4/6/81 . The report explained consideration of the appeal
and Variance 007 of the Hearing Examiner recommendation dated 2/27/81 as modified
by the correspondence of the Hearing Examiner dated 3/10/81 and
3/16/81 and found that Conclusion No. 6 is in error in that there
is no blockage of view caused by the proposed variance. The
report recommended the City Council grant the variance as requested
by the applicant to allow construction of structural improvements
no greater than 10 feet from the property line between the appli-
cant and the State Highway. MOVED BY ROCKHILL, SECOND REED, CON-
CUR IN THE RECOMMENDATION OF THE PLANNING AND DEVELOPMENT COMMITTEE.

Fire Damage Police Lt. Persson reported fire destroyed the Frank Cenkovich

Police Travel. Letter from Police Chief Darby requested Council approval for
Detective James Foust to attend the Western States Crime Conference
in Santa Cruz, CA 5/4-6/81 . Advance travel requested in amount
of $450. Council concur.
Qochnahl Letter from City Clerk presented the l0o Letter of Intent to annex
Annexation property to the City as petitioned by Dennis Dochnahl . State law •
Proposed requires signatures on the letter represent not less than 10% of
the assessed value of the lands to be annexed; Planning Department
Public Meeting certified signatures represent 68.34% of the assessed value. The
6/8/81 letter explained the Legislative Body, at the public meeting, will
need to determine whether to accept the letter of intent; require
adoption of the Comprehensive Plan, Zoning Ordinance and pre-
existing bonded indebtedness, and to authorize circulation of the
75% petition. The proposed annexation is located at SE 128th St.
and 136th Ave. SE. Council set 6/8/81 for public meeting.
Court Case Complaint for Damages was filed in District Justice Court of King
County by Washington Natural Gas Co. for alleged copper water
service layed over 2" gas main. Refer to City Attorney.
Environmental Letter from Planning Department requested temporary Environmental
Review Review Committee appointment of Roger Blaylock, Associate Planner,
Committee for the period 4/27 - 5/8/81 as the Environmental Ordinance
provides that the ERC consists of three department heads and
Acting Planning Director David Clemens will be attending a planning
conference in Boston. Council concur.
Travel Letter from the Finance Department requested an amendment to
Approval Resolution #2255 to allow the Mayor to approve in-state and out-of-
state travel deleting the requirement for Council approval . Refer
to the Ways and Means Committee for amendment to the resolution.
Appeal An appeal has been filed by Dominic Colasurdo re Land Use Hearing
Dominic Examiner's recommendation of 4/6/81 Special Permit SP-024-81 to
C{olasurdo fill and grade existing drainage ditch and install storm drains;
Special Permit located on south side of NE 4th St. east of Union Ave. NE. Refer
to the Planning and Development Committee.
Damages Claim Claim for Damages was filed by Menalee Adams, 152.1 SE 6th, Portland,
Oregon, for alleged injuries sustained from collision at the inter-
section of Rainier Ave.. S and S 3rd Place. Claim filed in the

PUBLIC HEARING This being the date set and proper notices having been posted,
Street Vacation published and mailed, Mayor Shinpoch opened the Public Hearing to
Portion of consider the vacation of a portion of Jefferson Ave. NE located
Jefferson Ave NE between NE 10th St. and NE 9th St. , Lots 32 and 33, petitioned by
Highlands Highlands Community Church, 3031 NE 10th St. Letter from the
Community Church Board of Public Works recommended approval of the proposed street
VAC-1-81 vacation and explained the right-of-way is not necessary to the
City's traffic circulation in the area, that easements must be
maintained over the entire right-of-way. The Board recommended the
value of the land be set at $2.60 per square foot, and that one-
half or $1 .30 be charged to the applicant per sq.• ft.
Persons present Don Schlemeier, 14220 145th SE, represented Highlands Community
Church, explained the 36 year history of the church, the need for
additional parking spaces and proposed growth. Mr. Schlemeier
asked Council approval of Jefferson Ave. NE street vacation, support
for temporary use permit of 4.59 acre site (matter before the Hearing
Examiner) to allow parking and the street be deeded to the church
at nominal fee, claiming lack of street maintenance and present City
liability. C. Gevers, 900 Kirkland Ave. NE, recalled 1976 hearings
for proposed street vacation, noting vacation had been denied due
to area traffic problems and feared adverse traffic patterns on
Kirkland with vacation. Kay Johnson, 912 Kirkland Ave. NE, objected
to, egress onto Kirkland. Acting Public Works Director Houghton used
map and explained streets of the area, including "phantom" street
which is not dedicated right-of-way. Mr. Schlemeier explained prior
1976 proposed street vacation had been petitioned by Globe Develop-
ment Co. Parking in the Highlands Church area was discussed and
upon inquiry, Public Works Director Houghton favored vacation to
provide parking facility, noting trash being dumped on Jefferson NE.
Versie Vaupel , 400 Cedar Ave. S. , inquired if procedure differed for
vacation by individual , church or business and was advised by City
Attorney Warren that the Council has authority to charge up to one-
half of the assessed value irrespective of petitioner. Following
further discussion, it was MOVED BY ROCKHILL, SECOND STREDICKE,
CLOSE THE PUBLIC HEARING. CARRIED. MOVED BY STREDICKE, SECOND BY
ROCKHILL, the Petitioner be granted vacation subject to restricted
use permit with reversionary clause to the City if not used for
church parking, the City retain its utility easements and fee of
one-fourth assessed value be charged. MOTION FAILED.

I hereby respectfully request that the Renton City Council
reverse the Hearing Examiner's decision on the subject appli-
cation and approve the request for fill and grade.
This appeal is based upon the following errors in fact and law:
1. The subject drainage ditch is not a natural stream. It is
not even desirous as a greenbelt because of its generally
dry character most of the year. It is wet only during
certain times when it accepts drainage from surrounding
development. Therefore, to apply Section 4-2316 of the
Mining, Excavation and Grading Ordinance to force preserva-
tion of such a ditch is an error in law and fact. Surely
the Council in adopting such a plicy meant for it to
apply to those significant streams, creeks, rivers and re-
lated greenbelts of sufficent size and beauty to warrant
such preservation. The subject ditch is not of such
character either as a stream or greenbelt.
2. Item 10. of the Examiner's findings failed to note those
developments in the area which filled or plan : to fill over
existing streams. The new Albertson-Pay N Save-Ernst
Shopping Center at Sunset and Duval was built over Honey
Creek which is a year-round stream.
There are also plans for a 12-unit condominium project
north of N.E. 4th Street which has been approved and will
culvert and fill the same drainage ditch that I am required
to leave open. The ditch has also been filled further south
of the site on property located in King County (McCann
property).
3. Item 7. of the Examiner's decision fails to note that the
Comprehensive Plan does not indicate the subject drainage
ditch as a greenbelt, which implies that it was not consid-
ered significant enough for preservation by the planners.
4. Item 4. of the Examiner's decision failed to note that the
plans for storm drainage facilities, including storm
retention/detention, were reviewed and approved by the
Public Works Department and the Building Department. Both
departments feel the plans submitted are acceptable and
meet City requirements.

5. Item 6. of the findings is in error. All of the property
is zoned B-1 Business.
6. Item 2. of the Conclusions implies that filling of the
drainage ditch will cause flooding and environmental
degradation. Actually, a controlled storm drainage system
designed in compliance with the City's Storm Drainage
Ordinance will improve the existing situation by controlling
drainage and runoff. Creating a narrow open ditch will not
only be an unsightly garbage trap, it will also be a safety
hazard. Therefore, the "public interest" as stated in
Item 1. of the Conclusions would actually be better served
by providing the proper storm drainage facilities as pro-
posed.
The Examiner also failed to rely upon the decision of the
Environmental Review Committee which issued a negative
declaration of environmental impact for the subject proposal.

PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on March 25, 1981 .
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on March 31 , 1981 at 9:50 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report. Roger Blaylock, Associate Planner, presented the report,
and entered the following exhibits' into the record:

Exhibit #2: Site Plan designating filled area and •
proposed fill area ' .
Mr. Blaylock advised receipt ofadditional information from the applicant. on March'30, 1981 ,
following issuance of the Planning Department report recommending' denial ',of the application.
The Examiner noted that the letter and four accompanying photographs are contained within
Exhibit #1 . The letter provides justification for the infeasibili'tyrof provision of an
open drainage system through the subject property required by the Examiner as a condition
of -pproval on a previous special permit application for the' purpose'of protecting an . '.

The Examiner requested testimony by the applicant. Responding was:

Mr. Colasurdo indicated that the submitted photographs which were taken March 12, 1981 show
tha the existing ditch is dry except during periods following heavy storms when water
froi1n surrounding paved parking lots flows through it. He noted that it is inaccurate to
state that an intermittent stream exists on the property, and the ditch is now overgrown
with brush and weeds.
The Examiner requested testimony in support or opposition to the application. There was
no response. Since there were no further comments, the hearing regarding File No.:.SP-024-81
was closed .by 'the Examiner at 10:02 a.m.

FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1 . The request is for approval of a special permit to grade and fill an existing drainage
ditch and install storm drains and culverts on the subject site.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance
has been issued for the subject proposal by the Environmental Review Committee,
responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. The subject property is located on the south side of N.E. 4th Street approximately
160 feet east of Union Avenue N.E. The site is generally level as a result of a fill
carried out under special permit, File No. SP-032-80. The previous approval for fill
and grade prohibited the elimination of the drainage channel which carries an
intermittent stream.
6. The subject site is zoned both B-I (Business/Commercial) and R-3 (Medium Density
Multifamily) . The B-1 zoning fronts along N.E. 4th Street. The R-3 zoning lies
along the south property line.
7. •The Comprehensive Plan designates the area in which the subject site is located as
suitable for the development of commercial uses.
8. The Planning Department recommended that the special permit be denied.
9. The previously approved special permit allowed filling and grading on the subject
site with the exception of the intermittent stream. The stream is generally active
during wet periods. The applicant proposes undergrounding the stream through a
culvert and leveling the entire site.
10. Sunset Square development, a commercial project, is incorporating a stream into the
design layout of its shopping center. Cedar Ridge is constructing a series of
intermittent streams to channel storm water during wet periods. These periodically
dry channels are also being incorporated into the design layout. Earlington Industrial
Park proposes incorporating a major stream into its final proposal .
CONCLUSIONS:
1 . The applicant has not demonstrated that potential development of the subject site
cannot incorporate a natural drainage channel into its final design. As previously
determined, the public interest would be better served by the incorporation of such
naturally occurring features into a project. Less area will be covered with an
impermeable surface, thereby lessening the burden on the remainder of the storm
drainage system.
2. The continued loss of minor streams and channels has led to increased flooding.
Undergrounding and culverting the stream will eliminate the natural absorption which
would or could have occurred along the banks of the channel and increase the potential
for flooding downstream.
3. Section 4-2316 of the Mining, Excavation and Grading Ordinance requires that "every
effort" at preservation of natural water courses be made. Similar types of
development have complied with this section and have incorporated natural features
including intermittent stream channels into the final design plans. The permit,
therefore, should be denied.
DECISION:
The special permit to fill and grade the intermittent stream channel on the subject site
is denied.

Dear Sirs:
The following are some good reasons why an open drainage system through my
' property and adjoining property is not feasible.
1. The open drainage ditch would average about eight feet deep and would
be very hard to keep clean from debri, over growing with brush and
ditch bank from caving in.
2. The location of said drainage ditch would take away about a third of
my frontage on N.E. 4th. It would leave an unsitely and dangerous
hole about eight feet deep and about forty feet fronting N.E. 4th and
about 1501 long.
3® An open drainage ditch through adjoining property to the East would
create all kinds of problems for the owner because it would be going
right through the middle of his property.
4. The only time there is water in drainage ditch is after heavy rains.
. 5.. If an approved storm drain could be installed now it would allow me
to finish filling and install a temporary sedimentation system. The
storm drain would clean up water in present ditch and the temporary
sedimentation system would take care of runoff from vacant land. It
would also allow land fill to settle for awhile for compaction.
6. The property across N.E. 4th from said property was filled with about
six feet of fill and the same drainage• ditch was left open. It is now
covered with brush and debri and partially plugged, you can hardly tell
that there is a ditch there. The same thing would happen on this prop—
erty too.
There are pictures for exhibit showing some of these above conditions
that are presently there.

C. HISTORY/BACKGROUND :
The subject site was annexed into the City by Ordinance 2308
on March 16 , 1967 . It was rezoned from G to B-i and R-3 by
Ordinance 2317 on April 13 , 1967 . A Special Permit for fill
and grade in the amount of 2 , 000 cubic yards was approved by
the Hearing Examiner on August 1 , 1980 (SP-032-80) .
D. PHYSICAL BACKGROUND
1 . Topography : The subject site is generally level except
for a depression in the area to be filled.

2 . Soils : Alderwood Gravely Sandy Loam (AgC) . Permeability
is moderately rapid in the surface layer and subsoil and ,
very slow in the substratum. Runoff is slow to moderate
and the erosion hazard is moderate . This soil is used
for timber , pasture, berries, row crops , and for urban
development .
3 . Vegetation : Virtually all of the natural vegetation on
site has been removed. What remains consists principally
of scrub grass .
4 . Wildlife : The existing vegetation provides minimal, if
any, habitat for area wildlife .
5 . Water : Some water was present in the drainage ditch along
the northeasterly corner of the subject site (March 31 ,
1981) .
6. Land Use : The site is presently vacant .
E. NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties are in a transitional state from
undeveloped and large-lot single family uses to light commer-
cial and some multiple family .
F . PUBLIC SERVICES :
1 . Water and Sewer : A 4" water main extends east-west on
N.E. 4th Street adjacent to the subject' site and a 16"
main runs north-south on Union Avenue adjacent to the
property . An 8" sanitary sewer is also located along N.E.
4th Street within 1 ,000 feet to the west of the site .
2 . Fire Protection : Provided by the Renton Fire Department
as per ordinance requirements .
3 . Transit : Metro Transit Route 107 operates along Union
Avenue N .E . within 1/4 mile to the north of the subject
site .
4 . Schools : Not applicable .
5 . Recreation : 'Not applicable.

I . IMPACT OF THE NATURAL OR HUMAN ENVIRONMENT :
1 . Natural Systems : Filling of the site and undergrounding
of the stream will disturb soils and vegetation, increase
storm water runoff, and increase traffic and noise levels
in the area on a temporary basis . However, through proper
development controls and procedures , these impacts can be
mitigated. Implementation of the fill could be a precedent
for future removal of the stream' s natural character.

2 . *Population/Employment : The fill and grade permit will
have no direct impact on employment . However, future
use of the filled site will have to be addressed upon
specific development .
3 . Schools : Not applicable .
4 . Social : Not applicable .
5. Traffic : Assuming 25 cubic yards per trip, approximately
80 vehicle trips will be expected for the filling opera-
tion.
J. ENVIRONMENTAL ASSESSMENT/THREHOLD DETERMINATION:
The Environmental Review Committee issued a declaration of non-
significance for the subject proposal on March 15 , 1981 .

L. PLANNING DEPARTMENT ANALYSIS :
1. The proposal is consistent with the land use element of
the Comprehensive Plan, which designates the site as
commercial.
2 . The applicant proposes to fill and grade an existing
drainage ditch on the subject site which was not included
in a previous fill permit of +2 , 000 cubic yards (SP-032-80) .
Storm drain installation is also planned.
3 . Police Department review of the proposal has resulted in
the following recommendations :
1
a. Streets are to be kept clean at all times. A cash
bond is to be posted to insure that ' cleaning is done .
b. Access to the site for hauling operations is to be
permitted off Union Avenue N.E. with none allowed
from N.E . 4th Street.
c . Operations are to be prohibited on Saturdays and
Sundays , as the department does not have adequate
staff to monitor the activity.
4 . A drainage easement acorss the property and at the dis-
charge of the non-owned property must be provided as per
Engineering Division comment. An evaluation of the
upstream basin will also be required to determine the
necessary culvert size through the site .
5 . As noted by the Hearing Examiner in SP-032-80, "The appli-
cant has failed to demonstrate that the elimination of a
natural drainage system is required. (Section 4-2316 of
the Mining, Excavation and Grading Ordinance requires that
every effort at preservation of natural water courses is
required. ) The Comprehensive Plan has also indicated that
natural features should be incorporated, into new develop-
ments , and such features should be preserved. "

The Examiner further stated that "The applicant
has the burden of demonstrating that the ultimate
plans for the reuse of the site cannot be reason-
ably altered to provide the continued vitality of
the stream coursing through the subject site. "
The Policies Element of the Comprehensive Plan adopted by
the City in January of 1981 includes the following policies
relative to water courses :
1 . Storm waters should be retained on-site and then
released at a natural rate and quality . The City ' s
storm drainage system should be designed to incorpor-
ate natural drainage features . "
2 . Precipitation should be returned to the soil at
natural rates near where it falls .
3 . Development should be designed to facilitate
percolation and to minimize impermeable surfaces .
4. Development should include appropriate design and/or
equipment to ensure clean runoff .
No specific site development plans have been submitted
by the applicant nor have any alternatives to unde(r-
grounding the intermittent stream been presented. As a
result, the applicant has not demonstrated sufficient
justification for the proposal . In the interim, the
applicant should install an oil-water separator at the
south end of the culvert on N .E. 4th Street and clean
up the debris from the existing fill operation .
M. DEPARTMENTAL RECOMMENDATIONS :
Based upon the above analysis , it is recommended that the subject
request be denied.

RE: Conditional Use Permit
A request is being made to you for a conditional use permit on
a property located in N.E. Renton. (See attached letter)
The subject, property has been zoned for B-1 and a usage of
L-I is being proposed. The property directly to the west side of
the subject property is used as a garage and storage yard for
heavy equipment. Running along the east side of the property all
the way south to S.E. 128th St. is Olympia Ave. which has been
confirmed as an unimproved public street owned by the city of
Renton. Along the other side of Olympia Ave. there are now two
active machine shops, a carpenter shop and a plumbing contractor
shop. All of these operations are perfect neighbors for our op-
eration.
The area as a whole will benefit greatly due to the development
of the improved street, sewer, water and storm drainage facilities
as well as professionally landscaped surroundings.
There will be no additional noise created by this development
and there are no flammable materials used.
In our opinion, this use is the logical one for this property.

This letter accompanies our request for the grantingof apermit to construct a temporary p q p y parking
lot on the site located at the Intersection of Strander Blvd. and West Valley Hwy.
The primary reason for the requested lot is to aliviate the problem of traffic conjestion both in our
existing lot and the traffic congestion on Strander Blvd. and West Valley Hwy.
We are applying for a temporary permit because suitable land for the lot is available only on a
month to month basis from the landlord, as they are planning future development of the site.
Because of the temporary nature of the lot we are requesting
q g permission to use crushed rock as the
surfacing material. It is easily applied and removed and will let the water percolate through the soil.
This facility will markedly improve the property in that it will provide a graded and even finished
surfaced parking area on a site that is at present unkept and unevenly contoured but is used for parking
by many people in conjunction with the Longacres Race Track.

When I recieved permit for land fill I also recieved an approved
drainage plan, so -then-I- assumed it was O.K. to proceed-work as planned-.—
But, by an error made by the building department and my misunderstanding
.we were wrong. I never gave it a thought to leave an open ditch, because
there is only about 150° where water can be seen running after a heavy rain.
The rest is covered with brush and running in all directions. The water
comes from several parkinglots, service stations, a portion of N.E. 4th, and
Union Ave. N.E. These waters are polluted with oil because there are no man
holes with oil seperation and clean out sumps. There are pictures inclosed
showing these conditions.
With a well •designed drainage plan, the above situation can be corrected.
I have submitted a plan designed by my engineer and approved by the department
of public works to take care of this problem on my property and can be continued
on adjoining propertys,

Gentlemen:
The project as proposed is designed to maintina a natural open vegeta-
•
tion barrier to the adjacent properties.
Having all the units in buildings no larger than 4-plexes, .keeps the
project in the character of the area and allows for more open spaces.
The project does have' a circular flow of vehicular traffic which makes
• easier egress for both occupants and emergency equipment.
• The developers will be able to retain a large number of the existing fir
trees and will leave a large portion of the natural ground cover.
The present R-2 zoning would require each building to have required
setbacks on individual sites. This would not lend itself to a freer design
which allows us to place buildings to retain trees and better fit the topo-
graphy. It would also have a more regimental appearance.
