COHMENTS 'Due to the location of this particular piece of property
there will be a substantial impact caused by traffic accessing the proposed
complex. The entrances to this site have to be designed very carefully due to
the curve in the roadway, the heavy traffic volumes, and the excessive speed in
the area. Also due to its remote location at the far edge of a patrol district 1
response time for patrol units will be poor, thus a need for security systems 1
in the buildings, especially if any of the buildings will contain drugs.

Dear Daryl:
After discussing the issue of eliminating the individual cooking facilities in, the
retirement home with both yourself and your architect, Mr. McClarty, the issue is still
unresolved.
I have raised the issue with various City departments and the Environmental Review
Committee. They concurr that the rezone proposal and conditional use are unaccept-
able to submit to the Hearing Examiner until the above primary issue is resolved.
As you are aware, the newly adopted definition of "retirement home", (Section
4-7(J2(R)(4), distinguishes two types of retirement facilities based on intensity. The
firs: type is basically a self-contained unit with bathroom and cooking facilities; these
are considered to be multiple family dwelling units. This type of facility must meet
the parking requirements of Section 4-2208(1)(A)(3) and provide 1.5 parking spaces per
dwelling unit.
On the other hand, the second type of "retirement" facility, as defined, has dependent
units without cooking facilities and are classified as boarding and lodging houses. Thus
having to comply with Section 4-2208(B) and provide, "one (1) parking space for the
proprietor plus one (1) parking space for each sleeping room for boarders and/or
lodging use plus one (1) additional space for each four (4) persons employed on the
pre]nises."
At the present time your proposal includes individual cooking facilities and provides
one (1) parking space per unit. This is in conflict with the definition of "retirement
hon e." There appears to be four (4) possible solutions:
1.Eliminate the cooking facilities;
2. Increase the parking to 1.5 parking spaces per dwelling unit;
3.Apply for a variance; or,
4.Appeal the Building & Zoning Department's administrative interpretation.

They Zoning staff does support your proposal to construct only a portion of the
required parking at this time. This is based upon the uncertainty of the actual need
for parking, and the ongoing evaluation may result in a modification to the ordinance.
Ho Never, both the Planning Commission and City Council were very positive in the
present definition and the problem in regulating such a wide range of intensities
possible in a retirement home.
Analyzing your possible alternatives, I would conclude that only the first one is viable.
The second alternative would force a reduction in the size of the project. Both the
thi-d and fourth alternatives are unlikely to be granted because the intent of the
definition is very clear and there are no physical hardships.
Please be advised that an administrative decision can be appealed to the Land Use
Hearing Examiner within 14 days of receipt of this correspondence pursuant to
prc,visions under Section 4-3011.

an operational traffic study be prepared to show how traffic
will access onto S.W. 43rd Street from the subject site, how
it will affect the traffic signal at S.W. 43rd Street and
Talbot Road South, and how it will affect the intersection
of S.W. 43rd Street and State Route 167.
Please submit the information as soon as possible. The
rezone request cannot be scheduled before the Hearing

1) The purchaser assumes and agrees to pay before delinquency all taxes and assessments that may as between grantor and granteehereafterbecomealienonsaidrealestate;and if by the terms of this contract the purchaser has assumed payment of any mortgage,contract orotherencumbrance, or has assumed payment of or agreed to purchase subject to, any taxes or assessments now a lien on said real estate,the
purchaser agrees to pay the same before delinquency.
2) The purchaser agrees, until the purchase price is fully paid,to keep the buildings now and hereafter placed on said real estate insured totheactualcashvaluethereofagainstlossordamagebybothfireandwindstorminacompanyacceptabletothesellerandfortheseller'sbenefit,as his interest may appear,and to pay all premiums therefor and to deliver all policies and renewals thereof to the seller.
3) The purchaser agrees that full inspection of said real estate has been made and that neither the seller nor his assigns shall be held to anycovenantrespectingtheconditionofanyimprovementsthereonnorshallthepurchaserorsellerortheassignsofeitherbeheldtoanycovenantoragreementforalterations, improvements or repairs unless the covenant or agreement relied on is contained herein or is in writing and
attached to and made a part of this contract.
4) The purchaser assumes all hazards of damage to or destruction of any improvements now on said real estate or hereafter placed thereon,and of the taking of said real estate or any part thereof for public use;and agrees that no such damage,destruction or taking shall constitute afailureofconsideration. In case any part of said real estate is taken for public use, the portion of the condemnation award remaining afterpaymentofreasonableexpensesofprocuringthesameshallbepaidtothesellerandappliedaspaymentonthepurchasepricehereinunlessthesellerelectstoallowthepurchasertoapplyalloraportionofsuchcondemnationawardtotherebuildingorrestorationofanyimprovementsdamagedbysuchtaking. In case of damage or destruction from a peril insured against,the proceeds of such insurance remaining after paymentofthereasonableexpenseofprocuringthesameshallbedevotedtotherestorationorrebuildingofsuchimprovementswithinareasonabletime,unless purchaser elects that said proceeds shall be paid to the seller for application on the purchase price herein.
5) The seller has delivered, or agrees to deliver within 15 days of the date of closing, a purchaser's policy of title insurance in standardform, or a commitment therefor,issued by SAFECO Title Insurance Company,insuring the purchaser to the full amount of said purchase priceagainstlossordamagebyreasonofdefectinseller's title to said real estate as of the date of closing and containing no exceptions other than the
following:
a. Printed general exceptions appearing in said policy form;
b. Liens or encumbrances which by the terms of this contract the purchaser is to assume,or as to which the conveyance hereunder is to be
made subject;and
c. Any existing contract or contracts under which seller is purchasing said reel estate,and any mortgage or other obligation,which seller bythiscontractagreestopay,none of which for the purpose of this paragraph 16)shall be deemed defects in seller's title.

8) Unless a different date is provided for herein, the purchaser shall be entitled to possession of said real estate on date of closing and to
retain possession so long as purchaser is not in default hereunder. The purchaser covenants to keep the buildings and other improvements on
said real estate in good repair and not to permit waste and not to use,or permit the use of,the real estate for any illegal purpose.The purchaser00covenantstopayallservice, installation or construction charges for water, sewer,electricity,garbage or other utility services furnished to said
NC real estate after the date purchaser is entitled to possession.
CD 9) In case the purchaser fails to make any payment herein provided or to maintain insurance,as herein required,the seller may make such
O payment or effect such insurance,and any amounts so paid by the seller,together with interest at the rate of 10%per annum thereon from date
of payment until repaid, shall be repayable by purchaser on seller's demand, all without prejudice to any other right the seller might have by
reason of such default.
OD 10) Time is of the essence of this contract, and it is agreed that in case the purchaser shall fail to comply with or perform any condition or
agreement hereof or to make any payment required hereunder promptly at the time and in the manner herein required,the seller may elect to
declare all the purchaser's rights hereunder terminated, and upon his doing so, all payments made by the purchaser hereunder and all
improvements placed upon the real estate shall be forfeited to the seller as liquidated damages, and the seller shall have right to re-enter and
take possession of the real estate; and no waiver by the seller of any default on the part of the purchaser shall be construed as a waiver of any
subsequent default.
Service upon purchaser of all demands,notices or other papers with respect to forfeiture and termination of purchaser's rights may be made
by United States Mail,postage pre-paid,return receipt requested,directed to the purchaser to his address last known to the seller.
11) Upon seller's election to bring suit to enforce any covenant of this contract,including suit to collect any payment required hereunder,
the purchaser agrees to pay a reasonable sum as attorney's fees and all costs and expenses in connection with such suit, which sums shall be
included in any judgment or decree entered in such suit.
If the seller shall bring suit to procure an adjudication of the termination of the purchaser's rights hereunder,and judgment is so entered,
the purchaser agrees to pay a reasonable sum as attorney's fees and all costs and expenses in connection with such suit,and also tie reasonable
cost of searching records to determine the condition of title at the date such suit is commenced,which sums shall be included in any judgment
or decree entered in such suit.

EXHIBIT A
1. NOTWITHSTANDING the aforementioned payment terms, purchaser agrees to
pay principal plus accrued interest no later than seven (7) years from
date of closing.
2. Seller shall have subject property staked in a manner that will allow purchaser
to clearly define property boundaries within four months from date of closing.
Seller agrees to provide purchaser with complete cooperation and sign the
necessary documents to enable purchaser to obtain building permits on said
property. Purchaser agrees to pay all costs of building permits obtained by
the purchaser including but not limited to survey, engineering, legal and filing
00 fees.
CD It is agreed by the parties hereto that , in addition to the
CD herein required semi-annual payments , purchaser will pay. i.n
t semi-annual payments a sum equal to of the annual real estate
O00 taxes . Said payment to become due and payable April 1 and
October 1 of each and every year said Real Estate Contract
remains in force. The amounts so paid shall be applied against
the principal balance due on this contract. It is further
agreed that, as real estate taxes shall become due, said amounts
shall be paid by seller. Any amounts so paid by seller ,
exclusive of any penalty, shall be added to the principal balance
then due on said Real Estate Contract, to commence with real
estate taxes beginning in 1978 .
Seller agrees to clear and level property to reasonable grades
that will be mutually established by buyer and seller and
grade maps showing complete elevations after all excavations
have been completed shall be delivered to purchaser prior to
possession by purchaser. In any event the grade shall not
be below the level of Carr Road, which lies to the north of
subject property, without agreement of purchaser in writing.
Seller agrees not to disturb existing creek on property in
grading and leveling operation, without written permission
from purchaser.
It is understood by all parties that the excess material which
is to be removed by seller from grading and leveling operation
shall be the sole property of the seller and seller has 120
days from the date of closing to have said material removed.
Seller agrees to deed release to purchaser those portions of
property legally described as : Lots 43 , 44 , 45 , Scotts Terrace
Addition , less county road, according to the plat recorded in
Volume 72 . of plats on pages 39-40 , Records of King County ,
Washington, upon written request of the purchase and receipt
of $70 , 000 . 00 (Seventy Thousand and no/100 Dollars) of
additional principal payment in addition to down payment.
In the event excess material belonging to seller is not
removed within 120 days from the date of closing as contained
herein, purchaser will be relieved of all principal and
interest payments on a per diem basis , as long as such
condition should exist. But , in any event, not to exceed
90 days from purchaser ' s right to possession of the property.
If after said 90 day period excess material has not been
completely removed , purchaser may , at his option , have said
material removed by a licensed contractor , cost of same to
be deducted from purchaser ' s semi-annual payment.

In the event seller exercises said option, seller agrees to grant purchaser,
and/or assigns' or their successors an easement over said portion until such time
property is deeded to county for road purposes. Easement to be used for purposes
of ingress and egress.
