Church of Christ Land Use Hearing Examiner Fred Kaufman recommends approval with
Rezone R-054-81 conditions for Rezone R-054-8 for property located at 2527 NE
12th Street rezoned from G-7200 to R-3 to permit expansion of
existing church; known as the Church of Christ Rezone. Refer to
the Ways and Means Committee for ordinance.
Latecomer Letter from Public Works Department recommends the Mayor and
Agreement City Clerk be authorized to sign latecomer agreement for
Richards and utilities systems installed by E. M. Richards and J. A. Holmes
Holmes in the vicinity of Raymond Ave. SW and Seneca Ave. SW.
Council concur.
Ti Cable Letter from Acting Public Works Director Houghton presented
Rate Increase request from Clearview Cable TV for rate increase from $8.95 to
9.95 per month; requested through 3-H Cable Communication Con-
sultant (3-H Management & Consultants) , Lon Hurd. Mr. Hurd
states the new rate has been in effect for one year in both
Kent and Auburn with no complaints and that the increase would
be used mainly to upgrade the cable system. Mr. Hurd recommended
approval of a subscriber' s rate increase. Council concur.
Fund Transfer Mayor Shinpoch requested transfer of funds for purchase of the
Parker property located on Cedar River for trail purposes .

Fenton Western Letter from Renton Merchants Association, Toni Nelson, President,
Lays 7-30 invited the Mayor and Council Members to attend the annual
Renton Western Days to be held in downtown 7/30-8/1/81 and
invited Council President to be present on the podium with
the parade judges.
4alkway Petition bearing names of residents in area of walkway between
Complaint 2103 Aberdeen Court SE and 2100 Aberdeen Court SE reported two
Eberdeen Ct. SE and 1/2 years of problems with walkthru easement and asked closure.
The letter noted problems of cars driving thru walkway; hang-
out for neighborhood children subjecting area residents to the
loud noise and vulgar language; property damage such as tearing
up shrubs , knocking down small trees , starting small fire, etc.

Carpenter Mayor Shinpoch announced Carpenter Centennial Week Proclamation
Centennial Carpenters and Joiners Brotherhood founded 8/8/1881 declaring 8/31-
Proclamation 1981 as Carpenter Centennial Week and 8/8/81 as Centennial Day.

Green River Post card petitions bearing 65+ signatures of property owners
Drainage Basin within the Green River Basin and hillside area were received

City of Kent Letter from Acting Public Works Director Houghton presented
Requests Sewer request from Kent for sewer service to five properties in con-
Service junction with the SW 43rd Street Project. The letter explained
allowing the Kent parcels to receive service with the project
will enable the Renton homes located west of the railroad tracks
to receive sewers at reduced cost to all properties; Kent proper-
ties to pay out-of-city utility rate. Refer to the Utilities
Committee and City Attorney for preparation of agreement.
Gambling Tax Letter from Acting Finance Director Bennett requested update of
the City' s gambling tax and amusement games ordinance to comply
with state law. The letter noted RCW 9.26. 110 sets taxation
limit on amusement games at 2% of the gross receipts, less cost
of prizes; that only two organizations located in Renton hold
State Gambling Commission licenses for amusement games and each
usually holds one event per year. Refer to Ways and Means
Committee.
Appropriation Parks Director Webley requested appropriation of funds in amount
Senior Center of $6,000 from Unanticipated Revenues to pay for totally self-
supporting programs at the Senior Center. Dances, classes and
special events not funded by the City budget can be offered on a
self supporting basis with the participant paying the entire
cost of the event. Refer to Ways and Means Committee for the
ordinance.
Cascade Sewer King County Boundary Review Board Notice of Intention for Cascade
Proposed Sewer District proposed annexation. Refer to the Board of Public
Annexation Works.

Planning and Planning and Development Committee report noted review of appeal

Family Housing by because of its close proximity to other publicly assisted units.
Housing Authority The report explained the site selection is a two-acre area east of
at NE 3rd Street Vantage Point Condominiums between NE 3rd St. and NE 4th St, with
access off NE 4th St. and is the second choice of the Housing
Authority. Following discussion, Acting Planning Director Clemens
noted HUD has not given final approval of the site, that assisted
housing does exist within the census tract. Council noted concern
for adequate bus transportation.
Parking Tickets Councilman Shane asked that parking tickets be cancelled that were
issued in the downtown area on Saturday during Western Days due
to streets being cleared. Mayor Shinpoch and Police Representative
Persson noted no complaints have been received.

response agreements. The report stated rendering of assistance
under this agreement would be of mutual benefit to all jurisdic-
tions for emergency medical aid and fire supression situations
and requested referral to the Ways and Means Committee for proper
form. MOVED BY STREDICKE, SECOND HUGHES, CONCUR IN COMMITTEE
REPORT. CARRIED.
Planning and Planning and Development Committee report noted review of appeal
Development by Dominic Colasurdo of Hearing Examiner 's decision for denial
Cor,mit—tee of a Special Permit for filling and grading of a site located
Chrm: Rockhill at the southeast quadrant of the intersection of NE 4th and
Appeal Union Ave. SE. The Committee concluded that the Examiner was in
Dominic Colasurdo error and the committee found that the drainage feature crossing
Special Permit the subject property is not a "stream" requiring preservation
SP 024-81 pursuant to Section 4-2313-4 of the Mining, Excavation and
Grading Ordinance. The Committee recommended the Examiner's
decision regarding SP-024-81 be reversed and the permit be
granted subject to compliance with the City' s Mining, Excavating
and Grading Ordinance. Councilman Stredicke inquired re defini -
tion of stream and was advised by Councilman Rockhill that stream
had permanent source of water; that committee felt this was drain-

Triad Associates Letter from Michael Miller, Project Engineer, Triad Associates ,
West Coast representing Gary M. Merlino submitted appeal of administrative
Trucking Site determination re compliance to the Bulk Storage Ordinance contend-
ing the proposed use of site does not fall under the definition of
Bulk Storage as defined by Code Section 4-702(28) . The letter also
contended past interpretation of the Ordinance has determined the
proposed use does not fall under that ordinance. The letter explained

LID 313 Letter signed by property owners included in the proposed Local
Talbot Road Improvement District 313 for improvements to Talbot Road, was
read which recalled the LID was formed after three new homes
butilt by contractor, Mr. Sasse, flooded after a heavy rain with
water coming across the road from Victoria Park. The letter
explained Mr. Lobe had attempted since 1976 to have water problems
corrected; City intiated the LID; present owners not aware of
conditions or LID 313 and asked review and revision so that the

formula will be used for jail and medical costs for prisioners
which will be prorated on number of days and population of cities
with no charge for prisioners held six hours or less. Preliminary
County budget will be available in mid-October. King County
Executive Dunlap was adamant that 911 bill was out of line upon
comparison with other areas (Florida and California) and Northwest
Bell has lowered costs ; that if proposed E-911 voted upon, figures
will be understandable by "man in the street."

PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on June 16, 1981 .
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on June 23, 1981 at 9:00 a.m. in the Council Chambers of the Renton
Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department preliminary report. Roger Blaylock, Associate Planner, presented the
report, and entered the following exhibits into the record:

Mr. Blaylock advised that the reference to "plat" in Section M. Recommendation, of the
Planning Department report should be changed to "rezone."
The Examiner requested testimony by the applicant. Responding was:

Mr. Menzel , agent for the applicant, advised that contingent upon rezone and plat approval ,
the property will be developed into 10 to 12 lots to allow construction of homes in the
90,000 to $100,000 price bracket. He noted that access to the subdivision cul-de-sac
would be via Olympia Avenue N.E. In reviewing the Planning Department recommendations, Mr.
Menzel indicated that the applicant is negotiating acquisition of an easement over the
northerly 15 feet of the Bethlehem Lutheran Church property to allow construction of require(
storm drains, and compensation would be provided to the church through construction of a six
foot fence along the east property line of the church property by the developer. Although
final approval has not been given by church officials, Mr. Menzel advised that a decision
would be made by the membership by July 19, 1981 at its next meeting. He submitted a
letter of confirmation of request for easement which was transmitted to church representativ(
on June 17, 1981 , and a tentative plat map. These were entered into the record by the
Examiner as follows:

No. R-046-81 was closed by the Examiner at 9:25 a.m.

FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1 . The request is for approval of a reclassification of approximately 2.49 acres from
GS-1 (General ; Single Family Residential ; Minimum lot size - 35,000 square feet) to
R-1 (Single Family Residential ; Minimum lot size - 7,200 square feet) .
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton' s Environmental Ordinance and the State Environmental
Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance
has been issued for the subject proposal by the Environmental Review Committee,
responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. The subject property is located on the west side of Olympia Avenue N.E. between
N.E. 10th Place and N.E. 10th Street.
7. The site is part of the original plat for the City of Renton.
8. The slope of about 6% rises from west to east. The site has a dense ground cover of
scotch broom and low to medium density shrubs. There are some larger speciman madrona
trees and Douglas firs on site.
9. An existing house and accessory outbuildings including a barn are currently located
on the site.
10. The Comprehensive Plan designates the area as suitable for the development of single
family dwellings.
11 . The area surrounding the site consists of well-maintained single family homes. The
western boundary of the site joins the Bethlehem Lutheran Church.
12. The applicant proposes developing a single family subdivision on the subject site.
The acreage would permit the development of up to about 10 to 12 lots. The applicant
proposes providing access via a cul-de-sac from Olympia Avenue N.E.
13. The potential impact of 12 lots would be an increase of about 42 residents (3.5 persons/
lot) ; an increase of about six students (.5 students/lot) and an increase of about 120
vehicle trips per day (10 trips/lot) .
14. The applicant indicated that an easement agreement with the church for an extension
of utility lines across church property is still subject to final approval of the
church membership. The easement would have to be 15 feet wide. The Planning Department
indicated that the easement should be executed prior to final approval of the rezone
request.
15. A 244 unit apartment complex was built within 1/2 mile to the south of the subject
site, and an additional 158 units of mixed density is proposed within a 1/4 mile to
the south along Monroe Avenue N.E.
16. Areas immediately north and east of the subject site are zoned R-1 , the classification
requested for the subject site. The areas located on the west side of Monroe Avenue,
west of the subject site are also zoned R-1 . A large area south of the subject site is
zoned GS-1 , the current zoning of the subject site, but this area was previously
developed on a 7,200 square foot lot pattern and lot sizes for the area are therefore
generally non-conforming.
CONCLUSIONS:
1 . The proponent of a rezone must demonstrate that the request is in the public interest
and will not impair the public health, safety and welfare in addition to compliance
with at least one of the three criteria listed in Section 4-3014 which provides in
part that:
a. The subject site has not been considered in a previous area-wide rezone or land
use analysis; or

b. The subject site is potentially designated for the new classification per the
Comprehensive Plan; or
c. There has been material and substantial change in the circumstances in the area
in which the subject site is located since the last rezoning of the property or
area.
The applicant has demonstrated that the necessary criteria have been met to permit
the reclassification of the subject property.
2. The request to reclassify the subject property to R-1 is consistent with the
Comprehensive Plan designation of the site for single family uses. R-1 permits
the creation and subdivision of property to form 7,200 square foot lots upon which
single family homes can generally be constructed.
3. The R-1 zone requested is consistent with surrounding zoning of R-1 to the immediate
north and east. It is also consistent with the nearby and adjacent uses of the large
GS-1 district immediately south of the site, wherein most of the lots are about
7,200 square feet.
4. Considerable growth has occurred in residential areas adjacent to the subject site
and reclassifying the subject site permits the establishment of new single family
uses in an area already developed permitting in-filling of undeveloped properties
and preventing leap frog development further out.
5. The increase in population in this single family area will not unduly or adversely
affect the community nor will it adversely affect the level of public services in the
area. The vehicle trips will generally be spread over the entire day with minimal
impacts on the peak hour traffic.
6. The subject site will have to be served by water line and sewer line extensions to
the west , and the easement for such is being reviewed by the affected property owner.
The rezone of the property to higher density standards is predicated on these extensions
and connections to city sewer lines and other utility lines. Therefore, the
reclassification should be conditioned on such easement being executed in favor of
the subject property.
RECOMMENDATION:
The City Council should approve the reclassification of the subject property from GS-1
to R-1 subject to the execution of an easement agreement which permits the orderly
extension of utility lines to the subject site.

The surrounding properties are principally single family
residential in nature.
F. PUBLIC SERVICES:
1 . Water and Sewer: A 10" water main extends north-south
on Monroe Avenue N.E. within 600 feet to the west
of the subject site, while an 8" main is located
on Olympia Avenue. Eight inch (8") sewers run
north-south on Monroe and Olympia Avenues.
2. Fire Protection: Provided by the City of Renton
as per ordinance requirements.
3. Transit: Metro Transit Route #107 operates along
Monroe Avenue N.E. adjacent to the subject site.
4 . Schools: The subject site is within 1/2 mile of
the Highlands Elementary School, while McKnight
Middle School is approximately one mile to the
north and Hazen High School is within 2 miles to
the east.
5. Recreation: Kiwanis Park is approximately 1/2

I. IMPACT ON THE NATURAL OR HUMAN ENVIRONMENT:
1 . Natural Systems: Rezoning the property will not
affect the subject site. Subsequent development
will remove the vegetation, disturb the soils,
increase torm water runoff, and have an effect
on traffic and noise levels in the area. Through
proper development controls and procedures, however,
these impacts can bP mitigated.
2. Population/Employment: The proposed rezone would
allow for a plat of approximately 12 lots . This
would increase the area population by approximately
42 persons (3. 5 persons/home x 12 homes) .
3. Schools : The proposal could increase the school
population by approximately 6 students ( . 5 students/
home x 12 homes) .
4 . Social: Increased opportunity for social interaction
will result from development of the subject site.
5. Traffic : A new subdivision will increase traffic
in the area by approximately 120 trips per day
10 trips/unit x 12 units) .

Pursuant to the City of Renton 's Environmental Ordinance
and the State Environmental Policy Act of 1971, as amended,
RCW 43-21C, a declaration of non-significance was issued
for the subject proposal on June 8, 1981 , by the Environ-
mental Review Committee.

L. PLANNING DEPARTMENT ANALYSIS:
1 . The proposed rezone is consistent with the Compre-
hensive Plan land use element and zoning designations
of single family residential use for the site and
surrounding area (Sec. 4-3014C1-b) .
2. The subject proposal is necessary to establish
future lots that are consistent with the zoning
and subdivision ordinances. This will allow for
platting of the site and subsequent development
for single family residences .
3. Research into Planning Department records indicates
that no areawide rezone has occurred in this area
with the exception of the adoption of the Comprehensive
Plan in 1965 (Sec. 4-3014C1-a) .
4 . Suitable utilities are available to the subject
site although an extension will be required. Consult
the Utilities Engineering Division for details.

5. The Engineering Division advises that off-site
improvements and storm water retention/detention
will bA required at the time of platting. In addition,
the applicant must provide off-site storm drainage
easements. These should be provided prior to approval
of any plat or in conjunction with such.
6. Any future development must meet all fire and building
code requirements for occupancy as per Fire Department
comment.
7. A 244-unit apartment complex within 1/2 mile to
the south of the subject site is nearing completion.
In addition, a combined multiple family single
family development of 158 units (within 1/4 mile
to the south) has received Special Permit approval
through the Hearing Examiner. These approvals
together with the construction of the necessary
associated utilities would suggest that the rezone
request is timely (Sec. 4-3n14c1-c) .
M. DEPARTMENTAL RECQ ENDATIONS:
Based upon the above analysis, recommend approval of
the plat request subject to:
1 . Utility extension as per #4 .
2. Satisfaction of Engineering Division requirements
as per #5.
3 . Compliance with Fire Department requirements as
outlined in #6.

Dear Mr. Blaylock:
Your letter of May 22nd expressed a concern about the availability of storm and
sanitary sewers to serve the reference property.
When Rudell 's 2nd Addition was constructed, a sanitary sewer stub was constructed
from the edge of our property through a 10' easement to Newport Court N.E. I
understand that their sanitary sewer design included the additional effluent quan-
tity oriainating from our property.
A 10" storm sewer exists downhill from our property in Monroe Ave. N.E. I have
contacted the Rev. Randle Grauer of the Bethleham Lutheran Church regarding an
easement to construct a storm sewer along the South boundary of their property.
He is arranoino a meeting with the 3 church trustees so that we can formalize an
agreement. I expect this agreement to be finalized prior to submittal of our
Plat application.
We will keep you advised if any change is made in our plans .

Dear Mr. Blaylock:
Your letter of May 22nd expressed a concern about the availability of storm and
sanitary sewers to serve the reference property.
When Rudell 's 2nd Addition was constructed, a sanitary sewer stub was constructed
from the edge of our property through a 10' easement to Newport Court N.E. I
understand that their sanitary sewer design included the additional effluent quan-
tity originating from our property.
A 10" storm sewer exists downhill from our property in Monroe Ave. N.E. I have
contacted the Rev. Randle Grauer of the Bethleham Lutheran Church regarding an
easement to construct a storm sewer along the South boundary of their property.
He is arranging a meeting with the 3 church trustees so that we can formalize an
agreement. I expect this agreement to be finalized prior to submittal of our
Plat application.
We will keep you advised if any change is made in our plans .

Enclosed is an application for rezone and supporting data for 2.49

When the Comprehensive Plan was adopted, this area of President Park
was zoned GS-1 even though it was substantially developed with 7200 sq. ft.
residential lots . The new recent developments in this area have been constructed

Over the past years , there has been a substantial population growth
in the Renton area, but because of the lack of available land, this growth has
occured primarily in King County. This 'has resulted in a bedroom community
type growth wherein the City of Renton is provided support services for
residence that don 't pay taxes for Renton.
The subject land is ideal for development as it is surrounded by
single family houses, is close to shopping, schools and a bus line; and is
served by existing sewer, water and electrical service. The zoning change
from GS-1 to R-1 is appropriate and in all ways , meets the intent of the
Comprehensive Plan.
