On July 22, 1982, the Office of the Land Use Hearing Examiner notified Mr. William
Rabel (applic4it in the referenced file) that he had until July 31, 1981, to appeal the
Planning Department's administrative decision in the above matter. That decision
concluded that no application would be accepted until unfulfilled requirements of a
previous Site Approval in 1978 wre satisfied. Upon checking with the Examiner's
office today, I was informed that no appeal had been filed in this application.
Therefore, the record is closed and the application is now considered a dead file.

in response to your letter of June 12 , 1961 . The time limit in
which you may file an appeal will be extended to July 31 , 1981 ;
however, if a response is not received by this office prior to
that date, an appeal of the Planning Department determination in
this matter will no longer be accepted.

RE: TEMPORARY USE APPLICATION FOR STAR RENTALS
Star Machinery has made application for the installation
of an equipment storage yard at the rear of their existing
facility located on West Valley Road. The proposed use is
a permitted use in the district. Therefore, the request
for temporary permit would be inappropriate. A temporary
permit application is appropriate only for those uses not
allowed in the district. Further, the applicant has not
completed the landscaping and paving requirements of the
Hearing Examiner issued in 1978. The applicant has occupied
the site for nearly two years in violation of these requirements.
The Board of Public Works did consider a deferral for some
of the items in the applicant ' s proposal. A deferral on
these items has expired, and the landscaping has not been
completed in accordance with the approved plans. Mr. Rabel' s
statement that the landscaping on the northerly side of the
property is complete is incorrect.
When the applicant made application, he was informed of the
deficient items. The applicant indicated that he was not
prepared to perform on the items previously required. Based
upon the fact that this application is for an expansion of
the existing use and cannot be considered as a temporary
application, I concluded that no further action by the City
was warranted until the existing development is completed,
or that the improvements would be assured as a part of this
application. When the applicant failed to agree to either
installing the improvements or assure their installation
as a part of this development, I concluded that the only
acceptable course of action for the City was to not proceed
with processing of the applicant 's current request. If you
have any further questions in regard to this matter, please
feel free to contact me at your earliest convenience.

DEPSUBJEC : Application for Temporary Use Permit
Gentle en and Ladies;
The Renton planning department has refused to process our
application for this permit, which they call "phase 2n. They
cite the fact that we have not complied with the screening re—
quirements of the Bulk Storage Ordinance..: •
We have put in the landscaping on the north side, facing
our neighbors. Burlington Northern's roadbed to the east is
an ideal barrier, and the runaway weeds and blackberries to the
south would envelop anything planted near them. Bond has been
posted for the completion of the landscape as designed, but it
seems there is reason to wait. Our application for temporary
use permit is just that. Temporary. It is incidental to the
planned development of this corner of Renton.
The property south of ours is extremely unsettled. pro—
posed widening. of SW. 43rd will make.;-.,many of these lots, t.00
shallow for many uses. We have .allowed; setbacks . on the; south
side of our buildingthat would, in the 'worst case, let us sell
or lease up to thirty feet of our property to the adjacent
pieces. Or, in the other extreme9 we may have to buyseme.,of
those , lots to improve our access, to SW . 43rd.
The back two acres of::our property are undeveloped.
Screening the line between the developed and the .undevelopedY
has no impact..
By not completing the screening to our south and east,
we have the most latitude to alter the plan to suit the , per—
manent development of those ' propertie.s. ,., Therefore -we :think-.it
is unreasonable for the planning department to withhold action
on a request of ours to use one—half acre as a temporary stor—
age yard.

prepared for all major actions significantly affecting the quality of the environment.The purpose of this checklist is to help the agencies involved determine whether or 'not a
proposal is such a major action.
