Dear Mr. ' Kaufman:
Pursuant to Title IV, Section 3015, of the Renton City Code,
the City of Renton Planning Department requests reconsideration
for clarification purposes of Conclusion #4 . Specifically,
which "old channel" are you referring to?
At the present time there is no P-1 Channel, the only existing
channels are the Black River Channel and the Springbrook
Channel. The proposal will leave the Black River Channel
basically intact, while the Springbrook Channel will be
relocated to the alignment of the proposed P-1 Channel.
Referrence is made to "reclaiming". the old channel with natural
landscaping material. If._ the ."present alignment" of the
Springbrook Channel is intended to be reclaimed, the question
is to what it is to be reclaimed to. The only plans submitted
as present suggest that it would be reclaimed to industrial
lands in Phase 2 of Earlington Park. Therefore, it would
appear that reclaiming with "natural landscaping materials"
is inappropriate.

LOCATION: The subject site is bounded by the Black River Channel ,
Springbrook Creek, FAI-405, and the Metro dike, and Monster
Road.
SUMMARY OF REQUEST: The applicant seeks approval of a special permit for fill and
grade for development of flood control facilities for the Soil
Conservation Service Green River Eastside Watershed Project
(Phase I) to include a holding pond and a portion of the P-1
Channel . Construction of the Phase I project will realign
both the Black River and Springbrook Creeks between Grady Way
and the Black River Pump Station. If implemented, the current
Springbrook Creek Channel located southerly of S.W. 7th Street
will be abandoned.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions.
Hearing Examiner Decision: Approval with conditions.
PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on August 6, 1981 .
PUBLIC HEARING: . After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on August 11 , 1981 at 9:07 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department preliminary report. Roger Blaylock, Associate Planner, presented the
report, and entered the following exhibits into the record:

The Examiner reported that an Environmental Impact Statement was prepared for the Federal
Government by the Soil Conservation Service. Mr. Blaylock corrected Section C. , History/
Background, of. the Planning Department report to indicate that the channel has not been
previously rezoned. He also corrected Section F.1 , Public Services, to denote that the
trunk line has been modified. Responding to the Examiner's inquiry regarding potential
plans for provision of a trail system, David Clemens, Acting Planning Director, stated that
the SCS proposal does not call for any recreational aspects to be implemented at the time
of initial construction of this development. However, the channel design is such that
future activity by either the City or County Park and Recreation Departments could
accommodate linear walkways and similar activities.
Referencing Section L.6 of the report, which states that a hydraulics permit was issued

in June, Mr. Blaylock indicated that permit application has occurred but has not yet been I;

The Examiner requested testimony by a representative of King County. Responding was:

Mr. Young clarified that although it is true to a large extent that existing natural
habitat will be required to be removed, plans call for no excavation on the existing bank
on the north side of the Black River and the northeast area adjacent to the riparian
forest, thereby permitting existing habitat to remain untouched. Responding to the Examiner's
comment regarding the City Council 's prior action and the fact there is no financing
available for the project, Mr. Young indicated that although a written response has not been
received by the county from the city, the Council 's previous attitude may change due to
reduction in cost estimates for Phase I construction as a result of dedications of property
at no cost to the county. He advised that the only remaining major expense would be for
ultimate disposal of materials not suitable for structural fill , although an exact cost
figure is unknown.
Mr. Clemens clarified that in its last action, the City Council had directed city staff
to work with property owners to provide a project package to meet both requirements of
flood protection and the property owners to minimize costs. Currently, the majority of
the property owners in question have agreed to the dedication, including First City
Equities, of which dedication of a portion of the right-of-way within the platted areas
was required as a condition of the preliminary plat review. Mr. Clemens discussed other
properties which will be dedicated for the purpose of the project, owned by Belterra
Corporation, Metro, and Burlington Northern Railroad Company in addition to First City
Equities property. He noted that local sponsors must obtain property through dedication
or purchase, easements must be obtained for temporary disposal of excavated material , and
an agreement drawn between the project sponsors and the Soil Conservation Service for the
actual construction of the first phase of the project.
The Examiner inquired if all required land has been obtained. Mr. Clemens advised that
Phase I would consist of the four previously mentioned properties with the largest area
required owned by First City Equities. Responding to the Examiner's inquiry regarding
alternative methods for providing flood control for the' area, Mr. Clemens advised that
he is unaware of other methods, and he explained flood storage capacity which is necessary
for the first phase. Responding to the Examiner's inquiry regarding timing and completion
of• the project, Mr. Young indicated that completion should occur by the end of 1982, barring
financial problems.

The Examiner requested testimony in support or opposition to the application. Since no
further comments were offered, the Examiner closed the public hearing at 9:42 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now and enters the following:
FINDINGS:
1 . The request is for a special permit to allow the applicant to fill , grade and excavate
approximately 500,000 cubic yards of material on about 35 acres.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, and the National Environmental Policy
Act, draft, final and supplemental Environmental Impact Statements were prepared for
the subject proposal .
4.. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. The subject site is bounded by the Black River Channel , Springbrook Creek, 1-405, the
Metro Treatment Plant and Monster Road. The site is essentially level and is intersected
by the waterways forming its boundaries. The site is covered principally with scrub
brush, blackberries and some deciduous trees.
6. The purpose of the subject proposal is to provide flood control to the portions of the
Green River Valley southerly of the subject site. Springbrook Creek would be relocated
and a large retention/detention pond would be carved out of the subject site to serve
a storage or holding pond. A deeper channel would be located within the pond to provide
r a continously flowing channel to accommodate fish runs up Springbrook Creek.
7. The excavated material may or may not be entirely reutilized on or near the subject
site. Total removal of the approximately 500,000 cubic yards would require approximately
20,000 truck trips. Dredge spoils will be dewatered on site. Reuse will ultimately

DECISION:
The special permit to fill , excavate and grade approximately 35 acres for flood control
is approved subject to the following conditions:
1 . The acquisition of funds to allow the applicant to mitigate all adverse impacts of
the construction on fish and wildlife habitat as called for in the Soil Conservation
Service Agreement and the EIS and to allow the restoration of all areas upon which
dredge spoils have been deposited.
2. Procurement of all permits necessary from the Washington State Departments of Game,
Fisheries and Ecology.
3. Execution of leases, easements or other legal agreements allowing either temporary
or permit storage of dredged spoils.
4. Compliance with the conditions specified by the Police Department if the spoils are
removed to remote locations.
5. The posting of a bond of not less than $2,000 to allow city crews to clear the streets
of project generated debris if the applicant fails to keep the roads clean.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before September 8, 1981 . Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery of new evidence which could not be reasonably available at the
prior hearing may make a written request for review by the Examiner within fourteen (14)
days from the date of the Examiner's decision. This request shall set forth the specific
errors relied upon by such appellant, and the Examiner may, after review of the record, take
further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection in
the Finance Department, first floor of City Hall , or same may be purchased at cost in
said department.

depend on the quality of the material for load bearing purposes and its applicability
for other in-filling purposes. Some of the spoils may be used by Metro in grading
and filling on property to the west of the subject site. Also spoils will be placed
on Burlington Northern )property but no easement has been executed at this time to
permit such placement.
.8. A mitigation agreement requires that the area be restored to a natural appearance and
use. Included in mitigation are plantings along streams and conversion of the holding
pond to a wetland character.
9. The subject area is zoned G (General ; Single Family Residential ; Minimum lot size -
35,000 square feet) and M-P (Manufacturing Park),.
10. The various impacts of the proposal have been thoroughly reviewed in the environmental
documents; including the social , economic and environmental impacts.
4 Permits must be approved by the Washington State Game and Fisheries Department as well
as the Department of Ecology.
12. Removal of the spoils from the site will require about 60 .to 80 trips per day over a
period of about 14 to 18 months. The Police Department recommended that a bond be
posted to provide for continued street cleaning as needed, route selection to minimize
interference with other traffic, and limitation on days and hours of operation (7:00 a.m.
to 3:00 p.m. , weekdays only) .
13. Fund.ing for the project is still uncertain. Much of the land in the immediate area
will be dedicated for the project. In addition, 70 acres of wetland must be preserved
outside the immediate project area as a mitigation measure for the loss of habitat.
CONCLUSIONS:
1 . The proposed special permit appears to serve the public use and, interest. The project
is to excavate, fill and grade large portions of the subject area in order to provide
flood control and water storage potential to prevent flooding of portions of the
eastern section of the Green River Valley.
2. The project will have certain positive effects which are to enhance the development
capability of the areas south and east of the subject site by minimizing flood potential.
The site will both temporarily impound flood waters and slowly pump and release them
after large floods. The creek and holding pond will provide a permanent channel in
which the ordinary flow of Springbrook Creek will be accommodated.
3. The mitigation measures outlined within the EIS and the Soil Conservation Service
Agreement will provide a natural area along both sides of the channel and surrounding
the holding pond. The pond shall be restored to wetland characteristics and fish
passage shall be provided in a deep channel running through the pond to provide all
season flow.
4. The applicant will have to reclaim the old channel and landscape it with natural
landscaping material .
5. Permits must be secured from various state agencies.
6.. Since funding for the project is still uncertain, the permit shall be subject to such
funding becoming a reality. The proposal and its mitigating measures must all be
accomplished in order to provide both a safe and secure flood control project and an
environmentally sound project which mitigates the potential loss of wildlife habitat
and fisheries habitat. Similarly, funding must be secured to provide for reclamation
and resurfacing of all areas affected by the project.
7. The applicant must also provide for a permanent method of disposing of the dredge
spoils whether such method be on site or off site. The applicant must also secure
an easement for the temporary storage of spoils on any property not within its legal
control .
8. The removal of spoils from the vicinity will require approximately 20,000 truck trips
or 60-80 trips per day with a great impact on roads and traffic in the area. Therefore,
the truck traffic shall be subject to review and approval of the Police Department.
A bond must be posted in an amount not less than $2,000 to permit the clearing of
the roadway of debris by city crews if necessary and at the discretion of the Police
Department.

The subject site was annexed into the City by Ordinance
1745 of April 14 , 1959. Portions of it have been rezoned

1 . Topography: The site is generally level except
for some very slight downward slopes in a north-south
direction in the northerly and westerly portions
of the property.
2. Soils : Tukwila muck (Tu) . Permeability is moderate.
There is a seasonal high water table at or near
the surface. Runoff is ponded and the erosion
hazard is slight. If drained, this soil is used
for row crops. It is also used for pasture. Woodin-
ville silt loam (Wo) . Permeability is moderately
slow. There is seasonal high water table at or
near the surface. Runoff is slow, and the erosion
hazard is slight. Stream overflow is a severe
hazard unless flood protection is provided. This
soil is used for row crops, pasture, and urban
development.
3. Vegetation: The vegetation consists principally
of blackberries and scrub brush with some deciduous
trees interspersed.
4 . Wildlife: Existing vegetation on the subject site
provides suitable habitat for birds and small mammals.
(See the NEPA Environmental Impact Statement. )
Suitable wetland mitigation for both vegetation
and wildlife is proposed by the project. Phase
I mitigation requires acquisition of 70 acres of
seasonal wetlands in Kent.
5. Water : Standing water is present on a portion
of the subject site. Springbrook Creek traverses
the east and northerly portions of the site, and
the Black River crosses the site at the north.
6. Land Use: The subject site is vacant.
E. EI r::i : OOD CHARACTERISTICS:
The surrounding properties are in a transitional state
from undeveloped to mixed industrial, warehousing, and
commercial uses.

L. PLANNING DEPOT ANALYSIS:
1 . The proposal is generally consistent with the Compre-
hensive Plan designation of Manufacturing Park
in that it provides a necessary public service
for flood control without which the development
of designated industrial areas in the Green River
Valley could not occur. The Comprehensive Plan
specifically recognizes this facility at a slightly
altered alignment and location.
2. The proposal complies with the Green River Valley
Comprehensive Plan and the East, Side Green River
Watershed Project.
3. The proposal is a public service and would comply
with the existing G zoning.
4 . The proposal is to create a holding pond along
\ with the first segment of the P-1 Channel. Approxi-
mately 500, 000 cubic yards of material will have ,
to be removed from the site. The spoils may be
deposited between the southern edge of the holding
pond and the northern edge of the dike surrounding
the METRO Treatment Plant. This would raise the
ground level approximately 10 feet. METRO is discussing
with King County the possibility of placing some
of the higher quality spoils within the diked area.
This would require further public hearings under
a new application before the Hearing Examiner.
The placement of materials on the adjacent properties
is primarily of a temporary nature to dewater the
spoils. Quality fill will be immediately reused
in permanent locations requiring future hearings
pursuant to the Mining, Excavation and Grading
Ordinance. However, some portion of the spoils
could be of such high peat content that they would
be removed from the area. Since the location of
the ultimate disposal is still unknown, review
of how, when and where the permanent disposal will
be accomplished should be required prior to the
completion of the project (December, 1982) .
5. The design calls for a minimum 20 foot. vegetational
buffer around the project in addition to the Black
River Riparian Forest to the north and could incor-
porate buffer areas although not a part of this
proposal. Plantings are required in the holding
pond and channel; however, exact design is dependent
upon future maintenance and operational conditions.
• The mitigation agreement for the project requires
the holding pond to attain a wetland character
with the channels restoring a tree canopy lost
along Springbrook Creek by encroaching urban devel-
opment. Maintenance dredging will probably become
necessary in the future.
6. The fisheries resources will be protected in the
low flow of the, summertime by use of an 8-foot
wide fishway. The Washington State Department
of Fisheries and Game issued the hydraulics permit
on June 18, 1981 , and the Department of Ecology
granted approval on June 16, 1981 .

7. The Parks Department. and Traffic Engineering Division
have recommended approval of the project. The
Engineering Division recommends approval subject
to the submission and approval (by the Public Works
Department) of. final plans.
8. If the material is not deposited immediately adjacent
to the subject site, the truck traffic generated
will be substantial over the 14 month construction
period. Sixty (60) to 80 truck trips per day could
be anticipated. The Police Department recommends :
a. Posting of $2, 000 Cash Bond.
b. Signing of area.
c. Approval of the truck route inside the City
by both the Police Department and Traffic
Engineering Division.
d. Limiting hours of operation from 7 : 00 a.m.
to 3 : 00 p.m. plus no weekend work.
e. Keeping streets clean by use of City crews,
if necessary, then proceeding against the
bond.
M. DEPARTMENTAL RECOMMENDATIONS:
Based upon the above analysis, it is recommended that
the Hearing Examiner grant approval of the request for
filling and grading, file SP-060-81 , subject to the
following conditions :
a. Review of the permanent location of spoils prior
to December 31 , 1982.
b. Posting of a $2, 000 Cash Bond to cover the cost
of street clean-up.
c . Signing of area ,per Traffic Engineering approval.
d. Approval of truck route within the city limits
by both the Police Department and the Traffic Engi-
neering Division.
e. Limiting of operating hours from 7 : 00 a.m. to
3 :00 p.m.
f. Compliance with the Eastside Watershed Mitigation
Agreement for wetland acquisition and channel
restoration.

We are returning herewith completed copies of the Special and Shoreline
Permit forms sent to us with your letter of 24 June. As Mr. Herb Young
discussed with you by phone, certain land ownership information will have
to follow, because we are still in the process of acquiring the necessary
property.
Eight copies are inclosed of a vicinity map, an aerial photo-plan, cross-
sections, and typical cross-sections of a preliminary landscaping plan
provided by the Soil Conservation Service. In regard to the last, it must
be noted that the landscaping plan has not been approved by SCS, and there
is a question of possible interference with flow by some of the in-channel
plantings shown. However, the drawings do indicate the direction of intent
so far as landscaping is concerned. Landscaping would be accomplished
under a separate contract to follow excavation.
The drawings do not show where excavated materials would be placed as this
matter is still open to negotiation. Preferably, the material would be
placed throughout the area bounded by the holding pond, the P-1 channel ,
the Metro dike, and Monster Road. The ground level in this area would be
raised about 10 feet, providing a base for construction of the Valley Park-
way, First City Equities development, and northward expansion of the Metro
treatment plant. Disposal plans will be furnished as they become finalized.
An existing 12-inch water line south of the holding pond would have to be
lowered where crossed by the P-1 channel . A letter has been sent to Mr.
Ron Olson, Renton Public Works Department, requesting permission to arrange
for this in connection with Phase 1 construction.
Please advise if additional information is required. The project is in the
interest of all entities in the Green River Valley, and we appreciate your
making this review before all elements of the plan are in place.

4. That the variance authorized does not constitute a grant of special
privilege not enjoyed by the other properties in the area, and will
be the minimum necessary to afford relief.

B. Development either waterward of the ordinary high water mark or within
marshes, bogs, or swamps:
1. That the strict application of the bulk, dimensional or performance
standards set forth in the applicable City of Renton Shoreline Master
Program precludes or significantly interferes with a reasonable permitted
use of the property.
2. That the hardship.is specifically related to the property, and is the
result of unique conditions such as irregular lot shape, size, or
natural features and the application of the master program, and not,
for example from deed restrictions or the applicant's own actions.
