REPORT AND RECOMMENDATION TO THE RENTON CITY COUNCIL.
APPLICANT: Julius and Stella Caraccioli FILE NO. R-069-81
LOCATION: West side of East Valley Road approximately 320 feet south of
S.W. 16th Street.
SUMMARY OF REQJEST: The applicant seeks a rezone of the subject site from G to L-1
for future office, warehouse and material storage uses.
SUMMARY OF Planning Department: Approval with restrictive covenants.
RECOMMENDATION:
Hearing Examiner: Approval with restrictive covenants.
PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on September 16, 1981 .
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows :
The hearing was opened on September 22, 1981 at 9:05 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report. Roger Blaylock, Associate Planner, presented the report,
and entered the following exhibits into the record:

Responding to the Examiner' s inquiry regarding proposed fill operations on the property,
Mr. Blaylock advised that the area designated for construction of a building will be
required to be filled. The Examiner noted that most of the lots surrounding the site
previously rez)ned to an L-1 designation had contained 6,000 square feet; however, because
the subject site contains 32 ,000 square feet, he inquired if there was any reason why
a rezone to the Manufacturing Park classification was not proposed. Mr. Blaylock explained
that due to the narrow configuration of the lot , maneuverability space for large trucks
could not be provided under the side and rear yard setback requirements of the M-P zone.
A concern was expressed by the Examiner that elimination of side yard requirements would
result in lack of provision of landscaping to buffer the site from adjoining lots. Mr.
Blaylock stated that adjacent properties located to the north, south and west of the site
are zoned L-1 and H-1 , respectively, and are not in compliance with the Comprehensive Plan.
The Examiner requested testimony by the applicant. Responding was:

Mr. Brown advised concurrence in the staff report recommendations. He strongly supported
approval of a rezone to the L-1 classification rather than the M-P zone in order to
utilize the site to its fullest potential . He requested that if and when the P-I Channel
is constructed or other measures taken for provision of storm drainage facilities in the
valley, a mechanism be included in restrictive covenants to remove the requirement for an
equal amount of excavation for purposes of flood control in order to assure that the
restriction does not run with the land even after measures have been taken by the city or
county to mitigate the storm drainage problem.
Responding to the Examiner' s inquiry regarding imposition of restrictive covenants at the
rezone stage, Mr. Blaylock confirmed the Planning Department' s intent for execution of the
document as part of rezone approval . The Examiner requested clarification of the fill

process, and asked if the applicant would be required to excavate one foot over an equal
square footage if the site were filled one foot over a certain square footage. Mr. Blaylock
advised than if the applicant were to bring in 10,000 cubic yards of fill , he would have to
excavate an area below flood level to accommodate displaced water. The Examiner inquired
regarding the responsibility for calculation of the formula if impermeable surfaces are
installed on the site. The intent of the Planning Department to require a general rather
than specific restrictive covenant was discussed by Mr. Blaylock, who noted that the covenant
would contain a general formula to require existing flood storage to be maintained on the
site through the fill and excavation process. The formula would subsequently be calculated
at the time of the fill permit application.
The Examiner requested further comments. Mr. Blaylock advised that the department would
not object to execution of restrictive covenants which would allow deletion of flood
storage requirements at the time the P-1 Channel is constructed.
Since no further comments were offered, the hearing regarding File No. R-069-81 was closed
by the Examiner at 9:21 a.m.
FINDINGS , CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1 . The request is for approval of a reclassification of approximately 32,520 square feet
of property from G (General ; Single Family Residential ; Minimum lot size - 35,000
square feet) to L-1 (Light Industry) .
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , RCW 43.21C, as amended, a Declaration of Non-Significance has been
issued for the subject proposal by the Environmental Review Committee, responsible
official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. Utilities will have to be extended to the subject site.
7. The subject property is located on the west side of the East Valley Road about 320
feet south of S.W. 16th Street. Immediately east of the East Valley Road is SR-167.
8. The subject site was annexed into the city by Ordinance No. 1745 in April of 1959,
at which time the current G classification was applied.
9. The site is level and is located in the northern extreme of the Green River Valley.
The site is located within the Federal Emergency Management Agency flood fringe.
10. The uses in the vicinity are generally industrial or manufacturing park type uses. The
area to the north is in transition from old single family dwellings to commercial and
industrial uses.
11 . The Comprehensive Plan designates the area in which the subject site is located as
suitable for the development of manufacturing parks. The site is also within the
orbit of the Green River Valley Comprehensive Plan, and screening and site review are
recommended to provide compatible and aesthetic working environments.
12. The area has a mix of industrial zoning. Immediately north is an L-1 property, the
classification requested by the applicant. South and west of the subject site is an
H-1 (Heavy Industry) zone. South of S.W. 19th Street is a large G zone.
13. Much of the area has been filled pursuant to grade and fill permits. The subject site
would have to be filled to bring it above the flood level for this area.
14. The subject lot is about 270 feet deep by 120 feet wide, and the requirements of the
M-P (Manufacturing Park) zone would require 20 foot side yard setbacks. The applicant
would be left with 80 feet of buildable width.
15. The Planning Department recommended that the site be classified to L-1 to provide less
stringent sideyard setback requirements. They indicated that the 60-foot front setback

should be required.
16. The Declaration of Non-Significance requires that ``:^ frond potential of the
site be mairtained. This would be accomplished by removing a like amount of material
from the site as has been used to fill the site. This would not account for the loss
of ground at sorption caused by the covering of the site with impermeable surfaces
such as paving and structures.
17. There have been a number of rezones of property to L-1 in the areas surrounding the
subject site.
CONCLUSIONS:
1 . The proponent of a rezone must demonstrate that the request is in the public interest
and will not impair the public health, safety and welfare in addition to compliance
with at least one of the three criteria listed in Section 4-3014 which provides in
part that:
a. The subject site has not been considered in a previous area rezone or land use
analysis; or
b. The subject site is potentially designated for the new classification per the
Comprehensive Plan; or
c. There has been material and substantial change in the circumstances in the area
in which the subject site is located since the last rezoning of the property or
area.
The applicant has demonstrated that the proposed rezone as conditioned below satisfies
the above enumerated criteria.
2. The subject site is located within a developing industrial area and is no longer
suitable fcr residential development. The site has good access to the major highway
network north and east of the property and will provide an appropriate location for
an industrial operation.
3. The size of the lot constrains the applicant from reasonably utilizing the lot to
advantage if all the setbacks imposed by the M-P zone were to be required; therefore,
it seems reasonable to permit the lot to be reclassified to L-1 , a category which
allows many of the manufacturing park uses, and impose restrictions of the M-P zone
to make the development compatible with both the Comprehensive Plan and the Green
River Valley Comprehensive Plan.
4. The 60-foot setback will not be overly burdensome since the lot is quite deep
compared to its width. The property should also be screened as required by the
M-P zone, and subject to a site approval review prior to development to assure
fidelity to the various comprehensive plans.
5. Since the property is located within the flood fringe as currently defined by FEMA,the ERC issued the Declaration of Non-Significance for the site subject to provision
of flood storage capacity equal to the 100-year flood calculations. The recommendation
to assure such capacity is that the applicant excavate an amount of material from thesiteequaltotheamountoffillrequiredtoprovideasafebuildingfoundationheight.Since this formula ignores the current holding capacity of the ground which would be
lost after coverage of the site with impermeable surfaces, the applicant should be
required to add capacity equal to the lost quantity.
6. Subject to the conditions indicated above, the reclassification of the subject property
should prove to be in the public interest, and as the neighboring properties are
similarly zoned, there will be no adverse effect on those properties.
RECOMMENDATION:
The City Council should approve the reclassification of the subject request from G to L-1
subject to the following conditions:
1 . The applicant to execute restrictive covenants to abide by all of the requirements of
the M-P zone with the exception of rear yard and side yard setbacks.
2. The applicant to execute covenants to maintain the 100 year flood capacity of thesubjectsiteincludingtheholdingcapacityofthesoilsandsubsurfaceofthesite;the covenant as to flood storage capacity shall only be in effect until such time as
this capacity is no longer necessary as a result of a change in flood hazard.

judgment, or the discovery of new evidence which could not be reasonably available at the
prior hearing may make a written request for review by the Examiner within fourteen (14)
days from the date of the Examiner' s decision. This request shall set forth the specific
errors relied upon by such appellant, and the Examiner may, after review of the record,
take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection in
the Finance Department, first floor of City Hall , or same may be purchased at cost in
said department.

PROPERTIES WITHIN THE CITY OF RENTON FROM GENERAL
CLASSIFICATION DISTRICT (G ) TO LIGHT INDUSTRIAL.

WHEREAS under Chapter 7 , Title IV ( Building Regulations) of
Ordinance No . 1628 known as the "Code of General Ordinances of the
City of Renton." , as amended , and the maps and reports adopted it
conjunction therewith , the property hereinbelow described has
heretofore beer zoned as General Classification District (G ) ; and
WHEREAS a proper petition for change of zone classification
of said property has been filed with the Planning Department or, or
about July 31 , 1981 , which petition was duly referred to the Hearing

Rentonarea; also including Planning Commission minutes of the pub-
lic hearing on 9/24/81. The Commission recommended adoption of
the Northeast Renton Comprehensive Plan amendment, noting the
Council may adopt, modify or reject the plan, that no public hear-
ing is required, although one may be considered. Ordinance adoption
is required to approve the amendment. MOVED BY CLYMER, SECOND BY
ROCKHILL, REFER MATTER TO THE PLANNING AND DEVELOPMENT COMMITTEE.
Council President Stredicke requested the Acting Planning Director
to present previous correspondence on the NE Quadrant Comprehensive
Plan. MOTION CARRIED.
Monterey Terrace Letter from The Monterey Club, Monterey Terrace Community, Inez
Street Resurfacing Kremer, President and Richard Houser, Past-President, thanked
the City for paving of streets without inconvenience, and asked
regarding time schedule for street markings. Councilman Rockhill
noted striping now accomplished. Councilman Reed noted asphalt
covered drains not yet chipped out, also noting South Renton done.

Emergency Sewer Letter from Public Works Director Houghton requested authorization
Repairs due to for emergency expenditure for repair of sanitary sewer trunk line
Rolling Hills break due to saturated portion of canyon wall below Thunderhill
Trunk Line Break Apartments destroyed part of 12 inch trunk sewer. The letter noted
temporary repairs were made immediately, however, it is imperative
that proper emergency repairs are made. Estimated cost is $20,000;
Thunderhill Apartments to share in cost; City share will be approxi-
mately $13,600. The letter noted monies are available in the
Utilities Fund. Moved by Clymer, Second by Rockhill, concur in
request to make repairs. SUBSTITUTE MOTION BY STREDICKE, SECOND
REED, REFER MATTER TO THE UTILITIES COMMITTEE FOR RECOMMENDATION.

Appointmenv: Letter from Mayor Shinpoch advised of appointment of Richard
Public Works Houghton to the position of Public Works Director, having been
Director Acting Director since early January 1981. The letter explained
Richard Houghton Houghton competed with 96 applicants through stringent testing
including assessment center evaluation to be one of two top final-
ists. Mayor Shinpoch determined the Acting Director was the most
appropriate choice; having been with the City for 20 years and pro-
gressing through the ranks from Draftsman to Asst. Civil Engineer,
Head Surveyor, Office Engineer, Utility Engineer, Engineering
Supervisor and Acting Director. Mayor Shinpoch requested Council

PS COG Councilman Hughes reported his attendance at special meeting last
week of Puget Sound Council of Government with brain storming on
items such as solid waste, energy, etc. Hughes will be reporting

Community Community Services Committee Chairman Reed presented committee
Services report explaining 10/20 meeting to review status of public use
Committee walkways in the City and recommended: (1) Public use walkways
Tiffany Park not adjacent to dedicated roadways be discouraged in all future
Walkway and residential plats; if circumstances exist which require walkway,
Future developer must construct it with hard surface and specifications
Walkways established by the Public Works Director. (2) The walkway in
Tiffany Park between Index Ave. and Lake Youngs Way SE, should
be improved with a cement surface and proper drainage system. The
Administration should contact the residents of Tiffany Park to
inform them that the improvements are necessary at a cost of
approximately $5,000 and ascertain if residents are willing to
participate in an L.I.D. or other funding mechanism to pay the

Gentlemen:
A study of the Springbrook drainage area concluded that 1080 acre feet of
flood storage is required to maintain a 100-year flood elevation of 15 feet
above mean sea level . Due to previous filling of the valley floor, the
1080 acre feet of storage may not be available. A study currently underway
which will take months to complete will determine if the valley has the
required storage. If the storage is not adequate, a new 100-year flood
elevation (higher than 15 feet) will be determined.
After talking to Wes Edins of the Federal Emergency Maintenance Agency, and
Herb Young of King County Surface Water Management, I feel the following
procedures are sufficient to prevent environmental impacts to such an
extent that the lead agency could withdraw its Declaration of Significance
and issue a Declaration of Non-Significance for this site.
1. The volume of flood storage that would be depleted by filling part of
the site for the building pad would be compensated by excavating (below
elevation of 15 feet) an equal volume of earth on the site. Using this
method, the floodway fringe will not be modified and a computer model
of the affects of this development will not have to be done.
2. I am sure a potential 100-year flood elevation can be agreed upon by
Engineers at the above mentioned agencies and Renton Public Works to
determine a reasonable finished flood elevation for the proposed
building. The potential 100-year flood elevation would not likely
raise more than one foot above the current 15 feet.

It is our opinion that the limited development of this small site
will not adversely affect the neighboring owners - either Austin Co.
or Metro. The intended purchasers plan a future building of from
4000 to 6000 square feet with limited outside storage. This would
occur sometime in the next year or two.

WHEREAS, Julius Caraccioli , as his separate property, is the owner of the
following reEl property in the City of Renton, County of King, State of Washington,
described as follows:
Located in the SW 1/4 of Section 19-23-5, portions of lots 8, 9, 10 and all
of 49, 5( and 51 of Hillman 's Earlington Gardens #1 , Volume 17, page 74 of
plats in King County, Washington, together with that portion of vacated
Harriman Avenue (91st Avenue South) .
WHEREAS, the owner of said described property, hereinafter "the property,"
desires to impose the following restrictive covenants running with the land as to
use, present and future, of the property;
NOW, THEFEFORE, the aforesaid owner hereby establishes, grants and imposes
restrictions and covenants running with the land as to the use of the land
hereinabove cescribed with respect to the use by the undersigned, his successors ,
heirs and assigns , as follows :
ZONING REQUIREMENTS
Development cn the property must conform to all requirements of Section 4-730, M-P,
Manufacturinc Park District , of the City of Renton Zoning Code with the exception of
rear yard one side yard setbacks .
MAINTENANCE OF 100 YEAR FLOOD CAPACITY
Maintenance cf the 100 year flood capacity shall be required on the subject site

DURATION

Hearing Examiner: Approval with restrictive covenants.
PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on September 16, 1981 .
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on September 22, 1981 at 9:05 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report. Roger Blaylock, Associate Planner, presented the report,
and entered the following exhibits into the record:

Responding to the Examiner' s inquiry regarding proposed fill operations on the property,
Mr. Blaylock advised that the area designated for construction of a building will be
required to be filled. The Examiner noted that most of the lots surrounding the site
previously rezoned to an L-1 designation had contained 6,000 square feet; however, because
the subject site contains 32,000 square feet, he inquired if there was any reason why
a rezone to the Manufacturing Park classification was not proposed. Mr. Blaylock explained
that due to the narrow configuration of the lot, maneuverability space for large trucks
could not be provided under the side and rear yard setback requirements of the M-P zone.
A concern was expressed by the Examiner that elimination of side yard requirements would
result in lack of provision of landscaping to buffer the site from adjoining lots. Mr.
Blaylock stated that adjacent properties located to the north, south and west of the site
are zoned L-1 and H-1 , respectively, and are not in comp) iance with the Comprehensive Plan.
The Examiner requested testimony by the applicant. Responding was:

Mr. Brown advised concurrence in the staff report recommendations. He strongly supported
approval of a rezone to the L-1 classification rather than the M-P zone in order to
utilize the site to its fullest potential . He requested that if and when the P-1 Channel
is constructed or other measures taken for provision of storm drainage facilities in the
valley, a mechanism be included in restrictive covenants to remove the requirement for an
equal amount of excavation for purposes of flood control in order to assure that the
restriction does not run with the land even after measures have been taken by the city or
county to mitigate the storm drainage problem.
Responding to the Examiner' s inquiry regarding imposition of restrictive covenants at the
rezone stage, Mr. Blaylock confirmed the Planning Department's intent for execution of the
document as part of rezone approval . The Examiner requested clarification of the fill

process, and asked if the applicant would be required to excavate one foot over an equal
square footage if the site were filled one foot over a certain square footage. Mr. Blaylock '
advised that if the applicant were to bring in 10,000 cubic yards of fill , he would have to
excavate an area below flood level to accommodate displaced water. The Examiner inquired
regarding the responsibility for calculation of the formula if impermeable surfaces are
installed on the site. The intent of the Planning Department to require a general rather
than specific restrictive covenant was discussed by Mr. Blaylock, who noted that the covenant
would contain a general formula to require existing flood storage to be maintained on the
site through the fill and excavation process. The formula would subsequently be calculated
at the time of the fill permit application.
The Examiner requested further comments. Mr. Blaylock advised that the department would
not object to execution of restrictive covenants which would allow deletion of flood
storage requirements at the time the P-1 Channel is constructed.
Since no further comments were offered, the hearing regarding File No. R-069-81 was closed
by the Examiner at 9:21 a.m.
FINDINGS , CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1 . The request is for approval of a reclassification of approximately 32,520 square feet
of property from G (General ; Single Family Residential ; Minimum lot size - 35,000
square feet) to L-1 (Light Industry) .
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton 's Environmental Ordinance and the State Environmental
Policy Act of 1971 , RCW 43.21C, as amended, a Declaration of Non-Significance has been
issued for the subject proposal by the Environmental Review Committee, responsible
official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. Utilities will have to be extended to the subject site.
7. The subject property is located on the west side of the East Valley Road about 320
feet south of S.W. 16th Street. Immediately east of the East Valley Road is SR-167.
8. The subject site was annexed into the city by Ordinance No. 1745 in April of 1959,
at which time the current G classification was applied.
9. The site is level and is located in the northern extreme of the Green River Valley.
The site is located within the Federal Emergency Management Agency flood fringe.
10. The uses in the vicinity are generally industrial or manufacturing park type uses. The
area to the north is in transition from old single family dwellings to commercial and
industrial uses.
11 . The Comprehensive Plan designates the area in which the subject site is located as
suitable for the development of manufacturing parks. The site is also within the
orbit of the Green River Valley Comprehensive Plan, and screening and site review are
recommended to provide compatible and aesthetic working environments.
12. The area has a mix of industrial zoning. Immediately north is an L-1 property, the
classification requested by the applicant. South and west of the subject site is an
H-1 (Heavy Industry) zone. South of S .W. 19th Street is a large G zone.
13. Much of the area has been filled pursuant to grade and fill permits. The subject site
would have to be filled to bring it above the flood level for this area.
14. The subject lot is about 270 feet deep by 120 feet wide, and the requirements of the
M-P (Manufacturing Park) zone would require 20 foot side yard setbacks. The applicant
would be left with 80 feet of buildable width.
15. The Planning Department recommended that the site be classified to L-1 to provide less
stringent sideyard setback requirements. They indicated that the 60-foot front setback

should be required.
16. The Declaration of Non-Significance requires that the 1n0-year flood potential of the
site be mairtained. This would be accomplished by removing a like amount of material
from the site as has been used to fill the site. This would not account for the loss
of ground at sorption caused by the covering of the site with impermeable surfaces
such as paving and structures.
17. There have heen a number of rezones of property to L-1 in the areas surrounding the
subject site.
CONCLUSIONS:
1 . The proponelt of a rezone must demonstrate that the request is in the public interest
and will no: impair the public health, safety and welfare in addition to compliance
with at least one of the three criteria listed in Section 4-3014 which provides in
part that:
a. The subject site has not been considered in a previous area rezone or land use
analysis; or
b. The subject site is potentially designated for the new classification per the
Comprehensive Plan; or
c. There has been material and substantial change in the circumstances in the area
in which the subject site is located since the last rezoning of the property or
area.
The applicant has demonstrated that the proposed rezone as conditioned below satisfies
the above enumerated criteria.
2. The subjec: site is located within a developing industrial area and is no longer
suitable fmr residential development. The site has good access to the major highway
network no-th and east of the property and will provide an appropriate location for
an industrial operation.
3. The size of the lot constrains the applicant from reasonably utilizing the lot to
advantage if all the setbacks imposed by the M-P zone were to be required; therefore,
it seems reasonable to permit the lot to be reclassified to L-1 , a category which
allows many of the manufacturing park uses, and impose restrictions of the M-P zone
to make the development compatible with both the Comprehensive Plan and the Green
River Valley Comprehensive Plan.
4. The 60-foct setback will not be overly burdensome since the lot is quite deep
compared 10 its width. The property should also be screened as required by the
M-P zone, and subject to a site approval review prior to development to assure
fidelity to the various comprehensive plans.
5. Since the property is located within the flood fringe as currently defined by FEMA,the ERC issued the Declaration of Non-Significance for the site subject to provision
of flood storage capacity equal to the 100-year flood calculations. The recommendation
to assure such capacity is that the applicant excavate an amount of material from thesiteequaltotheamountoffillrequiredtoprovideasafebuildingfoundationheight.Since this formula ignores the current holding capacity of the ground which would be
lost after coverage of the site with impermeable surfaces, the applicant should be
required to add capacity equal to the lost quantity.
6. Subject to the conditions indicated above, the reclassification of the subject property
should prove to be in the public interest, and as the neighboring properties are
similarly zoned, there will be no adverse effect on those properties.
RECOMMENDAT I Ott:
The City Council should approve the reclassification of the subject request from G to L-1
subject to the following conditions:
1 . The appl cant to execute restrictive covenants to abide by all of the requirements of
the M-P !one with the exception of rear yard and side yard setbacks.
2. The applicant to execute covenants to maintain the 100 year flood capacity of thesubjectsiteincludingtheholdingcapacityofthesoilsandsubsurfaceofthesite;the covenant as to flood storage capacity shall only be in effect until such time as
this capacity is no longer necessary as a result of a change in flood hazard.

errors relied upon by such appellant, and the Examiner may, after review of the record,
take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting

The subject site was annexed into the City by Ordinance
1745 of April 14 , 1959 at which time the present zoning
classification was applied.

D. PHYSICAL BACKGROUND:
1 . Topography: The site is level.
2. Soils: Puget silty clay loam (Pu) . Permeability
is moderately rapid. Runoff is slow and the erosion
hazard is slight. Stream overflow is a slight
to severe hazard depending on the amount of flood
protection provided. This soil is used for row
crops and pasture and for urban development.
3. Vegetation: The site consists principally of grass
and scrub brush.
4 . Wildlife: The existing vegetation may provide
some habitat for birds and small mammals.
5 . Water: The subject site is located within the
FEMA flood fringe designation. Noe surface water
was observed on the subject site. (September 11 ,
1981 )
6. Land Use: Although the subject site and adjacent
properties are largely undeveloped, substantial
filling operations are underway to the north, west,
and south.
E. NEIGHBORHOOD CHARACTERISTICS:
The surrounding properties consist principally of land
utilized for industrial purposes or in the process of
being prepared for such activity.
F. PUBLIC SERVICES:
1 . Water and Sewer: A sixteen-inch water main extends
east-west on S.W. 19th Street wihtin one-fourth--
mile to the south of the subject site while an
eight-inch sanitory sewer runs north-south on the
East Valley Road approximately one-half mile south.
2. Fire Protection: Provided by the City of Renton.
as per ordinance requirement.
3 . Transit : Metro Transit Route #156 operates along
SR 167 to the east of the subject site.
4 . Schools: Not applicable.

distrub the soils , remove the vegetation, increase
storm water runoff and cause an increase in traffic
and noise levels in the area. However, through
propert development controls and procedures , these
impacts can be mitigated.

addressed at the time of future development.

J. ENVIRONNENTAL ASSESS'/THRESHOLD DETERMINATION:
Pursuant to the City of Renton's Environmental Ordinance
and the State Environmental Policy Act of 1971, as amended,
RCW 43-21C, the ERC on September 7 , 1981 , issued a declaration
of non-significance for the subject proposal. The declaration
of non-significance is based upon the applicant' s proposal
to not change the flood stage on the site due to any
proposed development.

L. PLANNING DEPARTMENT ANALDCSIS:
1 . The proposed rezone to Light Industrial is not
directly in conformance with the Comprehensive
Plan Land Use Element designation of Manufacturing
Park for the subject site. However, the City has
approved a number of rezones in the vicinity to
Light Industrial subject to restrictive covenants
designed to be compatible with the objectives of
the Valley Comprehensive Plan. These rezones include
Ordinance 3469 (September, 1980) and Ordinance
3482 (November, 1981 ) . See applicant ' s letter
of justification for additional rezones. These
actions would indicate that the subject site is
potentially zoned for the L-1 classification being
sought. [Section 4-3014-C (la & 1b) .
2. The subject site is in an area which is in transition
from older single family residence and undeveloped
properties to commercial/industrial uses. Properties
to the west have either been filled extensively
or are in the process of being so in preparation
for similar uses .
3 . Although no specific site plan has been submitted
with the proposed rezone, the applicant indicates
future plans for a +4000-6000 square foot building
office and warehousing) together with limited
outdoor storage (screened) .

4 . Previous rezones to L-1 in the vicinity have been
accompanied by restrictive covenants in the form
of setbacks, landscaping, and screening (Lewis,
Dahlby) . These sites, however, were located adjacent
to residentially used and/or zoned parcels of property.
The subject site is not and therefore such restrictive
measures may not be completely appropriate. In
addition, the long, narrow shape of the property
limits development based solely upon M-P zone standards.
A viable alternative could be the requirement for
a sixty foot (60 ' ) front yard setback (from the
East Valley Road) and L-1 zone setback on the remaining
yards . This would permit utilization of the side
and rear yards for storage and warehousing (as
proposed by the applicant) and still allow for
construction of the building; while automobile
parking could be provided in the required front
yard.
5. The Engineering Division advises that the subject
site is in the flood zone and that any future filling
will eliminate necessary flood water storage area.
Because of this potential and the uncertain timetable
for future construction of the P-1 Channel, it
is imperative that the applicant provide suitable
assurance that any filling or grade activity will
be accompanied by provision of a like amount of
area on-site appropriate for flood water storage.
This is also part of the decision of the ERC in
issuing the declaration of non-significance.
6. . Water line and sanitary sewer line extensions will
be required at the time of future development as
per Utilities Engineering Division comment. Late-
comer ' s agreements for water and sewer must also
be provided as well as water and sewr plans. A
community facilities charge for water will apply
and fire hydrant locations will require approval
by the Fire Department.
7 . Future building construction shall meet all city
codes and the requirements of the Fire Marshall.
8. Participation in the LID for the East Valley Road
will be required as per Traffic Engineering Division
comment.
9. The Police Department indicates that future buildings
should have an adequate security system consisting
of an alarm, locks, and lighting.
M. DEPARTMENTAL RE6OMMENDATION; :
Based upon the above analysis , recommended approval
of the rezone request subject to the satisfaction of
items L-4 through L-9.

Gentlemen:
A study of the Springbrook drainage area concluded that 1080 acre feet of
flood storage is required to maintain a 100-year flood elevation of 15 feet
above mean sea level . Due to previous filling of the valley floor, the
1080 acre feet of storage may not be available. A study currently underway
which will take months to complete will determine if the valley has the
required storage. If the storage is not adequate, a new 100-year flood
elevation (higher than 15 feet) will be determined.
After talking to Wes Edins of the Federal Emergency Maintenance Agency, and
Herb Young of King County Surface Water Management, I feel the following
procedures are sufficient to prevent environmental impacts to such an
extent that the lead agency could withdraw its Declaration of Significance
and issue a Declaration of Non-Significance for this site.
1. The volume of flood storage that would be depleted by filling part of
the site for the building pad would be compensated by excavating (below
elevation of 15 feet) an equal volume of earth on the site. Using this
method, the floodway fringe will not be modified and a computer model
of the affects of this development will not have to be done.
2. I am sure a potential 100-year flood elevation can be agreed upon by
Engineers at the above mentioned agencies and Renton Public Works to
determine a reasonable finished flood elevation for the proposed
building. The potential 100-year flood elevation would not likely
raise more than one foot above the current 15 feet.

The purpose of this letter is to appeal the proposed Significant
Declaration on Mr. Carraccioli 's application for rezone #R 069-81
and ECF 074-81.
It is our opinion that the limited development of this small site
will not adversely affect the neighboring owners - either Austin Co.
or Metro. The intended purchasers plan a future building of from
4000 to 6000 square feet with limited outside storage. This would
occur sometime in the next year or two.
Stepan and Associates has provided us with additional supporting
information and documentation which is attached.

method, the floodway fringe will not be modified and a computer model
of the affects of this development will not have to be done.
2. I am sure a potential 100-year flood elevation can be agreed upon by
Engineers at the above mentioned agencies and Renton Public Works to
determine a reasonable finished flood elevation for the proposed
building. The potential 100-year flood elevation would not likely
raise more than one foot above the current 15 feet.

Acting as the Responsible Official, the ERC has determined
this development does have significant adverse impact on
the environment. An EIS may be required under RCW 43. 21C. 030 (2) (c) .
This decision was made after review by the lead agency of
a complete environmental checklist and other information
on file with the lead agency.
Reasons for proposed declaration of environmental significance:
1 . The subject site is located in the floodway fringe
as identified on the Flood Boundary and Floodway
Map from H.U.D.
2. Rezoning the site would suggest that the City approved
the subsequent development of the site; however,
that development will require filling which modifies
the floodway fringe.
Measures, if any, that could be taken to prevent or mitigate
the environmental impacts to such an extent that the lead
agency would withdraw its declaration of significance and
issue a declaration of non-significance.
1 . Construction of the East Side Watershed Project.
2. Presentation of a computer model showing that the
ultimate development of the site will not modify
the flood fringe and adversely affect other property.

Introduction The State Environmental Policy Act of 1971 , Chapter 43.21C, RCW, requires
