OFFICE OF THE LAND USE HEARING EXAMINER
CITY OF RENTON
REPORT AND DECISION.
APPLICANT: Church of Christ FILE NO. SP-071-81
LOCATION: 2527 N.E. 12th Street
SUMMARY OF REQUEST: The applicant seeks approval of a special permit to allow a
1200 square foot addition to an existing church together with
landscaping, paving, and parking improvements in an R-3 zone.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions.
Hearing Examiner Decision: Approval with conditions.
PLANNING DEPARTMENT The Planning Department preliminary report was received by
REPORT: the Examiner on September 16, 1981 .
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on September 22, 1981 at 9:25 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department preliminary report. Roger Blaylock, Associate Planner, presented the
report, and entered the following exhibits into the record:
Exhibit #1 : Application File containing Planning Department
report and other pertinent documents
Exhibit #2: Site Plan including Landscaping Plan with
staff comments
Exhibit #3: Elevation Schematic
Responding to the Examiner's inquiry regarding whether landscaping would block headlight
glare from the site into the adjacent duplex located immediately east, Mr. Blaylock
advised that a four-foot wooden fence will remain on site.
The Examiner requested testimony by the applicant. Responding was:

Mr. Hawthorne offered no further comments or additions to the Planning Department report.
Since there was no response to the Examiner's further request for input, the hearing
regarding File No. SP-071-81 was closed by. the Examiner at 9:42 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1 . The request is for approval of a special permit to allow the expansion of a church
building in an R-3 (Medium Density Multifamily) zone.
2. The application file containing the. application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , RCW 43.21C, as amended, a Declaration of Non-Significance has
been issued for the subject proposal by the Environmental Review Committee responsible

4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5• There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7• The proposal is compatible with the required setbacks, lot coverage and height
requi-rements of Section 4-709A (R-3) of Title IV, Ordinance No_ 1628, Code of
General Ordinances.

8. The subject property is located in the vicinity of 2527 N.E. 12th Street. The
property is approximately 25,400 square feet in size and the site is essentially
level .
9. The subject site was annexed into the city in October of 1959 by Ordinance No. 1795
and was automatically zoned G-7200 (General ; Single Family Residential ; Minimum lot
size - 7,200 square feet) . The site was rezoned to R-3 by Ordinance No. 3566 in
August, 1981 .
10. The applicant proposes adding an approximately 2,000 square foot addition to the
church. The actual lot area covered by the addition will be about 1 ,200 square
feet as part of the expansion will be contained within a second story.
The applicant also proposes to pave and enlarge the parking lot which adjoins the
church building and bring the parking facility up to current ordinance standards.
11 . The expansion will permit about 190 persons to occupy the sanctuary of the church.
The church is required to provide 38 parking spaces, whereas the applicant proposes
providing 39 parking spaces, one more than required. The applicant proposes
providing 9% internal landscaping, whereas only 5% is required.
12. The church has been located in the neighborhood for over 30 years, and there appears
to be no complaints about the operation of the church in this location.
13. There are a variety of uses in the vicinity. Duplex residential units are located
to the east of the subject site. Some large apartment houses are located west and
south of the subject site. McKnight Middle School is located just north across
N.E. 12th Street.
14. The subject site is located in an R-3 district occupying the northwest corner of
its block. A large R-2 (Duplex Residential) district is located just east of the
subject site running from N.E. 16th Street on the north to Sunset Boulevard N.E.
on the south.
15. The Comprehensive Plan designates the area in which the subject site is located as
suitable for medium density multifamily housing.
16. While the parking lot will not provide sufficient turnaround area for a fire truck
due to the location of the existing church, the Planning Department indicated that
sufficient setbacks exist on all sides of the church to provide safe Fire Department
access in the event of an emergency.
17. The Planning Department recommended additional larger plantings to soften the effect
of the structure and make it compatible with the Comprehensive Plan policy element
calling for setbacks and landscaping to serve as buffers for residential development.
CONCLUSIONS:
1 . The approval of the special permit appears to serve the public use and interest.
The existing church is located in an R-3 district and adjacent to an R-2 district
in which large apartment complexes and smaller duplexes have not been adversely
affected by the operation of the church and the occurrence of its related functions.
2. The church has been in the area for about 30 years and there is no indication that
the. facility has created any problems. The expanded church and parking area will
allow the continued operation with a minor increase in the seating capacity. A
paved and landscaped parking area will accommodate the church worshippers, and will
replace an informal , unpaved area.
3. The church is providing more parking than is generally required and the lot will
contain up to about 9% internal landscaping to soften the effects of the large

ex anse of parking. Compact car space will also be available. The parking lot
will also continue to be screened from the neighboring residential units by the
existing four foot high fence.
4.. The church is located on a major street which has accommodated not only the church
-but the neighboring multifamily development. N.E. 12th in this vicinity is generally
- compatible with the Comprehensive Plan which indicates that churches should be
located along arterial streets.
5. T e approval of a special permit will not impair neighboring property values nor
will it injure the public health, safety or welfare. The church will provide
s fficient parking, landscaping and buffering as well as sufficient setbacks and
fire access to permit its continued and unobtrusive presence in the area.
DECISION:
The special permit to expand the church is approved subject to the following conditions.
1 . Supplementation of the proposed landscaping along all property lines abutting
residential uses subject to approval of the city's landscape architect and the
maintenance of a headlight-obscuring fence along those same property lines.
2. P -ovision of fire hydrants and other fire safety measures as required by the Fire
Department.
3. Compliance with all applicable codes and regulations of the City of Renton.

August 19 , 1981 by the Environmental Review Committee
for the subject proposal that is substantially within
the scope of the declaration of non-significance issued
for the rezone on July 10, 1981 . .

L. PLANNING DEPARTMENT ANALYSIS:
1 . The proposal is to expand the existing 4, 600 square
foot Church of Christ by approximately 2,000 square
feet. Of this, 1200 square feet will be added
to the main floor for expansion of the sanctuary
and a possible meeting room and the basement will
be expanded by 800 square feet for the construction
of three classrooms. This , is approximately a 43%
expansion of the facility. In addition, the parking
lot will be upgraded to meet Municipal Codes and
landscaping will be added to buffer adjacent uses .
This expansion will result in the maximum use of
the subject site for church uses .

2 . The proposal generally complies with the Comprehensive
Plan designation of Medium Density Multiple Family
for the subject site. The location of churches
is not specifically designated on the Comprehensive
Plan. However, the 1981 Goals and Policies (page
23) suggest the following guidelines for the general
location of churches :
• Churches should be located on arterial
streets.
• Churches located in residential areas
should be designed with adequate setbacks,
landscaping and other buffers.
• Churches located in residential areas
should be of a size and intensity similar
to the adjoining residential. uses .
o ufficient access , circulation, walkways,
and off-street parking and loading should
be provided.
In applying these goals, it should be recognized
that the site is very limited, only 151 feet by
168 feet, and the church was constructed in the
County in 1951 and predates the Zoning Code and
the 1965 Comprehensive Plan. Therefore, the facility
is considered a pre-existing non-conforming use.
Even though, the church is not located on an arterial
street, the activities have functioned satisfactorily
for a period of 30 years: The church actually
provides a use buffer between the low density multiple
family duplexes to the east and the 3 story apartment
building to the south and west. The additional
landscaping accompanying the parking lot will add
a vegetational buffer. However, the landscaping
plans do not appear to create a visual screen and
should be supplemented with 6 to 10 trees along
the east, south and west boundaries .
By formalizing the parking lot and bringing it
up to Municipal Code, the circulation and pedestrian
pattern is improved. However, the lot size limits
the ultimate design of the parking lot and the
facility can not meet the turning radius for fire
trucks. This is mitigated by the size of the building
and the setbacks around the building, which allow
fire access.
3. The criteria established under Section 4-722 (F) (3)
for the Hearing Examiner to consider when evaluating
a request for a conditional use permit are most
appropriate when considering a new use. In this
case the facility having functioned adequately
for over 30 years shows that it is acceptable to
the community and is not considered detrimental
to the surrounding uses. In fact, the church existed
prior to the construction of the 3 story apartment
buildings located to the south and west; thus the
apartments created a more significant impact on
the church than the church on the apartments.

Granting of the request for expansion would be
more beneficial to the community because it will
force the upgrading of the facility without changing
the existing intensity. This will also eliminate
the pre-existing non-conforming status of the facility
and add the vegetational buffer to the established
use buffer.
4 . The Engineering Division advises that curbs, gutters
and sidewalks will be required plus on-site storm
water retention.
5. The Building Department states that the parking
and landscaping requirements must be met. Interior
landscaping is 9% and the proposal provides 9 more
parking spaces than required by code for the 150
capacity auditorium.
6. The Utilities Division suggests that the fire hydrants
may have to be relocated.

Based on the above analysis, it is recommended that
the Hearing Examiner approve the conditional use permit
request subject to the following conditions :
1 . Supplement the proposed landscaping plan with 10
trees along the southern, western, and eastern
property lines .
2. If required by the Fire Department, installation
of a new fire hydrant.
3. Installation of off-site improvements including
curbs, gutters , sidewalk and asphalt as required
by the Department of Public Works.
4 . Approval and installation of storm water retention/
detention system.

RE: LETTER OF JUSTIFICATION FOR CHURCH OF CHRIST SPECIAL PERMIT
Gentlemen:
This application for special permit requests a church use in an R-3 residential
zone. The subject property is currently the location of the Church of Christ
at 2527 N.E. 12th Street. The subject property is a 151' x 168' lot surrounded
by R-3 use to the south and west, R-2 duplexes to the east and McKnight Junior
High Sciool across N.E. 12th Street to the north. The subject site has recently
been rezoned to R-3 (pending approval of this special permit) .
The subject site has been the location of the Church of Christ since 1951 which
predates surrounding zoning and land use. The area containing the subject site was
annexed to the City of Renton in 1956. Therefore the property's use as a church, in
a residential zone, without a special permit is a pre-existing non-conforming use.
This application is part of a proposal to bring the church into compliance with
City of Renton Building $ Zoning Regulations in order to acquire a building permit
:or a much needed addition to the existing church structure. We believe that approval
of this special permit is in the interest of both the church and the City of Renton.
Mitigating Features
The greatest mitigating feature of this application is the fact that the church
is an existing use; since the church use predates all the surrounding developments,
approval of the church use will certainly not be detrimental to surrounding properties.
And since no change of use is sought, adverse impacts on the area are minimized.
In addition, the church proposes site improvements to bring the church into
compliance. Proposed improvements include paving, striping, and landscaping an
existing gravel parking lot. New perimeter and interior landscaping to meet
or exce d City of Renton regulations. These improvements should have a beneficial
effect 7 the neighborhood.
The proposed building addition and site improvements exceed all regulations listed
for R-3 zoned property in the Renton Building Regulations, Chapter 7, Section 4-709A.
The proposed building height is 35' , under minimum, The least proposed side yard
setback is 13' over minimum. The proposed front yard setback is 28' over the minimum.
The proposed rear yard setback is 5' over minimum. Finally, the proposed lot

coverage is only 14% while 35% is allowed. It is clear that the size and scale
of the proposal will not overpower any of the surrounding properties, and may act
as a transition in scale from the R-2 use on the east to the R-3 use on the west
and south of the subject site.
In conclusion, the church feels this special permit should be granted. The proposal
contains three main mitigating features:
1. The church is an existing u§e which minimizes adverse impacts on
surrounding properties;
2. The church proposes site improvements which should have beneficial
impacts on surrounding properties;
3. The size of the structure, with the proposed addition, does not over scale
the surrounding uses. -

RE: LITTER OF JUSTIFICATION FOR CHURCH OF CHRIST SPECIAL PERMIT
Gentlemen:
This application for special permit requests a church use in an R-3 residential
zone. The subject property is currently the location of the Church of Christ
at 2527IN.E. 12th Street. The subject property is a 151' x 168' lot surrounded
by R-3 use to the south and west, R-2 duplexes to the east and McKnight Junior
High School across N.E, 12th Street to the north. The subject site has recently
been rezoned to R-3 (pending approval of this special permit) .
The subject site has been the location of the Church of Christ since 1951 which
predates surrounding zoning and land use. The area containing the subject site was
annexed Ito the City of Renton in 1956. Therefore the property's use as a church, in
a residential zone, without a special permit is a pre-existing non-conforming use.
This application is part of a proposal to bring the church into compliance with
City of Renton Building $ Zoning Regulations in order to acquire a building permit
.for a much needed addition to the existing church structure. We believe that approval
of this special permit is in the interest of both the church and the City of Renton.
Mitigating Features
The greatest mitigating feature of this application is the fact that the church
is an existing use; since the church use predates all the surrounding developments,
approval of the church use will certainly not be detrimental to surrounding properties.
And since no change of use is sought, adverse impacts on the area are minimized.
In additio , the church proposes site improvements to bring the church into
compliance. Proposed improvements include paving, striping, and landscaping an
existing g avel parking lot. New perimeter and interior landscaping to meet
or exceed City of Renton regulations. These improvements should have a beneficial
effect on the neighborhood.
The propos€d building addition and site improvements exceed all regulations listed
for R-3 zoled property in the Renton Building Regulations, Chapter 7, Section 4-709A.
The proposed building height is 35' , under minimum, The least proposed side yard
setback is 3' over minimum. The proposed front yard setback is 28' over the minimum.
The propose. rear yard setback is 5' over minimum. Finally, the proposed lot

coverage is only 14% while 35% is allowed. It is clear that the size and scale
of the proposal will not overpower any of the surrounding properties, and may act
as a transition in scale from the R-2 use on the east to the R-3 use on the west
and south of the subject site.
In co clusion, the church feels this special permit should be granted. The proposal
contains three main mitigating features:
1. The church is an existing use which minimizes adverse impacts on
surrounding properties;
2. The church proposes site improvements which should have beneficial
impacts on surrounding properties;
3. The size of the structure, with the proposed addition, does not over scale
the surrounding uses.
