PUBLIC HE \RIRG: After reviewing the Building & Zoning Department report ,
examining available information on file with the application,
and field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as follows :
The hearing was opened on September 21 , 1982 at 9:07 a.m. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
Roger Blaylock, Zoning Administrator, presented the Building & Zoning Department report ,
and entered the following exhibits into the record:

Mr. Blaylock advised that the property immediately to the north was previously subdivided
into three lots under File No. Short Plat 019-75, Don Underwood, applicant. Responding
to the Examiner's inquiry regarding the correct address of the site, Mr. Blaylock
corrected all reference to S. 19th Place in the record to S. 17th Place. He also noted
that due to a discovery that the frontage on Talbot Road S. is of sufficient width to
meet ordirance requirements , dismissal of the variance without prejudice is recommended.
However, tecause the applicant has not applied for a waiver of off-site improvements , a
vacation cf S. 17th Place may be desired to eliminate that requirement , or a deferral
may be granted for a specific period of time by the Board of Public Works .
The Examirer inquired regarding provision of sewer facilities . Mr. Blaylock advised that
because tte property drops off steeply to the northeast , extension of service to the
north would be required or a pump station installed. In the front portion of Lot 2,
gravity service can be intercepted.
The Examiner requested testimony by the applicant. Responding was:

Mr. McKidcy discussed the proposed vacation, inquiring regarding segregation of property
and purchase agreements . Mr. Blaylock indicated his understanding that two-thirds of
abutting property owners must agree to the vacation; however, the applicant may wish to
enter into a private agreement to purchase the entire property from other owners. The
Examiner informed the applicant that the City Council is the appropriate body to review
street vacations , as such action does not fall within the Examiner's jurisdiction.

also inquired whether Mr. Halsen wishes to proceed with the short plat request with or
without approval of the street vacation. Mr. McKiddy advised the applicant 's intent to
proceed.

C. HISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinance
No. 1547 of May 24 , 1956. It was rezoned from GS-1
to SR-1 by Ordinance No. 3534 of May 1 , 1981 . A three-lot
short plat application was filed for on the subject
site in 1981 , and dismissed without prejudice by the
Heading Examiner on March 9, 1982 .

D. PHYSICAL BACKGROUND:
1 . Topography: The subject site slopes slightly downward
from west to east.
2 . Soils: Beausite Gravelly Sandy Loam, 6-15% slopes
BeC) . Permeability is moderately rapid. Available
water capacity is low. Runoff is medium and the
erosions hazard is moderate. The soil is used
for timber and pasture and for urban development.
3. Vegetation: The site is composed principally of
lawn grasw and short turf with some blackberries
and other short to medium growth shrubs along the
northerly, easterly and southerly perimeters.
4 . Wildlife: The existing vegetation provides suitable
habitat for birds and small mammals.
5. Water: No surface water was observed on the subject
site (September 9, 1982) .
6. Land Use: An existing single family dwelling is
located on the subject site. Similar uses are
to the north, west and south. The property to
the east is presently undeveloped.
E. NEIGHBORHOOD CHARACTERISTICS:
The surrounding properties are principally single family
residential in nature.
F. PUBLIC SERVICES:
1 . Water and Sewer: A sixteen-inch water main and
an eight-inch sanitary sewer are located along
Talbot Road South adjacent to the subject site.
2 . Fire Protection : Provided by the City of Renton
Fire Department as per ordinance requirements.
3. Transit : METRO Transit Route No. 155 operates
along Talbot Road South adjacent to the subject site.
4 . Schools : Talbot Hill Elementary School is approximately
1/4 mile to the southeast of the subject site while
Fred Nelson Middle School is approximately 1 1/4
miles to the east and Renton School is within 1 1/2
miles to the north.
5. Recreation: Talbot Hill Park is located adjacent
to the Talbot Hill Elementary School.

and the State Environmental Policy Act of 1971, as amended,
RCW 43-21C, the subject proposal is exempt from the
threshold determination of environmental significance.

L. DEPARTMENT ANALYSIS :
1 . The proposed short plat is consistent with the
existing R-1 zoning and the Comprehensive Plan
designation of Single Family for the subject site
and surrounding area.
2 . The proposal is compatible with the adjacent single
family residential uses and subdivision patterns
in the vicinity.
3 . The applicant seeks a variance from the newly established
minimum lot width standards of the R-1 zone, Section
4-706 (C) (2) , which requires that interior lots
be 75 feet in width and corner lots be 85 feet
in width. The applicant is specifically requesting
a variance from the corner lot requirement on proposed
Lot No. 2 .
The applicant must prove that the variance is justified
under Section 4-722 (G) (3) based upon the following
four criteria.
a. Criteria 1 : The applicant suffers undue hardship
as a result of the shape of the lot. The
original plat of the lot was much longer with
specific frontage on S. 19th Place which would
have possibly allowed the subdivision of the
property in an orderly manner. The state
highway, in its acquisition of right-of-way
for SR-515 , modified the original shape.
Therefore , the action of creating the shape
of the lot was a special circumstance beyond
the power of the subdivider and specifically
a result of governmental action.

b. Criteria 2 : The proposed lots in the short
plat far exceed the minimum requirements for
lot size of the zoning ordinance. In fact ,
Lot No. 1 is over two times the minimum size
of 7200 square feet and Lot No. 2 is almost
three times that square footage. Therefore,
the variance would not create an overcrowding
situation normally associated with substandard
lots resulting from reduced widths. Since
the residences will be placed on public sewers ,
there does not appear to be any materially
detrimental impact resulting from granting
the variance to width.
c. Criteria 3: The granting of the variance
does not appear to create a special privilege.
The developer will still have to put in all
of the public services and off-site improvements.
The proposed reduction to 63 feet would still
allow a buildable, useable site consistent
with the general lot width established in
this old residential area.
d. Criteria 4 : In evaluating whether this is
the minimum variance that will accomplish
the desired purpose of subdividing the subject
site into two lots , we must consider the existing
house and its location upon the property.
As proposed, Lot No. 1 would be 80 feet in
width. This would allow utilization of the
site and comply with all of the setback require-
ments in the R-1 zone. However, based upon
the site plan, it does appear that Lot No.
1 could be reduced to 75 feet in width and
Lot No.2 increased to 68 feet in width and
still accomplish functional access to the
garage on Lot No. 1 . This would appear to
be the minimum variance instead of what was
actually proposed. Therefore, a variance
request, instead of 22 feet, could be approved
at 17 feet.
It should be pointed out that even though S. 19th
Place might be vacated sometime in the future,
division of that surplus right-of-way would only
provide an additional 15 feet of width and, therefore,
a variance would still be necessary to allow for
subdivision. At that time, the width of Lot No.
2 might be increased to 82 feet.
4 . The applicant had submitted a previous short plat
request under file number Short Plat 092-81 . The
application was dismissed without prejudice by
the Examiner because of a number of possible conflicts
revolving around access, sewage disposal, and the
potential vacation of S. 19th Place. The applicant,
instead of attempting the vacation and adding the
additional cost for sewage disposal, has modified
that original proposal and submitted a new request
for two-lot short plat. Access will be directly
on to Talbot Road South and the issue of providing
increased right-of-way for S. 19th Place is now
moot.

As suggested in the comments from the Policy Development
Department, the issue of improvements on 19th
Place is clear. The improvements will be required
unless S. 19th Place is vacated. The applicant
can seek a deferral from the Board of Public Works
to provide sufficient time to seek the vacation
request, or not. The applicant has not sought
a waiver of those improvements at this time.
5. Department comments are attached for the Examiner 's
and public 's review. They all concur in recommending
the approval of the short plat. The Utilities
Engineering Division advises that a latecomer 's
agreement for water is applicable in the amount
of $1 ,855.
6 . Approval of the short plat is subject to approval
of the variance. The applicant has demonstrated
that by action, controllable by himself or the
previous property owner, the lot was changed by
shape thus precluding future subdivision. The
proposal does not create a special privilege nor
is it materially detrimental to the general public.
In addition , the short plat is acceptable under
the conditions of both the Comprehensive Plan and
Zoning Ordinance with approval of the variance.
M. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that
the short plat request , file Short Plat 039-82, be approved.
The variance should be approved subject to modification
from 22 feet to 17 feet and allow the reduction in width
of Lot No. 1 from 80 feet to 75 feet as the minimum
necessary variance.

REPORT AND RECOMMENDATION TO THE RENTON CITY COUNCIL.

SUMMARY OF REQUEST: The applicant seeks approval of a two-lot short plat along with
a variance to allow reduction in lot width in the R- 1 zone.
SUMMARY OF ACTION: Building & Zoning Department Recommendation: Approval of short
plat; Dismissal of the variance without prejudice.

BUILDING & ZONING The Building & Zoning Department report was received by the
DEPARTMENT REPORT: Examiner on September 14, 1982.
PUBLIC HEARING: After reviewing the Building & Zoning Department report ,
examining available information on file with the application,
and field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as follows :
The hearing was opened on September 21 , 1982 at 9:07 a.m. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
Roger Bla/lock, Zoning Administrator, presented the Building & Zoning Department report ,
and entered the following exhibits into the record:

Mr. Blaylock advised that the property immediately to the north was previously subdivided
into three lots under File No. Short Plat 019-75, Don Underwood , applicant. Responding
to the Examiner' s inquiry regarding the correct address of the site, Mr. Blaylock
corrected all reference to S. 19th Place in the record to S. 17th Place. He also noted
that due tD a discovery that the frontage on Talbot Road S. is of sufficient width to
meet ordinance requirements , dismissal of the variance without prejudice is recommended.
However, because the applicant has not applied for a waiver of off-site improvements , a
vacation of S. 17th Place may be desired to eliminate that requirement , or a deferral
may be granted for a specific period of time by the Board of Public Works .
The Examiner inquired regarding provision of sewer facilities . Mr. Blaylock advised that
because the property drops off steeply to the northeast, extension of service to the
north wouli be required or a pump station installed. In the front portion of Lot 2,
gravity service can be intercepted.
The Examiner requested testimony by the applicant. Responding was :

Mr. McKidd' discussed the proposed vacation, inquiring regarding segregation of property
and purchase agreements . Mr. Blaylock indicated his understanding that two-thirds of
abutting property owners must agree to the vacation; however , the applicant may wish to
enter into a private agreement to purchase the entire property from other owners. The
Examiner irformed the applicant that the City Council is the appropriate body to review
street vacations , as such action does not fall within the Examiner's jurisdiction. He
also inquired whether Mr. Halsen wishes to proceed with the short plat request with or
without approval of the street vacation. Mr. McKiddy advised the applicant 's intent to
proceed.

I11Mr. McKid y also advised the applicant's intent to pursue future subdivision of the
remainder of the property; however, because of steep topography on the site and
difficult es created by construction of SR-515 which interfered with the natural
drainage attern, provision of full utilities services will be difficult. The Examiner
noted tha the matter should be taken up with the State Department of Transportation.
Additionally, future development would be subject to City of Renton codes and the
King County Board of Health regulations.
Respondi g to the Examiner's inquiry regarding potential access to the third lot when
created, Mr. McKiddy stated that if S. 17th Place is vacated and the full 30-foot access
is acqui ed, it is feasible that a private road easement or pipestem could be provided
in that ocation. Mr. Blaylock noted that in the event the street vacation is not
granted, the applicant may wish to apply for a waiver of off-site improvements on S.
17th Place which may affect future subdivision of property.
The Examiner noted for the record that no other parties were in attendance to speak
either in support or opposition to the proposal . The hearing was then closed at 9:27 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
I
1 . The applicant, Bob Halsen, filed a request for approval of a two lot short plat
tog ther with a variance to permit establishment of a lot with less than the required
wid h.
2. The application file containing the application, SEPA documentation, the Building
an Zoning Department report, and other pertinent documents was entered into the
re ord as Exhibit #1 .
3. Pu suant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 , RCW 43.21C, as amended, the subject proposal has been determined
ex mpt from the threshold determination by the Environmental Review Committee (ERC) ,
re ponsible official .
4. PI ns for the proposal have been reviewed by all city departments affected by the
im act of this development.
5. The subject property is located at 1718 Talbot Road S. immediately south of S. 17th
Place. The right-of-way for SR-515 is located immediately east of the subject site.
6. T e subject site slopes downward from west to east. The east quadrant of the lot is
s fficiently below the grade of Talbot Road S. so that the rear portion of the lot
c nnot be served by the sewer lines along Talbot Road S.
7. Ah existing single family home is located on the southern half of the subject site.
A new dwelling is proposed for the northern portion of the subject site if the
subdivision is approved.

8. he subject site is within one and one-half miles of the furthest school which would
erve the site, Renton High School .
9. he subject site is zoned R-1 (Single Family Residential ; Minimum lot size - 7,200
quare feet) . The site was annexed into the city in May of 1956 by Ordinance No.
547. The site was reclassified from GS-1 (General Single Family Residential ; Minimum
of size - 35,000 square feet) to SR-1 in May of 1981 by Ordinance No. 3534. A
edefinition of zones in 1982 classified the site R-1 . A three lot short plat was
ismissed at the applicant 's request in March of 1982.
10. 1'he subject site is approximately 37,897 square feet in area. The applicant proposes
creating two lots with areas of approximately 16,584 square feet (Lot 1) and 20,296
square feet (Lot 2) , respectively. Each of the lots would have frontage on Talbot
Road South. Lot 2 would be a dog-legged lot approximately 63 feet wide along Talbot
Road South and approximately 145 feet wide at the rear eastern property line. Under
the definition of lot width contained within the Subdivision Code (Section 9-1102(8) (D))
the lot width exceeds the minimum 85 feet required by the Zoning Code. This provision
permits the averaging of width for irregular shaped lots.
Under this provision, a variance is no longer necessary and the request is dismissed.

11 . Questions of street vacation of 17th Place S. as well as the taking by the state of
property for the SR-515 right-of-way have no bearing on the subdvision request except
as insofar as the lot size of proposed Lot 2 may increase if a vacation is approved.

Similarly, the further division of proposed Lot 2 at some future date will be
processed under the prevailing ordinances at that time.
CONCLUSIONS:
1 . The proposed short plat appears to serve the public use and interest. The proposal
is compatible with the Comprehensive Plan which designates the area for single
family uses. The two lots are also consistent with the zoning which permits lots of
at least 7,200 square feet for single family uses .
2. The subdivision will create an additional in-city lot for the development of residential
uses . The site is located near schools and parks and will provide the necessary
resi .ential amenities .
3. The ',ite can be served by sewer and water service from the city for the two proposed
residences .
4. The applicant had not requested a waiver of the required off-site improvements , and
therefore they must be installed. Improvements will be required for both Talbot
Road S. and S. 17th Place. A vacation by Council order of the latter street would
obviate the need for improvements . The applicant may also seek deferrals of required
improvements from the Board of Public Works.
5. Since the variance was not necessary, the fee collected for same should be refunded.
DECISION:
The short plat is approved.

Pursuant to Title IV , Section 3015 of the City 's Code, request for reconsideration must

decision cf the Examiner is based on erroneous procedure , errors of law or fact , error in
judgment, or the discovery of new evidence which could not be reasonably available at the
prior hearing may make a written request for review by the Examiner within fourteen (14)
days from the date of the Examiner's decision. This request shall set forth the specific
errors relied upon by such appellant, and the Examiner may, after review of the record,
take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting

The applicant Bob Halsen finds it necessary that the Lot
Width Variance applied for be approved in order so he may
receive approval for the proposed s'iort plat application
submitted.
Do to the configuration of the subject property and with
