Dear Mr. Hastings:
I have reviewed the record in the above entitled matter and find that the matter must be
dismis:3ed as improvidently advertised with a legal description of a lot which does not
legally exist at this time.
The record discloses that while lot lines may be adjusted, they must follow the criteria
outlined in Sections 9-1102(19) and 9-1104(5)(A) and (B). These provisions require that the
adjustment create or maintain conforming lots, and further that the lots meet other
criteria. Under these circumstances the adjustment fails doubly. The adjustment has
created a non-conforming rear yard and the lot dimensions fail to satisfy Section
9-110E,(23)(F)(3)(a) which provides that lot length not exceed lot width by more than two
and one-half (2-1/2) times. The northern lot is approximately 100 feet wide by
approximately 398.56 feet wide, for a width to length ratio of 1 to 3.99.
To further complicate the matter, the adjustment, whether legal or not, was not
recorded. Therefore, the lot which was the subject of the subdivision request did not
legally exist at the time the legal notices were issued and is not the proper subject of a
public hearing.
The matter is therefore dismissed this date.

C. HISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinance #1822, of March 22, 1960,
at which time it was zoned G-7200. This zoning classification was changed to the
R-1 designation with the adoption of the new zoning map by Ordinance #3634 of
June 13, 1982.
D. PHYSICAL BACKGROUND:
1. Topography: The subject site slopes from the northern boundary along NE
27th Street to the south at about 2 to 15 percent. Proposed lots #1 and #2
slope at a faster rate than lots #3 and #4, which are fairly level.
2. Soils: The subject site consists of Indianola Loamy Fine Sand (InC). This is a
soil type in which permeability is rapid; the available water capacity is
moderate; runoff is slow to medium; and the erosion hazard is slight to
moderate. The soil is suitable for timber and urban development.

3. Vegetation: The site is generally covered with heavy natural vegetation
except for the area immediately surrounding the house on proposed lot #3.
4. Wildlife: The abundant natural vegetation provides suitable habitat for small
mammals and birds.
5. Water: No surface water was observed.
6.Land Use: The subject site is generally undeveloped. There is an existing
vacant single family residence.
E. IGHBORHOOD CHARACTERISTICS:
1 e neighborhood is primarily established single family residential with a few
t acts of undeveloped property.
F. P BLIC SERVICES:
1. Water and Sewer: An eight-inch water line extends along NE 27th Street
adjacent to the subject site. An eight-inch sanitary sewer line extends along
NE 27th Street adjacent to the subject site.
2.Fire Protection: Provided by the City of Renton as per ordinance
requirements.
3. Transit: METRO Transit Routes #142 and #144 operate along NE 27th Street
adjacent to the subject site.
4.Schools: Kennydale Elementary School is located 600 feet southeast of the
subject site. McKnight Middle School is approximately .3 of a mile to the
southeast and Renton High School is approximately .9 of a mile southwest of
the subject site.
5.Recreation: Kennydale Lions Park is approximately 175 feet south and Gene
Coulon Memorial Beach Park is approximately .3 of a mile southwest of the
subject site.

I.IMPACT ON THE NATURAL OR HUMAN ENVIRONMENT:
1. Natural Systems: Minor. Vegetation will be reduced. Runoff will increase
slightly.
2. Population/Employment: Minor. Construction of four (4) single family
residences would increase the area population by approximately ten (10)
persons.
3.Schools: Minor. The four (4) single family residences would result in the
addition of one (1) student to the schools in the vicinity.
4. Social: Minor.
5. Traffic: The development of four (4) single family residences would result in
approximately forty (40) average daily trips (10 trips/dwelling unit) on NE
27th Street.

J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton's Environmental Ordinance and the State
Environmental Policy Act of 1971, as amended, RCW 43-21C, the subject proposal
is exempt from the threshold determination of environmental significance.
K. AGENCIES/DEPARTMENTS CONTACTED:

4.City of Renton Utilities Engineering Division.
5.City of Renton Fire Prevention Bureau.
6.City of Renton Policy Development Department.

L. :DEPARTMENT ANALYSIS:
1.The applicant is seeking a 4-lot residential short plat of a 1.3 acre parcel
located at 2201 N.E. 27th Street.
The proposal complies with the Comprehensive Plan designation of low
density, single family and the zoning classification of R-1, residential use.
3. The only issue to arise from the staff has been the question of the legal
segregation of the subject property from lots #240 and #237.
1. The Building and Zoning Department granted preliminary approval of a lot
line adjustment between lots #240 and #237, (LLA-009-83). Approval was
granted on June 28, 1983, by the Building and Zoning Department subject to
the filing of a record of survey. The boundary line adjustment generally
followed a difference in contours between N.E. 27th Street and the property
to the south. Development of that subject property would eventually be from
Aberdeen Avenue N.F,., which is located to the west.
5. With the submission of the short plat, it was discovered that the existing
single family residence located on proposed lot #3 would not conform with
the setback requirements of the R-• 1 zone. Therefore, the applicant has
agreed to remove the house in question at the time of the sale of lot #3. This
is not sufficient to meet the demands of the Subdivision and Zoning Codes,
and the residence must be demolished prior to the filing of the final short
plat with King County.
6. All of the off-site improvements along N.E. 27th Street have been installed
including curbs, gutters, sidewalks, and street lighting. Extension of
necessary stormwater sewers and water and sewer lines will be required to
the subject parcels.
7. The Utilities Division of the Public Works Department advises that both
special assessment area charges are applicable for water and sewer.
8. The lots as proposed comply with the minimum requirements for lot width
and square footage in the R-1 zone.
9. The subject site is heavily wooded, and care should be taken to prevent
clear-cutting of the site. In fact, restrictive covenants should be placed upon
the property requiring retention of any tree over 12 inches in size with the
approval of the City of Renton before removal.

M. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that the short plat request by
Mr. T. C. Hastings, file Short Plat 050-83 be approved subject to the following
conditions:
1. Filing of the record of survey for the lot line adjustment, file LLA-009-83.
2. Removal of the existing single family residence on proposed lot #3 prior to
the filing of the record of survey for the lot line adjustment.
3. The filing of restrictive covenants on the subject parcel limiting the removal
of natural vegetation of any trees over 12 inches in caliper. The City of
Renton's landscape architect must grant approval prior to removal.

plat approval, as required by the City. The property is being
sold subject to final plat approval, and when we have a sale
on the lot we will apply for a demolition permit and remove
the house.
