SUBJECT: Nu Dawn Site, R-058-83 ; South 55th & Talbot Road
Based upon the "Greenbelt"designation on the City' s comprehensive
plan that incorporates a portion of this site, it falls under
Section 4-2828, Environmentally Sensitive Areas of the Building
Regulations.
Pursuant to Ordinance No. 3891, such environmentally sensitive
areas as greenbelt designated in the Comprehensive Plan,
conservancy and natural environments of the Shoreline Master
Program and the 100 year floodway on the FEMA maps are not
categorically exempt under WAC 197-11-800 and are thereby required
to prepare an environmental checklist and go through the
environmental threshold determination process.
Since the owner of this site or their agents have not submitted an
environmental checklist and there is evidence that the site may
provide habitat for Great Blue Heron and other potentially rare or
species of special concern" , etc. it might be prudent to issue a
Stop Work order on the site until we can meet with the concerned
Ps and ensure that all necessary prerequisites to tree cutting
ave e n meet.

Re: City of Renton Wetlands Study
Dear Mr. Williams.
As per our telephone conversation in early May, I am sending along my written
comments on the discussion of the Springbrook wetland that appears in the City
of Renton study. These comments are based on a visit I made to the site in
May 1981. While my visit to the site was brief and not comprehensive, the
portion of the area that I saw is different than is suggested by the descrip-
tion on page 12 of Appendix II. As we discussed over the phone, the area
could probably be divided into two areas which would distinguish between the
recently logged area and the relatively undisturbed swamp along SR 167.
My comments focus primarily on the relatively undisturbed portion of the site.
The following is my opinion on several characteristics of the Springbrook
wetland and the mixed forest swamp wetland type.
Diversity. The mixed forest swamp often contains a greater diversity
than other wetland types, such as the freshwater marshes and swamps of
the Green River Valley. During my brief visit I counted 23 plant spe-
cies (5 overstory, 7 midstory, 11 understory) in a relatively small por-
tion of the wetland, and certainly many more exist.
Wildlife habitat. Unfortunately, a discussion of wildlife habitat
value must be general in nature since specific information can be gen-
erated only in a more comprehensive study. The evaluation in your report
suggests middling values for wildlife diversity. While it is true that
there is not a wide variety of community types which creates an edge
condition and habitat diversity in a horizontal spectrum, the structural
complexity in a vertical plane, and the overall vegetation diversity, may
support a diverse wildlife community. Coniferous trees and snags, a
large deciduous overstory, and a diverse midstory and understory provide
numerous resources for wildlife.
Uniqueness. The mixed forest swamp habitat type is probably an example
of what may have been a much more common habitat type historically in the
region. However, very little of this habitat type remains in the devel-
oped central Puget Sound area. No other examples of this habitat type
remain in the Green River Valley with the exception of the area adjacent
to the Springbrook wetland west of SR 167, in the city of Kent. While a
portion of the site has been logged, much of the site seems to have
escaped such alterations for many years.

Cultural values. I find the mixed forest swamp ,to be one of the most
aesthetically pleasing wetland types for the following reasons: (1)
the great diversity of plant life, (2) the mix of tall evergreen trees
and snags that exceed the prevailing canopy which adds contrast to :deci-
duous vegetation, and (3) the age of this wetland type and the knowledge
that it may be an uncommon vestige that has escaped human disturbance
for many years.
Further investigation of this wetland area may provide definite information
on some of the points discussed above. For analysis and planning purposes,
a subdivision of the area into two parcels may be appropriate.
Thank you for the opportunity to comment on the Springbrook wetland area and
the wetlands report of your office. I hope you will consider these comments
on the general nature of the Springbrook wetland in your planning efforts.

1. Road improvement, water mains and fire hydrant installation is required prior
to issuance of building permits.

1. The proposed building separation in almost the entire area is five feet. If
this is accepted as final, then all buildings in the complex area separated
by less than 10 feet, will be treated as a single building with regard to

was in place. Since your project has been pending for over three years and given the City

Dear Mr. Depner:
On October 5, 1933, the Environmental Review Committee met and issued a final
declaration of significance for the above referenced project as presented. The
Committee determined that there were significant impacts requiring detailed information
in e',ght identified areas.
These eight areas of concern are:
1. Traffic/circulation
2. Storm water drainage
3. Natural areas/wetlands
4. Emergency access
5. Aesthetics
6. Recreation
7. Impact on adjacent properties
8. Public services and utilities
TF'AFFIC/CIRC ULATION:
The proposal will generate approximately 1,500 additional vehicle trips. Based
upon the present traffic circulation in the area, almost all of these trips will
impact the S.W. 43rd Street corridor which services the medical facilities around
Valley General Hospital. This corridor has been specifically identified in numerous
land use applications within the last three years as one of a critical land use
constraint. In fact, the City attempted the formation of an LID to mitigate the
traffic corridor problems. This project will add all of its trips onto the weak leg of
that primary intersection of S.W. 43rd Street and Talbot Road S. A detailed traffic
evaluation needs to be done to determine what modifications will be necessary as a
result of this project upon that corridor.

In addition, the project is nearly 1,200 feet south of the most recent improvements
to Talbot Road S. A major traffic question is whether Talbot Road S. in its present
condition has the capacity to meet the needs of the proposed project.
The third point that should be addressed in the traffic analysis would be the
consideration of a north/south street approximately half way through the property
to relieve traffic off of Talbot Road S. Talbot Road S. will eventually become a
major collector and consideration should be given to internal circulation to the
north of the subject property.
STOF.M WATER DRAINAGE:
The subject site is located within the Panther Creek Storm Water Drainage Basin.
Panther Creek has been identified on the Comprehensive Plan as a greenbelt area
and also in the wetlands study for the City of Renton. A detailed downstream
drainage analysis needs to be done to determine whether there are positive outfalls
sufficient to handle the modification in use. Panther Creek drains part of the
Eastside Watershed. Presently, because of inadequate storm water retention and
discharge designs, the Green River Valley floor is severely limited by
development. The City of Renton began construction of Phase I of the P-1
Channel which will eventually drain the storm water basin. Panther Creek is a
dynamic part of that entire storm water basin and must be evaluated in
relationship to downstream drainage.
NATURAL AREAS - WETLANDS:
The wetlands, as presented in the Reconnaisance Study, appear to show that
approximately half of the subject site is considered a wetland. The applicant needs
to show in their evaluation, a specific vegetational evaluation of the subject site to
determine what are actual wetlands at the present time. In turn, the impact
evaluation will consider any positive or negative effects upon that wetland. This
area has been clearly designated as a greenbelt area since 1965 by the
Comprehensive Plan of the City of Renton. The wetlands study should also
evaluate the animals present on the site and determine what impacts are
anticipated.
EMERGENCY ACCESS:
Emergency access can be considered in two respects for the project. The first is
access to the site in general and the second is specific access to individual units.
The site is very close to the medical facilities at Valley General Hospital.
However, it is more than two miles away from the nearest fire station and there is
a concern with immediate response time for fire protection. In addition, it is the
farthest southern limit of the City of Renton and normal police protection would
have to be substantially extended.

Zero side yard concept creates some specific concerns in relationship to emergency
access. Fire separation and protection and the ability to fight fires because of the
closeness of the buildings to one another, along with police accessability and
visibility from the streets, creates a potential problem for emergency services.
The City of Renton has not previously used the zero lot line configuration and
general concerns must be addressed as to possible changes in procedures for both
the fire and the police departments.
AESTHETICS:
It would appear as a result of the very close nature of the units proposed on the
site that the site will have to be completely stripped of all vegetation. The site
plan does not allow any flexibility to save groupings of trees. The end result would
be a completely developed parcel up to a greenbelt and the transition would be
dramatic. While maximizing the land use potential of the property, the architect
has cleverly utilized angles and staggered buildings to reduce the concept of row
housing. This can be considered an aesthetic plus and should be so discussed in the
EIS.
RECREATION:
The closest city park is more than two miles away on Talbot Hill. On-site
recreation seems to be severely lacking, and no assurances are given by the
developer to participate in general public improvements or off-site recreational
facilities. In comparison, the City of Renton recently approved a mobile home
park and required that active on-site recreational areas be provided. A
recreational study should be conducted based upon the potential demographic
trends as a result of market for the proposed project. Recreation should be
anticipated to be phased, along with the phasing of the project.
IMPACT ON ADJACENT PROPERTIES:
Since Nu-Dawn is the first major development in this area, it is faced with a test
of adequately buffering adjacent land uses. The project proposal assumes that the
entire property would be zoned to a residential classification. The Comprehensive
Plan clearly shows that a large portion of the subject site is designated greenbelt
with questionable residential value. If 18 acres was determined to be greenbelt,
the remaining 31 acres would only have a development potential of approximately
180 to 190 units. This, of course, would create a different impact upon the
adjacent properties. The effect of both the intensity and the design of the proposal
should be evaluated as to impact on the adjacent properties.

PUBLIC SERVICES AND UTILITIES:
This category overlaps into some of the previous concerns dealing with roads,
storm water drainage and emergency access. In this case, we are specifically
looking at the ability of the City to provide water surface and sanitary sewers.
Even though the City has a major water transmission line immediately adjacent to
the subject site, there is a question whether direct connections can be made to that
or whether a water main would have to be extended from the north off of the
reservoir. Even though the subject site is in the Cascade Sewer District, the City
of Renton may attempt to gain control over the physical system itself.
Additionally, there may be questions of whether these lines operated by Cascade
Sewer District have capacity for the actual development.
The Environmental Review Committee, after considering all of the questions raised in the
above items, determined that an impact statement was necessary. However, the state
law now allows cities to scope a project instead of having to address all of the items one
by one as presented in previous impact statements. Under these procedures, the specific
scope of the EIS statement can be determined within a 30-day period. Our normal
procedure in the past has been to sit down will the appropriate consultant preparing the
EIS ;;tatement and scope out the work. The applicant generally submits a list of
consultants that would be acceptable to him and to the city. The city is not concerned
with the issue of cost, but only with the quality of the end product and the qualifications
of the consulting firm.
Please be aware that the declaration of significance was issued on October 5, 1983, with
publication on October 10th, with an appeal date of October 24, 1983. The applicant has
the rights of appeal under city ordinance to the Land Use Hearing Examiner. At that
point, the burden of proof is upon the developer to show that there are not significant
impacts and that an impact statement is not required.

GENERAL
1. Road improvement, water mains and fire hydrant installation is required prior
to issuance of building permits.
PHASE I, II & III
1. The proposed building separation in almost the entire area is five feet. If
this is accepted as final, then all buildings in the complex area separated
by less than 10 feet, will be treated as a single building with regard to
Required Fire Flow" as established by I.S.O. standards.
2. The building separation also poses a problem from an acceptable access for fire
fighting and exposure protection under the fire code. If plans are to be approved,
fire sprinklers are required to be installed per N.F.P.A. #13D•

Dear Roger:
I am writing this letter on behalf of Bud Tynes of Nu-Dawn Homes. He
indicates to me that you transmitted to him a letter requesting a
schedule for moving this project through to completion.
As you will recall from our discussions during our meeting on December
II , we are basically going back and replanning the site in an attempt to
respond to concerns that have been raised by Staff with regard to this
project. Once we have completed that, we intend to do a cost analysis,
submit a revised site plan to the City for review and comment, move
forward through the environmental review based on the new site plan and
the Staff comments; upon completion of that, move back into the public
hearings. We would anticipate that the plan would probably be completed
and ready for submission to the City in late January.
Once the City has completed their review and made their comments, we
would commence work on the environmental issues and once those are
complete and submitted, which would take several months, we would be in
a position to circulate the revised plan and "scoped" checklist for
comment. We would anticipate that we probably would not be ready to go
back into hearings until mid to late 1986, depending on the types of
concerns that the City have and the time it takes to get through the
process.

We have been reviewing pending land use applications, including the above-referenced
NU--Dawn Project, to determine whether or not the applications should be dismissed. A
review of the file shows that we have not had any correspondence with your company
since April, 1984. In a recent phone conversation (August 23, 1985), you indicated an
interest in completing the applications.
The Environmental Review Committee issued a declaration of significance for the
pro sect. The reasons for the declaration were outlined in letter dated October 13, 1983.
which was sent to Robert Depner. I have attached a copy for your review. As you are
aware, state law has changed with respect to the requirement for an Environmental
Imp act Statement. The new scoping process requires an applicant to address only the
areas of concern. I would like to meet with you as soon as possible to discuss the scoping
process and the timing for completing the NU-Dawn application. Due to the amount of
tirr e this project has been pending, I would like your company to respond by October 4,
19E15. If not, we will ask for dismissal of the application.

This letter is to follow up on our brief conversation of April 3, 1984,
regarding the possible formation of a U.L.I.D. by Valley General Hospital,
One Valley Place, and the City of Renton to solve the traffic problems
at the above intersection. As discussed, the City of Renton would recover
their portion of this proposed U.L.I.D. by passing on to developers, in
that area, a pro-rata portion, based on the traffic impact to that inter-
section, a fee or assessment at the permit stage.
We want you to know that we would definitely support such a proposal and
see it as a viable solution to a long standing problem.
We also want you to know that we would proceed immediately with our devel-
opment at 192nd and Talbot Rd. and would start construction on the first
phase as soon as all approvals were received and permits were available.
The remaining phases would be developed as soon as the market would allow
us to proceed.

highly concerned about the proposed Nu-Dawn development
yaat ^4- at the site of the Great Blue Heron rookery located

An environmental study should be required for this
rezone. There are few Great Blue Heron nesting sites
left in the Puget Sound area and they are a resource
that must be protected. Also, Rainier Audubon would
like to officially comment on the environmental study
submitted by the developer.

Dear Mr. Blaylock:
After visiting the site northwest of Talbot Road and 192nd S.E. on
December 7 , 1983 and talking to concerned citizens about the timing and
activities of Great Blue Herons on site from February through July,
I think there is a high probability that herons are nesting there.
Federal Aviation Administration regulations prohibit low-level flying
over the congested area without extensive paperwork, equipment and
pilot certifications, and ground visits by FFA personnel; therefore, I
cannot fly that area to verify the presence or absence of nests in
large conifer trees.
I suggest that the developer be required to hire an environmental con-
sultant to study Great Blue Heron nesting on site during the nesting
period (February 1-July) to verify the presence or absence of herons
nesting there, locate nest trees, and develop a management plan to
preserve those trees and the continued reproductive success on site.
Birds, nests, and therefore nest trees are protected by state laws
Regulatory Code of Washington 77.16.120 Taking of Protected
Wildlife--Destruction of Nest or Eggs; Washington Administrative Code
232-12-011 Wildlife Classified as Protected Wildlife; Regulatory Code
of Washington 77.18.010 Definitions (19)--"Protected wildlife" means
wildlife disignated by rule of the Commission that shall not be hunted
or fished. ) Additionally, I suggest that the status of cavity nesting
birds (Pileated Woodpecker, etc. ) , raccoon and other wildlife on site
be evaluated.
This study should be performed before any clearing and/or development
should proceed on site. Also, if Great Blue Herons are in fact nesting
there, no construction and/or clearing should be allowed within 1/8
mile of a nest during the nesting season to prevent nesting failure or
abandonment of eggs or chicks.

Dear Mr. Kauffman:
We are negative to rezoning 48.92 acres of property (NW corner of
Talbot Road and South 55th St) from G-1 to R-1 and for approval of
a single , duplex and multi-family housing complex totaling 242 units
The land on Talbot Road near the hospital is zoned for multiple
housing. It seems appropriate to wait and see if these multiple
housing units will be occupied and what impact that they will have
on traffic and the surrounding area. An additional 242 units will
do nothing except creat congestion on Talbot Road and 43rd Street.
If it is necessary to have more land zoned multiple housing (which
we do not believe it is) it seems appropriate to work in an orderly
manner out from the hospital rather than have multiple housing at the
hospital end of Talbot Road---then single family housing----and then
to have multiple housing again which this rezone suggests .
We feel that it is not appropriate to rezone this is a manner which
allows multiple housing.

Dear Mr. Blaylock:
My firm and Williams-Roth & Associates, Inc. (consulting engineers) have
been retained by Nu Dawn Homes to design their 50 acre piece of property on
the N.W. corner of Talbot and 192nd.
This property is heavily treed and has substantial grade changes culminating
in a low area along the freeway. In order to design these sensitive condi-
tions in a prudent manner it is necessary that we have accurate survey data.
With the large area of the subject property and with the dense brush and
tree growth present, hand clearing transit lines is impractical . Therefore
we are going to use a small cat to clear 3 or 4 sight-lines across the property
at varying angles.
This letter is for your records and to notify you that said activity is not
a major site clearing operation. With the survey data obtained, we will be
proceeding with design processing through your departments in accordance with
your rules and regulations before any improvements are made on the subject
property.
I thank you for your attention to this matter and look forward to our mutual

this property' s last classification;
1. 2000 feet to the north (also between Talbot Road and the freeway)
a similar piece of topography (17.19 acres) was recently rezoned
from G (general single family residential-minimum lot size-35,000
sq. ft. ) to an R-2 density coupled with P.U.D. documentation and
other conditions. That project resulted in an actual unit count
of 325 multi-family residences with an over-all density of 18.9
units per acre (versus this application' s request for 4.92 units
per acre) .
2. Immediately across the street from NuDawn' s property (N.E. corner
of Talbot Road and 192nd) a 4.35 acre tract of land has been re-
zoned from G-1 to R-1 allowing for 6 units per acre density
versus this application' s request for 4. 92 units per acre) .
3. The problems of increased traffic loads to Talbot Road over
recent years have been studied extensively since this property's
last classification. As a result of these detailed studies, the
City, new developments in the neighborhood and the neighborhood
itself, have all arrived at substantial concurrence on improve-
ments to be made to Talbot Road. These improvements also con-
centrate on the connection(s) necessary for the Talbot Road/43rd
intersection with that of the on and off ramps to the Valley
Freeway.
In conclusion, the rezoning of this property is justified in not one, but
all (3) circumstances listed within Renton' s Building Regulations.

JUSTIFICATION FOR THE REZONE .
An R-1 single family residential P.U.D. by NuDawn Homes on 40 acres at Talbot
Rd. and 192nd)
Per the Building Regulations of Renton, certain circumstances need to be esta-
blished in order to justify a decision for rezoning. They include any of the
following:
a) That substantial evidence was presented demonstrating the
subject reclassification appears not to have been specifically
considered at the time of the last area land use analysis and
area zoning.
Pertaining to this item; it is a fact that the owners of NuDawn Homes have
owned the property for sometime without having a definite intent as to its
development. During the last land use analysis by the City, no specific in-
tent was presented by these owners and therefore no specific consideration
except the surrounding and the existing vacant land use) could be made by the
City.
b) That the property is potentially classified for the proposed zone
being requested pursuant to the policies set forth in the Compre-
hensive Plan and conditions have been met which would indicate
the change is appropriate.
Pertaining to this item; the Comprehensive Plan does encourage single family
residential development on this site. Due to the property's vacant nature
over the years, specific types of single family development have not been
explored in close consideration with topography, drainage, utility servicing
and flora and fauna existence, i .e. , insufficient evidence has been available
to determine how this property can best be used to serve the single family
character of the actual property as well as the neighborhood and community.
The new circumstance is that considerable survey and design work have been
gathered to show that the goals and policies of the Renton Planning Department
and the Comprehensive Plan can be maintained for this 49 acre piece of property.
Documentation of these newly established circumstances are included and guar-
anteed via the P.U.D. application and documentation being processed as part
and parcel of this rezone.
c) That since the last previous land use analysis of the area zoning
of the subject property, authorized public improvements, permitted
private development or other circumstances affecting the subject
property have undergone significant and material change.
Pertaining to this item; the greatest divergence this rezone would have from
the existing zone of G-1 is that of density (not land use which may be single
