SUBJECT: DEVELOPMENT OF TRACT 'B' OF SPRINGBROOK TECHNICAL CENTER
The ERC conditions at the time of plat approval required the dedication and construction
of Oakesdale Avenue (2 lanes) along the west side of Tract 'B' from S.W. Seventh Street
to S.W. Grady Way prior to the development of Tract 'B'. Development of the parcels
adjacent to Tract 'B' by First City Equities and Holvick, deRegt and Koering (HDK) have
been short of parking spaces on existing lots. In order to accommodate proposed parking,
lot line adjustments have been approved in which a portion of Tract 'B' is added to the
adjacent lots. These lot line adjustments for parking lot areas raised the question of
whether Oakesdale needed to be constructed.
On October 30, 1985. the ERC upon review of a new traffic analysis determined that "...
parking lots can be constructed on Parcel B without the implementation of the condition
to construct Oakesdale Avenue. This interpretation does not include the construction of

CORRESPONDENCE Building and Zoning Department recommended denial of request from

Waiver of Buildings #3, 12, 13 and 14 of the Springbrook Technical Center in
Community exchange for dedication to the city of 17 acres for storm water detention
Facilities basins (13 of which are zoned Manufacturing Park designation) , for a
Charge - HDK market value claimed in excess of $2 million. Moved by Hughes, seconded
by Stredicke, Council concur in the recommendation of the Building and
Zoning Department. Substitute motion: MOVED BY FOCKHILL, SECONDED BY

OLD BUSINESS Mayor Shinpoch distributed status reports to each Councilman regarding

at last Council meeting .
Holvick deRegt Having received new information regarding the request of Holvick deRegt
Koering Request Koering and having voted on the prevailing side, Councilman Stredicke
for Waiver felt the matter should be reconsidered. MOVED BY STREDICKE, SECONDED
BY HUGHES, TO RECONSIDER THE VOTE ON THE MOTION TO TABLE MATTER OF HDK' s
REQUEST FOR WAIVER OF COMMUNITY FACILITIES CHARGE. CARRIED .
Administrative Assistant Michael Parness stated that due to complexity
of the matter, referral to a Council committee for discussion would be
preferable. SUBSTITUTE MOTION BY STREDICKE, SECONDED BY HUGHES, REFER
THE MATTER TO THE PLANNING & DEVELOPMENT COMMITTEE FOR RECOMMENDATION.
Rockhill reported several week delay before the matter could be scheduled
for discussion. MOTION CARRIED.
Planning and Planning and Development Committee Chairman Rockhill presented a report
Development recommending the following amendments to the Subdivision Ordinance be
Committee enacted: 1 ) that preliminary plat approval be effective for three years
Subdivision with one year extension available; 2) additional notice of subdivision
Ordinance applications be provided a) in not less than five locations on or
Revisions adjacent to the parcel in question with discretion for requirement of
additional postings for larger parcels ; and b) delivery of the notice of
hearing by ordinary mail to property owners within 300 feet of the
proposed subdivision with specific requirements for such mailings.
The report further recommended referral to the Ways and Means Committee
for legislation and setting of a public hearing for April 4, 1983 to
review the matter. For the record , Chairman Rockhill stated that
although the committee report has been signed by two members and read
into the record, the official vote on the recommendation should be
held until after the public hearing. Therefore, it was MOVED BY
ROCKHILL, SECONDED BY TRIMM, COUNCIL ADOPT THE PORTION OF THE COMMITTEE
REPORT WHICH RECOMMENDS SETTING A PUBLIC HEARING FOR APRIL 4, 1983 TO
CONSIDER THE MATTER. CARRIED.

PROCLAMATION A proclamation by Mayor Shinpoch endorsed efforts of Renton Chapter of
Anti-Shoplifting DECA (Distributive Education Club) of Renton High School in its
83 Campaign Anti-shoplifting '83 Campaign to make citizens and business community
aware that shoplifting is harmful to our economy; and urged consumers ,
retailers, law enforcement officials, and courts to treat shoplifting
as a crime which will not be tolerated. The proclamation was accepted
by club members Lynette Buckmier, Mari Shudshift, Joey Hodgson, Mark Carve
and Tim Evans.
PUBLIC HEARING This being the date set and proper notices having been posted and
Amendment to published according to law, Mayor Barbara Shinpoch opened the public
1983-1988 Six hearing to consider an amendment to the 1983-1988 Six Year Transportation
Year Improvement Program for installation of traffic interconnect from N. 6th
Transportation Street to Sunset Boulevard N.E. along Park Avenue N. Also being
Improvement considered were revisions to the 1983 Street Overlay List. Public Works
Program Director Richard Houghton explained project previously included in
original improvement program under "Controller Modernization" project
8; however, Department of Transportation State Aid has requested
separate identification for the project for which a federal grant of
91 ,300 has been received to be matched with city funds totaling $18,700.
Continued Discussion then addressed deletions and additions to previously adopted
1983 Street Overlay List as follows: Kennewick Avenue N. E. between N.E.
14th and N. E. 16th deleted since future sewer project will require
associated street improvements; N. 1st Street deleted since major
improvement required rather than just overlay; Williams Avenue S. between
S. 4th and Grady Way added; Jones Avenue N.E. between N.E. 20th Street
and 700 feet north of N.E. 24th Street added; and N.E . 22nd Street between
Edmonds Avenue N. E. and dead-end street added. Councilman Stredicke
raised concern regarding addition of latter item, noting limited number
of residences served on a dead-end street. Houghton discussed potential
to serve larger area by street improvement; and advised Council that overlay
list does not necessarily reflect city' s priorities, but, rather, groups
projects by general location for economic reasons. Councilman Stredicke
compared condition of Renton streets favorably to state highways between
Renton and Olympia. MOVED BY TRIMM, SECONDED BY ROCKHILL, CLOSE THE
PUBLIC HEARING. CARRIED. MOVED BY TRIMM, SECONDED BY HUGHES, COUNCIL

Holvick deRegt Koering is requesting waiver of the community facilities charge for Bldgs . #3 ,
12 , 13, and 14 of the Springbrook Technical Center in exchange for dedication to the city of

While the ordinance establishing community facility charges has been repealed (action
necessitated by change in state law) , the fees in contention were applied during the period
the ordinance was in full force and effect. Staff recommendation : Denial of request.

We have reviewed my original memorandum which was submitted to you
on February 16, 1983. The staff consolidated thoughts and recozarenda-
tions to present to you and the Council. Richard Houghton, Public Works
Director, 'like Parness and myself then discussed all comments and the
following conclusions were reached:
1. The dedication of the seventeen acres for the P-1
holdinc pond was an rnvircnmental Review Committee
condition. The Fearing Examiner reaffirmed this in
his findings and conclusions with no appeal received
on either decision.
2. The two issues of dedication ner Environmental Review
Committee and the Community Facility Charge are two
separate issues and should not be tied together.
RECOMMENDATION: Denial of request.

SUBJECT: Ordinance #3547 Establishing the Community Facility
Charge and the Request by Holvick deRegt & Koering
to Waive Charges.
The subject ordinance went into effect on June 28, 1981. Due to
legislation at the state level, the ordinance was terminated on
June 30, 1982. Those applications received during that time period
continued to be affected by the ordinance and fees imposed accord-
ingly. Those fees can be found in Section VI of Ordinance #3547.
Holvick, deRegt & Koering (HDK) has requested those charges be waived
in lieu of their dedication of lands for storm water detention basins.
See attached letter from HDK)
The method of consideration for a request such as this is outlined
in Section XIV of the subject ordinance. (See attached)
Replies from other departments are as follows:

1. The ordinance does have a section in it (Section XIV)
which allows for dedication in lieu of charge. In this
case, I believe the dedication to be substantial and
would go along with that in lieu of the charges.
2. The dedication does not, however, affect payment of any
other charges levied by the ERC.
Policy Development

1. The requirement for dedication of the seventeen (17)
acres for the P-1 Channel holding pond was an Environ-
mental Review Committee condition and subsequently a
Ordinance #3547

condition of the rezone and plat of the subject property.
2. As a result of the conditions apposed above, the dedica-
tion was made as a stipulation of the minimum requirement
for development of the property, rather than as a "trade-
off" for some other development requirement or credit.
3. It is clear that at least a significant portion of the
dedicated area is required to accommodate this project,
a portion of the dedicated area could be utilized for
storm water storage by other developing properties.
4. The Community Facilities charge provisions was intended
to cover a broad spectrum of public improvements. If
all or a portion of that fee is refunded as a result
of this request, other public facilities and utilities
other than storm drainage will have a adverse fiscal
affect.
5. It would seem reasonable to base any reduction in the
Community Facilities charge on the fraction of the dedi-
cated area which is not required to retain storm water
by this development. For instance, if the site requires
60% of the dedicated area for storm water drainage, the
City should retain 60% of the Community Facilities fee and
refund 40% (that portion not required by this development)
to the applicant. I would not recommend a direct corre-
lation between the value of the property in question and
the Community Facilities charge which was made. In fact,
all of the property would have been essentially valueless
without the requirement for that dedicated area.
RECOMMENDATION:
Determine that portion of the dedicated area which was required
for storm water storage by this development and refund that per-
centage of the Community Facilities charge equivalent to the percen-
tage of the dedicated area not required by this development.

1. The original intent of the ordinance in question was to
acquire needed land in lieu of the changes to be imposed.
This development falls into that catagory. However, this
request should have been negotiated at the time rather
than after the fact. We would agree with the recommenda-
tions made by Mr. Clemens. The fees charged against the
first four buildings in Phase I total $13,044.50. -

RE: SPRINGBROOK TECHNICAL CENTER - COMMUNITY FACILITY CHARGE
Dear Mr. Nelson
Pursuant to the City of Renton Ordinance #3547, Section XIV, Holvick deRegt
Koering is requesting that the community facility charge for Buildings #3,
12, 13 & 14, be waived.
On November 30, 1982, the plat of Washington Technical Center which incorporates
the buildings of Springbrook Technical Center, was recorded. That plat dedicated
17 acres of land to the City of Renton for use as a storm water detention basin.
See the attached plat dedication) This detention basin parcel was dedicated
to the city due to the needs of the city to provide a storm water detention
basin adjacent to the Springbrook Creek pump plant. A portion of this storm
water detention basin will be used for the Washington Technical Center and
the remaining portion of the detention basin will be used for other properties
in the City of Renton.
Of the 17 acres that were dedicated to the City of Renton, 13 of the acres were
zoned M.P. Those 13 acres had a current market value of $3.00 - $4.00 per
square foot, and are valued in excess of $2,000,000.
Holvick deRegt Koering is requesting that the community facilities charge
applicable to Buildings #3, 12, 13 & 14, be waived in lieu of the dedication
of land for the storm water detention basin. HdK feels that the dedication
of the storm water detention basin was in the best interest of the city and
therefore, meets the requirements of Section XIV of the City of Renton
Community Facility Ordinance #3547. HdK therefore, requests that this waiver be
reviewed by the city staff and council and a determination of acceptability of
the waiver be issued as soon as possible. Thank you for your attention to this
matter.

SECTION XIV: Dedication in Lieu of Charge_ Whenever a
charge is due under this Ordinance and the owner of the property wishes
to dedicate land to the City in lieu of that charge , the owner may
petition the City to accept such dedication in lieu of all or a
portion of this community facilities charge . In each such instance
the Building Official shall contact the affected City departments
and determine whether or not the acceptance of such dedication would
be in the City' s best interest . After receiving all replies from
affected City departments the Building Official shall recommend to the
City Council the approval or disapproval of the dedication as submitted .
The dedication shall be accepted only when it appears from all avail-
able information that the dedication would be in the City ' s best
interest. When such dedication has been determined to be in the City ' s
best interest , the Building Official shall establish what portion of
the community facilities charge shall be waived because of such
dedication and forward that information to the City Council . The
Council shall then determine if the City will accept the property and
further establish the amount of the community facilities charge to be
waived. Any unwaived portion of the fee shall be paid under the
terms of this Ordinance . Informatio;, concerning the extent of the fee
waived shall be communicated to tilt' o':Lter and the dedication accepted
by the City in return . If the owner should fail to dedicate the
property to the City , then the fee in total shall be due the City at
the time and under the terms set forth in this Ordinance .
SECTION XV: Repealer : Section 3-241 (F) and Section 8- 718
A) of the Code and any and all other sections of the Code dealing with
and establishing system development charges , community facilities
charges or similar charges are hereby repealed.
SECTION XVI : Severability . The invalidity or unconsti-
tutionality of any provision or section of this Ordinance shall not
render any other provision or section of this Ordinance invalid or
unconstitutional .

RE: WASHINGTON TECHNICAL CENTER LATECOMERS AGREEMENT
Dear Gary:
Pursuant to our conversation of today's date, please provide me with a
recorded copy of the latecomer agreements for the traffic signals at the
intersection of Powell Avenue/Grady Way and S.W. Seventh Avenue/Hardy Ave-
nue. Holvick deRegt Koering's mailing address is 725 Powell Avenue, S.W. ,
Suite A.
The latecomer agreement for the traffic signal at Powell Avenue S.W. and
Grady Way requires that O.W. Properties provide 17.9% of the cost for the
traffic signal. It is my understanding that this percentage was based
upon the requirements imposed by the hearing examiner at the time of their site
plan approval. Holvick deRegt Koering was unable to negotiate an agreement with
O.W. Properties for their contribution towards the signal cost at the time
we constructed the signal. Therefore, Holvick deRegt Koering is anxious to
receive O.W. Properties fair share apportion of the traffic signal at this time.
It is my understanding that the City of Renton will issue a request for payment
from O.W. Properties for their fair share apportion of the signal.
I have attached to this letter Attachment A of the latecomers agreement for
the traffic signal at Powell Avenue S.W. and Grady Way. The Attachment A
defines First City Equities Phase II property description in footnote no. 1.
In addition to the attachment, I have provided you with a marked up copy of
the plat showing First City Equities Phase II property. Also shown on the
plat is a portion of Holvick deRegt Koering's property that was released to
First City Equities in December of this year. That portion of the plat is
highlighted in red and was included in Holvick deRegt Koering's Phase I portion
of Washington Technical Center plat as defined in Attachment A of the latecomers
agreement.

Koering is extremely anxious to receive O.W. Properties fair share apportion
of the traffic signal at Powell Avenue S.W. and Grady Way. The signal has
been up and operable for approximately nine months. Each day that Holvick
deRegt Koering has not received O.W. Properties fair share apportion is cost-
ing Holvick deRegt Koering additional money in interest costs. We look
forward to hearing from the City of Renton in the very near future.

SUMMARY OF REQUEST: Applicant seeks site plan approval for a modification of the
approved site plan, File SA-094-81, by reducing the
number of buildings from four to three, allowing an
addition to Building No. 12, and increasing the parking
count to accommodate an increase in the percentage of
office use in lieu of warehouse/manufacturing use.
SUMMARY OF ACTION: Building and Zoning Department Recommendation:
Approval, subject to conditions.

BUILDING & ZONING The Building & Zoning Department Report was
DEPARTMENT REPORT: received by the Examiner on October 18, 1983.
PUBLIC HEARING: After reviewing the Building and Zoning Department
Report, examining available information on file with the
application, and field checking the property and
surrounding area, the Examiner conducted a public hearing
on the subject as follows:
The hearing was opened on October 25, 1983, at 9:45 a.m. in the Council Chambers of the
Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner.
The Examiner entered the following documents into the record:
Exhibit #1: Yellow file containing the application, staff
report, and other documents pertinent to
posting and publication.
Exhibit #2: Site plan showing the original site plan and
the revisions.
Exhibit #3: Elevation drawing for Building Nb. 12, which
is the main structure being revised.
Roger Blaylock, Zoning Administrator, presented the staff report. He indicated the site has
been modified, filled and graded and that the expansion would follow along the lines of the
existing building. Mr. Blaylock pointed out that the critical issues raised by the Environmental
Review Committee were storm water drainage and traffic generation; that the storm water
drainage situation will be resolved by construction of the P-1 Channel and the traffic
generation estimates from the project are not to exceed 6,660 average trips daily for Phase I,
and 8,015 ADT for Phase II. A table was prepared and included in the staff report to show trip
generation as was originally anticipated in the draft Environmental Impact Statement in 1980,
and that of construction in Phase I of the project to date.

Mr. Blaylock noted the staff recommends approval of the request, subject to the following
conditions:
1. Revising the site plan to correspond to the Parking and Loading Ordinance for dimensional
requirements.
2. Submission of a detailed landscaping plan showing the revisions on the entire site with the
building permit request for expansion of Building No. 12.
The Examiner called for testimony from the applicant or representative. Responding was:

Mr. Davis indicated they are requesting modification of the existing site plan proposed in 1981.
At that time, they had requested the site plan as it now is because they were uncertain of the
tenant mix that would be housed in the complex and asked then that they be allowed to alter
their plans at some point in the future when it was evident there was a need to do so and when
they saw a trend being developed for the use of the buildings. Mr. Davis stated they have now
decided to drop Building #15 to allow for the proper parking requirements for office use since
that is the trend being set in their development; further, that the site plan submitted was for
18' deep parking stalls and their architect who prepared it did not know of Renton's codes and
they have subsequently prepared a revised site plan which shows the proper parking stalls.
The Examiner entered the following into the record:

Exhibit #5: Site plan, by reference, from File No.
SA-094-81 and accompanying Environmental
Impact Statements.
Mr. Davis further stated a detailed landscaping plan would be submitted at the time of
application for a building permit.
The Examiner called for further testimony in support of the application. There was none. The
Examiner then called for testimony in opposition to the application. There was none.
There being no further testimony offered, the Hearing Examiner closed the hearing at 10:00 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The applicant, Holvick, deRegt & Koering, filed a request for approval of modification to
a required site plan for the subject site.
2. The application file containing the application, the State Environmental Policy Act
documentation, the Building and Zoning Department Report, and other pertinent
documents was entered into the record as Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and SEPA, a Memorandum of
Concurrance has been issued for the subject proposal by the Environmental Review
Committee (ER C), responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the impact
of this development.
5. The subject proposal met with no opposition from the public.

6. The subject site is located on the site of the former Earlington Golf Course at the
southwest corner of Powell Avenue S.W. and S.W. 7th Street.
7. The subject 3.36 acre site is level and is covered with urban ornamental vegetation.
8. The original plan for the subject site included four office/warehousing buildings with
associated parking.
9. The applicant has requested approval to modify the original plan to eliminate one building
No. 15) and increase the area of another building (No. 12) by approximately 2,224 sq. ft.
In addition, the applicants would seek approval of the city for use of the building for
office rather than warehousing uses.
10. The revised plans submitted by the applicant at the public hearing indicate sufficient
space for the modification which requires additional parking for office uses.
11. Staff's main concern regarding the proposed changes result from the additional
traffic/employee numbers which would be generated by office use as opposed to
warehousing uses. The original EIS prepared for the entire plat indicated a maximum
traffic impact and approval was predicated upon that impact.
Modification to a larger percentage of office uses will increase the traffic substantially
and the city has put the applicant on notice about potential limitations.
12. Whereas the original proposal was to have generated approximately 6,660 vehicle trips per
day, approximately 4% of the total square footage will probably generate about 11% of
the traffic. Projecting these numbers out would increase the traffic over that indicated
in the EIS by a considerable factor.
13. The plans continue to incorporate landscaping and a variety of on and off site
improvements have been installed. Three of the proposed original buildings have been
constructed and the new plans would permit the expansion of one of them.
CONCLUSIONS:
1. The modification will not materially affect the original proposal with the exception of
increasing the number of vehicles accessing the site and this is still within the range
forecasted by the EIS and initially approved by the City.
The modifications appear to serve the public use and interest and appear to serve the
needs of the community by providing additional office space for which the applicant has
forecasted a demand.
2. The staff concerns regarding traffic must be considered because the original projections
included substantially more warehousing which generates less traffic per square foot of
space than does office uses which have more employees per square foot.
3. As long as the applicant is aware of the potential discrepancy on traffic generation, the
proposed modifications are acceptable. The City, though, has the authority to continue to
review the remaining construction and take the necessary actions to mitigate any
unexpected impacts of altered construction.
DECISION:
The modified site plan is approved.

The Appearance of Fairness Doctrine provides that no ex parte (private one-on--one)
communications may occur concerning land use decisions. This means that parties to a land use
decision may not communicate in private with any decision-maker concerning the proposal.
Decision-makers in the land use process include both the Hearing Examiner and members of the
City Council.
All communications concerning the the proposal must be made in public. This permits all
interested parties to know the contents of the communication and would allow them to openly
rebut the evidence. Any violation of this doctrine would result in the invalidation of the
request by the Court.
The Doctrine applies not only to the initial public hearing but to all Requests for
Reconsideration as well as Appeals to the City Council.
Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be filed
in writing on or before November 15, 1983. Any aggrieved person feeling that the decision of
the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the
discovery of new evidence which could not be reasonably available at the prior hearing may
make a written request for review by the Examiner within fourteen (14) days from the date of
the Examiner's decision. This request shall set forth the specific errors relied upon by such
appellant, and the Examiner may, after review of the record, take further action as he deems
proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that such
appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other
specified requirements. Copies of this ordinance are available for inspection or purchase in the
Finance Department, first floor of City Hall.

C. HISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinance 41 1745 of April 14, 1959,
and rezoned from "G" to M-P by Ordinance #3344 of August 17, 1979. The Land
Use Hearing Examiner approved a site plan for the subject site on July 13, 1982
file SA-094-81, V-014-82).
D. PHYSICAL BACKGROUND:
1. Topography: The subject site is basically level.
2. Soils: Woodinville Silt Loam (Wo), slopes are less than 2%. Permeability is
moderately slow. The available water capacity is high. Runoff is slow, and
the hazard of erosion is slight. Stream overflow is a severe hazard unless
flood protection is provided. This soil is used for row crops, pasture and
urban development.

3. Vegetation: Urban ornamental vegetation has recently been placed on the
site.
4. Wildlife: 1 he existing vegetation may provide some habitat for birds and
small mammals.
5. Water: No surface water was observed on the subject site, October 14, 1983
6. Land Use: The subject site has been developed with three buildings for office
warehouse / manufacturing uses. A fourth proposed building has not been
built.
E. NEIGHBORHOOD CHARACTERISTICS:
To the east of the subject site are office and warehouse uses, while to the south,
west and north are vacant.
F. PUBLIC SERVICES:
1. Utilities:
a. Water - A twelve-inch water mains extends east-west on S,.W. 7th
Street and north-south on Powell Avenue S.W.
b. Sewer - A ten-inch sanitary sewer is located on Powell Avenue S.W.
b. Storm Water Drainage - The site drains into Springbrook Creek. No
on-site storm water retention is required. No compensating flood
storage is required.
2. Fire Protection: Provided by the City of Renton as per ordinance
requirements.
3.Transit: Not applicable.

IMPACT ON THE NATURAL OR HUMAN ENVIRONMENT:
1. Natural Systems: Construction on the site will remove the vegetation,
disturbe the soils, increase storm water runoff and have an effect on traffic
and noise levels in the vicinity. Through proper development controls and
procedures, however, these impacts can be mitigated.
2. Population/Employment? Employment opportunities will increase about five
5) times with a shift from warehousing to office uses.
3. Schools: Not applicable.
4. Social: Minor.
5.Traffic: The proposed use change from office/warehouse and manufacturing
to totally office use, together with the reduction of the size of proposed
buildings and the elimination of Building No. 15, will result in more average
daily trips. The proposed office use of the site is estimated to generate 689
average daily trips based on 21 trips per 1000 square feet of office building as
stated in the DEIS for Earlington Park on page C-12.

Pursuant to the City of Renton's Environmental Ordinance and the State
Environmental Policy Act of 1971, as amended, RCW 43-21C, a Memorandum of
Concurrence was issued for the subject proposal by the Environmental Review
Committe on September 28, 1983.

L. DEPARTMENT ANALYSIS;
1. The applicant, Holvick, deRegt and Koering, is requesting site plan approval
of a modification to the approved site plan granted under file SA-094-81.
The revision will include the elimination of Building No. 15 and the
enlargement of Building No. 12 by 2,224 square feet. The applicant had
originally proposed, in 1982, to utilize 30% of the floor area for office and
70% for light industrial uses. This will be modified to 100% usage for office.
Both buildings No. 13 and No. 14 have been slightly reduced in area from that
originally anticipated. In addition, with the elimination of Building No. 15,
the area has been devoted to providing additional parking spaces.
2. The proposal, as submitted, complies with the Comprehensive Plan
designation of Manufacturing Park for the subject site and the present M-P,
Manufacturing Park Zoning.
3.The site plan does not modify any of the public services to the site. Access,
storm water retention, water and sanitary sewer will not be modified
substantially. In 1982, a variance was granted to allow joint use access on
the common property lines, file V-014-82. This variance is still valid and not
a point of consideration in this application.
4.The new parking area shown in the southwest corner of Lot #8 of Washington
1 echnical Park does not conform with the dimension criteria of the Parking
and Loading Ordinance. The parking spaces are shown at eighteen (18) feet
while the code specifically requires twenty (20) foot long parking spaces. The
site plan presently shows 171 parking spaces, but with the adjustment
necessary to comply with the code requirements, approximately 13 parking
spaces will have to be eliminated. It is suggested that these should be the
ones along the southern property line of the new parking area. There will be
an additional ten (10) feet left over after the adjustment and this can be
placed into a large landscaped island which will then separate this office
complex development from any future development on the lot to the south.
The reduction in available parking will be felt in a total reduction in the final
interior areas that can be occupied by office. Out of the total 34,160 square
feet in all three buildings, only 30,761 square feet can be office. Since
Building No. 12 and No. 14 have been already committed to total office
functions, Building No. 13 will be limited to a maximum of 5200 square feet
of office with approximately 3400 of light industrial uses.

5.The Environmental Review Committee has issued a Memorandum of
Concurrence based upon the original EIS prepared in 1980. The critical issues
in that EIS centered on storm water drainage and traffic generation. The
storm water drainage situation is being resolved by the construction of the
P-1 Channel. The traffic generation estimates from the entire project were
not to exceed 6,660 average daily vehicle trips (ADT) for Phase One, and
8,015 ADT for Phase Two. With the present development of buildings No. 12,
13, 14 and partial occupancy of Building No. 3, a total of 702 trips are
generated by the standards established by the Draft EIS (page C-12). This
represents approximately 10.5% of the total acceptable traffic volumes in
Phase Two, but only 3.7% of the total potential building square footage is
constructed in Phase One.
Based upon the present trends of primarily office park uses instead of
industrial uses for the subject site, Phase One could only accommodate
approximately 283,714 square feet of additional office park uses. In effect,
this will create a short fall somewhere in the future and the Environmental
Review Committee will have to re-evaluate the environmental impacts
associated with the additional traffic generation from full development in
office uses. Since a full EIS was prepared on the initial proposal, it is
probable that a supplemental EIS or new impact statement may have to be
prepared at the time that this threshold is approached. The applicant should
be aware of this situation at this time and begin preparation of new
environmental information evaluating the major change in use of the
proposed facilities.
The attached table shows trip generation as originally theorized in the Draft
EIS in 1980, and that of actual construction in Phase One of the project to
date.
6. Departmental comments have been attached for the Hearing Examiner's and
publics' review.
M. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that the site approval request,
SA-065-83, be approved subject to the following conditions:
1. Revising of the site plan to correspond to the Parking and Loading Ordinance
for dimensional requirements.
2. Submission of a detailed landscaping plan showing the revisions on the entire
site with the building permit request for expansion of Building No. 12.

Dear Mr. Blaylock:
Pursuant to our meeting of September 20, 1983, Holvick deRegt Koering is
requesting that the enclosed application be processed to modify the
above referenced site plan approval. The existing site plan approval,
calls for four (4) one story buildings with associated parking to be
constructed on Lot #8 of Washington Technical Center. Holvick deRegt
Koering requests city approval on revising the site plan to incorporate
three buildings and associated parking on the site.
The initial site plan approval referenced approximately 30% office use and
70% warehouse/manufacturing use. At the time of the public hearing, Holvick
deRegt Koering requested the flexibility of allowing the building to serve
either office or light warehousing functions, depending upon the market
demands. I reference Item #7 in the Hearing Examiner findings. The Hearing
Examiner in his conclusions, stated that the nature of the use will in fact
be determined by the amount of available parking, and the Building and Zoning
Department will control uses when the occupancy permit is applied for, or a
change of use is requested. I reference Item #3 of the Hearing Examiner's
conclusions. The existing site plan as is now constructed, contains 120
parking spaces which would allow for 24,000 S.F. of office space to be con-
structed at this time. This office space is based on the City of Renton's
code requirement of one parking space per 200 S.F. of office space.
Holvick deRegt Koering is requesting the City of Renton to approve the use
of Building #12 and Building #14 with 13,554 S.F. and 9,783 S.F. respectively,
as 100% office use. It is understood that the addition to Building #12 and
the ability to receive an occupancy permit for Building #13 cannot occur
until the three building, 100% office use site plan has been approved through
the Hearing Examiner's process.

Acting as the Responsible Official, the ERC has determined that the requested
modifications to the initial proposal reviewed under ECF-101-81 on January 1982, are
within the scope of that original proposal and the environmental determination of
non-significance is still valid.
This decision was reached following a presentation by Jerry Lind of the Building and
Zoning Department. Oral comments were accepted from: Roger Blaylock, Paul Lumbert,
Ronald Nelson, Richard Houghton, David Clemens, Robert Bergstrom and James Matthew.

Dear Mr. Blaylock:
Pursuant to our meeting of September 20, 1983, Holvick deRegt Koering is
requesting that the enclosed application be processed to modify the
above referenced site plan approval. The existing site plan approval,
calls for four (4) one story buildings with associated parking to be
constructed on Lot #8 of Washington Technical Center. Holvick deRegt
Koering requests city approval on revising the site plan to incorporate
three buildings and associated parking on the site.
The initial site plan approval referenced approximately 30% office use and
70% warehouse/manufacturing use. At the time of the public hearing, Holvick
deRegt Koering requested the flexibility of allowing the building to serve
either office or light warehousing functions, depending upon the market
demands. I reference Item #7 in the Hearing Examiner findings. The Hearing
Examiner in his conclusions, stated that the nature of the use will in fact
be determined by the amount of available parking, and the Building and Zoning
Department will control uses when the occupancy permit is applied for, or a
change of use is requested. I reference Item #3 of the Hearing Examiner's
conclusions. The existing site plan as is now constructed, contains 120
parking spaces which would allow for 24,000 S.F. of office space to be con-
structed at this time. This office space is based on the City of Renton's
code requirement of one parking space per 200 S.F. of office space.
Holvick deRegt Koering is requesting the City of Renton to approve the use
of Building #12 and Building #14 with 13,554 S.F. and 9,783 S.F. respectively,
as 100% office use. It is understood that the addition to Building #12 and
the ability to receive an occupancy permit for Building #13 cannot occur
until the three building, 100% office use site plan has been approved through
the Hearing Examiner's process.

for the site plan approval for the three building, 100% office use. Holvick
deRegt Koering, also requests a written approval of the 100% office use for
Building #12 and Building #14, as they now exist on the site. Your immediate
review and concurrence of the 100% office use for Building #12 and Building
14 as they now exist, is requested. Holvick deRegt Koering appreciates
the time we spent at Tuesday's meeting and hopes that the city staff review
of this revised site plan along with the needed advertisement for the public
hearing, can happen within the next two weeks such that the public hearing
before the Hearing Examiner can occur on the open date of October 4, 1983.

RE: WASHINGTON TECHNICAL CENTER - BUILDINGS #12, 13 & 14
Gentlemen:
On Friday, September 2, 1983, I delivered a revised site plan for the above
referenced buildings at Washington Technical Center. The site plan along
with an addition to Building #12, was left with Mr. Jerry Lind of your
office. Holvick deRegt Koering requests an administrative review of the
revised site plan and the addition to Building #12, for compliance with
the original site plan approval, City of Renton file #SA-094-81.
The request for the administrative review evolves from Holvick deRegt
Koering's desire to convert the entire site to a 100% office use. The
addition to Building #12, is being proposed to satisfy the need of a
proposed tenant who is the State of Washington's Disability Insurance
Division. There is adequate parking for the site, as the original Building
15 will not be built. The area where Building #15 was to be constructed
will be converted to a parking use.
Holvick deRegt Koering is looking forward to an administrative decision on
the site plan in the very near future. Thank you for your attention to
