The subject property is approximately 515,253 square feet (11.83 acres) and located within the Residential Multi-Family (RMF) and the City Center Community Planning Area. According to the City of Renton (COR) Maps, a moderate landslide hazard area, regulated slopes, and the Well 5A Wellhead Protection Area Zone 2 are mapped on the project site. Geologically hazardous areas, such as a steep slope, require a Critical Areas Exemption. A geotechnical report was waived following a site visit by staff due to the slope not impacting Tree 2 and for Tree 1, the slope does not have a steep grade for a long distance making the concern for a geologically unstable slope for a tree removal minimal. An Arborist Report, prepared by A Plus Tree, LLC, dated September 16, 2024 (Attachment A), was submitted with the application. In the report, the IAS Certified Arborist (Daniel Potts) proposed the removal of two (2) hillside trees labeled “Tree 1” and “Tree 2.” Tree 1 is a black cottonwood (Populus trichocarpa) that is thirty-eight inches (38”) in diameter at breast height (dbh) and approximately one hundred feet (100’) in height. According to the report, Tree 1 has a significant lean towards the building, is exposed to wind coming from the typical prevailing wind direction, has very little roots on the tension side of the lean, and is on a slope with an angle of repose that is susceptible to erosion and earth movement. According to the report, Tree 2 has already failed approximately forty feet (40’) up the stem and is suspended in the trees below. Tree 1 is proposed to be removed at the base of the stump, only leaving the root system, and Tree 2 is proposed to be reduced to a ten-foot (10’) tall wildlife snag. Remnants of both trees would be chipped and moved off-site to prevent additional weight on the slope. CRITICAL AREA: Regulated Slopes, Moderate Landslide Hazard Area, and Well 5A Wellhead Protection Area Zone 2 EXEMPTION JUSTIFICATION: Renton Municipal Code (RMC) 4-3-050 Critical Areas Regulations: RMC 4-3-050C.3.c.iii, Dangerous Trees ROUTINE VEGETATION MANAGEMENT REVIEW CRITERIA 4-9-195D.4: YES 1. The lot shall comply with minimum tree density requirements pursuant to RMC 4-4-130, Tree Retention and Land Clearing Regulations. Staff Comments: In accordance with RMC 4-4-130.H, compliance with tree credit requirements necessitates a minimum of 30 tree credits per net acre. The subject property, located at 2100 Lake Washington Blvd (APN 0423059158), is approximately 515,253 square feet (11.83 acres). Based on the property size, 355 tree credits are required to meet the minimum tree density requirement (30 tree credits per acre × 11.83 acres = 355 credits). According to the Tree Retention and Tree Credit Worksheet (Attachment B), the property has 118 trees that are six-inch (6”) caliper or greater in size after deducting trees in critical areas and the two (2) proposed for removal. Page two of the Tree Retention and Tree Credit Worksheet (Attachment B) shows that the 118 trees included in the calculations total 574 tree credits. This shows the property would maintain the minimum tree density for the subject property following the removal of the two (2) hazardous trees. YES 2. The land clearing and tree removal shall be consistent with restrictions for critical areas, pursuant to RMC 4-4-130, Tree Retention and Land Clearing Regulations, and RMC 4-3-050, Critical Areas Regulations. Staff Comments: City of Renton (COR) maps has identified sensitive and protected slopes, moderate landslide hazard, and a wellhead protection area onsite. A critical areas exemption certificate is a component of this decision due to the presence of a protected steep slope. After conducting a site visit, staff does not anticipate that the proposed removals would have any negative environmental impacts and therefore a geotechnical report was waived. The geotechnical report was waived because the slope for Tree 1 has a steep grade for a short distance and removing the tree to the stump and leaving the roots for stability does not pose a significant hillside destabilization potential (Attachment C). Tree 2 on City of Renton (COR) Maps is located within the regulated slopes based on preliminary data, but a site visit showed that the tree is not located on a steep slope (Attachment D). Removal of the two (2) dangerous trees is an exempt activity per Renton Municipal Code (RMC) 4-3- 050C.3.c.iii. According to the Arborist Report, the applicant is proposing to leave a 10-foot-tall wildlife snag to mitigate the risk posed by the failed tree. In accordance with the arborist’s recommendation, the applicant shall leave the failed black cottonwood tree (Tree #2) as a 10- foot-tall wildlife snag as determined by the Current Planning Project Manager. YES 3. Removal of a landmark tree shall meet the review criteria for removal off landmark tree, pursuant to RMC 4-4-130, Tree Retention and Land Clearing Regulations. i. The tree is determined to be a high-risk tree; or ii. The tree is causing obvious physical damage to buildings (over 200 square feet), driveways, parking lots, or utilities, and it can be demonstrated to the Administrator’s satisfaction that no reasonable alternative to tree removal exist, including tree root pruning, tree root barriers, tree cabling, or preventative maintenance, such as cleaning leaf debris, deadwood removal, or directional/clearance pruning; or iii. Removal of tree(s) to provide solar access to buildings incorporating active solar devices. Windows are solar devices only when they are south facing and include special storage elements to distribute heat energy; or iv. The Administrator determines the removal is necessary to achieve a specific and articulable purpose or goal of this Title. Staff Comments: According to RMC 4-4-130.F.2.c.i, a landmark tree may be removed if it is determined to be high risk. In RMC 4-11-200, a high-risk tree is classified as such if it has a probable or imminent likelihood of failure; and a medium or high likelihood of impact; and the consequences of failure for the tree are significant or severe. Tree 1 is susceptible to failure due to very little roots on the tension side of the lean combined with the slope of the hill. In the event of high winds, there has been testimony about root plate movement. The arborist concludes Tree 1 is likely to fail in the next few years. The consequence of failure has potential to be severe due to the location of the tree being close to housing and the lean of the tree indicates failure would occur toward the structure. Tree 1 is a high- risk tree due to its potential to damage housing and harm the people inside. Tree 2 has already failed approximately thirty feet (30’) to forty feet (40’) up the trunk and is being suspended by the trees below it. In the future, it is likely that the broken section of this tree would dislodge from the surrounding canopies. Tree 2 has a medium probability of hitting a person due to it being in an area used by the residents for walking. Tree 2 is already a failed tree and letting it remain unaltered poses a significant threat since it can collapse onto a passerby. Staff concurs the trees should be removed due to criteria i in RMC 4-4- 130.F.2.c being satisfied. YES 4. Street frontage and parking lot trees and landscaping shall be preserved unless otherwise approved by the Administrator. Staff Comments: Not applicable. The subject tree is not a street frontage tree nor a parking lot tree. YES 5. The land clearing and tree removal shall not remove any landscaping or protected trees required as part of a land development permit. Staff Comments: Not applicable. The tree removal would not be removing landscaping or protected trees required as part of a land development permit. YES 6. The land clearing and tree removal shall maintain visual screening and buffering between land uses of differing intensity, consistent with applicable landscaping and setback provisions. When a Residential Multi-family Zone or Use is abutting a less intense residential zone a fifteen-foot (15') wide partially sight-obscuring landscaped visual barrier, or ten-foot (10') wide fully sight-obscuring landscaped visual barrier, is required along the common property line. Staff Comments: The minor tree removal activity would not be removing any planned landscaping, nor would it impact the sight-obscuring screening located between the existing RMF zoned property and the R-6 zoned properties to the east. While there is a difference in land intensity use between the subject property, Residential Multi-Family (RMF), and the adjacent use of Residential-6 (R-6) to the east, there would be a sufficient continuation of screening provided by the abundance of remaining trees. YES 7. The land clearing and tree removal shall not create or contribute to a hazardous condition, such as increased potential for blowdown, pest infestation, disease, or other problems that may result from selectively removing trees and other vegetation from a lot. Staff Comments: The removal of the dangerous trees, as recommended by the arborist, would not create a hazardous condition. Removal of the chipped material from the trees is also being proposed as a way to not contribute to the hazardous condition of land movement by over weighting the steep slope. Instead, removing the trees and their debris would mitigate the risk of tree collapse, land movement, and potential damage to people and property. N/A 8. The land clearing and tree removal shall be consistent with the requirements of the Shoreline Master Program, pursuant to RMC 4-3-090F1, Vegetation Conservation, and RMC 4-4-130, Tree Retention and Land Clearing Regulations. Staff Comments: Not applicable. The property is not located within shoreline jurisdiction. CRITICAL AREA EXEMPTION FINDINGS: The proposed development is consistent with the following findings pursuant to RMC section 4-3- 050C.2.d: YES i. Approval of this exemption would act as written permission to allow the removal of the two (2) identified dangerous trees. YES ii. The activity will be conducted using best management practices as specified by industry standards or applicable Federal agencies or scientific principles; Staff Comments: The best management practice recommended by the arborist is to remove the two (2) high-risk trees from the steep slope. Tree 1 would be removed to the base of the stump due to it being located near housing with low root tension on the side of the lean and the probability of land movement; in this case, reducing to a wildlife snag would not sufficiently reduce the hazard to housing or people, and thus the roots will be left to help stabilize the slope. Tree 2 would be reduced to a wildlife snag. All pieces of both trees would be chipped and moved off-site to reduce additional weight on the slope. YES iii. Impacts are minimized and, where applicable, disturbed areas are immediately restored; Staff Comments: The removal process is aimed at minimizing potential damage to people and structures while maintaining the slope. This is accomplished through the measures written in the above comment. YES iv. Where water body or buffer disturbance has occurred in accordance with an exemption during construction or other activities, revegetation with native vegetation shall be required; Staff Comments: Not applicable. The proposed tree removals will not disturb any water body or buffer. YES v. If a hazardous material, activity, and/or facility that is exempt pursuant to this Section has a significant or substantial potential to degrade groundwater quality, then the Administrator may require compliance with the Wellhead Protection Area requirements of this Section otherwise relevant to that hazardous material, activity, and/or facility. Such determinations will be based upon site and/or chemical-specific data. Staff Comments: Not applicable. The proposal does not include a significant or substantial potential to degrade groundwater quality. DECISION: The Bella Vista Tree Removal Routine Vegetation Management Permit and Critical Areas Exemption, LUA24-000319, RVMP, CAE is Approved and subject to the following condition:. *CONDITION OF APPROVAL: 1. As recommended in the Arborist Report, the applicant shall leave the failed black cottonwood tree (Tree 2) as a 10-foot-tall wildlife snag as determined by the Current Planning Project Manager. The report has been requested because the root plate around one of these trees was moving during a recent high wind event, so the property managers called us out to take a look at this tree as well as the surrounding hillside. This visual inspection was from ground grade only. The assignment is to assess and provide recommendations for future action. Trees are living organisms that may fail in ways we do not fully understand. Conditions are often hidden within trees and below ground. Arborists cannot guarantee that a tree will be healthy or safe, or fail for that matter, under all circumstances, or for a given period of time. Likewise, remedial treatments, like any medicine, cannot be guaranteed. Construction activities are hazardous to trees and cause many short and long-term injuries, which can cause trees to die or topple. Even when every tree is inspected, inspection involves sampling; therefore, some areas of decay or weakness may be missed. Weather, winds and the magnitude and direction of storms are not predictable, and some failures may still occur despite the best application of high professional standards. I hereby declare that the above observations, discussion and recommendation are true to the best of my knowledge, belief and professional opinion. The area below the broken stem is regularly used by residents walking their dogs, and the tree is within 1 tree length of the building. Within a 3 year time period, it will probably uproot and has a high probability of hitting the building, with a medium probability of hitting a resident inside. In the event of failure and impact, it would likely have significant consequences for the building, and anyone hit by this tree would be severely injured. Tree 2 has already failed approximately 40 feet up the stem, and is suspended in the trees below it. Within a 3 year time period, the stem will probably dislodge from the canopies it is suspended in. The area below it is occasionally occupied by residents: In the event of failure, there is a medium probability of it hitting someone, but the consequences would be severe.
