The work on pedestrian facilities, shall be limited to one corner at a time, with the least possible inconvenience or delay to pedestrians.  WORK TIME begins when any street or travel lane is fully or partially closed. This includes set up within the traveled way.  Comply with all traffic regulations of the City of Renton and the State of Washington.  Prepare a traffic control plan and obtain City approval of that plan. Comcast is applying for a variance request in order to upgrade existing facilities. Comcast proposes to PLACE AND TIE INTO NEW SPLICE CASE SP0289.WAKV, OVERLASH (1) 24CT FIBER ON EXISTING STRAND, ON NE 9TH ST AND HARRINGTON AVE NE , RENTON, WA 98057 Comcast is requesfing that the City of Renton approve this variance request based on the fact that the requirements for undergrounding this proposed overlash on exisfing plant will cause undue hardship: 1. Installafion of undergrounding facilifies will increase the total cost of construcfion roughly 15-25 fimes the amount of an aerial over-lash on the exisfing Comcast strand. 2. Risk of potenfial damage to underground facilifies will be increased. 3. Over-lash will not cause substanfial adverse impact to other persons or enfifies in the immediate area. Over-lashing the cable will be accomplished in a few days, and the residents will not nofice any impact. Comcast will clean up the over-lashed spans as necessary and idenfify and remove any exisfing dead cables along this route. 4. The variance is necessary to prevent any undue hardship due to the increased construcfion costs if forced to install the proposed extension underground. 5. The granfing of the variance will not be materially detrimental to the public welfare. Comcast does agree to parficipate in future underground improvements for its proporfionate share of the undergrounding costs, waiving the obligafion into the future when all other ufilifies are undergrounded to prevent an undue hardship against Comcast currently. Upon the granfing of the variance, Comcast will coordinate construcfion and traffic control as per your requirements. Comcast and their contractors want to cooperate at the highest level and agree to adhere to all provisions and requirements set forth by the City of Renton to insure safe installafion and maintenance of the proposed facilifies. Jacob Neu Permit Department Manager ADP Resources, LLC 503-673-8256 | row_permits@adp-resources.com November 20, 2024 Jacob Neu ADP Resources, LLC 163 SW academy St Dallas, OR 97338 Via Email: row_permits@adp-resources.com SUBJECT: Request for Undergrounding Exemption (JB#194754, MFP24005143, 900 Harrington Ave NE) Dear Mr. Neu: The City of Renton has reviewed your request to grant Comcast an exemption from Renton Municipal Code (RMC) 4-6-090(C) which states that all new electrical or communication facilities shall be required to be installed underground, pursuant to the standards of the section of RMC. Comcast proposes to have Cannon Construction Inc overlash new fiber for a total of approximately 737 lineal feet to existing Puget Sound Energy (PSE) poles along Harrington Ave NE and NE 9th St within the City. See the enclosed Site Plan showing the proposed overlashing limits. ANALYSIS: The City has considered the request for an exemption from RMC 4-6-090. Ordinance 5720 grants Comcast, the right to install fiber optic cable and related appurtenances under, along, over, below, through and across the streets, avenues and alleys of City of Renton within the right-of-way of Renton. Section 3.4 of the franchise ordinance states that if all of the distribution lines all the wireline service providers, such as telecommunications service providers, as defined in RCW 35.99.010, a utility service provider or a Cable Operator (collectively “Service Providers”) in any portion of the Franchise Area are underground, Grantee shall place its Cable System’s distribution cables underground within that area; provided that such underground locations are actually capable of accommodating Grantee’s cable and other equipment without technical degradation of the Cable Systems’ signal quality. The proposal would utilize existing poles with other attached franchisee communication facilities and overlash to the existing Comcast aerial path. As minimum vertical height clearance of 15’-6” would need to be provided for, any existing obsolete cable will need to be removed; staff recommends these as conditions of approval. Therefore, the City is granting an exemption with conditions, per the Comcast franchise agreement which allows new overhead facilities to be placed overhead provided there are other similar providers overhead as well. Comcast is required to obtain all necessary private utility easements for work on private property. DECISION: The requested exemption from underground utility installation requirements RMC4-6-090 (C) as requested by the applicant is approved with conditions subject to the conditions below as the request complies with the Comcast Franchise Agreement. The new aerial fiber lines within the Project Reach must be converted to underground facilities in the future, at the Applicant’s cost, when any one of the following events occurs: (1) any other utilities are undergrounded within the Project Reach, (2) a joint use trench is proposed by a franchisee within the Project Reach, in which case the Applicant shall participate in the joint use trench installation for the purpose of undergrounding its aerial lines, or (3) a conduit is made available within the Project Reach that will accommodate the aerial lines. The new aerial lines must be undergrounded within one year, or approved otherwise by the City of Renton Community and Economic Development Administrator or designee, from the first event triggering the requirement to underground the aerial lines. This decision to approve the exemption with conditions is subject to a fourteen (14) day appeal period from the date of this letter per RMC 4-8-110. Any appeals of the administrative decision must be filed with the City Clerk, along with the required appeal fee, by 5:00 pm, December 4, 2024. Appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub Monday through Friday.  The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date if your appeal is submitted electronically.
