A separate violation of this Section shall be deemed to have occurred when, after issuance of a citation, twenty four (24) or more consecutive hours passes and the offending vehicle remains in an impermissible location, regardless of whether or not the vehicle has been relocated from the original location. For the purpose of this Section, driveways consisting of compacted dirt and/or gravel established prior to the effective date of this Section shall be considered a permissible parking location. September 23, 2024: Sent out Warning of Violation with due date of October 8, 2024. Exhibit 3. September 27, 2024: The City received signed return receipt from Warning of Violation. Exhibit 4. October 10, 2024: Follow up inspection found that red Chevrolet Camaro (Lic# AUT3481) is now registered, still parked impermissibly. Exhibit 5. October 11, 2024: Sent out second Warning of Violation with due date of October 26, 2024. Exhibit 6. October 18, 2024: The City received signed return receipt from second Warning of Violation. Exhibit 7. 2 October 28, 2024: Follow up inspection found that red Chevrolet Camaro (Lic# AUT3481) is still parked impermissibly on the front yard grass. Exhibit 8. October 29, 2024: Sent out Notice of Violation with due date of November 13, 2024. Exhibit 9. November 5, 2024: The City received signed return receipt from Notice of Violation. Exhibit 10. November 19, 2024: Follow up inspection found that red Chevrolet Camaro (Lic# AUT3481) is now parked permissibly in driveway. Closed case. Exhibit 11. The City’s position is that more than ample time has been granted to bring the property into compliance. The property owners were made aware of the ongoing violation on their property several times and did nothing about it until on or about November 19, 2024. The $100.00 fine should be sustained. Vehicles and boats which are kept on site and outside of an enclosed building shall be operational and currently registered. Therefore a code violation penalty, consistent with RMC 1~3~2.P is imposed, not including any costs, fees or assessments. You may respond in the following manner: I deny creating, permitting to exist, maintaining or failing to eliminate the violation(s) and I am requesting a hearing to contest this Notice of Violation.
