HomeMy WebLinkAboutAddendum - 4700 Fifth Avenue | PO Box 34018 | Seattle, WA 98124-4018 | 206-684-3000 | seattle.gov/utilities September 26, 2024 Mayor Armondo Pavone City of Renton 1055 South Grady Way Renton, WA 98026-8981 Dear Mayor Pavone, The City of Seattle, through its Seattle Public Utilities department (SPU) continues to appreciate the opportunity and good will these ongoing discussions have been with City of Renton (Renton) and the Full and Partial contract holders regarding the proposal to amend the City of Seattle Full or Partial Requirements Contracts. As you are aware, Section II.A.3 provides for the periodic review and the right to change certain terms and conditions. Last September, Renton along with the Full and Partial contract holders agreed to extend Section II.A.3, for an additional year to consider the proposal. We are fast approaching the end of 2024 and discussions between SPU and Renton are still ongoing. Although we are near agreement on all issues, we do not anticipate reaching a signed agreement before the end of this year. SPU recommends an additional one-year extension to allow for the finalization of these discussions and to obtain the contract signatures by the respective parties by the end of 2025. SPU and Renton therefore recognize the continued value of additional time to finalize the proposal and ensure all proposed changes are fully vetted and agreed to by each p elected officials. This letter memorializes our mutual agreement to extend for an additional year. Agreement Section II.A.3 of the 2001 City of Seattle Full Requirements Contract for the Supply of Water to City of Renton (Contract) between SPU and Renton provides for periodic review and right to change certain terms and conditions by January 1, 2022. The parties have extended that date three times. Most recently in September of 2023, Renton and SPU agreed to amend Section II.A.3 of the Contract to extend that date for an additional 12 months to January 1, 2025. This letter amendment extends that date from the previous extension letter agreement an additional 12 months: The one-year period for parties to agree on a proposal using the Consensual Process defined in Section II.A.3 of the Contract is extended from a four-year period to a five-year period. 5 set forth in Section II.A.3 of the Contract is hereby changed to January 1, 2026.
