The work on pedestrian facilities, shall be limited to one corner at a time, with the least possible inconvenience or delay to pedestrians. • WORK TIME begins when any street or travel lane is fully or partially closed. Zayo Group is requesting that the City of Renton grant a variance to the undergrounding code. The purpose of this project is a relocation of existing aerial fiber to underground conduit in front of the new development at NE12th st and NE11th PL. The project consists of replacing the existing fiber on 431’ of existing Zayo strand and removing the old fiber when splicing is completed and placing 508’ of fiber into existing conduit. This project reduces the amount of Zayo Fiber plant that is aerial. This work can be completed in a few days with minimal impact to the residents and ongoing construction projects. Zayo Group will clean up the spans as necessary and identify the old fiber from the strand. The variance requested does not constitute the granting of special services to Zayo Group because Zayo Group is agreeing to obligate the cable system to be placed underground when all other utilities are placed underground. Such as the 508’ that is being placed underground by this project. The variance is necessary to prevent an undue hardship due to the increased construction costs if forced to install the proposed extension underground. As well as increased impact to the ROW and disturbance to residents. The granting of the variance will not be materially detrimental to the public welfare because Zayo Group does agree to underground the cable system, but they are waiving the obligation into the future when all other utilities are undergrounded to prevent an undue hardship against Zayo Group currently. Upon the granting of the Variance, Zayo Group will coordinate construction and traffic control as per your requirements. Zayo Group and their contractors want to cooperate at the highest level and agree to adhere to all provisions and requirements set forth by the City of Renton to insure safe installation and maintenance of the proposed facilities. Zayo proposes to have Cannon Construction Inc overlash new fiber for a total of approximately 297 lineal feet to existing Puget Sound Energy (PSE) poles along NE 12th Street, within the City. See the enclosed Site Plan showing the proposed overlashing limits. ANALYSIS: The City has considered the request for an exemption from RMC 4-6-090. Ordinance 5497 grants Zayo, the right to install fiber optic cable and related appurtenances under, along, over, below, through and across the streets, avenues and alleys of City of Renton within the right-of-way of Renton. Section 3 of the franchise ordinance states that if all of the distribution lines all the wireline service providers, such as telecommunications service providers, as defined in RCW 35.99.010, a utility service provider or a Cable Operator (collectively “Service Providers”) in any portion of the Franchise Area are underground, Grantee shall place its Cable System’s distribution cables underground within that area; provided that such underground locations are actually capable of accommodating Grantee’s cable and other equipment without technical degradation of the Cable Systems’ signal quality. The proposal would utilize existing poles with other attached franchisee communication facilities and overlash to the existing Zayo aerial path. As minimum vertical height clearance of 15’-6” would need to be provided for, any existing obsolete cable will need to be removed; staff recommends these as conditions of approval. Therefore, the City is granting an exemption with conditions, per the Zayo franchise agreement which allows new overhead facilities to be placed overhead provided there are other similar providers overhead as well. Zayo is required to obtain all necessary private utility easements for work on private property. DECISION: The requested exemption from underground utility installation requirements RMC4-6-090 (C) as requested by the applicant is approved with conditions subject to the conditions below as the request complies with the Zayo Franchise Agreement. New aerial lines within the Project Reach must have a minimum vertical clearance of 15’-6”. 2. Any abandoned or unused lines within the Project Reach must be removed at the time that construction is taking place. 3. A traffic control plan must be separately submitted to the City, and no construction may take place until the City has approved a traffic control plan. 4. The new aerial fiber lines within the Project Reach must be converted to underground facilities in the future, at the Applicant’s cost, when any one of the following events occurs: (1) any other utilities are undergrounded within the Project Reach, (2) a joint use trench is proposed by a franchisee within the Project Reach, in which case the Applicant shall participate in the joint use trench installation for the purpose of undergrounding its aerial lines, or (3) a conduit is made available within the Project Reach that will accommodate the aerial lines. The new aerial lines must be undergrounded within one year, or approved otherwise by the City of Renton Community and Economic Development Administrator or designee, from the first event triggering the requirement to underground the aerial lines. This decision to approve the exemption with conditions is subject to a fourteen (14) day appeal period from the date of this letter per RMC 4-8-110. Any appeals of the administrative decision must be filed with the City Clerk, along with the required appeal fee, by 5:00 pm, December 25, 2024. Appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub Monday through Friday. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date if your appeal is submitted electronically.
