Dear Mr. Hearing Examiner –
The City respectfully requests you respond to our December 10, 2024 email inquiring as to whether you will
consider Mr. Carner’s “Defense to the City of Renton” dated December 7, 2024. If you will not consider that email
submittal, the City’s request is moot and we withdraw our request to respond.
If you do intend to consider Mr. Carner’s December 7, 2024 “Defense to City of Renton”, our request to respond
stands. We will then also respond to Mr. Carner’s “Motion to Strike” of December 11, 2024, and upon a decision
on that Motion submit a response to the December 7 “Defense”.

It is my understanding that a motion before you follow the following procedure: Motion by Party A, Response by
Party B, Reply by Party A and that closes the briefings. We have followed that process throughout this appeal. It
appears that Mr. Carner has provided an additional briefing following his Response to the City’s Motion.
If you are considering his most recent communication in order to make a decision related to the City’s Motion to
Strike, we are requesting an opportunity to reply.
