Tract 1 of Liberty Ridge Phase 1, as recorded in Volume 201 of Plats, pages
87 through 95 under recording number 20010907001815, records of King
County, Washington.
CONVEYANCE OF TRACT W TO THE HOMEOWNERS ASSOCIATION
Tract W is hereby conveyed and quit claimed to the Liberty Ri dge Homeowners
Association, a Washington non-profit corporation, subject to the Native Growth
Protection Easement that is set forth on Sheet 8, below.
HOMEOWNERS ASSOCIATION'S DUTY TO MAINTAIN TRACT W
In addition to any other homeowners association maintenance and repair
obligations described on this plat, the Liberty Ridge Homeowners Association
shall have the duty to maintain Tract W, including without limitation the duty
to maintain and repair (1) any and all landscaping, landscape irrigation
systems, signage improvements and recreation facilities lying within Tract W,
and (2) the steep slopes lying within Tract W.
PROTECTIVE COVENANTS. CONDITIONS. EASEMENTS AND RESTRICTIONS
See that certain "Declaration of Protective Covenants, Conditions, Easements
and Restrictions of Liberty Ridge (formerly known as La Colina)" recorded
under King County Recording No. 20000202001302 (the "Origina l Declaration")
as amended by that certain "First Amendment to the Declaration of Protective
Covenants, Conditions, Easements & Restrictions of Liberty Ridge -Adjacent
Real Property" recorded under King County Recording No. 20010907001816
(the "First Amendment") and as further amended by that certain "Second
Amendment to the Declaration of Protective Covenants, Conditions, Easements
& Restrictions of Liberty Ridge -Adjacent Real Property" recorded under King
County Recording No. ______________ (the "Second Amendment"). (On
this plat, the Original Declaration as amended by the First and Second
Amendments is referred to as the "Liberty Ridge CCRs".) Note t hat the
Liberty Ridge CCRs may subsequently be amended from time to time as
provided-for therein or as otherwise provi ded-for by law .
RINGEL & ASSOCIATES
PRIVATE STREET EASEMENTS. PRIVATE DRAINAGE EASEMENTS. AND MAINTENANCE
OF THE IMPROVEMENTS LYING WITHIN THOSE EASEMENTS
Non-exclusive easements for ingress and egress and for construction,
maintenance, repair and use of roadway and storm drain pipes and
appurtenances are hereby declared over, under, along and across the portions
of Lots 182, 183 and 184 depicted on the map pages of this plat as "Private
Street Easement". These easements shall run with the land burdening Lots
182. 183 and 184 and benefiting Lots 182, 183 and 184, respectively.
The owners of Lots 182 through 184 shall have the perpetual right and duty
to maintain and repair the roadway and storm drain pipes and appurtenances
located in the Private Street Easement. The costs of such maintenance and
repair are to be shared equally among the owners of Lots 182 through 184.
In addition, non-exclusive easements for construction, maintenance, repair and
use of a storm drain pipe and appurtenances located in the portions of Lots
186 and 187 depicted on the map pages of this plat as "Private Drainage
Easement" are hereby declared over, under, along and across those portions
of Lots 186 and 187. These easements shall run with the land, burdening
those portions of Lots 186 and 187 and benefiting Lots 186 and 187 as well
as Lot 185 and the portions of Liberty Ridge Phase 1 (which is recorded In
Volume 201 of Plats, pages 87 through 95 under King County Rec. No .
20010907001815) that drain into Lots 185. 186 and 187. (Note that a
drainage swale across the southerlymost corner area of Lot 186 is intended to
drain into a catch basin located near the south end of the Private Drainage
Easement that burdens Lots 186 and 187.)
The Lib e rty Ri dge Homeowners Association shall have the perpetua l right and
duty to maintain and repair the storm drain pipe and appurtenances located in
the Private Drainage Easement that burdens portions of Lots 186 and 187.
Further. non-exclusive easements for construction, maintenance, repair and use
of a storm drain pipe and appurtenances located in the portions of Lots 197
and 198 depicted on the map pages of this plat as "Private Drainage
Easement" are hereby declared over, under, along and across those portions
of Lots 197 and 198. These easements shall run with the land, burdening
those portions of Lots 197 and 198 and benefiting Lots 197 and 198 as well
as Lots 191 through 196 and the portions of Liberty Ridge Phase 1 that
drain into Lots 191 through 198. (Note that a drainage swale across the
southerlymost edge of Lot 197 is intended to drain into a catch basin located
nea r the south end of the Private Drainage Easement that burdens Lots 197
and 198.)
The Liberty Ridge Homeowners Association shall have the perpetual right and
duty to maintain and repair the storm drain improvements located in the
Private Drainage Easement that burdens portions of Lots 197 and 198.
EASEMENT FOR EMERGENCY VEHICLE INGRESS AND EGRESS
A non-exclusive easement for emergency vehicle ingress and egress is also
hereby reserved and granted to the City of Renton over, under, along and
across the portions of Lots 182, 183 and 184 depicted on the map pages of
this plat as "Private Street Easement". This easement shall also run with the
land, (1) burdening those portions of Lots 182, 183 and 184 and (2)
benefiting the City of Renton.

ROCKERY-RELATED DRAINAGE EASEMENTS AND SWALE-RELATED DRAINAGE
EASEMENTS AND MAINTENANCE OF THE DRAIN PIPES AND DRAINAGE SWALES
LYING WITHIN THEM
Non-exclusive easements for installation, maintenance, repair and replacement
of (a) rockery-related drain pipes (including without limitation the perforated
drain pipes lying behind rockeries) and appurtenances thereto and (b)
rockery-related drainage swales [i.e., drainage swales lying along (behind or in
front of and generally parallel with the face of) rockeries] are hereby declared
over, under, along and across those portions of Lots 182 through 186, 190
through 192, and 197 depicted on the ma p pages of this plat as
"Rockery-Related Drainage Easements". In addition, non-exclusive easements
for installation, maintenance, repair and replacement of drainage swales and
swale-related drain pipes and appurtenances thereto are hereby declared over,
under, along and across those portions of Lots 186, and 193 through 198
depicted on the map pages of this plat as "Swale-Related Drainage
Easements". The Rockery-Related Drainage Easements and the Swale-Related
Drainage Easements shall run with the land (1) burdening those portions of
the above-stated Lots and (2) benefiting both (a) the Liberty Ridge
Homeowners Association and (b) such of the lots created by this plat that
drain into the drain pipes and swales lying within these easements.
The Liberty Ridge Homeowners Association shall have the perpetual right and
duty to maintain, repair and reconstruct as necessary the drain pipes and
appurtenances lying within the Rockery-Related Drainage Easements and the
Swale-Related Drainage Easements.
FRANCHISE UTILITY EASEMENT PROVISIONS
A non-exclusive easement is hereby reserved for and conveyed to Puget
Sound Energy Company (the electric power and natural gas company), Qwest
(the telephone and telecommunications services company), and AT&T Cable
Services (the television and telecommunications cable company) and their
respective successors and assigns along, across, under and upon:
(a) The portions of all lots, tracts and open spaces within the plat
lying within ten (10) feet of all public street rights-of-way
dedicated by this plat: and
(b) The portions of Lots 182, 183 and 184 depicted on the mop
pages of this plat as "Private Street Easement".

This easement authorizes the construction, operation, maintenance, repair,
replacement, and enlargement of underground pipes, conduits, cables and wires
with all necessary or convenient underground or ground-mounted
appurtenances thereto for the purpose of serving the subdivision and other
property with electric, gas, telephone, television coble, other communication
cable(s) and other utility services, together with the right to enter upon the
streets and above-mentioned easement areas at all times for the purposes
herein stated. No lines or wires for the transmission of electric current, or
for telephone use, cable television, fire or police signals, or for other
purposes, shall be placed upon any lot unless the same shall be underground,
ground-mounted, or in conduit attached to a building.
CITY OF RENTON SEWER AND WATER EASEMENT PROVISIONS
A non-exclusive easement is hereby reserved for and conveyed to the City of
Renton and the City's successors and assigns along, across, under and upon:
(a) The portions of all lots, tracts and open spaces within the plat
lying within ten (10) feet of all public street rights -of-way
dedicated on this plat; and
(b) The across the portions of Lots 182, 183 and 184 depicted on
the map pages of this plat as "Private Street Easement".
This easement authorizes the construction, operation, maintenance, repair,
replacement, and enlargement of underground sewer and water mains, services
and all necessary or convenient underground or ground-mounted
appurtenances thereto for the purpose of serving the subdivision and other
property with sewer and water service, together with the right to enter upon
the streets and the above-mentioned easement areas at all times for the

PUBLIC SIDEWALK EASEMENTS
A non-exclusive easement for construction, maintenance, repair and use of
public sidewalks is hereby reserved for and conveyed to the City of Renton
and the City's successors and assigns over, along and across the portions of
all lots, tracts and open spaces within the plat lying within five (5) feet of all
public street rights-of-way dedicated on this plat.
AQUIFER PROTECTION NOTICE
The lots created by this plat lie within Zone 1 and/or 2 of Renton's Aquifer
Protection Area and are subject to the requirements of City of Renton
Ordinance No. 4367 as amended by Ordinance No. 4740. This City's sole
source of drinking water is supplied from a shallow aquifer under the City's
surface. There is no natural barrier between the water table and the ground
surface. Extreme care should be exercised when handling any liquid substance
other than water to prevent contact with the ground surface. It is the
homeowner(s)' responsibility to protect the City's drinking water.

PRIVATE DRAINAGE EASEMENTS AND MAINTENANCE OF STORM DRAINS LYING WITHIN THEM
A private, non-exclusive drainage easement 2.50 feet in width is hereby declared to run
parallel to and abutting all interior lot lines of the Lots created by this plat. In
addition, a private non-exclusive drainage easement 5.00 feet in width is hereby
declared to run parallel with and abutting all rear lot lines of the Lots created by this
plat. Further, a private, non-exclusive drainage easement 10.00 feet in width is hereby
declared to run parallel with and abutting all public street right-of-way frontages of all
of the Tracts and Lots lying within this plat. All of these easements include the right
to enter upon the easement areas at all times for the stated purposes of these
easements, which includes (a) the installation, use, maintenance and repair of private
storm drain(s) and appurtenances thereto and (b) the installation, use, maintenance and
repair of drainage swales along the base or along the top of rockeries in those areas
where Rockery-Related Drainage Easements are not otherwise provided by this plat. In
the event that any of the lot lines of the Lots created by this plat are adjusted after
the recording of this plat, the corresponding abutting private drainage easement(s)
created by this section shall automatically be deemed to move with the adjusted lot
line(s).
These private drainage easements shall be for the benefit of (a) all of the Lots and
Tracts set forth on this plat, (b) all other lots and tracts that are subject to the
Liberty Ridge CCRs as amended from time-to-time, and (c) the Liberty Ridge
Homeowners Association. Unless otherwise specifically set forth in this plat, the
owner(s) of each Lot served in common by private storm drain(s) and appurtenances
thereto lying within a private drainage easement shall be equally responsible for the
maintenance, repair, and/or reconstruction of the storm drain(s) and appurtenances
thereto lying within these easements; provided, however, that no owner(s) shall be
responsible for such maintenance, repair, and/or reconstruction of that portion of storm
drain(s) used in common to the extent that such s t orm dra i n(s) are located upstream
from the point of drainage connection of that respective owner's Lot. The owner(s) of
any Lot that has segment(s) of drainage swale(s) within these easements crossing the
Lot shall be responsible for the maintenance of such drainage swale segments on the
Lot.
NATIVE GROWTH PROTECTION EASEMENT
Tract W is in an area of generally steep slopes. All of Tract W is hereby declared to
be a Native Growth Protection Easement ("NGPE"). The purpose of the NGPE shall be
for preserving native vegetation for the control of surface water and erosion,
maintenance of slope stability, visual and aural buffering, and protection of plant and
animal habitat. The NGPE prohibits all present and future owner(s) of Tract W from
disturbing any trees and other vegetation within the NGPE unless done pursuant to
express written permission of the City of Renton. This prohibition shall be enforceable
by the City of Renton. Except as provided for above, the owner(s) of Tract W may not
cut, prune, cover with fill, remove or damage the vegetation within in it; provided,
however, that the owner(s) may install landscaping within it. The right of entry granted
herein shall apply to the agents, representatives and employees of the owner(s) or
subsequent owner(s) of the underlying property. The Liberty Ridge Homeowners
Association shall be responsible to maintain and protect Tract W consistent with this
paragraph.

DEDICATION
Know all people by these presents that the undersigned owner of interest in the land
hereby subdivided hereby declares this plat to be the graphic representation of the
subdivision made hereby and does hereby dedicate to the use of the public forever all
streets and avenues not shown as private hereon and dedicate the use thereof for all
public purposes not inconsistent with the use thereof for public highway purposes, and
also the right to make all necessary slopes for cuts and fills upon the lots shown
thereon in the original reasonable grading of said streets and avenues.
Further. the undersigned owner of land hereby subdivided waives for itself, its heirs,
successors and assigns and any person or entity deriving title from the undersigned,
any and all claims for damages against the City of Renton, its successors and assigns
which may be occasioned by the establishment, construction or maintenance of roads
and/or drainage systems within this subdivision other than claims resulting from
inadequate maintenance by the City of Renton.

from the negligence of the City of Renton, its successors, or assigns.
This subdivision, dedication, waiver of claims and agreement to hold harmless is made
with the free consent and in accordance with the desire of said owner.

(the "First Amendment") and as further amended by that certain "Second
Amendment to the Declaration of Protective Covenants, Conditions, Easements

IMPROVEMENTS LYING WITHIN THOSE EASEMENTS
Non-exclusive easements for ingress and egress and for construction, maintenance, repair
and use of roadway and storm drain pipes and appurtenances are hereby declared over,
under, along and across the portions of Lots 182, 183 and 184 depicted on the map
pages of this plat as "Private Street Easement". These easements shall run with the land
burdening Lots 182, 183 and 184 and benefiting Lots 182, 183 and 184, respectively.
The owners of Lots 182 through 184 shall have the perpetual right and duty to maintain
and repair the roadway and storm drain pipes and appurtenances located in the Private
Street Easement. The costs of su ch maintenance and repair are to be shared equally
among the owners of Lots 182 through 184.
In addition, non-exclusive easements for construction, maintenance, repair and use of a
storm drain pipe and appurtenances located in the portions of Lots 186 and 187
depicted on the map pages of this plat as "Private Droinage Easement" are hereby
declared over, under, along and across those portions of Lots 186 and 187. These
easements shall run with the land, burdening those portions of Lots 186 and 187 and
benefiting Lots 186 and 187 as well as Lot 185 and the portions of Uberty Ridge Phase
1 (which is recorded in Volume 201 of Plats, pages 87 through 95 under King County
Ree. No. 20010907001815) that drain into Lots 185, 186 and 187. (Note that a
drainage swale across the southerlymost corner area of Lot 186 is intended to drain into
a catch basin located near the south end of the Private Drainage Easement that burdens

The owners of Lots 186 and 187 shall have the perpetual right and duty to maintain and

Non-exclusive easements for installation, maintenance, repair and replacement
of (a) rockery-related drain pipes (including without limitation the perforated
drain pipes lying behind rockeries) and appurtenances thereto and (b)
rockery-related drainage swales [i.e., drainage swales lying along (behind or in
front of and generally parallel to the face of) rockeriesJ are hereby declared
over, under, along and across those portions of Lots 182 through 186, 190

Services (the television and telecommunications cable company) and their
respective successors and assigns along, across, under and upon:

replacement, and enlargement of underground pipes, conduits, cables and wires
with all necessary or convenient underground or ground-mounted
appurtenances thereto for the purpose of serving the subdivision and other

cable(s) and other utility services, together with the right to enter upon the

AQUIFER PROTECTION NOTICE
The lots created by th i s plat lie within Zone 1 and/or 2 of Renton's Aquifer
Protection Area and are subject to the requirements of City of Renton
Ordinance No. 4367 as amended by Ordinance No. 4740. This City's sole
source of drinking water is supplied from a shallow aquifer under the City's
surface. There is no natural barrier between the water table and the ground
surface. Extreme care should be exercised when handling any liquid substance
other than water to prevent contact with the ground surface. It is the
homeowner(s)' respons i bility to protect the City's drinking water.

PRIVATE DRAINAGE EASEMENTS AND MAINTENANCE OF STORM DRAINS LYING WITHIN THEM
A private, non-exclusive drainage easement 2.50 feet in width is hereby declared to r un
parallel to and abutting all interior lot lines of the Lots created by this plat. In
addition, a private non-exclusive drainage easement 5.00 feet in width is hereby
declared to run parallel to and abutting all rear lot lines of the Lots created by this
plat. Further, a private, non-exclusive drainage easement 10.00 feet in width is hereby
declared to run parallel to and abutting all public street r i ght-of-way frontages of all
of the Tracts and Lots lying within this plat. All of these easements include the right
to enter upon the easement areas at all times for the stated purposes of these
easements, which includes (a) the installation, use, maintenance and repair of private
storm drain(s) and appurtenances thereto and (b) the installation, use, maintenance and •
repair of drainage swales along the base or along the top of rockeries in those areas
where Rockery-Related Drainage Easements are not otherwise provided by this plat. In
the event that any of the lot lines of the Lots created by this plat are adjusted after
the recording of this plat, the corresponding abutting private drainage easement(s)
created by this section shall automatically be deemed to move with the adjusted lot
line(s).
These private drainage easements shall be for the benefit of (a) all of the Lots and
Tracts set forth on this plat, (b) all other lots and tracts that are subject to the
Liberty Ridge CCRs as amended from time-to-time, and (c) the Liberty Ridge
Homeowners Association. Unless otherwise specifically set forth in this plat, the
owner(s) of each Lot served in common by private storm drain(s) and appurtenances
thereto lying within a private drainage easement shall be equally responsible for the
maintenance, repair, and/or reconstruction of the storm drain(s) and appurtenances
thereto lying within these easements; provided, however, that no owner(s) shall be
responsible for such maintenance, repair, and/or reconstructi o n o f th a t p o rti o n o f storm
drain(s) used in common to t h e extent t h at such storm d ra i n(s) are located upstream
from the point of drainage connection of that respective owner's Lot. The owner(s) of
any Lot that has segment(s) of drainage swale(s) within these easements crossing the
Lot shall be responsible for the maintenance of such drainage swale segments on the

NATIVE GROWTH PROTECTION EASEMENT
Tract W is in an area of generally steep slopes. All of Tract W is hereby declared to
be a Native Growth Protection Easement ("NGPE"). The purpose of the NGPE shall be
for preserving native vegetation for the control of surface water and erosion,
maintenance of slope stability, visual and aural buffering, and protection of plant and
animal habitat. The NGPE prohibits all present and future owner(s) of Tract W from
disturbing any trees and other vegetation within the NGPE unless done pursuant to
express written permission of the City of Renton. This prohibition shall be enforceable
by the City of Renton. Except as provided for above, the owner(s) of Tract W may not
cut, prune, cover with fill, remove or damage the vegetati on within in it; provided,
however, that the owner(s) may install landscaping within it. The right of entry granted
herein shall apply to the agents, representatives and employees of the owner(s) or
subsequent owner(s) of the underlying property. The Liberty Ridge Homeowners
Association shall be responsible to maintain and protect Tr act W consistent with this
paragraph .

Know all people by these presents that the undersigned owner of interest in the land
hereby subdivided hereby declares this plat to be the graphic representation of the
subdivision made hereby and does hereby dedicate to the use of the public forever all
streets and avenues not shown as private hereon and dedicate the use thereof for all
public purposes not inconsistent with the use thereof for public highway purposes, and

Non-exclusive easements for ingress and egress and for construction.
maintenance, repair and use of roadway and storm drain pipes and
appurtenances are hereby declared over. under, along and across the portions
of Lots 182, 183 and 184 depicted on the map pages of this plot as "Private
Street Easement". These easements shall run with the land burdening Lots
182. 183 and 184 and benefiting Lots 182. 183 and 184. respectively.
The owners of Lots 182 through 184 shall have the perpetual right and duty
to maintain and repair the roadway and storm drain pipes and appurtenances
located in the Private Street Easement. The costs of such maintenance and
repair are to be shared equally among the owners of Lots 182 through 184.
In addition, non-exclusive easements for construction, maintenance, repair and
use of a storm drain pipe and appurtenances located in the portions of Lots
186 and 187 depicted on the map pages of this plat as "Private Drainage
Easement" are hereby declared over, under, along and across those portions
of Lots 186 and 187. These easements shall run with the land, burdening

The Liberty Ridge Homeowners Association shall have the perpetual right and
duty to maintain and repair the storm drain pipe and appurtenances located in
the Private Drainage Easement that burdens portions of Lots 186 and 187.

source of drinking water is supplied from a shallow aquifer under the City's
surface. There is no natural barrier between the water table and the ground
surface. Extreme care should be exercised when handling any liquid substance

A private, non-exclusive drainage easement 2.50 feet in width is hereby declared to run

addition, a private non-exclusive drainage easement 5.00 feet in width is hereby

NATIVE GROWTH PROTECTION EASEMENT
Tract W is in an area of generally steep slopes. All of Tract W is hereby declared to
be a Native Growth Protection Easement ("NGPE"). The purpose of the NGPE shall be
for preserving native vegetation for the control of surface water and erosion,
maintenance of slope stability, visual and aural buffering, and protection of plant and
animal habitat. The NGPE prohibits all present and future owner(s) of Tract W from
disturbing any trees and other vegetation within the NGPE unless done pursuant to
express written permission of the City of Renton. This prohibition shall be enforceable
by the City of Renton. Except as provided for above, the owner(s) of Tract W may not
cut, prune, cover with fill, remove or damage the vegetation within in it; provided,
however, that the owner(s) may install landscaping within it. The right of entry granted
herein shall apply to the agents, representatives and employees of the owner(s) or
subsequent owner(s) of the underlying property. The Liberty Ridge Homeowners
