HomeMy WebLinkAboutAddendum - 3Docusign Envelope ID: 883F7 405-34D3-49E0-8201-A80A0BF17FDB AMENDMENT NO. 3 TO AGREEMENT FOR FINAL DESIGN OF THE SE 172ND ST & 125TH AVE SE GREEN STORMWATER INFRASTRUCTURE PROJECT THIS AMENDMENT, dated for reference purposes only as December 1, 2024, is by and between the City of Renton (the "City"), a Washington municipal corporation, and Osborn Consulting, Inc. ("Consultant"), a Washington corporation. The City and the Consultant are referred to collectively in this Amendment as the "Parties." Once fully executed by the Parties, this Amendment is effective as of the last date signed by both parties. Whereas, the City engaged the services of the Consultant under Agreement CAG-23-082, dated February 1, 2023, to provide necessary services for the Final Design of the SE 172nd St & 125th Ave SE Green Stormwater Infrastructure Project (referred to herein as the "Agreement"); Whereas, the Parties wish to amend the Agreement to change the scope of work, change the time for performance, and change the compensation in order to prepare the bid-ready plans, specifications, engineer's estimate, and design report, as well as to provide support during bidding and construction. NOW THEREFORE, It is mutually agreed upon that CAG-23-082 is amended as follows: 1.Scope of Work: Section 1, Scope of Work, is amended to add work as specified in Exhibit A-3, which is attached and incorporated herein. 2.Time of Performance: Section 3, Time of Performance, is amended pursuant to the schedule(s) set forth in Exhibit B-3. All Work shall be performed by no later than December 31, 2025. 3.Compensation: Section 4, Compensation, is amended so that the maximum amount of compensation payable to Consultant is increased by $98,731 from $231,583 to $330,314, plus any applicable state and local sales taxes. The additional compensation shall be paid based upon Work actually performed according to the rate(s) or amounts specified in Exhibit C-3,which is attached and incorporated herein]. 4.All terms of the Agreement not explicitly modified herein shall remain in full force and effect and such terms shall apply to Work performed according to this Amendment as if fully set forth herein. Contract Number: BACKGROUND The Project will plan and design stormwater system modifications and green stormwater infrastructure (GSI) to improve water quality and drainage capacity for approximately half a block (600 ft) north of SE 172nd Street for 122nd Ave SE, 123rd Ave SE, 124th Ave SE and 125th Ave SE, and approximately two blocks (1,400 ft) of SE 172nd Street. This project for the City of Renton (City) will consist of installing a new stormwater conveyance system and green infrastructure with pervious concrete sidewalks supplemented with GULD facilities to collect and treat stormwater runoff from approximately 2 acres of pollution generating impervious surfaces. The project design and deliverable will meet the requirements of the Washington State Department of Ecology (Ecology) Water Quality Stormwater Pre-Construction Grant agreement and follow the 2019 Stormwater Management Manual for Western Washington (2019 SWMMWW), and the 2022 City of Renton Surface Water Design Manual (SWDM) as an amendment to the 2021 King County Surface Water Design Manual. This amendment will provide additional design support for the final design of the project to bid-ready plans, specifications and engineers estimate. This will include coordination with Puget Sound Energy for resolution of existing gas and utility pole conflicts and coordination with Ecology for the Final Design for bid documents approval. The final bid package will include the water and sewer final design elements as a separate bid schedule that will be compiled through a separate contract with Soos Creek Water and Sewer District. This amendment also adds support services during bidding and construction for the City's improvements. The scope of work below covers additional design work assumed to be completed by the end of December 2024, as well as additional project management and bid and construction support through December 2025. SCOPE OF WORK Task 1 Project Management Monitoring and communicating the status of the scope, schedule, and budget of this work assignment and providing monthly reporting to the City through December 2025. Consultant Services ■Prepare status reports describing the following: SE 172nd St Green Stormwater Infrastructure Project-Phase 2 Amendment 3 -Final Design and Construction Support 1IPage Docusign Envelope ID: 883F7 405-34D3-49E0-8201-A80A0BF17FDB Consultant Services ■ Updates to the Final Design Report will be completed to address City and Ecology comments and meet the grant submittal requirements. ■ A summary memo of design changes will be compiled to accompany the Final Design Report submitted to Ecology ■ The construction plans, specifications and cost estimates will be updated to address review comments. ■ Additional design coordination with Puget Sound Energy to confirm and limit vertical and horizontal conflicts with existing gas and utility poles. Client Responsibility ■ City to provide consolidated review comments of the 100% Design submittal by the City and Soos Creek. ■ Provide updates to the project specifications and updates to Division 1, as needed. Assumptions ■ The single Cover Sheet, Notes and Abbreviations sheets will used for the final combined submittal with the Soos Creek improvements included as a separate bid schedule. ■ The project specifications will be based on City special provisions provided by the City with the 100% review comments. ■ Additional updates to the project specifications will be provided by the City, with exception to the bid schedule summary in Section 10 and the Special Provisions in Section 24. ■ There will only be minor changes to the project design to address review comments of the Bid­ Ready submittal. ■ A design report of water and sewer improvements will not be required. ■ Any additional utility potholes will be provided by the utility owners. Survey verification of the utility locations will not be required. ■ Up to one site visit will be required prior to the final design submittal to verify utility pothole locations. ■ No roadway or pedestrian improvements will be required south of SE 172nd St along 125th Ave SE.
