draina�e facilities shall b� maintair�ed in campliance with the operatinn and rroaintenance

facili�ies include pipes, eharanels, flow control facilities, water quality facilities, on-site best

treat starmwater on the Praperty. Qn-site �MPs include dispersian and infiltratian devices,
biaretentian, permeable pavert�ents, rainwater harvesting systems, tree retention credit,
reduc�d irnpervious surface faetprint,veget�ted roofs and other measures designed to rreimic
pre-developed hydrology and minirnize storrnwater runoff on the Property.
2. City of Renton shall have th� right to in�ress and egress over those partions af the Property
n�cessary ta perform inspections of the stormwater facilities and BMPs and conduct
mair�tenanee activities specified in this C?eclar�tion of Covenant and in accerdanee with the
R�ntan Municipal Cade. City of Fter�ton shall provide at least thirty(3�) days'written natice to
the Ovvr�ers that entry an the Property is planned for the inspectian of dr�inage facilities.After
the thirty(3�) days,the Owners shall �Ilaw the City of Renten to enter for th�sole purpose of
inspectirsg drainag�facilities. In lieta af inspecfion by the City,the Own�rs may elect to enga��
a lieensed civil�ngineer re�istered in th�st�t�af V4lashin�ton wha has expertise in dr�ina�e to
inspect the drainage faeilities and provide a written report describing their canditi�n. If the
engin�er c�ption is chosen,the Qwners shall pro�ride written rootice ta the City of Renton within
fifteen(15)d�ys af reeeiuing the City's notice of inspection.Within thirty(30)days of�iving this
natice,the Owners,or engiraeer on faehalf�f th���nrners,shall provide the engineer's r�part to
the City c�f Renton. If the report is not prc�vided in a timely manner as specified �bove,the City
of Renton may ir�spect the drainage facilities vvithout further nc�tice.
3. If City of f�er�ton determines frorrr its inspection, or frorn an engineer's report provided in
acccardance vvith Paragraph 2,�hat maintenanc�, repair, rest�ration, ar�d/or rv�itigati�n work is
required ta be done to any�f the dr�inage facilities, City af Reraton shall notif}r the C?�naners of
the specific rvraintenance, repair, restoration, and/or miti�atic�n work ("�1/ork") req�ired
pursuant to the Rentr�n f�9unicipal Ccade. The City shall alsa s�t a reasonable deadline for th�
Ovuners to comple�e the Wark, er ta provide an engir�eer's repart that verifies campletion of
the W�rk. /�fter the de�dline has passed, the Qvear�ers shall allow the Ci�y�ceess to re-inspect
the drair�age facilities unless an engineer's report: has beer� provided verifyirsg cornpletian af
�he �lliork. I�Che VVork is not completed vvithin the tirne frarne set by the City, the City r�ay
iraitiate an enfarcerr�ent action and/or perforrn the V1/ork and hereby is given access to the
Property for sueh purposes. Written raotice u�rill be sent to the Ovmners stating the Cit�s
intention to perform such Vlfork.This t�4/ork will not cart7rrrence until at least seven(7}days after
such notice is mailed. If, within the sole discretion af the City, fhere exists an imrr�inent ar
present dar�ger, the seven (7} day r�atice period will be waived and V0/nrk will be�in
immedi�tely.
4. The Owners shall assume all responsibility far the cost af any Work, ar any measures taken by
the City to �ddress car�ditions as described in Paragraph 3. Such responsibility shall include
reimburserner�t to the City within thirty(30)days of the receipt of the inveice for any such Vilork
perforrra�d. O�i�rdue payments will require payment of interest at the maximum Icgal rate
allowed by R�W 19.52.C}20(currently twelve percent(12%)). If the City initiates legal action to
enforce this agreernent, the prevailing party in such a�tion is entitled to recover reasonable
litigation costs and attorney`s fe�s.
5. The Uvvners are required to obtain written approval fram City of Renton prior tc�fillireg, pipir�g,
cuttir��, or rernovir�g vegetation (except in routirae landscape maintenanc�) in open ree�etated
stormwater faeilities (such as svvales, ehannels, ditches, ponds, ete.), or performing any
alterations ar rnodificatians to the drainage facilities referenced in this Declaration of Covenant.
