PROJECT DESCRIPTION: The applicant, AT&T (Smartlink), is requesting a Shoreline Exemption (SME)
from a Substantial Development Permit to replace the existing defunct generator with a 50 kW Generac
industrial diesel generator with a 190-gallon subbase fuel tank and a level 2 acoustic enclosure on an existing
4’ 10” x 12’ 0” concrete pad. In addition, the scope of work would include replacing the existing 10-foot (10’)
wide double swing chain link enclosure gate with a new 12-foot (12’) wide double swing chain link enclosure
gate. Several fixed existing bollards would be removed and replaced with ten (10) new removable bollards
around the perimeter of the diesel generator. Approximately 15 feet (15’) of new eight-foot (8’) tall chain link
fencing, with black privacy slats, is proposed along the west side of the generator enclosure area. The existing
enclosure area is approximately 153 square feet (8’ 10” x 17’ 8”) and is surrounded by approximately 53 feet
(53’) of wrought iron and chain link fencing. The site is located in the Urban Center-2 (UC-2) zone with a
Commercial Mixed Use (CMU) Comprehensive Plan Land Use designation. The site is also within the City
Center Community Planning Area and is within the Urban Design District C overlay area. The project site is
located along the eastern shore of the Cedar River, a Shoreline of the State. A portion of the project proposal
is located within the Shoreline High Intensity buffer and Cedar River Reach CR-A. Proposed work would occur
approximately 175 feet (175’) east of the river’s shoreline ordinary high-water mark (OHWM). In addition, a
high seismic hazard area and the Downtown Wellhead Protection Area Zone 2 are mapped on the Renton
Memorial Stadium parcel according to City of Renton (COR) Maps.

SHORELINE EXEMPTION FINDINGS:
The proposed development is consistent with the following findings:
YES i. Consistent with the policies of the Shoreline Management Act.
YES ii. Not applicable to the guidelines of the Department of Ecology where no Master
Program has been finally approved or adopted by the Department.
YES iii. Consistent with the City of Renton Shoreline Mater Program.
EXEMPTION JUSTIFICATION/DECISION: An exemption from a Shoreline Management Substantial
Development Permit is hereby Approved on the proposed project in accordance with RMC.4.9.190C
“Exemption from Permit System” and for the following reasons:
Normal maintenance or repair of existing structures or developments, including damage by accident, fire or
elements. "Normal maintenance" includes those usual acts to prevent a decline, lapse, or cessation from a
lawfully established condition. "Normal repair" means to restore a development to a state comparable to its
original condition, including but not limited to its size, shape, configuration, location, and external
appearance, within a reasonable period after decay or partial destruction, except where repair causes
substantial adverse effects to shoreline resource or environment. Replacement of a structure or development
may be authorized as repair where such replacement is the common method of repair for the type of structure
or development and the replacement structure or development is comparable to the original structure or
development including but not limited to its size, shape, configuration, location and external appearance and
the replacement does not cause substantial adverse effects to shoreline resources or environment.
This proposal does not require an environmental threshold determination as it meets the following exemption
criteria in accordance with WAC 197-11-800(3) “Categorical Exemptions”:
Repair, remodeling, and maintenance activities. The following activities shall be categorically exempt: The
repair, remodeling, maintenance, or minor alteration of existing private or public structures, facilities, or
equipment, including utilities, recreation, and transportation facilities involving no material expansions or
changes in use beyond that previously existing, except that, where undertaken wholly or in part on lands
covered by water, only. Minor repair or replacement of structures may be exempt (examples include repair or
replacement of piling, ramps, floats, or mooring buoys, or minor repair, alteration, or maintenance of docks).

Staff Comment:
The proposal to replace the existing generator at Renton Municipal Stadium would qualify as an Exemption
from a Shoreline Substantial Development Permit under the allowance for Normal Repair to restore a
development to a state comparable to its original condition. It is common practice to replace a defunct
generator when the old generator reaches the end of its lifespan. The proposed maintenance and
improvement work noted in the ”Project Description” section above would allow AT&T the ability to continue
to operate the existing telecommunication facility and leased compound at this site, an important private
telecommunication facility for this area. The proposed maintenance or minor alteration of existing private or
public structures, facilities, or equipment, including utilities, would not impact any trees or habitat and would
result in no net loss of ecological functions and values on the project site.

RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be
reopened by the approval body. The approval body may modify his decision if material evidence not readily
discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After
review of the reconsideration request, if the approval body finds sufficient evidence to amend the original
decision, there will be no further extension of the appeal period. Any person wishing to take further action
must file a formal appeal within the 14-day appeal time frame.
APPEALS: This administrative land use decision will become final if not appealed in writing to the
Hearing Examiner on or before 5:00 PM on January 31, 2025. An appeal of the decision must be filed
within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). Appeals must be submitted
electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub
Monday through Friday. The appeal fee, normally due at the time an appeal is submitted, will be collected at
a future date if your appeal is submitted electronically. The appeal submitted in person may be paid on the
first floor in our Finance Department. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and
additional information regarding the appeal process may be obtained from the City Clerk’s Office,
cityclerk@rentonwa.gov.
EXPIRATION: Two (2) years from the date of decision (date signed).
