Corridor Improvements -Phase 4 Contract No. CAG-22-163 Page 1 of 16 THE CONTRACT IS MODIFIED AS FOLLOWS: Description of Change: This Change requires the Contractor to remove and dispose of sections of asbestos concrete pipe in an approved facility in accordance with all local,state,and federal regulations. Proposal Schedule of Prices: ADD the following to Schedule A: 29-C22 -Removal and Disposal of Asbestos Concrete Pipe,$DAY @ $3,136.00 = $25,088.00 Specification and/or Special Provision: SP 2-02.3(2)is supplemented as follows: Removal and Disposal of Asbestos Material Prior to performance of any contract work,the Contractor shall obtain all permits from and provide notification to,the Washington State Department of Labor and Industries,the Washington State Department of Ecology,the local clean air agency,and other permitting and regulatory agencies with jurisdiction over the work involving asbestos as the laws,rules,and regulations require. Prior to commencing asbestos related work,the Contractor shall submit as a Type 1 Working Drawing any and all written verification of approvals and notifications that have been given and/or obtained from the required jurisdictional agencies.The Contractor shall include a schedule of activities for all work involving asbestos removal as part of the Type 1 Working Drawing. Asbestos related work shall also be shown on the Contractor’s project progress schedule. The Contractor shall designate a Washington State Certified Asbestos Supervisor (CAS),certified in accordance with WAC 295-65-012,to supervise the asbestos removal and to ensure that the handling and removal of asbestos is accomplished by certified asbestos workers,pursuant to Washington State Department of Labor and Industries standards.The Contractor shall ensure that the removal and disposal of asbestos meets the requirements of EPA regulation 40 CFR Part 61,local health department regulations,and all other applicable regulations. The Contractor shall ensure the safety of all workers,visitors to the site,and the public in accordance with all applicable laws,rules,and regulations. Materials: None. Measurement: 2-02.4 is supplemented with the following: “Removal and Disposal of Asbestos Concrete Pipe,”per day. The per day cost of “Removal and Disposal of Asbestos Concrete Pipe”shall consist of all work required to remove and dispose of the asbestos concrete pipe in compliance with the specifications. Payment: 2-02.5 is supplemented with the following: “Removal and Disposal of Asbestos Concrete Pipe,”per day. Materials Specifications: None. Plans: None. Reason for Change: During the course of construction,it was discovered that sections of existing sanitary sewer pipe to be removed between MH2145 —MH6345 and MH2111 —MH2112 contain asbestos. This pipe to be removed was not identified in the plans as containing asbestos.Asbestos Containing Material (ACM)necessitates specialized handling,removal,and disposal procedures that comply with all applicable asbestos abatement regulations.This Change is necessary to cover the additional costs associated with the removal,transportation,and disposal of the ACM at an approved facility. Equitable Adjustment: This Change Order does include an equitable adjustment per Section 1-09.4 of the 2022 WSDOT/APWA Standard Specifications.See attached. The concrete sewer pipe at S Tobin St was tested by Jordan Widener of Widener &Associates and confirmed to be Non-Fibrous Asbestos on September 26,2024.The concrete sewer pipe at 5 2’’St was discovered around October 2,2024 and was identical to the asbestos concrete pipe at S Tobin St In Ms.Widener’s email it is stated “for Washington State,the removal of non-friable asbestos- containing waste does not require a licensed asbestos contractor...”.Pivetta does not specialize in asbestos pipe removal and reached out to firms that specialize in asbestos to ensure it was handled safely/properly per local agency guidelines.Both firms informed Pivetta that per LNI (Labor and Industries)and PSCAA (Puget Sound Clean Air Agency)work with asbestos pipe needs to be performed by an asbestos company. Pivetta believes the presence of asbestos concrete sewer pipe is a differing site condition and requests a change order for removal and disposal of asbestos concrete sewer pipe.
