Renton WA. 98057 Violator: DK Market/PDA LLC •RMC Violation: RMC 4-5-050/4-5-060 No Building Permit On November 2nd, 2023 Donna Locher received an email from Daniel Johnson, Fire Inspector, reporting that he received an inspection report from a sprinkler company indicating that DK Market has a new walk in cooler that does not have a sprinkler head inside. He also states that DK Market constructed a new wall in the store, and that he did not see a permit for the cooler. Exhibit 2, 3, On November 3rd,2023 I performed an inspection of the store taking photos of the violations described in the email. Photos taken of the new wall constructed in the entry, a photo of the exterior of the walk in cooler and a photo of the rack system for storing large area rugs. All constructed without the benefit of a permit. Exhibit 4 On November 6th,2023 I sent a Warning of Violation letter to PDA LLC, who is the listed property owner of DK Market. Exhibit 5 On December 6th,2023 Received a phone call from Glen in regards to getting a contractor to do plans and submit for a permit. I supplied Glen with all contact information for the Permitting Department. On December 27th,2023 Lisa Walker, permit technician, had a virtual meeting with Haroon. Haroon is the vendor that has the rug rack system, and that he will be applying for the permit separately from the other violations. On January 9th,2024 I performed another inspection of the property and noted that the wall was removed, so no permit would be required. On January 12th,2024 Permit Technicians received an email from Bach Phan requesting to apply for a building permit for the 12x12 walk-in cooler. Exhibit 6 On February 13th,2024 I reviewed City records, which confirmed that the property had submitted for a building permit on the 12x12 walk-in cooler. On February 23rd,2024 permit was issued for the rug rack system, which expires on February 25th,2025. Exhibit 7 2 March 5th thru April 18th,2024 Correspondence was going back and forth with permit technicians and property owner’s contractor for resubmission of revisions to the permit. On July 24th,2024 Sent an email to Bach Phan requesting an update to the revisions of the plans that was sent to him on 4/18/2024. On July 27th,2024 Received a response from Bach Phan. Exhibit 8 On September 23rd,2024 Sent out the Second Warning of Violation. Exhibit 9 On October 16th,2024 Sent out Notice of Violation with a 250 dollar fine for not having a permit for the walk-in cooler. Exhibit 10 On November 6th,2024 Received a phone call from Glen stating that he is trying to hire another contractor and needs more time. I allowed another month to either contact me for more time or I would assume that he has another contractor. On December 12th,2024 I have not received any word from property owner and in reviewing city records there is no correspondence with the city permitting department. Sent out the Second Notice of Violation with a 250-dollar fine. Exhibit 11 On January 7th,2025 Reviewed city records with the last correspondence on 11/6/2024, and still no movement with the permit. Sent out the Third Notice of Violation with a 250-dollar fine. Exhibit 12 On January 21st,2025 The City of Renton clerks office receives a letter of appeal from PDA LLC. Exhibit 13 The city’s position is that more than ample time has been granted to make substantial gains in bringing the property into compliance. The property owners were made aware of the violations on their properties several times. The property owners either continue with the permit process or remove the cooler from the premises. The fine should stand and continue until the property is brought into compliance.
